Während die Geschichte vom ersten Zionistenkongreß 1897 bis zur israelischen Staatsgründung 1948 nur kursorisch abgedeckt ist (S. 8-25), nehmen die Entwicklungen und Probleme des jüngsten Jahrzehnts (Intifada seit 1987, Friedensprozeß und Friedensperspektiven) den breitesten Raum ein. European legal systems have long encompassed the concept of the "general clause", particularly in contract and labor law. The general clause includes unwritten legal norms such as good faith and public morality, and these principles are duly incorporated in the process of construing civil and labor contracts. While the general clause itself is formally absent in common law systems, its principles have found their way into modern British and American law. Two primary examples include the doctrines of good faith and unconscionability. In a broader sense, the idea of introducing rather indeterminate legal norms to be construed and interpreted by judges appears to be well‑ suited to a common law system. However, as applied to American labor law, the very indeterminacy of these terms has had rather negative effects on the rights of employees and the labor unions that represent them. UKSW for his comments and suggestions, which helped me considerably to improve the article. ; A compulsory licence is an authorisation under the state administration to use intellectual property rights by third parties, subject to payment of remuneration, regardless of the patent holder's objection. In the Polish legal system, the institution of a compulsory licence is regulated by: the Paris Convention for the Protection of Industrial Property Rights (20 March 1883), the Agreement on Trade-Related Aspects of Intellectual Property Rights (15 April 1994), Regulation (EC) No 816/2006 of the European Parliament and of the Council of 17 May 2006 on the granting of compulsory licences for patents relating to the manufacture of pharmaceutical products for export to countries with public health problems and the Industrial Property Law Act (30 June 2000). The basic research thesis of my paper was based on the assumption that a compulsory licence does not meet the objective of providing access to biologics. Penelitian ini bertujuan untuk menguji dan menganalisa pengaruh konflik peran dan ambiguitas terhadap kinerja melalui kepuasan kerja pada tenaga fungsional RSUD Sekadau. Metode penelitian yang digunakan merupakan jenis penelitian non-eksperimental dengan pendekatan kuantitatif, deskriptif korelasi dan desain cross-sectional. Populasi dalam penelitian ini adalah seluruh tenaga fungsional RSUD Sekadau yang berjumlah 181 orang dengan sampel yang diambil adalah 123 orang tenaga fungsional RSUD Sekadau. Alat analisis yang digunakan adalah analisis jalur (path analysis) dengan metode SEM (structural equation modelling) menggunakan WarpPLS versi 6.0. Hasil penelitian menunjukkan terdapat pengaruh positif signifikan konflik peran terhadap kinerja, terdapat pengaruh negatif signifikan ambiguitas terhadap kinerja, terdapat pengaruh negatif signifikan antara konflik peran dan ambiguitas terhadap kepuasan kerja, terdapat pengaruh negatif signifikan kepuasan kerja terhadap kinerja, terdapat pengaruh positif signifikan antara konflik peran dan ambiguitas terhadap kinerja melalui kepuasan kerja. Nilai profesionalisme menjadi penting untuk variabel konflik peran, tanggung jawab menjadi faktor penting untuk variabel ambiguitas, hubungan yang baik dengan profesi lain di Rumah Sakit menjadi penting untuk variabel kepuasan kerja dan karyawan memahami harapan pekerjaan dan tetap melaksanakannya sesuai dengan tanggung jawab merupakan nilai penting untuk variabel kinerja. The paper features the fi rst general description in the Russian language of two necropolises located in Campochiaro (Campobasso, Italy) – Vicenne and Morrione, dating back to the period from the last third of the 7th – the beginning of the 8th century AD. The cultural content of the necropolises refl ects their strong ties with the population of Central Asian origin. The most important feature of the necropolises are burials with a horse, corresponding to the Eurasian nomadic burial rite. The author supported the conclusions of European researchers according to which it is highly probable that the necropolises were left by the Bolgars of the duke–gashtald Alzeko, originally recorded by Paul the Deacon in the 8th century in the territories of Bojano, Sepino and Isernia. The similarities of the Campochiaro necropolises with the burials of the Avar Khaganate imply the presence of the Bolgars in the Avar society with a similar burial ritual. Out of the thousands of horse burials left by the Avar population, a large portion could have been left by the Bolgars. The Avars and Bolgars constituted the basis and ruling elite of the Khaganate. The Alzeko people were the part of the Bolgars who in 631 AD fought for the Khagan throne, which indicates the high position of the Bolgars and their large number. After the defeat, this group of the Bolgars migrated to Bavaria, Carantania and Italy. Several decades of living in the Venedian, and later in the Lombard and Roman environment resulted in the heterogeneity of the funerary inventory, but did not change the rite itself. The Bolgars of the Lombard kingdom formed a new military layer - professional cavalry, which received land plots. This equestrian squad is an early example of the European feudal military and social class which was later referred to as chivalry. ; Настоящая работа является первым общим описанием на русском языке двух некрополей Кампокиаро (Кампобассо, Италия) – Виченне и Морионе, датируемых последней третью VII в. – началом VIII в. Культурное содержание некрополей показывает прочные связи с населением центральноазиатского происхождения. Важнейшим признаком некрополей являются захоронения с конем, соответствующие евразийскому кочевому погребальному обряду. Автор поддержал выводы европейских исследователей о том, что с большой долей вероятности некрополи оставлены булгарами дукса–гаштальда Алзеко, зафиксированными Павлом Диаконом в VIII в. на территориях Бояно, Сепино и Изернии. Аналогии некрополей Кампокиаро с погребениями Аварского каганата показывают присутствие в аварском обществе булгар со схожим погребальным обрядом. Из тысяч погребений с конем, оставленных аварским населением, булгарам могла принадлежать большая часть. Авары и булгары составляли основу и правящую верхушку каганата. Народ Алзеко являлся той частью булгар, которая в 631 г. боролась за каганский престол, что указывает на высокое положение булгар и их большое количество. После поражения эта группа булгар мигрировала последовательно в Баварию, Карантанию и Италию. Несколько десятков лет проживания в венедской, а затем в лангобардской и романской среде привели к гетерогенности погребального инвентаря, но не изменили сам обряд. Булгары лангобардского королевства составляли новый военный слой, который представлял из себя профессиональную кавалерию, получивший землю. Inhaltsangabe:Einleitung: 'Ein Schlachtfeld, das scheint für einige Reporter so etwas zu sein wie ein Abenteuerspielplatz, illuminiert von einem Feuerwerk, ein aufregendes Lichterspiel mit einer bombigen Geräuschkulisse. Das Bild vom Kriegsreporter, das in den Köpfen mancher meiner Kollegen irrlichtert, sieht ungefähr so aus: Lederjacke, düsterer Blick, der sagt: ,Ich habe schon so ziemlich alles gesehen', dazu noch ordentlicher Alkoholkonsum, Whiskey natürlich passend zu rauen Stimmen und den drei Scheidungen, die der ,verdammte Beruf' halt so mit sich gebracht hat. Andere verstehen das Wort vom Kriegsspiel allzu wörtlich. Sie meinen, ein Kurzeinsatz in Afghanistan könne sie von der angeblichen Langeweile der Regionalberichterstattung erlösen, wenn auch nur für drei Wochen. Schließlich gibt es noch jene Kollegen, die glauben, durch einen Einsatz als Kriegsreporter ihre Karriere beschleunigen zu können. Gerade die letzteren sind nicht wenige.' (Armbruster 2007; ARD-Kriegsreporter vor dem zweiten Irakkrieg in Bagdad). Mythische Vorstellungen über das Berufsbild des Krisen- bzw. Kriegsreporters gibt es nicht nur auf Seiten der Journalisten, sondern auch auf Seiten der Rezipienten medialer Informationen aus weltweiten Kriegsgebieten: Kriegsreporter gelten als ,coole' Helden in weißen Hemden, die im mutigen Alleingang an der Front leben und arbeiten - weit entfernt von der sicheren Heimat. Sie haben keine Angst und scheuen sich nicht, nur ,bewaffnet mit einem Presseausweis' im Schützengraben zu liegen, um unter Einsatz ihres eigenen Lebens ,live' für ,ihr' Publikum aus dem Ausland Bericht erstatten zu können. Für Kriegsreporter ist der Ausnahmezustand Normalzustand. Ihre Arbeit ist ein ständiger Adrenalin-Kick. Kehrt der Kriegsreporter in seine Heimatredaktion zurück, bringt der Auslandseinsatz unter Gefechtsbedingungen einen Karriere-Kick, heißt es. Im Extremfall stirbt der Kriegsreporter einen ,heroischen', weil unschuldigen und öffentlichen Tod, denn Kriege werden oftmals zu globalen Medienereignissen stilisiert. Vielleicht sind es gerade die außergewöhnlichen Arbeitsbedingungen im Krieg und Verantwortlichkeiten des Kriegsreporters, die die mythischen Elemente im Selbstbild dieser Profession begründen. Weil Krieg für Rezipienten aus Westeuropa häufig ein von der Heimat weit entferntes Spektakel ist, fungieren Kriegsberichterstatter als die einzigen Augenzeugen vor Ort mit öffentlichem Informationsauftrag. Sie tragen außerhalb des heimatlichen Einflussbereiches der Rezipienten dafür Sorge, dass das Publikum in der Heimat wie ,selbstverständlich' von den kriegerischen Auseinandersetzungen im Ausland erfährt. Als Spezialkorrespondenten im Ausland sind Kriegsreporter oft die Ersten, die am Ort einer Katastrophe eintreffen. Ihr Einsatz im Kriegsgebiet zählt zu den gefährlichsten und schwierigsten Auslandseinsätzen eines Journalisten. Momente und Bilder von Tod, Barbarei und Sinnlosigkeit gehören von Berufs wegen zu ihrem riskanten Arbeitsalltag. Sprachlosigkeit können sich Kriegsreporter angesichts der Omnipräsenz von Tod und Gewalt aber nicht leisten, denn ,Krieg' ist ein Wort, das die Agenda der Medien tagtäglich dominiert. Mit seiner Dominanz wächst die Nachfrage der Rezipienten nach vertrauenswürdigen Informationen aus dem Ausland, die durch eine Orientierung bietende Kriegsberichterstattung gestillt werden muss. Für viele Menschen beginnen Kriege zudem erst dort, wo die Medien auftreten. Eine professionelle und unabhängige Kriegsberichterstattung ist besonders wichtig, weil Kriegsberichterstattung nicht nur für die Strukturierung der Realität des Rezipienten und für seine Vorstellungen von der Welt von besonderer Relevanz ist, sondern auch dafür, wie die am Krieg beteiligten Länder, Völker und Politiker massenmedial wahrgenommen werden. Weil Kriegsparteien die Macht der Medien erkannt haben, wirkt diese Tatsache unmittelbar auf die Kriegsberichterstatter zurück. So reagieren die Kriegsparteien mit einem immer professioneller ausgestalteten Informationsmanagement und versuchen, die Nachfrage nach Informationen mit möglichst produktionsgerechtem Informationsmaterial oder durch mediengerechte Inszenierung von Ereignissen zu befriedigen. Zu den besonderen Herausforderungen eines Kriegsberichterstatters gehört es folglich, den Überblick in Zeiten der desorientierenden Informationsflut und der Instrumentalisierungs- und Abschirmungsversuche zu bewahren. Im Sinne des allgegenwärtigen journalistischen Objektivitäts-Primats müssen Journalisten auch unter verschärften Arbeitsbedingungen im Kriegsgebiet nach der ,Wahrheit' suchen. Gleichzeitig müssen die Kriegsreporter die Erwartungshaltungen der Redaktionen und des Publikums im Rahmen ihrer Berichterstattung erfüllen, die sich in Abhängigkeit von den Tendenzen und Trends in der Auslandsberichterstattung des 21. Jahrhunderts herauskristallisieren. Verstärkte Kommerzialisierungstendenzen und technologische Innovationen haben seither einen markanten Einfluss auf die Art der journalistischen Berichterstattung und erhöhen nicht nur den Selektions- und Aktualitätsdruck, sondern provozieren vor allem scharfe Kritik am Journalismus. Ereignisorientierung statt Hintergrundberichterstattung, Abhängigkeit vom militärischen Informationsmanagement, Spekulationen statt Fakten, überflüssige oder übertrieben-dramatische Berichterstattung lauten häufige Vorwürfe im speziellen Kontext der Kriegsberichterstattung (vgl. Löffelholz 2003, S. 11). In Anbetracht der verschärften Arbeitsbedingungen und Herausforderungen im fernen Ausland ist es nachvollziehbar, dass Kriegsreporter zu den prominentesten Journalisten zählen und diese ,Sonderform' der journalistischen Auslandsberichterstattung viele Klischees und Mythen hervorgebracht hat. Das mythische Bild vom Kriegsreporter ist auch im 21. Jahrhundert noch existent, weil der Forschungsstand speziell rund um die Person des Kriegsberichterstatters als rudimentär subsumiert werden kann. Nach Beham ist die Kriegsberichterstattung selbst in der Journalistenausbildung eine 'terra incognita' (Beham 1996, S. 234). Statt wissenschaftlich fundierten Erkenntnissen zu den Rahmenbedingungen des journalistischen Kriegseinsatzes und den Urhebern der ausländischen Berichte existieren primär (kommerzielle) Berichte von einzelnen Kriegsreportern in Tagebuchform über ihre Arbeit im Kriegsgebiet. Es ist auffallend, dass sich zahlreiche Studien allgemein dem journalistischen Berufsstand an sich widmen, die wenigen Studien im speziellen Kontext der Kriegsberichterstattung den Journalisten selbst aber regelmäßig ausblenden. Die Mehrzahl dieser analytischen Studien beschäftigt sich nicht mit dem Kommunikatorverhalten, sondern mit dem Rezipientenverhalten (vgl. Bentele 1993, S. 121 f.). Hinzu kommt, dass die wenigen Kommunikatorstudien entweder den Auslandsberichterstatter allgemein fokussieren (siehe z. B. Hahn et al. 2008) und ihn nur an einzelnen Nachrichtenplätzen erforschen (siehe z. B. Mükke 2009) oder sich lediglich mit speziellen Kriegsreportern wie den ,Embedded Journalists' auseinandersetzen (siehe z. B. Kryszons 2007; Richter 1999). Zwar haben die Kriegserfahrungen der jüngsten Vergangenheit das Thema Kriegsberichterstattung mit neuer Dringlichkeit auf die wissenschaftliche Agenda gesetzt (vgl. Daniel 2006, S. 8), jedoch wirft sie aufgrund der oben beschriebenen Lücken in der Forschung (,gap of research') auch im Jahre 2010 noch eine Reihe von zu untersuchenden Fragen auf (vgl. Kleffel 1994, S. 76). Forschungsgegenstand dieser Arbeit sind daher die Protagonisten, die im Kern des Verhältnisses von Medien und Krieg an verschiedenen Kriegsschauplätzen weltweit stehen. Aus einer akteurszentrierten Perspektive sollen deutschsprachige Kriegsberichterstatter als Berufskommunikatoren näher beleuchtet werden, die vor Ort in weltweiten Kriegsgebieten arbeiten. Die vorliegende explorative Untersuchung ist als eine Fallstudie der Kommunikatorforschung zu verstehen. Forschungsziel ist, Erkenntnisse über deutschsprachige Kriegsberichterstatter und die Rahmenbedingungen ihrer Arbeit vor Ort sowie vor und nach ihrem Kriegseinsatz zu gewinnen. Dazu sollen die theoretischen Behauptungen in der Literatur durch einen Vergleich der Aussagen von Praktikern in Bezug auf personenbezogene Dispositionen sowie Arbeitsweisen und Arbeitsumstände angereichert werden, um etwaige Tendenzen innerhalb eines weltweiten Kontextes aufzeigen zu können. Die zum Vergleich benötigten Daten werden mittels einer Befragung von deutschsprachigen Kriegsberichterstattern gesammelt, durch die der Zielgruppe die Gelegenheit gegeben wird, individuelle Meinungen bzw. Einstellungen zu äußern sowie Überzeugungen, Verhaltensweisen und personenbezogene Eigenschaften darzulegen. Die folgenden Forschungsfragen, die den Fokus insbesondere auf Selbstwahrnehmung, Meinungen und Verhaltensweisen der Kriegsreporter legen, spezifizieren das Forschungsziel und verdeutlichen, welche Aspekte in der vorliegenden Studie von zentralem Interesse sind: Personenbezogene Dispositionen: Wie sieht das Profil der befragten deutschsprachigen Kriegsberichterstatter aus? Welches Motiv bewegt den Journalisten, als Kriegsreporter vor Ort arbeiten zu wollen? Welches Rollenbild hat der Journalist in Bezug auf seine Aufgabe im Kriegsgebiet? Arbeitsumstände: Wie sind die infrastrukturellen und logistischen Arbeitsbedingungen vor Ort zu bewerten? Wie lässt sich das Verhältnis der Kriegsberichterstatter untereinander charakterisieren? Welche Rolle spielt die Heimatredaktion für den Kriegsreporter vor Ort? Wie lässt sich das kommunikative Verhältnis zwischen Heimatredaktion und Kriegsreporter vor Ort beschreiben? Hat die Heimatredaktion eine Ordnungsfunktion inne? Welche Vor- und Nachsorgemaßnahmen werden getroffen? Welche physischen und psycho-sozialen Gefahren birgt der Einsatz im Kriegsgebiet? Arbeitsweisen: Wie generieren die Journalisten ihr Fachwissen über das Einsatzgebiet? Aus welchen Quellen gewinnt der Reporter seine Informationen und wie überprüft er deren Vertrauenswürdigkeit? Wie häufig werden unverifizierte Informationen weitergeleitet? Welche Meinung vertritt der Reporter in Bezug auf kontrovers diskutierte visuelle und verbale Darstellungsoptionen in seinen Kriegsberichten? Zur Beantwortung der Forschungsfragen ist die Arbeit in fünf Kapitel gegliedert. Nach der Einleitung (I.) wird in Kapitel II. das theoretische Fundament zum Verständnis von Kriegsberichterstattung gelegt. Weil Kriegsberichterstattung zur Auslandsberichterstattung gehört, liefert Kapitel II.1. zunächst eine kurze Einführung in dieses Feld, damit in Kapitel II.2. die Kriegsberichterstattung als eine ,Sonderform' der Auslandsberichterstattung verortet und näher beleuchtet werden kann. Kapitel III. skizziert praktische Implikationen der Kriegsberichterstattung und bildet mit der Fokussierung der besonderen Modalitäten vor (III.1.), während (III.2.; III.3.; III.4.) und nach (III.5.) dem journalistischen Einsatz im Kriegsgebiet den Schwerpunkt der vorliegenden Arbeit. In Kapitel IV. wird die empirische Untersuchung vorgestellt (IV.1.) und ein exklusives Meinungsbild von weltweit tätigen Kriegsreportern präsentiert und diskutiert (IV.2.), um die forschungsleitenden Fragestellungen in der Einleitung zu beantworten. Befördert wurde die mythische Betrachtungsweise der Person des Kriegsreporters dadurch, dass er zu damaliger Zeit traditionsgemäß aus der Oberschicht oder den oberen Mittelschichten stammte und damit auch oftmals aus der gleichen sozialen Schicht wie die angesehenen Offiziere der damaligen Truppen, die ihn begleiteten. Überlappende Bekanntschaftskreise und geteilte Männlichkeitsvorstellungen sowie Ehrenkodizes verfestigten das Verhältnis zwischen den militärischen Befehlshabern und den Kriegsberichterstattern zusätzlich. Kriegsberichterstatter waren 'Gentlemen unter Gentlemen' (Daniel 2006, S. 13), die den Kontakt mit einfachen Soldaten mieden und privilegiert mit Diener, Pferd und Wagen reisten. Erst um 1900 sei diese elitäre Gruppe der Kriegsberichterstatter mit einem weniger elitären Typus konfrontiert worden, der später als ,freelancer' bezeichnet wurde. Sein vorrangiges Ziel ist es gewesen, durch seine Berichte vom Schlachtfeld Karriere zu machen (Vgl. ebda.): 'Sie brachten einen neuen, von der Generation der Älteren und Erfahrenen nicht goutierten Stil in die Korrespondentenschar, da sie sich ihren Namen erst noch machen mussten und deswegen die einvernehmlichen Umgangsweisen zwischen Korrespondenten und Militärs durch Umgehen von Zensurvorschriften und ähnliches störten.' (Daniel 2006, S.13). Zwar habe sich im Verlaufe des 20. Jahrhunderts die soziale Einzugsbasis beider Berufsgruppen erweitert, durch die sich der 'soziale Konnex zwischen Offizierskorps und Journalisten' (ebda.) auflöste, dennoch ist der Mythos Kriegsreporter auch heute noch beständig. Nach Klein und Steinsieck sind die um das Berufsbild kursierenden Mythen insbesondere im Zusammenhang mit dem damals gängigen Bild des 'archetypischen' (Klein/Steinsieck 2006, S. 9) Kriegsberichterstatters, welches sich auf einer fortwährend suggerierten Kompetenz und Glaubwürdigkeit gründen würde, auch heute nicht überholt. Klein und Steinsieck sind überzeugt, dass Kriegsberichterstatter auch im 21. Jahrhundert noch bemüht sind, Vertrauen aufzubauen, indem sie ein spezifisches Bild von ihrer Persönlichkeit und ihrem Beruf zu vermitteln versuchen. In autobiographischen Diskursen würden Kriegsreporter deshalb vorzugsweise ihre unmittelbare Augenzeugenschaft vor Ort betonen, mit dem Ziel, ihre Glaubwürdigkeit auf diese Weise nachhaltig unterstreichen zu können. In diesem Zusammenhang würden Kriegsreporter mit Vorliebe nicht über ihren Alltag, der meist eher langweilig sei, sondern vor allem von außergewöhnlichen Momenten erzählen, in denen sie als Kriegsreporter selbst im Mittelpunkt explosiver Gewalt stünden. (Vgl. ebda.) Kriegsreporter Pedelty argumentiert in ähnlicher Weise die mythischen Elemente im Selbstbild seiner Profession: 'The mythological core of press corps culture contains a shared narrative of adventure, independence, and truth that imbues the correspondents` heavily controlled practice with sense of magic and purpose. The myths become anodynes, narcotic fantasies (and ?phalluses?) which assuage the pangs of mundane, difficult, and disciplined labor.' (Pedelty 1995, S. 39). Spekuliert werden kann, ob mit dieser bewussten Betonung der persönlichen Augenzeugenschaft ein Grund für den klischeegeprägten Mythos des beinahe unverwundbaren und coolen Berichterstatters gegeben ist (vgl. Hoff 2008), 'der notfalls abends an der Bar die gruseligen Bilder des Tages herunterspült' (Staun 2010; vgl. auch Hoff 2008). Darüber hinaus hat aber auch die Frage nach Beweggründen für die persönliche Grundsatzentscheidung des Journalisten aus einem Kriegsgebiet zu reportieren und damit das eigene Leben bei der Berufsausübung zu riskieren, schon viele Spekulationen befördert: Ist es 'Sensationsgier, Effekthascherei, um durch Heldentum seiner Karriere einen Schub zu verpassen?' (Armbruster 2008, S. 55) Doch neben den eigentlichen Motiven sind auch die Charakterzüge eines Kriegsreporters wichtig. Brase (2008, S. 42), selbst Kriegsreporter im damaligen Kosovo-Krieg, mahnt eindringlich: 'Der Einsatz in einem Krisengebiet ist nichts für Zartbesaitete, genauso wenig wie der journalistische Einsatz etwas für Draufgänger und Abenteurer ist'. Eine ähnliche Ansicht vertritt Limbourg (2008, S. 171 f.), der als verantwortlicher Chefredakteur auch für die Auswahl von Kriegsreportern zuständig ist: 'Bei Kriseneinsätzen gilt: viele Kollegen fühlen sich berufen – wenige sind ausersehen. Natürlich wissen Reporter, dass bei einem gelungenem Einsatz Ruhm und Ehre warten. Die Aufmerksamkeit von Redaktion und Chefs ist sicher. Tägliche Präsenz in den Hauptnachrichten ist gewiss. Man kann es sogar selbst zum Medienereignis bringen [...] Aber im Vordergrund müssen immer der Journalismus und die Geschichte stehen. Lawrence of Arabia-Darsteller und Bruce Willis-Imitate sollen schön zu Hause bleiben. An der Front braucht es den besonnenen Kollegen'. Verantwortliche Entscheidungen bei der Rekrutierung von Kriegsreportern sind folglich auch auf Redaktionsseite notwendig, die feststellen sollte, ob die Charakterzüge und Motive eines Journalisten nicht im Widerspruch zum eigentlichen öffentlichen Informationsauftrag stehen. Allerdings werfen manche selbstkommunizierten Motive von Kriegsreportern Fragen in Bezug auf die Eignung des Journalisten für die Besetzung des Auslandpostens auf. Wenig kritisch reflektiert erscheint beispielsweise das Motiv von Kriegsreporter Judah, der offen zugibt, primär den Wunsch nach einem Ausbruch aus der alltäglichen Arbeitsroutine der Heimatredaktion verspürt zu haben und im Rahmen eines 'Spaßfaktors' auch persönlich dabei sein wollte, wenn Geschichte geschrieben wird: 'I became a journalist because I wanted to see history being made, and I certainly didn`t want to while away my working years behind a flickering screen in an office while everyone else had fun.' (Judah 2002, S. 39) Ebenso offenbart der junge Kriegsreporter Reichelt, was für ihn den 'wirklichen' Reiz an seinem Job ausmacht: 'Ich wollte schon immer da sein, wo Menschen Leid ertragen müssen. Warum? Die gute Antwort lautet: Um darüber zu berichten, etwas zu ändern, zu bewegen, einen Unterschied zu machen. Die nicht so gute Antwort ist, dass ich dachte, es wäre irgendwie cool. Cool, an Orten zu sein, an die sonst kein Mensch fahren würde. Man will wissen, wie viel Leid man ertragen kann. Es ist, als würde man die Hand über eine Flamme halten.' (Reichelt 2009, S. 49). Herkel (2000) sieht hinter dieser besonderen und riskanten Berufswahl den Wunsch mancher (junger) Journalisten, sich in der Redaktion etablieren zu wollen, indem ein spannender Kriegsbericht den lang ersehnten Karrieresprung einleiten und so der Redaktion zur erhofften Einschalt- und Leserquote verhelfen würde. Eine gute Quote aufgrund eines sensationellen Fotos oder ein Berichtes kann folglich auch unter Umständen bereits ,über Nacht' zum schnellen, persönlichen Profit des Kriegsreporters führen. Himmelstein und Faithorn (2002, S. 553) konstatieren, dass sich besonders am frühen Anfang des 21. Jahrhunderts viele junge Journalisten für den Job des Kriegsreporters beworben hätten: 'The wars in Afghanistan in 2001 and Israel/Palestine in 2002 produced a waiting list of young general assignment reporters who felt they could advance their careers by covering war'. Klein und Steinsieck kommen in ihrer Studie aus dem Jahr 2006 zu dem Schluss, dass die Motivation der Kriegsberichterstatter am Anfang und Ende des 20. Jahrhunderts Kontinuitäten aufweise. Motive der Kriegsreporter sind demnach 'in wesentlichen Punkten unverändert geblieben: Abenteuerlust, der Wunsch nach Anerkennung und die Hoffnung, Karriere zu machen.' (Klein/Steinsieck 2006, S. 4) Nach Auffassung von Himmelstein und Faithorn basieren die Motive für den Kriegseinsatz allerdings bei berufserfahrenen Reportern auf einem weitgefächerten Set von Beweggründen. Diese reichen von altruistischen bzw. empathischen Motiven für (unter anderem) das menschliche Leid im Kriegsgebiet bis hin zu Neugierde und dem Wunsch nach Lernen bzw. Wissenserweiterung in Zusammenhang mit kulturellen und geschichtlichen Ereignissen: 'Many top reporters share a conviction that their work has purpose, specifically that they can help their audience gain greater insight into the larger social meaning of the events they report. Their concern with the human condition and desire to contribute to its improvement whenever possible inevitably involve an underlying altruistic motive based in empathy for human suffering, ignorance and confusion. Other reporters have a more self-enhancing sense of purpose - for example, an intense curiosity and desire to learn about cultures and history - and consider the benefit their audiences may derive from their reporting to be a positive by-product of their primary motivation.' (Himmelstein/Faithorn 2002, S. 54).
Energy security is among the key issues in political agendas worldwide. Developed and developing economies, in fact, are increasingly concerned to secure constant flows of energy for fuelling their economic and social development. Despite there is no universally accepted definition of energy security, there is widespread consensus on that it relies, inter alia, on appropriate international instruments for promoting and, more important, protecting cross-border energy investments. Energy investments, effectively, are capital-intensive, long-lasting and highly-risky. This is particularly so as far as foreign energy investments are concerned. Investors investing in foreign Countries, in fact, are particularly exposed to non-commercial risks such as nationalizations, expropriations or discriminatory treatments. In order to carry out their investments and, more important, to protect them, therefore, said investors require proper guarantees on that their activities will not be undermined by unjustified or unreasonable measures which may be put into place by the host States. Of paramount importance, to this respect, is the prevision of impartial mechanisms for the settlement of disputes that may arise between foreign investors and host States concerning the activities carried out by the former in the territory of the latter. Indeed, a response to this need is represented by international arbitration, by which possible conflicts are settled by arbitral tribunals external to the host States' judicial systems. In the course of time, international law has provided for numerous instruments by which promoting and protecting foreign energy investments. The Energy Charter Treaty (ECT or "Treaty") is the most relevant instrument to this regard, considering its geographical scope and the matters treated therein. As such, it represents the main attempt to provide for global rules on energy security. The ECT, in fact, encourages the energy cooperation between its around fifty Contracting Parties in a wide range of sectors, such as trade, transit, environmental protection and investment promotion and protection. As regards investment promotion and protection, the ECT provides for a regime which is unique at the international level. It safeguards energy investments by providing, in particular, for fair and equitable treatment, most constant protection and security, no discrimination and most favoured nation treatment standards. A major feature of the ECT investment regime is the prevision of an investor-State dispute settlement (ISDS) mechanism, laid down in Art. 26, by which investors can bring claims before international arbitral tribunals for alleged breaches of ECT investment commitments which undermine the investments made by them in host Countries. Since the first dispute was filed on April 2001, namely AES Summit Generation Limited v. Republic of Hungary (ICSID Case No. ARB/01/4), nearly a hundred and seventeen arbitral proceedings have been incepted so far, eighty of which – amounting to about the 70% of all cases – have been commenced during the last six years. A state of things suggesting how the Treaty's ISDS regime, after a slow start, has become an important tool by which energy investors can protect their investments. Notwithstanding such a remarkable achievement, however, there are many shortcomings that prevent the ECT from becoming the reference legal framework for international energy security. To this respect, it is worth mentioning the non-participation of major economies such as the USA and China and the decision of Russia to not ratify the Treaty after having applied it provisionally until 2009. In addition, it is worth highlighting also the decision of Italy to withdraw – first and unique case – starting from 1 January 2016. The withdrawal took effect during a turning point of the ECT: by that time, the ISDS mechanism had just started to be fully-tested by investors, especially within the EU context; in addition, the Treaty was experiencing a process of relaunching and updating which culminated with the adoption of the International Energy Charter, a political declaration aimed at bringing the ECT in line with current challenges in energy security. While Italy's withdrawal undisputedly undermined the authority of the Treaty, it had the merit of reviving the doctrinal debate on unsettled and not entirely explored issues concerning its application, especially within the EU context. To this respect, the issues posed by the mixed accession of the EU and its Member States to the ECT stand out. For long, the doctrine has pointed out many interpretative concerns about to what extent the Treaty, in particular the investment regime and, more specifically, its ISDS mechanism, applies to relations between EU Member States and between them and the EU. Following the Italian withdrawal, such issues have gained new momentum and are likely to be explored more in depth in the foreseeable future. This thesis examines three broad subjects: the attempt of the ECT to become the reference set of rules on international energy security; the many issues posed by the mixed accession of the EU and its Member States to it; the implications of the Italian withdrawal in terms of investment promotion and protection. Accordingly, this work consists of three chapters. Chapter I provides for an overview of the ECT as the reference set of rules on international energy security. To this respect, it describes the main steps of the Energy Charter process, i.e. the process that, starting with the European Energy Charter of 1991 and arriving to the International Energy Charter of 2015, led to the adoption of the ECT on 1994 and its entering into force on 1998. Moreover, the chapter describes the main fields of energy cooperation dealt with by the ECT, markedly trade, transit and, more important, investment promotion and protection. The purpose of the chapter is to point out the importance of the Treaty for the promotion and protection of energy investments and the complex issues that prevent its vocation to become the reference international framework for global energy security. Chapter II focuses on the complex procedural issues that the mixed accession of the EU and its Member States poses with respect to the ECT ISDS mechanism. After having examined the status of the EU as a REIO party to the ECT, the qualification of the latter as a "mixed agreement" under EU law and the division of competences within the EU on the matters dealt with by it, the chapter focuses on the following issues: questions of international responsibility of the EU and its Member States for the performance and for breaches of ECT investment provisions; the applicability of the ECT investment regime and, more specifically, its ISDS mechanism, to EU internal relations; the relevance and, more specifically, the applicability of EU law in investor-State disputes filed under Art. 26; the relationship between EU law and the ECT. Chapter III deals, in the first place, with Italy's withdrawal from the ECT. More precisely, the chapter investigates the reasons of the withdrawal and its consequences in terms of investment promotion and protection and on the future of the Energy Charter process. In the second place, the chapter examines the disputes filed against the Italian State under Art. 26. To this regard, after having taken into account the wider context of the ECT ISDS regime and the reasons of the sudden raise of disputes against Italy, it focuses on two cases, namely Blusun S.A., Jean-Pierre Lecorcier and Michael Stein v. Italian Republic (ICSID Case No. ARB/14/3) and Eskosol S.p.A. in liquidazione v. Italian Republic (ICSID Case No. ARB/15/50). Both cases are still pending. As to earlier, which is the first case filed against Italy under Art. 26 ECT, an award has been rendered by the tribunal established to settle the dispute. Currently, a proceeding for annulment of the award is underway. Regarding the latter, a decision on an application under Rule 41(5) of the ICSID Rules of Procedures for Arbitration Proceedings has been rendered by the tribunal constituted to settle the controversy. Finally, the work is closed by some conclusive remarks with respect to the matters treated therein. As it will be seen, the issues discussed in this thesis have found – and indeed are increasingly founding – much attention in academic and specialised literature, since they touch very sensitive questions of international, EU and national law. Said issues, however, are far from being comprehensively investigated by the doctrine. As things stand, in the course of the analysis, the state of the art of the doctrinal debate will be taken into account first. Then, the issues at hand will be examined in light of relevant ECT case law. To this respect, some of the awards and decisions rendered by ECT arbitral tribunals – notably those established to settle disputes involving EU Member States and investors therefrom – will be examined with particular attention. By following this methodology, it will be possible to appreciate how said issues emerge or are likely to emerge in investment disputes and are or are likely to be dealt with by ECT arbitral tribunals. In other words, it will be possible to appreciate how said issues affect, in practice, the ECT and process. The aim of the present investigation is to contribute to the debate on the ECT and process, a debate which has just started, and which is likely to get academics and practitioners busy in the future. To this respect, it must be highlighted that ECT practice, now more than ever, is in a state of constant evolution. As a result, additional food for thought is likely to emerge in the future. Indeed, this work is the result of a research started in February 2015 at the Centre for Climate Change, Energy and Environmental Law of the University of Eastern Finland and completed in Rome on August 2018. In the intervening period, subsequent decisions and awards rendered by ECT arbitral tribunals as well as by the Court of Justice of the EU – namely the Achmea Judgement rendered on March 2018 – shed some light on the issues discussed in this work while at the same time raised new questions and interpretative concerns, with the result that a constant work of adaption has been necessary in order to take into account the latest developments on the matter. Accordingly, this work can be seen as a starting point for addressing the many interpretative issues which affect the ECT and which will assume further complexity as far as new awards and decisions are rendered by ECT arbitral tribunals.
Il presente studio si propone di ricostruire il processo evolutivo della cooperazione internazionale allo sviluppo e il ruolo assunto, in tale ambito, dagli aiuti legati allo sviluppo. Gli aiuti legati - come noto - costituiscono i fondi che i Paesi avanzati, inclusa l'Italia, destinano alla cooperazione allo sviluppo, e la cui allocazione avviene attraverso gare di appalto riservate ad imprese nazionali e a prodotti di origine nazionale. Il rapporto tra tali aiuti legati e la cooperazione allo sviluppo, non ancora debitamente esplorato dalla dottrina, merita un particolare interesse, giacché, nell'attuale situazione di crisi economica generalizzata, tanto gli aiuti legati quanto la cooperazione allo sviluppo possono indurre gli Stati a porre in essere condotte che si allontanano dalla ratio legis originaria, posta a fondamento di tali istituti. Un motivo aggiuntivo di interesse potrebbe, inoltre, risultare dalla difficoltà di conciliare tali strumenti di diritto internazionale, apparentemente contraddittori: infatti, il divieto - imposto dall'Unione Europea agli Stati membri - di erogare alcune tipologie di aiuti di Stato può apparire in contrasto con la disciplina normativa di diritto internazionale prodottasi al fine di incentivare alcune di forme di aiuto allo sviluppo. La metodologia adottata nella presente trattazione permetterà, dunque, in primo luogo, di ripercorrere le tappe maggiormente significative nell'evoluzione giuridica della cooperazione internazionale allo sviluppo: partendo dal significato originario di "diritto allo sviluppo", proseguendo dunque con l'analisi dei singoli accordi che hanno cercato di dettare una disciplina in materia , fino ad arrivare alla elaborazione di propositi futuri. Il primo capitolo avrà così ad oggetto l'individuazione, sul piano giuridico internazionale ed europeo, degli aiuti legati e delle finalità che la Comunità Economica Internazionale si prefigge, con particolare riguardo alla promozione dello sviluppo e alla liberalizzazione degli scambi commerciali. Sul piano giuridico internazionale, le Nazioni Unite definiscono l'aiuto allo sviluppo non come "la conseguenza di un obbligo internazionale", ma – piuttosto - come "il risultato di un discrezionale impegno morale o al massimo politico". La Dichiarazione dell'Assemblea Generale sul diritto allo sviluppo, adottata nel 1986, all'art. 4 stabilisce infatti che: "Gli Stati hanno il dovere di adottare, separatamente e congiuntamente, misure per formulare politiche internazionali di sviluppo allo scopo di promuovere la piena realizzazione del diritto allo sviluppo e indispensabile un'azione sostenuta per garantire un più rapido sviluppo dei Paesi emergenti, ad integrazione degli sforzi compiuti dai Paesi emergenti è essenziale garantire un'assistenza internazionale che offra a questi Paesi i mezzi per promuovere uno sviluppo globale". La disposizione chiarisce che la cooperazione internazionale allo sviluppo è uno strumento complementare alle politiche attuate a livello interno dei PVS; inoltre, i Paesi avanzati - che liberamente decidono di attuare una politica di assistenza - sono tenuti ad adottare strumenti efficaci al fine di fornire ai Paesi beneficiari mezzi e strutture per ingenerare, in loco, processi di sviluppo propri, in modo da eliminare qualsiasi dipendenza da aiuti esterni. Sul piano del diritto dell'Unione Europea, poi, è opportuno inquadrare gli aiuti legati alla luce della disciplina UE sugli aiuti di Stato, chiedendosi se, dal punto di vista del diritto dell'UE, gli aiuti legati non possono essere assimilati agli aiuti di Stato vietati ex art. 107 TFUE. L'analisi delle origini della cooperazione allo sviluppo nelle relazioni internazionali non può, tuttavia, prescindere dallo studio della natura e dei fondamenti della cooperazione allo sviluppo. A tal fine, una riflessione è stata dedicata anche al concetto di cooperazione allo sviluppo e ai principali attori internazionali, governativi e non, che operano in tale ambito, così come alle varie istituzioni rilevanti in materia. Queste ultime, in particolare, nate a seguito della seconda guerra mondiale, sono state influenzate, da un lato, dai processi di globalizzazione e di liberalizzazione degli scambi, e, dall'altro, dal passaggio dal GATT al WTO. Nel multiforme e articolato insieme di strumenti internazionali volti a stimolare lo sviluppo emerge la disciplina giuridica degli scambi commerciali prodotta dall'Organizzazione mondiale del commercio (OMC), foro negoziale di un complesso sistema di accordi in materia di scambio di merci e di servizi, ed ente gestore di problematiche correlate al commercio. Il GATT, nella sua versione iniziale, non teneva conto delle differenze di sviluppo tra Stati membri, in quanto doveva essere inserito in un contesto di più ampio respiro, costituito dalla Carta dell'Avana. Questa rappresentava, infatti, un disegno compiuto e completo dei rapporti economici internazionali: a tal fine, istituiva un quadro normativo volto a realizzare un sistema più equilibrato tra gli Stati membri e i soggetti economici coinvolti. Solo successivamente, quando risultò evidente che il GATT sarebbe stato l'unico strumento operativo di cooperazione economica commerciale multilaterale, e in presenza di una situazione mutata anche sul piano delle relazioni internazionali, si elaborarono le norme del trattato speciale e differenziato. Il passaggio dal sistema GATT 47 all'OMC è segnato dagli Accordi di Marrakech del 15 aprile 1994, durante l'Uruguay Round, l'Organizzazione mondiale del commercio (OMC) ha trasformato il precedente Accordo generale sulle tariffe doganali e il commercio (General Agreement on Tariffs and Trade - GATT), del 1947, in un'organizzazione internazionale dotata di personalità giuridica. Successivamente, questo studio, dedicherà una particolare attenzione all'incidenza dell'Accordo di Cotonou nella politica comunitaria di cooperazione allo sviluppo, dove la cooperazione internazionale allo sviluppo è stata oggetto di numerose analisi e interpretazioni di carattere politico, economico e sociologico, che hanno contribuito a individuarne le principali caratteristiche, gli obiettivi e i protagonisti. In questo capitolo si è cercato di individuare il momento più difficile dello sviluppo di questo processo che ha portato all'attuale politica comunitaria di cooperazione allo sviluppo, ben rappresentata dall'evoluzione delle relazioni tra la Comunità Europea ed i Paesi dell'Africa, dei Caraibi, del Pacifico (Paesi ACP), regolate dalla Convenzione di Lomé. La cooperazione tra l'Unione Europea e i Paesi Africani è iniziata con la firma del Trattato di Roma con cui nasceva la Comunità Economica Europea (CEE). Nella sua quarta parte il Trattato prevedeva la creazione di un Fondo europeo per lo sviluppo (Fed) mirante a fornire un aiuto tecnico e finanziario ai Paesi Africani che erano ancora colonie. La Convenzione di Lomé I ha esteso il programma di cooperazione ad alcuni Paesi non africani, nasce l'acronimo Acp (Africa, Carabi, Pacifico). Questa convenzione istituisce il sistema delle quote preferenziali, il regime Stabex, per finanziare le perdite sui prodotti agricoli derivanti dalle fluttuazioni dei mercati, la convenzione di Lomé II istituisce il regime Sysmin per finanziare le perdite sui prodotti minerari derivanti dalle fluttuazioni dei mercati la convenzione di Lomé III questa convenzione modifica l'orientamento degli aiuti, abbandonando la promozione dello sviluppo industriale per lo sviluppo autonomo, fondato sulla autosufficienza e sicurezza alimentare. La Convenzione di Lomé IV è stata la prima Convenzione di durata decennale con una revisione intermedia, per la prima volta il rispetto dei diritti dell'uomo, dei principi democratici e dello stato di diritto diventano elementi essenziali della Convenzione. L'accordo di Cotonou fu preceduto da un ampio dibattito critico sui risultati di venticinque anni di cooperazione (il Libro Verde), firmato da 71 Paesi Acp per la durata di venti anni. Viene introdotto un nuovo approccio alla cooperazione con riguardo: al contesto istituzionale e politico nel Paese partner, alla partecipazione della società civile ed alle strategie di sviluppo mirate alla riduzione della povertà. L'accordo di partenariato tra i membri del gruppo degli Stati dell'Africa, dei Caraibi, del Pacifico, da un lato, e la Comunità europea e i suoi Stati membri dall'altro, firmato a Cotonou il 23 giugno 2000 è pubblicato sulla GUCE n. L 317 del 15 dicembre 2000 (sulla Gazzetta sono state pubblicate le decisioni per l'applicazione provvisoria). In base all'art. 93,3 l'Accordo è entrato in vigore 1° aprile del 2003 dopo il deposito del l'ultimo strumento di ratifica e di approvazione. I principi fondamentali sanciti a Cotonou erano: l'eliminazione della povertà, lo sviluppo sostenibile e la graduale integrazione dei Paesi ACP nell'economia mondiale. L'ultimo capitolo di questo studio si concentra sulla delibera, della III Commissione (Affari esteri e comunitari) nella seduta del 30 settembre 2008, sullo svolgimento dell'indagine conoscitiva degli obiettivi di Sviluppo del Millennio delle Nazioni Unite adottati dall'Assemblea generale delle Nazioni Unite nel 2000, come impegni per la comunità internazionale ai quali improntare l'azione di cooperazione internazionale. Il 18/9/2012 si è svolta la sessantasettesima sessione dell'Assemblea Generale delle Nazioni Unite inizia il 18 settembre 2012 presso la sede delle Nazioni Unite a New York, relativa agli Obiettivi di Sviluppo del Millennio, la quale ha valutato l'esito della Conferenza delle Nazioni Unite sullo Sviluppo Sostenibile, che si è tenuta in Brasile nel giugno 2012. Inoltre l'Assemblea svolgerà le attività di preparazione in vista di due incontri di alto livello programmati nel corso della sessantottesima sessione, che si è svolta il 4 giugno del 2013: un dialogo sullo sviluppo e sulle migrazioni internazionali, e un incontro sul tema "Il cammino che abbiamo davanti: un'agenda per lo sviluppo che sia comprensiva delle disabilità in vista del 2015 e oltre". La Dichiarazione del Millennio, approvata nel 2000 da 186 Capi di Stato e di Governo nel corso della Sessione Speciale dell'Assemblea Generale delle Nazioni Unite, fissa l'obiettivo del dimezzamento della povertà entro il 2015 e l'articola in otto finalità: Obiettivo n. 1 sradicare la povertà estrema e la fame: Obiettivo n. 2 garantire l'educazione primaria universale; Obiettivo n. 3 promuovere la parità dei sessi e l'autonomia delle donne; Obiettivo n. 4 ridurre la mortalità infantile; Obiettivo n. 5 migliorare la salute materna; Obiettivo n. 6 combattere l'HIV/AIDS; Obiettivo n. 7 garantire la sostenibilità ambientale; Obiettivo n. 8 sviluppare un partenariato mondiale per lo sviluppo . La Commissione era determinata nel procedere in una duplice direzione: l'istituzione di un Comitato permanente ad hoc e allo svolgimento di un'indagine conoscitiva sui temi degli Obiettivi di Sviluppo del Millennio ha inteso, in questo modo, esprimere un'attenzione rafforzata sulle questioni attinenti la tematica della cooperazione allo sviluppo.
La presente tesis doctoral consiste en un estudio historiográfico de la erotología árabe e islámica medieval, para el cual hemos tomado como referencia el Kitāb al-īḍāḥ fī asrār al-nikāḥ escrito por el erudito 'Abd al-Raḥman Ibn 'Abd Allah Ibn Naṣr al-Šayzarī, durante el siglo XIII. Para entender la información contenida en este tratado, previamente exploramos la literatura sexual como un espacio histórico desde el nacimiento del islam, a fin de comprender cómo este corpus textual se ha configurado con el paso de los siglos. A partir de aquí, realizamos una traducción completa del Kitāb al-īḍāḥ fī asrār al-nikāḥ siguiendo la edición llevada a cabo por Muḥammad Sa'īd al-Ṭarīḥī. El Kitāb al-īḍāḥ fī asrār al-nikāḥ que traducimos como El Manifiesto sobre los secretos del coito o Elucidación de los secretos del matrimonio viene a sumarse al género de la erótica árabe medieval, conocido este como kutub al-bāh o "libros eróticos". Entendemos por kutub al-bāh un acervo de escritos, caracterizados por su estilo multidisciplinar y misceláneo, en los que se relata sobre el arte del coito, afrodisíacos, ventajas y perjuicios del sexo, cuidado e higiene sexual, descripción del deseo carnal, el goce y el apetito, etc., independientemente de su orientación sexual e implicación transgresiva, producidos a partir del siglo IX, en el espacio geográfico que el islam ocupaba en estos siglos. Es a partir de la época mencionada que la sociedad abasí de Bagdad se convierte en un campo fecundo para los tratados eróticos árabes, una costumbre que se mantendría a lo largo de los siglos. La emergencia de los kutub al-bāh surge en la sociedad árabe e islámica, como consecuencia del cambio de costumbres de los árabes debido esencialmente al contacto con otras culturas y a la transformación histórico-política que coloca en primer plano a la corte y al estado, lo que da lugar al establecimiento de una cultura árabe más refinada y lujuriosa. En el caso de la obra que nos ocupa, esta es una compilación principalmente de afrodisíacos, afeites, preparados alimenticios, vendajes, ungüentos, etc., que estimulan la potencia y el apetito sexual, engrosan el pene, mejoran la higiene sexual y embellecen el cuerpo de las mujeres. Se trata igualmente de una gran compilación sobre las características de la belleza femenina, lo cual ha valido a su autor cierta popularidad y reconocimiento. La estructura de la tesis consta de cinco capítulos en los que se vislumbran los objetivos principales de los que partimos: por un lado, en los dos primeros capítulos ofrecemos un estudio dedicado a los aspectos históricos, religiosos, sociales, lingüísticos y literarios que han influido al desarrollo de los kutub al-bāh. De esta manera, pretendemos proporcionar un análisis exhaustivo de un género singular en el conjunto de la literatura árabe medieval que hasta el momento no había recibido una investigación en profundidad. Por otro lado, en los tres capítulos restantes ofrecemos a la comunidad investigadora el primer estudio sobre su biografía y la obra erótica de 'Abd al-Raḥman Ibn 'Abd Allah Ibn Naṣr al-Šayzarī, y completamos esta tesis aportando la traducción al castellano de su tratado erótico Kitāb al-īḍāḥ fī asrār al-nikāḥ. Las razones por las que hemos elegido esta temática y en especial la obra de al-Šayzarī son la distinción del erotismo como género propio de la literatura árabe medieval, la evolución de este género y como no, la necesidad de aportar una nueva traducción al castellano de una obra erótica. Conclusiones No cabe duda de que el Kitāb al-īḍāḥ posee un valor innegable como fuente de documentación, pues su carácter multidisciplinar, educativo y misceláneo se expande a lo largo de obra. Es incuestionable además la evidente vinculación que esta tiene con el género del erotismo. Su estructura, contenido, finalidad, temática y léxico empleados en ella siguen los patrones propios de los tratados eróticos árabes. De esta manera, si bien su contenido formal la adscribe al repertorio de los kutub al-bāh, podemos concluir que el fondo del Kitāb al-īḍāḥ es un ejemplo más para el subgénero de los afrodisíacos y la fisiognomía femenina. De igual manera, el autor, con el recurso a los alimentos potenciadores del apetito sexual y a las numerosas recetas afrodisíacas, no solo pretende causar exaltación en el lector masculino, sino que, como bien se ha explicado a lo largo de esta investigación, es también una meta lícita por parte de los musulmanes. De ahí que planteemos el por qué de su composición y cómo esta se relaciona con el contexto en el que fue redactada. Por esta razón, concluimos que existe una estrecha conexión entre el espacio temporal en el que se redactó la obra y el factor sociopolítico islámico de expansión y absorción de las culturas iranias y turcas, que son la clave principal y de motivación que impulsaron a nuestro autor a redactar esta obra. De manera que al-Šayzarī a través de su obra se coloca al mismo nivel que sus contemporáneos al-Ṭūsī y al-Tīfāšī. En cuanto a la enigmática figura de al-Šayzarī, desde un principio, hemos contado con escasos datos extraídos de enciclopedias en las que se presenta una información harta dispersa. Es más, ni siquiera los mismos enciclopedistas árabes se han puesto de acuerdo a la hora de establecer un dato fijo y preciso: fecha de muerte, ocupación y otros datos. Al-Šayzarī aparece situado en dos siglos distintos: s. XII y s. XIV. Sin embargo, esto no ha sido un óbice para la investigación que nos ocupa. Como resultado, después de todo este largo recorrido y de poner en cuestión un largo trasiego de hipótesis e ideas, hemos llegado a la conclusión de que todas las investigaciones anteriores a la nuestra resultan cuanto menos inconclusas. Al-Šayzarī no fallece en la misma fecha que Ṣalāḥ al-Dīn (m. 1193), al igual que rechazamos la posibilidad de que este pudiera morir a finales del siglo XIV. Llegados a este punto y sin poder afirmar tajantemente cuál fue su fecha de deceso, concluimos que nuestro autor vivió a lo largo del siglo XIII, habiendo podido morir a inicios del siglo XIV. De igual modo, cabe la posibilidad de que el autor del Kitāb al-īḍāḥ no coincida con el resto de obras que se le han atribuido, lo cual queda abierto para futuras investigaciones. Respecto del género erótico árabe, en general, podemos decir que el factor de la medicina es el eje vertebrador en los tratados eróticos árabes, deudor asimismo de la erudición griega hipocrática, aristotélica y galénica. Por lo cual, la literatura erótica, con todo el repertorio de recetas afrodisíacas que en ella aporta para promover la actividad sexual y mejorar su higiene, bebe directamente de la literatura médica precedente. Como resultado, nos ha llegado hasta hoy un amplio corpus literario, en el que son protagonistas reyes, califas, médicos, ulemas e incluso, el mismo Profeta. El islam pues se muestra receptivo a establecer unas normas y conductas sexuales, tanto en el ámbito del matrimonio como en el concubinato. En suma, se cosifica una literatura sexual, gestionada bajo el beneficio masculino en la que la imagen de las mujeres es el único objeto sexual. Sin embargo y pese a que la sociedad islámica actual ofrece una imagen silenciada y tabuizada de los asuntos sexuales desde cualquier punto en el que se estudie, una de las constantes a lo largo de la historia árabe e islámica ha sido la actitud positiva y receptiva hacia la sexualidad, al contrario de lo que parece ocurrir en otras culturas en las que ha predominado, por ejemplo, la imposición del cristianismo. En la cultura islámica se reconoce la importancia del amor, la pasión, el placer y el deseo y es por ello que la erudición en materia erótica resulte tan elevada como la de otros géneros. Con todo esto, estudiar la sexualidad en el islam y el esparcimiento en la literatura es explorar el islam oculto. El discurso erótico en el ámbito islámico académico está totalmente silenciado a causa del rigorismo al que ha sido sometido en el último siglo. The paper addresses the history of excavations of the largest Roman tomb, the Mausoleum of the Emperor Caesar Augustus. The author focuses on the results of recent archaeological activities and how they have transformed the perception of the monument. The tomb of the fi rst Roman Emperor in the post-classical era underwent various transformations and was repeatedly plundered. As a result, the tomb has preserved in a severely damaged condition. The monument had been used for utilitarian purposes until the 1930s. The mausoleum was used as a quarry, a fortress which has been repeatedly destroyed, a vineyard, a garden, an amphitheater for bullfi ghting, a theater, and a concert hall. The fi rst archaeological excavation in the territory of the monument was carried out in the 16th century. It is them which marked the beginning of the monument's study history. The material obtained during these fi eld works is still of great importance for scholars who engage in the study of the monument. For a long time after the Renaissance era the Mausoleum was studied only periodically due to construction works carried out in its territory. The archaeological study of the monument has intensifi ed since the beginning of the 20th century. Ambitious works were carried out in the 1920s and 1930s. Their implementation was not dictated by scholarly interest: Benito Mussolini sought to use the heritage of Ancient Rome for his propaganda. Nevertheless, as a result of the completed excavations, the mausoleum was not only freed from the post-antique layers, but the obtained results laid the foundation for the modern idea of the monument. New interest in the monument arose only after seventy years. The immediate reason to that was the government's plan for the reconstruction of the mausoleum and the surrounding area. Excavations were carried out by the Department of Cultural Heritage of the Capital of Rome. The obtained archaeological data have greatly changed the modern perception of the monument and make it possible to put an end to the discussion of the issue. ; В статье рассматривается история раскопок крупнейшей римской гробницы, а именно мавзолея императора Цезаря Августа. Основное внимание уделяется результатам недавних археологических работ и тому, как они повлияли на представление о памятнике. Гробница первого римского императора в пост-античную эпоху претерпела различные трансформации и неоднократные грабежи, в результате которых сильно пострадала. Памятнику находили практическое применение вплоть до 1930-х гг. За многовековую историю мавзолей использовали как каменоломню, крепость, которую не раз разрушали, виноградник, сад, амфитеатр для корриды, театр и концертный зал. Первые археологические работы на территории памятника проводились уже в XVI в. Именно с них начинается история исследования монумента и результаты, полученные тогда, до сих пор имеют большое значение для науки. На протяжении длительного времени после эпохи Ренессанса объект изучался только периодически, в связи с какими-либо строительными работами, проводившимися на его территории. Работы на памятнике активизируются с начала XX в. Масштабные раскопки состоялись в 1920-30-е гг. Их проведение диктовалось не научными целями: Бенито Муссолини стремился использовать римское наследие в своей пропаганде. Тем не менее, в результате проведенных работ мавзолей был не только освобожден от пост-античных наслоений, но полученные тогда результаты заложили современное представление о памятнике. Интерес к мавзолею возобновляется только через семьдесят лет. Непосредственным толчком было решение реконструировать мавзолей и площадь вокруг него. В результате раскопок, проведенных департаментом культурного наследия столицы Рима, были получены археологические данные, изменяющие взгляд на внешний облик монумента и позволяющие поставить точку в дискуссии по данному вопросу. Aus der Einleitung: Obwohl der Kommunikationssektor boomt, heißt das noch lange nicht, dass ein einheitliches Verständnis darüber besteht, was in diesem Betätigungsfeld überhaupt geleistet wird. Der gesamte Kommunikationsbereich – das gilt vor allem auch für die PR – leidet unter diffusen Berufsbildern und schwammigen Vorstellungen über Tätigkeitsbereiche und Aufgaben. In Zeiten, in denen es selbst bestens ausgebildeten Arbeitskräften immer schwerer fällt, zu erkennen, wen Stellenanzeigen ansprechen sollen und ob ihr eigenes vorhandenes Potential dem Gewünschten entspricht, wird es zunehmend dringlicher, Tätigkeitsbereiche zu beschreiben. Die Kommunikationsbranche macht da keine Ausnahme. Sofern einmal nicht Wirtschaft oder Politik im Mittelpunkt stehen, sondern Sport, geht es zumeist um Journalismusforschung. Dabei benötigt auch der Sportsektor den Dialog mit seinen Teilöffentlichkeiten, um selbstbestimmt über Vorgänge innerhalb der Organisation zu informieren. Der gesamte Sektor erfreut sich großer Beliebtheit, nicht zuletzt aufgrund der Athleten, die mittendrin stehen und zu Helden stilisiert werden. Wie aber ist es um die Leute im Hintergrund bestellt, die als Schaltstelle zur Öffentlichkeit fungieren? Welche Tätigkeiten verrichten sie und mit welchen Qualifikationen? Der Sportjournalist informiert in seinem Artikel in einer Zeitung oder einer Zeitschrift bzw. in seinem Beitrag im Fernsehen oder Radio über aktuelles Sportgeschehen. Dazu zählt in dessen beruflichen Alltag aber nicht nur die reine Ergebniswiedergabe. Wesentlich häufiger als um den Ausgang von Wettbewerben, geht es um die Vor- und Nachberichterstattung. Als Ansprechpartner dafür dienen bevorzugt die Betroffenen selbst, in diesem Fall die Sportler. Die Realität sieht aber eine Funktion dazwischen geschaltet: den Pressesprecher. An ihn wendet sich der Journalist, wenn der Athlet nicht zu erreichen ist, sich eine Geschichte aufgetan hat, der er nachgehen will oder einfach, wenn der Redakteur in der so genannten 'Sauren-Gurken-Zeit' Seiten oder Sendezeit füllen muss. Die Verfasserin der vorliegenden Arbeit war selbst jahrelang in der Situation, die Verantwortlichen für die Öffentlichkeitsarbeit als Radio- und Fernsehjournalistin zu kontaktieren. An einem gewissen Punkt stellte sich dann die unbedarfte Frage: Sitzen die Ansprechpartner der einzelnen Sportorganisationen den ganzen Tag über am Telefon, um sieben Tage die Woche, 24 Stunden lang, für die Medien erreichbar zu sein oder umfasst der Beruf noch andere Tätigkeiten und wenn ja, welche? Nicht zuletzt erfüllt das zum Teil die seit Jahren existierende Forderung der Wissenschaft, zu untersuchen, 'wie sich Berufsrollen, Tätigkeitsbereiche, Macht- und Einflußgrößen, Status, Prestige und Gehälter der Public Relations bei uns entwickeln'. Forschungsstand: Der Beruf des PR-Experten oder Pressesprechers im Allgemeinen bzw. dessen Tätigkeit und die damit verbundenen Qualifikationen ist bereits mehrmals Mittelpunkt des Forschungsinteresses von Wissenschaftlern im deutschen Sprachraum gewesen. Bereits 1985 wurden die Anzahl, das Geschlecht, das Wirken, das Einkommen sowie die notwendige und vorhandene Vorbildung der im Berufsfeld Public Relations Tätigen erstmals in einer Untersuchung in Zahlen ausgedrückt. Deren Verfasserin Meta Hass gilt daher als Pionierin in Österreich. Bis heute eignet sich ihre Forschungsarbeit als klassisches Basiswerk für Vergleiche innerhalb der Public Relations, etwa bei der Untersuchung der Berufsrollen oder bei der Erhebung von Veränderungen durch das Gegenüberstellen aktuellerer Daten. Waren Mitte der 1980er Jahre noch 81 Prozent der PR-Fachleute Männer mit vorwiegend journalistischer Vorbildung, so hat sich das Blatt innerhalb von nur eineinhalb Jahrzehnten regelrecht gewendet. 15 Jahre später ist das Berufsfeld zu 70 bis 80 Prozent weiblich und rund neun von zehn Agierenden verfügen über eine höhere Ausbildung bis hin zum Studienabschluss. Die Angst, dass ein mehrheitlich von Frauen ausgeübter PR-Beruf an Status verliert, herrscht in Österreich, im Gegensatz zu Deutschland, nicht.Wobei nicht auszuschließen ist, dass eine derartige Diskriminierung hierzulande schlichtweg von den Betroffenen nicht wahrgenommen wird. Wieder andere Ergebnisse liefert in diesem Zusammenhang die Schweiz. Die Öffentlichkeitsarbeit unserer westlichen Nachbarn wird vor allem von Laien beherrscht. Eine Aus- oder Weiterbildung im Public Relations-Bereich haben nur wenige PR-Leute. Die Anzahl der Frauen und Männer hält sich in diesem Berufsfeld die Waage. In höheren Positionen sind Frauen, gemessen an ihrem Gesamtanteil in der Branche untervertreten und verdienen im Durchschnitt weniger als Männer. Intensiver mit dem Betätigungsfeld der Pressesprecher hat sich bisher einzig Günter Bentele in Deutschland beschäftigt. Vereinfacht hat ihm die Sache, dass deutsche Pressesprecher in einem Berufsverband zusammengeschlossen sind. Bentele hat diesen Berufsstand als Ganzes mittlerweile zweimal vermessen und herausgefunden, dass in diesem Bereich der PR mehr Männer als Frauen tätig sind. Zu Österreich gibt es bislang keine vergleichbaren Ergebnisse. Eine Vielzahl weiterer Autoren widmete sich dem Tätigkeitsbereich eines PR-Profis. Bei allen aber fehlt der Blick auf den Sport. Das Berufsbild eines Pressesprechers in einer Sportorganisation wird man vergeblich suchen. Lediglich die Beschreibung eines Tätigkeitsbereiches stand schon im Focus wissenschaftlicher Arbeiten. In einem Vergleich zwischen der Pressearbeit der Fußball- und Schiverbände von Österreich und der Schweiz durch Gottfried Stienen richtete sich das Augenmerk auf die Bedeutung der Tätigkeit für den davon profitierenden Journalisten und auf Verbesserungsmöglichkeiten. Weitere Aufgabengebiete der Ansprechpartner der Organisationen blieben ausgespart. Auf Grundlage dieser Untersuchung verfasste Michaela Wörndl wenige Jahre später eine Arbeit und beklagte eine '(…) spärliche, Literatur über Öffentlichkeitsarbeit im Sport bzw. in Sportorganisationen' und 'daß die Sportvereins- und -verbändeforschung in Österreich einen sehr geringen Entwicklungsstand aufweist.' Eine Klage, die nahezu ungehört blieb – mit Ausnahme von Jasmine Hötzl, die anhand des Fallbeispieles eines Fitness-Centers das Aufgabengebiet eines PR-Fachmannes im Sport skizzierte – denn auch Bernhard Beyer bekannte, 'dass es zwar jede Menge Literatur zum Thema Öffentlichkeitsarbeit (…) beziehungsweise zum Thema Sport (…) gibt. Texte, die sich sowohl mit PR als auch mit Sport (…) beschäftigen, habe ich jedoch nur sehr vereinzelt gefunden.' (Beyer 2000: 6) Er widmet sich der Bedeutung der PR für den Sport, nachdem dieser im 20. Jahrhundert enorm expandiert und sich als Wirtschaftfaktor etabliert hat. Gleichzeitig bemängelt Beyer das Fehlen einer Lobby, wie in Wirtschaft und Politik üblich. Kritik an Aufgaben und Zielen der PR einer Sportorganisation und im Detail deren für die öffentliche Ansprache einzusetzenden Mittel finden sich bei Birgit Schielin. Fragestellung: Um dem Berufsbild des Pressesprechers einer Sportorganisation auf die Spur zu kommen, sollen nachfolgende Fragestellungen beantwortet werden, deren theoretischer Fundierung sich die nachfolgenden Kapitel widmen: -Wie notwendig ist Öffentlichkeitsarbeit im Sport, etwa im Vergleich zu Wirtschaft und Politik? -Was macht den Öffentlichkeitsarbeiter einer Sportorganisation aus? -Wie nah kommt der Pressesprecher im OSV dem idealen PR-Praktiker? -Auf welche Weise/mit welchen Mitteln werden die Teilöffentlichkeiten angesprochen? -Welche Anforderungen und Erwartungen gilt es im Österreichischen Schwimmverband zu erfüllen? Welche Rolle spielt dabei das Geschlecht des Pressesprechers? -Pressearbeit gilt als die klassische Technikerarbeit. Welchen Tätigkeiten aber wird im OSV hauptsächlich nachgegangen? -Welche Berufsrolle überwiegt dadurch? Die rein journalistischen Fähigkeiten reichten plötzlich nicht mehr aus und leiteten in den 1970er Jahren in den USA den Beginn der Rollenforschung ein. Je nach Art der ausgeübten Tätigkeit lassen sich nun die Berufsrollen 'PR-Techniker' und 'PR-Manager' unterscheiden. Während ein Techniker wie beiläufig als 'Spezialist für das Verfassen und Produzieren von PR- und Pressematerialien' bezeichnet wird, greift der Manager auch zu wissenschaftlichen Methoden, 'analysiert, plant, berät [und] kontrolliert (…)'. PR-Techniker: Der Ausdruck 'PR-Techniker' bezeichnet den klassischen PR-Praktiker. Nach der von Grunig getroffenen Unterscheidung der vier Modelle der Public Relations zählt er zum handwerklich-technischen Bereich der Öffentlichkeitsarbeit, der die ersten beiden Modelle der Publicity und der Information umfasst. Klaudia Gründl hat sechs Tätigkeiten der PR-Techniker nach der Häufigkeit ihres Praxiseinsatzes erhoben: - Schreiben und redigieren von Texten. - Herstellung und Pflege der Medienkontakte. - Durchführung von PR-Aktionen. - Verbreitung von Meldungen. - Produktion von Druckschriften. - Herstellen von Fotos und Grafiken. Bereits aus dieser Liste geht deutlich hervor, dass Presse- und Medienarbeit in Österreich den höchsten Stellenwert in der täglichen PR-Arbeit genießt. Daran soll sich in der vergangenen Dekade nichts geändert haben. Nach der jüngsten Untersuchung der Pressesprecher in Deutschland beansprucht der Kontakt zu den Medien den größten Teil der Arbeitszeit, gefolgt von Internet-Auftritt und PR-Aktionen. Seit den ersten Untersuchungen Ende der 1970er Jahre in den USA ist das Rollenbild des Technikers in der Öffentlichkeitsarbeit vorherrschend. Sowohl in den Vereinigten Staaten als auch in Deutschland wurden geschlechtsspezifische Unterschiede deutlich. Demnach ist es das von Frauen am stärksten besetzte Betätigungsfeld der Public Relations. Gleichzeitig verdienen sie auch bei gleicher Berufsausbildung und Qualifikation wie Männer, weniger als diese. In den USA wurde errechnet, dass die Einkommensdifferenz und damit der Verlust der Frauen im Laufe von rund vierzig Arbeitsjahren zwischen 300.000 und 1,5 Million Dollar beträgt. Dafür wurde der Begriff von 'The million dollar penalty' geprägt. In Österreich allerdings schwammen die Frauen schon früh gegen den Strom. Bereits in den ausgehenden 1990er Jahren zeigte sich in einer Untersuchung ein ausgewogener Anteil von Männern und Frauen unter den PR-Technikern. Gleichsam konnten auch beim Durchschnittsverdienst keine Hinweise auf eine grundsätzliche Schlechterstellung oder Diskriminierung von Frauen gefunden werden. PR-Manager: 'Als Public Relations (PR) (…) bezeichnet man das Management der Kommunikationsprozesse von Organisationen mit ihren Bezugsgruppen.' Die in dieser Definition der 'Schweizer Public Relations Gesellschaft' (SPRG) angeführte Management-Funktion findet sich auch schon in früheren Begriffserklärungen. So erfasste etwa Harlow eine 'distinctive management function' und auch Grunig/Hunt bezeichnen PR als 'management of communication'. Innerhalb der vier PR-Modelle ist der PR-Manager Vertreter der professionellen Public Relations, als die Grunig seine beiden Modelle der asymmetrischen und der symmetrischen Kommunikation bezeichnete. Das bedeutet, ihr Kommunikationsverhalten ist ein dialogisches. Auch gilt ihre PR-Eignung als höher als jene von Technikern. (Vgl. Dorer 1994: 17) 'PR-Manager sind (…) verantwortlich für die Formulierung, Abstimmung und Umsetzung der Kommunikationsstrategie. Ihr Tätigkeitsprofil ist (…) durch planende, steuernde und kontrollierende Tätigkeiten gekennzeichnet'. Nach Gründl lassen sich folgende sechs praktische Tätigkeiten gereiht nach ihrer Häufigkeit dem PR-Manager zuschreiben: - Planung und Empfehlung von PR-Maßnahmen. - Organisation von PR-Aktionen. - Entwicklung von PR-Konzepten. - kommunikationspolitische Entscheidungen treffen. - Analyse von Kommunikationsproblemen. - Erfolgskontrolle. PR-Manager sind männlich und älter als PR-Techniker. Das zeigt sich in Studien aus den USA, Deutschland und der Schweiz zu diesem Thema. In Österreich allerdings hält sich die Geschlechterverteilung diesbezüglich die Waage. Ein Männerüberhang in der Managerrolle ist nicht zu konstatieren. Rund ein Drittel aller PR-Praktiker war zur Mitte der 1990er Jahre in diesem Bereich tätig, darunter mehrheitlich Männer. Die Annahme der Wissenschaftler ist, dass die Karriereleiter bei Männern besser funktioniert als bei Frauen. Als Hintergrund dient der allgemeine Konsens darüber, dass Frauen von ihrer Anlage her die bessere kommunikative Eignung für den Techniker-Beruf mitbringen. Für Ulrike Röttger bedingt das aber auch das Erreichen der gläsernen Decke. Ein Aufstieg innerhalb des Unternehmens in eine Funktion, die strategische Fähigkeiten verlangt, scheint nicht möglich zu sein. Romy Fröhlich wiederum spricht in diesem Zusammenhang von einem Stereotyp, das sie als 'Karrierekiller' und 'Freundlichkeitsfalle' bezeichnet. Langfristig soll die Öffentlichkeitsarbeit eines Managers erfolgreicher sein als jene des Technikers. In der Praxis ist eine Verschmelzung beider Rollen feststellbar, jedoch keine Taylorisierung. Mehrheitlich lehnen die PR-Experten in Österreich zudem eine eindeutige Trennung der Berufsrollen ab. Sie bevorzugen die Bezeichnung 'Kommunikationsarchitekten'. Zusätzlich hat die Wissenschaft neben diesen beiden klassischen Rollenbildern noch ein weiteres ausgemacht: das Berater-Profil. Dieses ist gekennzeichnet durch Tätigkeiten, wie dem Kommunizieren mit Kunden, dem Bearbeiten von Korrespondenz sowie dem Pflegen von Medienkontakten und ist primär in Agenturen anzutreffen.
