Aim. To develop recommendations for improving the countering of medical products falsification in Ukraine using the international mechanism to confront, which should lead to increasing the pharmacy.Results. The international mechanism for countering the falsification of medical products, as shown by the analysis of the WHO documents, the MEDIСRIME Convention and others applies to medicines (both for human and veterinary use), as well as medical devices. The use of "falsified" concept in the Ukrainian legislation in relation to medicines and other products includes, in terms of content, substandard, unregistered/unlicensed and falsified products themselves. This concept does not correspond to the international legal definition of such products. The study concluded that the institutional component of the mechanism to counter the falsification of medical products is a system of international organizations, consisting of organizations working in the field of public health, crime control and assistance in carrying out other measures to counter falsification of drugs. Ukraine, as a member of these organizations, can and should use its capabilities in this area. Organizational support, as a necessary component of the mechanism under consideration, consists in the direct activities of these international organizations in such key areas as preventing the falsification of medical products, detecting falsified medical products and responding to such facts.Conclusions. The existing international mechanism for countering the falsification of medical products is a system of informational, institutional and organizational support of states for the prevention, detection and appropriate response. To increase the efficiency of using this mechanism in Ukraine, it is necessary to unify the definition of the concept of falsified medical products with the concepts of substandard, unregistered/unlicensed and falsified medical products, which are accepted by WHO. ; Целью работы является выработка рекомендаций по совершенствованию в Украине организации противодействия фальсификации медицинской продукции с использованием международного механизма такого противодействия, что должно привести к повышению качества в фармации.Результаты. Международный механизм противодействия фальсификации медицинской продукции, как показал анализ документов ВОЗ, Конвенции Совета Европы Медикрим и других применяется в отношении лекарственных средств (как для человеческого, так и ветеринарного применения), а также медицинских изделий. Использование в украинском законодательстве понятия «фальсифицированный» применительно к лекарственным средствам и другой продукции по содержанию охватывает субстандартную, незарегистрированную/нелицензированную и собственно фальсифицированную продукцию. Это понятие не соответствует международно-правовым определениям такой продукции. Исследование позволило сделать вывод о том, что институционную составляющую механизма противодействия фальсификации медицинской продукции составляет система международных организаций, состоящая из организаций, осуществляющих деятельность в сфере общественного здоровья, борьбы с преступностью, а также содействие при осуществлении иной деятельности противодействия фальсификации медицинской продукции. Украина, будучи членом этих организаций, может и должна использовать все возможности в этой сфере. Организационная поддержка, будучи необходимой составляющей рассматриваемого механизма, заключается в непосредственной деятельности указанных международных организаций по таким основным направлениям, как предупреждение фальсификации медицинской продукции, выявление фальсифицированной медицинской продукции и реагирование на факты такого обнаружения.Выводы. Существующий международный механизм противодействия фальсификации медицинской продукции представляет собой систему информационной, институциональнойи организационной поддержки государств по предупреждению, выявлению и надлежащему реагированию. Для повышения эффективности использования этого механизма в Украине необходимо унифицировать определение понятия «фальсифицированная медицинская продукция» с понятиями субстандартная, незарегистрированная/нелицензированная и фальсифицированная медицинская продукция, которые приняты ВОЗ. ; Метою роботи є вироблення рекомендацій щодо вдосконалення в Україні організації протидії фальсифікації медичної продукції з використанням міжнародного механізму такої протидії, що має привести до підвищення якості у фармації.Результати. Міжнародний механізм протидії фальсифікації медичної продукції, як показав аналіз документів ВООЗ, Конвенції Ради Європи Медікрім тощо застосовується щодо лікарських засобів (як для людського, так і для ветеринарного застосування), а також медичних виробів. Використання в українському законодавстві поняття «фальсифікований» стосовно лікарських засобів та іншої продукції за змістом охоплює субстандартну, незареєстровану/неліцензовану та власне фальсифіковану продукцію, що не відповідає міжнародно-правовим визначенням такої продукції. Інституційною складовою механізму протидії фальсифікації медичної продукції є система міжнародних організацій, які здійснюють діяльність у сфері громадського здоров'я, боротьби зі злочинністю, а також сприяють при здійсненні іншої діяльності протидії фальсифікації медичної продукції. Україна, будучи членом цих організацій, може і має використовувати всі можливості у цій сфері. Організаційна підтримка, будучи також необхідною складовою цього механізму, полягає у безпосередній діяльності зазначених міжнародних організацій за такими основними напрямами, як попередження фальсифікації медичної продукції, виявлення фальсифікованої медичної продукції та реагування на факти їх виявлення.Висновки. Існуючий міжнародний механізм протидії фальсифікації медичної продукції являє собою систему інформаційної, інституційної та організаційної підтримки держав з попередження, виявлення та належного реагування. Для підвищення ефективності використання цього механізму в Україні необхідно уніфікувати визначення поняття «фальсифікована медична продукція» з поняттями субстандартна, незареєстрована/неліцензована та фальсифікована медична продукція, що ухвалено ВООЗ.

En el año 2009 se desarrolló en Navia (Asturias) el Programa de Orientación Educativa Familiar (POEF), en fase de pilotaje. En este momento, se comenzó un proceso cíclico de planificación – ejecución – evaluación, como es propio en la práctica de las ciencias sociales. No entendimos este momento como un punto y final, como si fuese la culminación de un proceso, sino que desde su origen tratamos de adaptarnos al contexto, que viene determinado por los cambios sociales y educativos de cada momento, para dar respuestas lo más ajustadas posibles a las necesidades de las personas. Consideramos que en ese momento no se había hecho más que el planteamiento inicial del programa, por lo que continuamos mediante un proceso dialéctico entre la teoría y la práctica, dando forma a una herramienta más adaptada a nuestro entorno de trabajo y a la finalidad última de los servicios sociales que es la compensación de desigualdades, con el objetivo prioritario convertirlo en una medida de acción positiva, entendiendo por acción positiva, aquellas actuaciones o intervenciones que se realizan en un colectivo en el que existe una desigualdad con el fin de disminuir o eliminar esta descompensación social. El trabajo que se presenta podríamos decir que consta de dos partes; en la primera parte, se desarrolla en distintos Ayuntamientos "el programa-guía para el desarrollo de competencias emocionales, educativas y parentales" desarrollado por la profesora Dra. Raquel-Amaya Martínez González de la Universidad de Oviedo. Desde un primer momento, valoramos el programa como una herramienta necesaria, muy eficaz y valiosa por su carácter multiplicador y preventivo. En la segunda parte, como respuesta a la convocatoria que presenta el Ministerio de Sanidad, Servicios Sociales e Igualdad y la Federación Española de Municipios y Provincias que tiene por fin promover el ejercicio positivo de la parentalidad y reforzar el apoyo a la parentalidad positiva en las políticas y servicios públicos de los Gobiernos Locales y en el tejido asociativo. La iniciativa era una oportunidad clara de optimizar la gestión a favor de la coordinación interdisciplinar, la sensibilización, la formación, la promoción ciudadana y la prevención de situaciones de riesgo; también la invitación a que diferentes agentes sociales sumen a sus objetivos o líneas de actuación esta filosofía; todo ello siguiendo la recomendación del Consejo de Europa 2006. ; In 2009, the Family Educational Orientation Program (POEF) was developed in Navia (Asturias), during the piloting phase. At this time, a cyclical process of planning - execution - evaluation was started, as it is inherent in social sciences. This moment wasn't understand as final point, as if it were the finalization of an adaptation process; However, from its origin, we have tried to adapt to the context. This is determined by the social and educational changes of each moment, to give adapted answers to the needs of people. At that time, we considered that the only initial approach of the program had been done. This is why we continued through a dialectic process between theory and practice, and we designed an adapted tool to our work environment with the main aim of the social services which is the compensation of inequalities. Furthermore, the priority objective of this tool is become an 'positive action measure', we should understand 'positive action' as those actions or interventions that are carried out in a group in which there is an inequality situation in order to decrease or eliminate this social decompensation. It could be said that this project has two parts. In the first one, in different municipalities in the area, the 'guide-program for the development of emotional, educational and parental competences' designed by the professor Dr. Raquel-Amaya Martínez González from Oviedo University, is developed by technicians from social services. From the beginning, we value the program as a necessary tool, very effective and valuable due to its multiplying and preventive impact. In the second one, after the call by the Ministry of Health, Social Services and Equality and the Spanish Federation of Municipalities and Provinces the 'certificate of positive parenthood' is obtained. Its aims is to promote the positive exercise of parenthood and support positive parenting in the policies and services public of the Local Governments and association networks. The initiative was a clear opportunity to optimize the management in favor of interdisciplinary coordination, awareness, training, citizen promotion and the prevention of risk situations. Besides, different social agents are invited to add this philosophy to their objectives or lines of action. This follows the recommendation of the Council of Europe 2006. ; peerReviewed

The need for reforming the system of anti-money laundering, terrorist financing and financing of the proliferation of weapons of mass destruction (AML / CFT), one of the elements of which is the introduction of adaptation mechanisms in the field of state regulation and supervision is a very topical issue. Risk assessment and a risk-based approach are the first FATF recommendation of international standards. The article assesses the impact of state regulation and supervision on the development of a risk-oriented system of AML / CFT in Ukraine based on the construction of a five-level hierarchical model for the development of this system. The methodological basis of the researche was a method for analyzing the hierarchy of T. Saaty for conducting an experiment on identifying a priority scenario for developing a risk-oriented system in Ukraine. The research has been carried out to determine the impact of adverse factors, influence instruments and subjects on the priority goals and scenarios of the development of a risk-oriented system of AML/CFT, in particular, the most likely to be realized scenario is neutral. The basic of the hierarchical model was the development goals (ensuring Ukraine's status as a reliable partner of the international community in the field of preventing and AML / CFT, enhancing the information transparency of the system of AML / CFT, improving the legislation in the field of prevention and AML / CFT, reducing the asymmetry of information for participants in the system of AML / CFT; reducing the risk of using SIFM for ML / CFT; improving the mechanism and model of state regulation and supervision in AML / CFT) and scenarios of develoopment (accelerated, neutral and braking). ; Необходимость реформирования системы противодействия легализации (отмыванию) доходов, полученных преступным путем, финансированию терроризма и финансированию распространения оружия массового уничтожения (ОД/ФТРО), одним из элементов которой является внедрение адаптационных механизмов в сфере государственного регулирования, является особенно актуальным вопросом. Оценка рисков и применения подхода, основанного на оценке рисков, является первой рекомендацией международных стандартов FATF. Оценено влияние уровня государственного регулирования и надзора на развитие риск-ориентированной системы обеспечения противодействия отмыванию денег, финансированию терроризма и финансированию распространения оружия массового уничтожения в Украине на основе построенной пятиуровневой иерархической модели развития этой системы. Методологическую основу исследования составлял метод анализа иерархий Т. Саати для определения приоритетного сценария развития риск-ориентированной системы обеспечения противодействия ОД/ФТРО в Украине. Проведен опыт по определению влияния неблагоприятных факторов, инструментов воздействия и субъектов влияния на приоритетные цели и сценарии развития риск-ориентированной системы обеспечения противодействия ОД/ФТРО в Украине, в частности определено наибольшую вероятность реализации именно нейтрального сценария. Базовой основой иерархической модели стали цели развития (обеспечение утверждения Украины статуса надежного партнера международного сообщества в сфере предотвращения и противодействия ОД/ФТРО, усиление информационной прозрачности системы обеспечения противодействия ОД/ФТРО, совершенствование законодательства в сфере предотвращения и противодействия ОД/ФТРО, снижение асимметричности информации для участников системы обеспечения противодействия ОД/ФТРО, уменьшение риска использования СПФМ для ОД/ФТРО, совершенствование механизма и модели государственного регулирования и надзора в сфере противодействия ОД/ФТРО) и сценарии (ускоренный, нейтральный и торможения). ; Необхідність реформування системи запобігання i протидії легалізації (відмиванню) доходів, одержаних злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення (ВК/ФТРЗ), одним з елементів якої є запровадження адаптаційних механізмів у сфері державного регулювання, є особливо актуальним питанням. Оцінка ризиків і застосування підходу, що ґрунтується на оцінці ризиків, є першою рекомендацією міжнародних стандартів FATF. Оцінено вплив рівня державного регулювання і нагляду на розвиток ризик-орієнтованої системи забезпечення протидії відмиванню коштів, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення в Україні на основі побудованої п'ятирівневої ієрархічної моделі розвитку цієї системи. Методологічну основу дослідження становив метод аналізу ієрархій Т. Сааті для проведення досліду щодо визначення пріоритетного сценарію розвитку ризик-орієнтованої системи забезпечення протидії ВК/ФТРЗ в Україні. Проведено дослід щодо визначення впливу несприятливих факторів, інструментів впливу та суб'єктів впливу на пріоритетні цілі та сценарії розвитку ризик-орієнтованої системи забезпечення протидії ВК/ФТРЗ в Україні, зокрема визначено найбільшу ймовірність реалізації саме нейтрального сценарію. Базовою основою ієрархічної моделі стали цілі розвитку (забезпечення утвердження Україною статусу надійного партнера міжнародної спільноти у сфері запобігання та протидії ВК/ФТРЗ; посилення інформаційної транспарентності системи забезпечення протидії ВК/ФТРЗ; удосконалення законодавства у сфері запобігання та протидії ВК/ФТРЗ; зниження асиметричності інформації для учасників системи забезпечення протидії ВК/ФТРЗ; зменшення ризику використання СПФМ для ВК/ФТРЗ; удосконалення механізму та моделі державного регулювання і нагляду у сфері протидії ВК/ФТРЗ) та сценарії (прискорений, нейтральний і гальмування).

Background: Epidemiological Surveillance Systems are part of public policies to evaluate the impact of prevention interventions or the occurrence of related health events. In Dental Public Health has been valuable the surveillance systems to follow the fluoridation programs, the prevalence of caries or the fluorosis cases. Purpose: Identify and summarize published information regard the status of fluoridation programs and their epidemiological surveillance systems in Latin America and the Caribbean region. Methods: In this narrative literature review, articles searches in Medline and LILACS, in four languages, was carried out. Results: The authors included the analysis of 291 references published by government entities, international agencies, academic institutions and other sources, and summarizing the synthesis of all findings in two tracking matrices to contribute with new knowledge for policy making and program improvement through monitory systems. The results showed 11 active programs, 18 in uncertain status, and one country projecting a future program. Only six countries that started their fluoridation programs in the mid-eighties in the twentieth century have structured or strengthened a surveillance system for their fluoridation programs. Conclusions: The authors recommend a new stage of international accompaniment by several agencies to resume fluoridation programs in countries where structural, economic, or political factors affected the implementation or continuation of fluoridation programs in the 21st century. ; Antecedentes: Los sistemas de vigilancia epidemiológica forman parte de las políticas públicas para evaluar el impacto de intervenciones preventivas o la ocurrencia de eventos relacionados con la salud. En salud pública dental los sistemas de vigilancia para seguir programas de fluorización, prevalencia de caries o casos de fluorosis han sido valiosos. Objetivo: Identificar y resumir la información publicada sobre el estado de los sistemas de vigilancia epidemiológica en los programas de fluorización en América Latina y el Caribe. Métodos: En esta revisión narrativa de la literatura se efectuaron búsquedas de artículos en las bases Medline y LILACS en cuatro idiomas. Resultados: Los autores incluyeron el análisis de 291 referencias publicadas por entidades gubernamentales, agencias internacionales, instituciones académicas y otras fuentes, y resumieron la síntesis de todos los hallazgos en dos matrices de seguimiento para contribuir con nuevo conocimiento para la formulación de políticas y la mejora de programas a través de sistemas de monitoreo. Los resultados mostraron 11 programas activos, 18 en estado incierto y un país proyectando un programa futuro. Solo seis países que comenzaron sus programas de fluorización a mediados de los años ochenta en el siglo veinte han estructurado o fortalecido un sistema de vigilancia para sus programas de fluorización. Conclusiones: Los autores recomiendan una nueva etapa de acompañamiento internacional por parte de varias agencias para reanudar los programas de fluorización en países donde los factores estructurales, económicos o políticos afectaron la implementación o la continuación de los programas de fluorización en el siglo XXI. ; Antecedentes: Os Sistemas de Vigilância Epidemiológica fazem parte das políticas públicas para avaliar o impacto das intervenções de prevenção ou a ocorrência de eventos relacionados à saúde. Na saúde pública odontológica tem-se valido os sistemas de vigilância para acompanhar os programas de fluoretação, a prevalência de cárie ou os casos de fluorose. Objetivo: Identificar e resumir informações publicadas sobre a situação dos programas de fluoretação e seus sistemas de vigilância epidemiológica na região da América Latina e Caribe. Métodos: Nesta revisão de literatura narrativa, foram realizadas buscas de artigos em Medline e LILACS, em quatro idiomas. Resultados: Os autores incluíram a análise de 291 referências publicadas por entidades governamentais, agências internacionais, instituições acadêmicas e outras fontes, e resumindo a síntese de todos os resultados em duas matrizes de rastreamento para contribuir com novos conhecimentos para formulação de políticas e melhoria de programas através de sistemas monitorados. Os resultados mostraram 11 programas ativos, 18 em status incerto e um país projetando um programa futuro. Apenas seis países que iniciaram seus programas de fluoração em meados dos anos 80 no século XX estruturaram ou reforçaram um sistema de vigilância para seus programas de fluoretação. Conclusões: Os autores recomendam uma nova etapa de acompanhamento internacional por várias agências para retomar os programas de fluoração em países onde fatores estruturais, econômicos ou políticos afetaram a implementação ou continuação de programas de fluoretação no século XXI.

Background: In Europe, although the prevalence of childhood obesity seems to be plateauing in some countries, progress on tackling this important public health issue remains slow and inconsistent. Breastfeeding has been described as a protective factor, and the more exclusively and the longer children are breastfed, the greater their protection from obesity. Birth weight has been shown to have a positive association with later risk for obesity. Objectives: It was the aim of this paper to investigate the association of early-life factors, namely breastfeeding, exclusive breastfeeding and birth weight, with obesity among children. Method: Data from 22 participating countries in the WHO European COSI study (round 4: 2015/2017) were collected using cross-sectional, nationally representative samples of 6- to 9-year-olds (n = 100,583). The children's standardized weight and height measurements followed a common WHO protocol. Information on the children's birth weight and breastfeeding practice and duration was collected through a family record form. A multivariate multilevel logistic regression analysis regarding breastfeeding practice (both general and exclusive) and characteristics at birth was performed. Results: The highest prevalence rates of obesity were observed in Spain (17.7%), Malta (17.2%) and Italy (16.8%). A wide between-country disparity in breastfeeding prevalence was found. Tajikistan had the highest percentage of children that were breastfed for ≥6 months (94.4%) and exclusively breastfed for ≥6 months (73.3%). In France, Ireland and Malta, only around 1 in 4 children was breastfed for ≥6 months. Italy and Malta showed the highest prevalence of obesity among children who have never been breastfed (21.2%), followed by Spain (21.0%). The pooled analysis showed that, compared to children who were breastfed for at least 6 months, the odds of being obese were higher among children never breastfed or breastfed for a shorter period, both in case of general (adjusted odds ratio [adjOR] [95% CI] 1.22 [1.16–1.28] and 1.12 [1.07–1.16], respectively) and exclusive breastfeeding (adjOR [95% CI] 1.25 [1.17–1.36] and 1.05 [0.99–1.12], respectively). Higher birth weight was associated with a higher risk of being overweight, which was reported in 11 out of the 22 countries. Bulgaria, Croatia, France, Italy, Poland and Romania showed that children who were preterm at birth had higher odds of being obese, compared to children who were full-term babies. Conclusion: The present work confirms the beneficial effect of breastfeeding against obesity, which was highly increased if children had never been breastfed or had been breastfed for a shorter period. Nevertheless, adoption of exclusive breastfeeding is below global recommendations and far from the target endorsed by the WHO Member States at the World Health Assembly Global Targets for Nutrition of increasing the prevalence of exclusive breastfeeding in the first 6 months up to at least 50% by 2025. ; The authors gratefully acknowledge support from a grant from the Russian Government in the context of the WHO European Office for the Prevention and Control of NCDs. Базовой основой иерархической модели стали цели развития (обеспечение утверждения Украины статуса надежного партнера международного сообщества в сфере предотвращения и противодействия ОД/ФТРО, усиление информационной прозрачности системы обеспечения противодействия ОД/ФТРО, совершенствование законодательства в сфере предотвращения и противодействия ОД/ФТРО, снижение асимметричности информации для участников системы обеспечения противодействия ОД/ФТРО, уменьшение риска использования СПФМ для ОД/ФТРО, совершенствование механизма и модели государственного регулирования и надзора в сфере противодействия ОД/ФТРО) и сценарии (ускоренный, нейтральный и торможения). ; Необхідність реформування системи запобігання i протидії легалізації (відмиванню) доходів, одержаних злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення (ВК/ФТРЗ), одним з елементів якої є запровадження адаптаційних механізмів у сфері державного регулювання, є особливо актуальним питанням. Оцінка ризиків і застосування підходу, що ґрунтується на оцінці ризиків, є першою рекомендацією міжнародних стандартів FATF. Оцінено вплив рівня державного регулювання і нагляду на розвиток ризик-орієнтованої системи забезпечення протидії відмиванню коштів, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення в Україні на основі побудованої п'ятирівневої ієрархічної моделі розвитку цієї системи. Методологічну основу дослідження становив метод аналізу ієрархій Т. Сааті для проведення досліду щодо визначення пріоритетного сценарію розвитку ризик-орієнтованої системи забезпечення протидії ВК/ФТРЗ в Україні. Проведено дослід щодо визначення впливу несприятливих факторів, інструментів впливу та суб'єктів впливу на пріоритетні цілі та сценарії розвитку ризик-орієнтованої системи забезпечення протидії ВК/ФТРЗ в Україні, зокрема визначено найбільшу ймовірність реалізації саме нейтрального сценарію. Базовою основою ієрархічної моделі стали цілі розвитку (забезпечення утвердження Україною статусу надійного партнера міжнародної спільноти у сфері запобігання та протидії ВК/ФТРЗ; посилення інформаційної транспарентності системи забезпечення протидії ВК/ФТРЗ; удосконалення законодавства у сфері запобігання та протидії ВК/ФТРЗ; зниження асиметричності інформації для учасників системи забезпечення протидії ВК/ФТРЗ; зменшення ризику використання СПФМ для ВК/ФТРЗ; удосконалення механізму та моделі державного регулювання і нагляду у сфері протидії ВК/ФТРЗ) та сценарії (прискорений, нейтральний і гальмування).

The article reviews the scientific positions on understanding the concept of "legal responsibility", considers it as a positive and retrospective liability, and also proposes its own definition of legal liability of a civil servant. Emphasis is placed on distinguishing the civil servant's legal liability from the ordinary employee's legal liability, since the civil servant's legal responsibility is at the heart of each official's official activity, follows from the powers conferred, is a guarantee of the civil servants' observance of the law, civil service principles and their proper performance ulcers, etc. The legal responsibility of a civil servant is considered, which is quite complex and multifaceted in contrast to the legal liability of ordinary citizens, since it is connected with the powers of the individual, the performance of their individual actions and functions, the exercise of administrative and administrative-legal influence on public relations in the state. Accountability of civil servants has both general and specific features of legal liability. The scientist has identified a number of features that distinguish the legal liability of civil servants from the legal liability of ordinary workers. Such features include: 1) the legal liability of a civil servant is characterized by an increased level of liability of such persons for similar crimes, offenses or disciplinary offenses as provided by the current legislation; 2) increased possibilities for applying the head of the department, directly subordinate to a civil servant, to have powers to identify disciplinary actions and to bring a civil servant to disciplinary responsibility; 3) the broad effect of the legal liability of a civil servant for the offenses committed; 4) the purpose of legal responsibility consists not only in punishment of the guilty person, restoration of the violated rights and interests of the person, carrying out preventive activity, but also in ensuring in the further proper fulfillment by the civil servant of his official duties, prevention of behavior which could discredit the public service and the public employee as a whole; 5) features of its classification. The author of the article emphasizes that applying to a civil servant a certain type of legal responsibility not only condemns a civil servant by applying to him a state coercion, but also encourages other persons to behave properly and properly perform their official duties, to prevent committing actions that directly prohibited by applicable law. ; У статті здійснюється розгляд наукових позицій щодо розуміння поняття «юридичної відповідальності», розглянуто її як позитивну та ретроспективну відповідальність, а також запропоновано власне визначення юридичної відповідальності державного службовця. Наголошено на розрізненні юридичної відповідальності державного службовця від юридичної відповідальності звичайного працівника, оскільки юридична відповідальність державного службовця лежить в основі службової діяльності кожної посадової особи, випливає з наданих повноважень, є гарантом дотримання державними службовцями законності, принципів державної служби, належного виконання ними своїх посадових обов'язків тощо. Здійснено розгляд юридичної відповідальності державного службовця, яка є досить складною та багатогранною на відміну від юридичної відповідальності звичайних громадян, оскільки пов'язана з повноваженнями особи, виконанням ними окремих дій та функцій, здійсненням управлінського та адміністративно-правового впливу на суспільні відносини в державі. Відповідальність державних службовців має як загальні так і спеціальні ознаки юридичної відповідальності. Науковцем виділено ряд особливостей, які вирізняють юридичну відповідальність державних службовців від юридичної відповідальності звичайних працівників. До таких особливостей відносяться: 1) юридична відповідальність державного службовця характеризується підвищеним рівнем відповідальності таких осіб за аналогічні злочини, правопорушення чи дисциплінарні проступки, які передбачені чинним законодавством; 2) розширені можливості щодо застосування керівником відділу, якому безпосередньо підпорядкований державний службовець повноважень щодо виявлення дисциплінарних поступків та притягнення державного службовця до дисциплінарної відповідальності; 3) широка дія юридичної відповідальності державного службовця за вчинені правопорушення; 4) мета юридичної відповідальності полягає те тільки в покаранні винної особи, відновленні порушених прав та інтересів особи, здійсненні превентивної діяльності, але й у забезпеченні у подальшому належному виконанні державним службовцем своїх посадових обов'язків, недопущення поведінки, яка може дискредитувати державну службу та державного службовця в цілому; 5) особливості її класифікації. Автор статті наголошує на тому, що застосування до державного службовця певного виду юридичної відповідальності не тільки засуджує державного службовця, шляхом застосування до нього державного примусу, а й стимулює інших осіб до належної поведінки та належного виконання своїх посадових обов'язків, недопущення вчинення дій, які прямо заборонені чинним законодавством.

Introduction: burn injuries on duty are frequent and affect attrition rate of military personnel. Nevertheless French data on this topic remains scarce. The purpose of the study was to describe epidemiological characteristics and the management of burn injuries on duty in the French Armed Forces. Methods: a retrospective observational study was performed of French casualties with burns, transported to Percy Burn Center (R4 Medical Treatment Facility) between January 1, 2001, and December 31, 2017. Results: 67 patients were included. 54% of burns analyzed were non-operational injuries, mainly due to mishaps occurring with the burning of waste and the use of fuel. Operational burns (n=31/67) were mostly explosions related (improvised explosive devices and ammunition handle). The median total body surface area burned was 12% [7; 23,5]. Major anatomical regions affected were upper limbs (85%), head/neck (75%) and hands (69%). 7 patients (10%) had smoke inhalation injuries. The combination of burn injury and multiple trauma occurred in 22% (n=15/67). Operational burns resulted in more blast injuries and multiple trauma, more MASCAL procedures, in higher median Injured Severity Score (ISS) and Abbreviated Burn Severity Index (ABSI), more patients under mechanical ventilation, more blood transfusions and surgeries (p <0.001). The case fatality rate was 3% (n=2/67). Discussion: more than half of casualties occur in a non-operational setting. Non-operational burn injuries are less severe and accessible to prevention. Further efforts are needed to expand the spectrum of effective preventive and educational interventions and to improve their effectiveness. The higher severity score of operational burn injuries are due to the associated trauma and mechanism. Burn injuries on duty require a multidisciplinary team approach with highly specialized personnel together in a dedicated trauma and burn center. A French trauma registry is a critical need. Only patients with burns that required hospitalizations have been included. So this study is the visible tip of the iceberg. All military care providers should be familiar with the assessment and treatment of burns. ; Introduction : les brûlures en mission sont fréquentes et ont un impact fort sur la disponibilité des militaires. Néanmoins les armées françaises disposent de très peu de données sur les militaires brûlés. L'objectif de cette étude était de décrire les caractéristiques et la prise en charge des militaires français brûlés en service. Patients et méthode : une étude épidémiologique rétrospective incluant les militaires brûlés en service hospitalisé au Centre de Traitement des Brûlés (CTB) de l'hôpital d'instruction de armées Percy entre le 1er janvier 2001 et le 31 décembre 2017 a été conduite. Résultats : 67 patients ont été inclus. 54 % présentaient des brûlures non liées à une situation opérationnelle, principalement par incinération de déchets et manipulation de carburants. Les brûlures en situation opérationnelle (n=31/67) étaient principalement secondaires à un mécanisme par explosion (engins explosifs improvisés, manipulation de munitions). La surface cutanée brulée totale médiane était 12% [7; 23,5]. Les régions anatomiques les plus touchées étaient : les membres supérieurs (85%), tête/cou (75%) et les mains (69%). 7 patients présentaient des lésions d'inhalation de fumées (10%). 22% des patients (n=15/67) présentaient une association de brûlure et de lésions traumatologiques. Les brûlures en situation opérationnelle étaient associées à plus de lésions de blast et de lésions traumatiques, à plus de plans MASCAL, à des scores ISS et ABSI plus élevés, à plus de recours à la ventilation mécanique en réanimation, à plus de transfusions et de chirurgies (p < 0,001). La létalité était de 3% (n=2/67). Discussion : plus de la moitié des patients étaient brûlés en situation non opérationnelle. Ces brûlures étaient moins sévères et surtout accessible à des mesures de préventions. Des efforts doivent être entrepris dans la mise en oeuvre des mesures de préventions et dans l'éducation des forces. La gravité des brûlures en situation opérationnelle est due au mécanisme par explosion et aux lésions traumatiques associées. La prise en charge des brûlés militaires nécessite des équipes pluridisciplinaires de haut niveau au sein d'un centre de brûlé et de traumatologie lourde. Il existe un besoin urgent dans l'élaboration d'un registre français des blessés de guerre. Cette étude n'incluait que les patients brûlés hospitalisés au CTB et ne représente pas l'intégralité des militaires brûlés en opérations. Tous les acteurs de la chaîne de santé doivent être formés à la prise en charge des brûlés.

The modern stage of Ukrainian regions' economy development, on the one hand, shifts the accents towards administrative and financial decentralization with simultaneous transfer of resources, authorities and responsibilities to the local level, and on the other hand – stipulates efficient use of territories' internal capacity and orientation at «smart specialization», optimization of the system of authorities and prevention of regional asymmetries. In this sense, an efficient system of inter-budgetary relations is the key to balanced sustainable development of the country and its regions, which should minimize the disproportions of regions' development, provide efficient redistribution of budget resources inside the budget system caused by territorial asymmetries of revenue base and, therefore, serve as the key instrument to maintain sustainable territorial development. The paper aims to reflect on domestic experience of construction of the inter-budgetary relations model in conditions of financial decentralization in order to outline the perspective directions of its improvement. The paper assesses current functioning condition of the system of inter-budgetary relations in Ukraine according to the results of the first stage of financial decentralization. The risks and challenges of its aggravation for regions' social and economic development are outlined. The following of them are defined as the most essential: unbalanced local budgets; excessive transfer dependence; imperfect mechanism of subvention allocation for forming of CTCs (consolidated territorial communities) infrastructure; legally unregulated and non-transparent mechanism of investment subventions allocation among the regions; insufficient mechanism of allocation of additional subsidy granted for oblast budgets as compensation of revenue loses by local budgets emerging from delegated liabilities regarding funding the educational and healthcare institutions; accumulation of the volumes of temporarily free local governments' funds on deposit accounts in state banks. The range of practical recommendations is suggested in order to minimize the risks of inter-budgetary relations' decentralization, in particular improvement of the procedure of allocating the infrastructural subvention to CTCs and subvention for social and economic development of regions; delineation local governments' functional liabilities. ; Реалізація започаткованої реформи фінансової децентралізації в Україні, яка спрямована на розширення повноважень органів місцевого самоврядування, надання їм більшої самостійності у вирішенні завдань місцевого масштабу, а відтак і поліпшення якості суспільних послуг для населення зумовлює необхідність переосмислення важливої сучасної проблеми державних фінансів – удосконалення наявних механізмів перерозподілу доходів бюджетів різних рівнів. Дано оцінку сучасному стану функціонування системи міжбюджетних відносин в Україні за підсумками першого етапу фінансової децентралізації. Виявлено ризики і виклики для соціально-економічного розвитку регіонів. Серед основних з них визначено: незбалансованість місцевих бюджетів; надмірну трансфертну залежність; недосконалий механізм розподілу коштів субвенції на формування інфраструктури ОТГ; законодавчу неврегульованість і відсутність прозорого механізму розподілу інвестиційних субвенцій між регіонами; недосконалий механізм розподілу додаткової дотації, що надається обласним бюджетам як компенсація втрат доходів місцевих бюджетів унаслідок переданих повноважень з фінансування видатків з утримання закладів освіти та охорони здоров'я; акумулювання обсягів тимчасово вільних коштів ОМС на депозитних рахунках у державних банках. Для нівелювання (мінімізації) ризиків децентралізації міжбюджетних відносин запропоновано низку практичних рекомендацій у частині: удосконалення процедури виділення субвенцій на соціально-економічний розвиток регіонів і на формування інфраструктури ОТГ; визначення уніфікованих параметрів і критеріїв розподілу додаткової дотації для місцевих бюджетів на делеговані повноваження в галузях освіти та охорони здоров'я; удосконалення розподілу функціональних обов'язків між ОМС шляхом ухвалення Закону України «Про адміністративно-територіальний устрій». ; Реализация начатой реформы финансовой децентрализации в Украине, которая направлена на расширение полномочий органов местного самоуправления, предоставления им большей самостоятельности в решении задач местного масштаба, а затем и улучшения качества общественных услуг для населения обусловливает необходимость переосмысления важной современной проблемы государственных финансов — совершенствование существующих механизмов перераспределения доходов бюджетов разных уровней. Дана оценка современному состоянию функционирования системы межбюджетных отношений в Украине по итогам первого этапа финансовой децентрализации. Выявлены риски и вызовы для социально-экономического развития регионов. Среди основных из них определены: несбалансированность местных бюджетов; чрезмерная трансфертная зависимость; несовершенный механизм распределения средств субвенции на формирование инфраструктуры ОТГ; законодательная неурегулированность и отсутствие прозрачного механизма распределения инвестиционных субвенций между регионами; несовершенный механизм распределения дополнительной дотации, предоставляемой областным бюджетам для компенсации потерь доходов местных бюджетов вследствие переданных полномочий по финансированию расходов по содержанию учреждений образования и здравоохранения; аккумулирования объемов временно свободных средств ОМС на депозитных счетах в государственных банках. В целях нивелирования рисков децентрализации межбюджетных отношений предложен ряд практических рекомендаций.

The objective of the research is to determine the relationship between adaptation strategies from the design of urban permits and the reduction of risks related to climate change, with a view to improving the physical, social, and institutional conditions that directly affect the improvement of the quality of life of the population. The research has been carried out based on the Hypothetical-Deductive research methodology, where data is collected for testing hypotheses based on the numerical measurement (quantities) and statistical analysis (statistical methods), in order to establish guidelines for behavior and prove theories, with a correlational research design, where the sample is the urbanizations that make up the urban authorizations. The sample corresponds to the Campiña conformed by 9 urban authorizations, and the population of said urban habilitations, that ascends to 3,864 inhabitants. The technique of surveys and observation of data was used, using as instruments the questionnaire and the observation form. The analysis of the community, environmental and institutional aspects was carried out, where training, adaptation in green areas, as well as programs and projects play a fundamental role in the definition of mitigation and adaptation strategies in risk reduction due to climate change. It concludes with the approach of strategies for the zones of greater risk, the integration of the mitigation and adaptation in the instrument of territorial ordering like one of the alternatives to reduce the impact of the climatic change. Also increase the adaptive capacity and resilience of ecosystems, design projects that contemplate green infrastructure in public spaces are approaches of the present investigation. The social component also affects the reduction or risk due to climate change, with a population trained in prevention measures, in the response to hazards caused by climate change, such as heavy rains, it will be possible to reduce vulnerability in their exposure and fragility and therefore the risk is reduced. Another component is the institutional, in charge of local governments and institutions of civil society that lead and propose Safe Development Model, organize the population to face the impacts of climate change, promote projects that are financed with Green bonds; these are some solution alternatives. ; La investigación consiste en determinar la relación existente entre las estrategias de adaptación desde el diseño de habilitaciones urbanas y la reducción de los riesgos relacionados al cambio climático, con miras a mejorar las condiciones físicas, sociales e institucionales que incidan directamente en la mejora de la calidad de vida de la población. La investigación ha sido realizada en base a la metodología de investigación Hipotético-Deductiva, en donde se recolecta datos para la comprobación hipótesis con base en la medición numérica (cantidades) y el análisis estadístico (métodos estadísticos), con el fin de establecer pautas de comportamiento y probar teorías, con un diseño de investigación correlacional, donde la muestra son las urbanizaciones que conforman las habilitaciones urbanas. La muestra corresponde a la Campiña conformada por 9 habilitaciones urbanas, y la población de dichas habilitaciones urbanas, que asciende a 3 864 habitantes. Se empleó la técnica de encuestas y observación de datos, utilizando como instrumentos el cuestionario y la ficha de observación. Se hizo el análisis de los aspectos comunitario, ambiental e institucional, en donde la capacitación, adaptación en áreas verdes, así como los programas y proyectos juegan un rol fundamental para la definición de estrategias de mitigación y adaptación en la reducción del riesgo por cambio climático. Se concluye con el planteamiento de estrategias para las zonas de mayor riesgo, integración de la mitigación y adaptación en los instrumentos de ordenamiento territorial en los instrumentos de ordenamiento territorial como una de las alternativas para reducir el impacto del cambio climático. Así mismo aumentar la capacidad adaptativa y de resiliencia de los ecosistemas, diseñar proyectos que contemplen infraestructura verde en los espacios públicos son planteamientos de la presente investigación. El componente social también incide en la reducción del riesgo por cambio climático, contando con una población capacitada en medidas de prevención, en la respuesta a peligros originados por el cambio climático, como las lluvias intensas, se conseguirá reducir la vulnerabilidad en su exposición y fragilidad y por ende se reduce el riesgo. Otro de los componentes es el institucional, a cargo de gobiernos locales institucionales de la sociedad civil que conducen y proponen Modelo de Desarrollo Seguro, organizar a la población para hacerle frente a los impactos del cambio climático, promover proyectos que se financien con los bonos verdes son algunas alternativas de la solución.

Background: By 2013, the UK government's Migration Advisory Committee had listed sonography as an official 'shortage specialty' (Migration Advisory Committee, 2013; Parker & Harrison, 2015). As a consequence of the working stresses allied to this shortage, British sonographers have increasingly been reducing hours or leaving clinical practice entirely (Society and College of Radiographers, 2014). Moreover, among those who remain, incidences of reported chronic pain and active injury are also on the increase within a profession that was already synonymous with high rates of work-related musculoskeletal disorder (WRSMD; Harrison & Harris, 2015). While contemporary research has described the rates of WRMSD among ultrasound practitioners (Bolton & Cox, 2015), none has to date extensively explored its personal and professional impacts. Methods: Using a model of Interpretative Phenomenological Analysis with proven facility in medical imaging research (Miller et al., 2017), extended semi-structured interviews with N=10 experienced sonographers were analysed. Results: Participants routinely reported a sensation of guilt and depleted self-efficacy that not only permeated any working absence resultant of their own WRMSD, but also to taking legitimate leave when colleagues were suffering from WRMSD. An upshot of this was to recurrently "take one for the team" and work through excessive pain, even when this would likely result in greater prospective physical damage. While the basic shortage of sonographers was the core attribution for such behaviours, participants also cited (1) increasingly obese patients, (2) increasingly unhelpful (i.e. profiteering) equipment manufacturers, and (3) their own paternalism regarding healthcare. Conclusions: The present situation in ultrasound mirrors a culture of potentially dangerous pain acceptance that been noted in the psychology of sport for some time (Weinberg et al., 2013) albeit for altruistic, rather than egotistic, reasons. There is a clear body of evidence to suggest that sonographers are in crisis point both in terms of staffing levels and in terms of inter-related issues of WRMSD. The issue of WRMSD remains complex and under-researched and few studies are able to establish a definitive cause of the condition, because the causes are multifactorial. However, the majority of the literature seems to agree that poor posture, repetitive movements and insufficient strength seem to be the main physical causes, but little has been explored in terms of how the philosophy of being a sonographer, their behaviours and cultures might also be contributing to this issue. This study contributes to a new body of knowledge, looking at the unique experiences of (n=9) individual sonographers and the ideological dilemmas they are facing. It is acknowledged that extensive deeper levels of analysis and interpretation need to take place around the data collected for this study in order to draw more comprehensive conclusions. In the legal pluralism and increasing inter-normativity context, this thesis demonstrates the influence of international climate change law on the formation and development of European Union (EU) environmental law through the techniques, methods and rules of integration provided for by international law as well as by European law. European environmental law now includes the concepts (green economy, sustainable development, carbon market .) and principles (common but differentiated responsibility, precaution, prevention, responsibility, etc.) of the climate change international Law. Thus, the Europeanisation and constitutionalisation of international climate change law resulted in its insertion into the legal system of member states. Indeed, by virtue of its international commitments to combat global warming, the EU has adopted legally binding instruments that impact national legal systems and is committed to Kyoto II. The dynamics, controversies, clashes and the woes of the multilateral climate policy and negotiations have led to the establishment of a well-structured European climate diplomacy and a green economy policy that do not fail to come up against challenges of international cooperation, international collective action, global public goods equitable production and consumption, as well as technical,technological, institutional, human, economic, financial, sovereignist, social, energy, and ecological and transformational barriers.On the basis of the binding effect and enforceability of the provisions of international climate law and European primary law, the international climate regime produces legal effects within the member states and even towards third states dealing with the European organization. Indeed, because of supranationality, direct effect and the primacy of European law, the international legal rules relating to the fight against climate change, transposed and integrated, are binding in the national legal orders where they require a uniform application. As a consequence, the EU law, by virtue of its supranational character and its control and sanction mechanisms, including jurisdictional ones, has become the instrument of effectiveness and efficiency of international conventional climate law. As a result, the shortcomings of this right relating to the absence of compulsory jurisdiction, the non-compliance by States with their international commitments and the weakness of international control are largely offset by the effectiveness of the European and national legal system. ; Dans le contexte du pluralisme juridique et de l'inter-normativité croissante, la présente thèse démontre l'influence du droit international des changements climatiques sur la formation et le développement du droit de l'environnement de l'Union Européenne (UE) à travers les techniques, méthodes et règles d'intégration prévues aussi bien par le droit international que par le droit européen. Le droit européen de l'environnement comporte désormais les concepts (économie verte, développement durable, marché de carbone.) et principes (responsabilité commune mais différenciée, précaution, prévention, responsabilité, etc.) du droit international des changements climatiques. Ainsi, l'européanisation et la constitutionnalisation du droit international des changements climatiques ont eu pour conséquence son insertion dans le système juridique des Etats membres. En effet, en vertu de ses engagements internationaux en matière de lutte contre le réchauffement global, l'UE a adopté des instruments juridiquement contraignants qui impactent les systèmes juridiques nationaux et s'est engagée sur le Kyoto II. Les dynamiques, les controverses, les heurs et les malheurs de la politique et des négociations climatiques multilatérales ont suscité la mise en place d'une diplomatique climatique européenne bien structurée et d'une politique d'économie verte qui ne manquent pas de se heurter à des défis de la coopération internationale, de l'action collective internationale, de production et de consommation équitables des biens publics mondiaux, ainsi qu'à des obstacles techniques, technologiques, institutionnels, humains, économiques, financiers, souverainistes, sociaux, énergétiques, écologiques et transformationnels. Sur le fondement de l'effet obligatoire et de la force exécutoire des dispositions du droit international du climat et du droit primaire européen, le régime international climatique produit des effets juridiques à l'intérieur des Etats membres et même à l'égard des Etats tiers traitant avec l'organisation européenne. En effet, en raison de la supranationalité, de l'effet direct et de la primauté du droit européen, les règles juridiques internationales relatives à la lutte contre les changements climatiques, transposées et intégrées, ont force obligatoire dans les ordres juridiques nationaux où elles requièrent une application uniforme. Il s'ensuit que le droit de l'UE, de par son caractère supranational et ses mécanismes de contrôle et de sanction, notamment juridictionnels, est devenu l'instrument d'effectivité et d'efficacité du droit conventionnel international du climat. De ce fait, les défaillances de ce droit relatives à l'absence d'une juridiction obligatoire, au non-respect par les Etats de leurs engagements internationaux et à la faiblesse du contrôle international sont largement compensées par l'efficacité du système juridique européen et national.

Introduction: burn injuries on duty are frequent and affect attrition rate of military personnel. Nevertheless French data on this topic remains scarce. The purpose of the study was to describe epidemiological characteristics and the management of burn injuries on duty in the French Armed Forces. Methods: a retrospective observational study was performed of French casualties with burns, transported to Percy Burn Center (R4 Medical Treatment Facility) between January 1, 2001, and December 31, 2017. Results: 67 patients were included. 54% of burns analyzed were non-operational injuries, mainly due to mishaps occurring with the burning of waste and the use of fuel. Operational burns (n=31/67) were mostly explosions related (improvised explosive devices and ammunition handle). The median total body surface area burned was 12% [7; 23,5]. Major anatomical regions affected were upper limbs (85%), head/neck (75%) and hands (69%). 7 patients (10%) had smoke inhalation injuries. The combination of burn injury and multiple trauma occurred in 22% (n=15/67). Operational burns resulted in more blast injuries and multiple trauma, more MASCAL procedures, in higher median Injured Severity Score (ISS) and Abbreviated Burn Severity Index (ABSI), more patients under mechanical ventilation, more blood transfusions and surgeries (p <0.001). The case fatality rate was 3% (n=2/67). Discussion: more than half of casualties occur in a non-operational setting. Non-operational burn injuries are less severe and accessible to prevention. Further efforts are needed to expand the spectrum of effective preventive and educational interventions and to improve their effectiveness. The higher severity score of operational burn injuries are due to the associated trauma and mechanism. Burn injuries on duty require a multidisciplinary team approach with highly specialized personnel together in a dedicated trauma and burn center. A French trauma registry is a critical need. Only patients with burns that required hospitalizations have been included. So this study is the visible tip of the iceberg. All military care providers should be familiar with the assessment and treatment of burns. ; Introduction : les brûlures en mission sont fréquentes et ont un impact fort sur la disponibilité des militaires. Néanmoins les armées françaises disposent de très peu de données sur les militaires brûlés. L'objectif de cette étude était de décrire les caractéristiques et la prise en charge des militaires français brûlés en service. Patients et méthode : une étude épidémiologique rétrospective incluant les militaires brûlés en service hospitalisé au Centre de Traitement des Brûlés (CTB) de l'hôpital d'instruction de armées Percy entre le 1er janvier 2001 et le 31 décembre 2017 a été conduite. Résultats : 67 patients ont été inclus. 54 % présentaient des brûlures non liées à une situation opérationnelle, principalement par incinération de déchets et manipulation de carburants. Les brûlures en situation opérationnelle (n=31/67) étaient principalement secondaires à un mécanisme par explosion (engins explosifs improvisés, manipulation de munitions). La surface cutanée brulée totale médiane était 12% [7; 23,5]. Les régions anatomiques les plus touchées étaient : les membres supérieurs (85%), tête/cou (75%) et les mains (69%). 7 patients présentaient des lésions d'inhalation de fumées (10%). 22% des patients (n=15/67) présentaient une association de brûlure et de lésions traumatologiques. Les brûlures en situation opérationnelle étaient associées à plus de lésions de blast et de lésions traumatiques, à plus de plans MASCAL, à des scores ISS et ABSI plus élevés, à plus de recours à la ventilation mécanique en réanimation, à plus de transfusions et de chirurgies (p < 0,001). La létalité était de 3% (n=2/67). Discussion : plus de la moitié des patients étaient brûlés en situation non opérationnelle. Ces brûlures étaient moins sévères et surtout accessible à des mesures de préventions. Des efforts doivent être entrepris dans la mise en oeuvre des mesures de préventions et dans l'éducation des forces. La gravité des brûlures en situation opérationnelle est due au mécanisme par explosion et aux lésions traumatiques associées. La prise en charge des brûlés militaires nécessite des équipes pluridisciplinaires de haut niveau au sein d'un centre de brûlé et de traumatologie lourde. Il existe un besoin urgent dans l'élaboration d'un registre français des blessés de guerre. Cette étude n'incluait que les patients brûlés hospitalisés au CTB et ne représente pas l'intégralité des militaires brûlés en opérations. Tous les acteurs de la chaîne de santé doivent être formés à la prise en charge des brûlés.

Introduction: general practitioners express some brakes to help stop smoking and do not feel trained enough in this domain. The new health policies have focused many of their prevention measures around the smoking issue. The idea of a city-hospital partnership has emerged as a new way to support patients in their approach, while offering a formative line for the general practitioners, knowing that no such device exists in France. Objectives and method: it was a question of collecting the feedback of general practitioners involved in the partnership, in terms of perceptions (motivation, satisfaction, perceived utility), attitudes (wish to renew this support, feeling of capacity), and practices ( adherence to the course, use of the proposed tools, evolution of practices). We conducted a cross-sectional survey by individual directive interviews, supplemented by a qualitative approach, conducted from January to March 2018 among 30 general practitioners in the Bordeaux agglomeration. Results: general practitioners have been motivated and satisfied by this partnership and wish for the majority to renew it. They felt helped and supported, benefitting from better formation. They were all the more so since their patients managed to maintain abstinence, which was evaluated at 1, 3 and 6 months. The longer the course of care was followed, the more the abstinence was maintained over time. Their practice in helping to stop smoking has been strengthened. Discussion: in the limit of our small sample of study, it appears that this innovative device gives convincing results and could be transposable to a wider population. This is the notion of transferability of interventions, at a time when policies advocate innovation in the health system and the decompartmentalization of the city and hospital. Since smoking is a public health priority, the doctors interviewed raise the question of valuing the tobacco consultation. Conclusion: this partnership appears as a new way of care to offer patients to optimize their chances of reaching the cessation of smoking and its maintenance. It also allows refocusing the general practitioner in the course by fully attributing to him his role as a major player in primary care. The deployment of this method is envisaged in the coming months. ; Introduction : les médecins généralistes expriment certains freins à pratiquer l'aide à l'arrêt du tabac et ne se sentent pas assez formés dans ce domaine. Les nouvelles politiques de santé ont axé plusieurs de leurs mesures de prévention autour de la question du tabagisme. L'idée d'un partenariat ville-hôpital est apparue comme un nouveau moyen d'accompagner les patients dans leur démarche, tout en proposant une ligne formatrice pour le médecin généraliste, sachant qu'aucun dispositif de ce type n'existe en France. Objectifs et méthode : il s'agissait de recueillir le retour d'expérience des médecins généralistes impliqués dans le partenariat, en termes de perceptions (motivation, satisfaction, utilité perçue), attitudes (souhait de renouveler cette prise en charge, sentiment de capacité), et pratiques (adhésion au parcours, utilisation des outils proposés, évolution des pratiques). Nous avons réalisé une enquête transversale par entretiens individuels directifs, complétée par une approche qualitative, menée de janvier à mars 2018 auprès de 30 médecins généralistes de l'agglomération bordelaise. Résultats : les médecins généralistes ont été motivés et satisfaits par ce partenariat et souhaitent pour la majorité le renouveler. Ils se sont sentis aidés et accompagnés, bénéficiant d'une meilleure formation. Ils l'étaient d'autant plus que leurs patients ont réussi le maintien de l'abstinence qui était évaluée à 1, 3 et 6 mois. Plus le parcours de soins était suivi, plus l'abstinence était maintenue dans le temps. Leur pratique en termes d'aide à l'arrêt du tabac s'est trouvée renforcée. Discussion : Dans la limite de notre petit échantillon d'étude, il apparaît que ce dispositif novateur donne des résultats convaincants et pourrait être transposable à une plus large population. C'est la notion de transférabilité des interventions, à l'heure où les politiques prônent l'innovation dans le système de santé et le décloisonnement ville-hôpital. Le tabagisme étant une priorité en santé publique, les médecins interrogés soulèvent la question d'une valorisation de la consultation tabac. Conclusion : ce partenariat apparaît comme un nouveau moyen de prise en charge à proposer aux patients pour optimiser leur chance d'accession à l'arrêt du tabac et à son maintien. Il permet également de recentrer le médecin généraliste dans le parcours en lui attribuant pleinement son rôle d'acteur majeur en soins premiers. Le déploiement de cette méthode est envisagé dans les mois à venir.

The purpose of the article is to identify and analyze the features of the constituents of the fiscal policy of the state with their components.The fiscal policy of the state as one of the key components of the state financial policy: 1) plays an essential role in regulating the economy by influencing the state revenues and expenditures; 2) is caused by a number of factors (causes), in particular the requirements of the European integration processes, decentralization and the fight against systemic crisis phenomena in the economy. Today, Ukraine's fiscal policy does not fully realize its potential, which determines the relevance of the issues raised in the work.It has been clarified that the fiscal policy of the state should be understood as the purposeful policy in the field of state budget revenues, the policy of establishing (defining) and receiving (accumulation) of its revenues (i.e. the state budget) in order to solve such key (main) tasks as : 1) reduction of the general level of unemployment; 2) raising the standard of living of the population; 3) stimulation of entrepreneurial activity (initiative); 4) prevention of inefficient use of resources; 5) development of innovation and investment activity; 6) preventing the growth of inflation.It has been found out that the main (key) integral structural components of the fiscal policy of the state are: 1) the policy of state income (revenues), which consists of the targeted activity of the state in regulating tax, non-tax and other revenues on a non-refundable basis in accordance with the legislation in force in a particular country (including fees for the provision of administrative services, transfers, own revenues (receipts) of budget institutions and organizations) in order to effectively perform state functions; 2) the policy of state expenditures, which should be understood as the targeted state activity in regulating budget expenditures, providing loans from the budget, repaying debt and placing budget funds in deposits, purchasing securities, etc.It has been proved that the strategic goals of the fiscal policy of Ukraine should be: 1) unshadowing the economy; 2) creating a favorable investment climate; 3) ensuring the investment of resources into the human capital, in the first turn, into the educational and professional potential; 4) optimization of the structure of budget revenues/expenditures; 5) carrying out the weighted debt policy, etc.The prospect of further research in this direction is the development of practical proposals (recommendations) for improving Ukraine's fiscal policy in the context of anti-crisis measures. ; Метою статті є визначення та аналіз особливостей складових фіскальної політики держави з їх компонентами.Фіскальна політика держави як одна з ключових складових державної фінансової політики: 1) виконує суттєву роль у регулюванні економіки шляхом впливу на надходження та витрати держави; 2) зумовлена низкою факторів (чинників), зокрема потребами євроінтеграційних процесів, децентралізації та боротьби із системними кризовими явищами в економіці. На сьогодні фіскальна політика України не повною мірою реалізує свій потенціал, що зумовлює актуальність піднятого у роботі питання.З'ясовано, що під фіскальною політикою держави слід розуміти цілеспрямовану політику в галузі доходів державного бюджету, політику щодо встановлення (визначення) та отримання (акумулювання) надходжень до нього (тобто до державного бюджету) з метою вирішення таких ключових (основних) завдань, як: 1) зменшення загального рівня безробіття; 2) підвищення рівня якості життя населення; 3) стимулювання підприємницької діяльності (ініціативи); 4) недопущення неефективного використання ресурсів; 5) розвиток інноваційно-інвестиційної діяльності; 6) недопущення зростання рівня інфляції.Встановлено, що основними (ключовими) невід'ємними структурними складовими фіскальної політики держави є: 1) політика державних доходів (надходжень), яка полягає у цілеспрямованій діяльності держави щодо регулювання податкових, неподаткових та інших надходжень на безповоротній основі відповідно до діючого законодавства певної країни (включаючи плату за надання адміністративних послуг, трансферти, власні доходи (надходження) бюджетних установ та організацій) з метою ефективного виконання державою своїх функцій; 2) політика державних видатків (витрат), під якою слід розуміти цілеспрямовану державну діяльність щодо регулювання видатків бюджету, надання кредитів із бюджету, погашення боргу та розміщення бюджетних коштів на депозитах, придбання цінних паперів тощо.Доведено, що стратегічними цілями фіскальної політики України мають бути: 1) детінізація економіки; 2) створення сприятливого інвестиційного клімату; 3) забезпечення вкладення інвестиційних ресурсів у людський капітал, в першу чергу у освітньо-фаховий потенціал; 4) оптимізація структури бюджетних доходів/видатків; 5) проведення виваженої боргової політики тощо.Перспективою подальших досліджень у цьому напрямі є розроблення практичних пропозицій (рекомендацій) з удосконалення фіскальної політики України в контексті проведення антикризових заходів.
