This book analyzes the investment chapter of a new type of trade agreement between Canada and the European Union to help readers gain a better understanding of this mega-regional deal, which includes foreign investment protection. It first provides background information on the Comprehensive Economic and Trade Agreement (CETA), particularly focusing on the chapter on foreign investment, including the rules on the entry of investments, their protection and the stringent dispute settlement mechanism. It goes on to explore whether these provisions are a further step toward reforming the current international investment law regime. It also examines the highly innovative part of the agreement: the inclusion of crosscutting issues, such as sustainable development. In addition, it examines the CETA investment chapter from the perspective of non-contracting parties, including Africa, Asia and Latin America. The book is of interest to academics and students in the field of international investment law. It is also an essential resource for government legal advisers, policymakers, business practitioners, and others dealing with international investment law.

Die diskursanalytische Arbeit untersucht die handelspolitischen Interessen der Provinz Quebec während der CETA-Verhandlung zwischen Kanada und der EU (2006-2014). Die Verhandlung der Vertragskapitel "Öffentliche Vergabe", "Ausländische Direktinvestition" und "Landwirtschaft" aus der Perspektive Quebecs macht deutlich, dass die Regierung aus bestehenden Ideenrepertoires schöpfte, um Quebecs Interessen in einem komplexen transatlantischen Gefüge zu entwickeln und geschickt voranzutreiben. Den Bezugsrahmen, um aktuelle und historische Vorgänge zu interpretieren und Allianzen zur Durchsetzung der eigenen Position zu schmieden, stellten dabei insbesondere der kanadische Föderalismus sowie wirtschaftspolitische und kulturelle Entwicklungsdiskurse dar. Die Untersuchung basiert auf der systematischen quantitativen Analyse von Quebecer Parlamentsdebatten sowie der qualitativen Auswertung strukturierter Interviews mit Regierungsmitgliedern, Verwaltungsbeamten, Wirtschaftsverbänden und NGOs.

Abstract
Has the high-profile public opposition to recent EU trade agreements supplanted the traditional socio-economic pattern of competition in European trade policy with a value-driven one? This article draws on new data analysing the outcome of the ratification process of a mixed free trade agreement (CETA) in the European Parliament and in all national parliaments that have so far completed ratification. With help of a logistic regression model analysing the vote-outcome, this article demonstrates that despite high social salience, economic considerations remain prominent. Values (TAN-GAL cleavage) were relevant but played a different role than expected. Against the expectation, green parties associated with the GAL-spectrum voted against CETA demonstrating that party preferences on specific values do not necessarily coincide or generate the same policy preference.

Il presente lavoro analizza da una prospettiva giuslavoristica il Comprehensive Economic and Trade Agreement (CETA), trattato internazionale di libero scambio, da poco sottoscritto da Unione Europea e Canada: il saggio si interroga se tale trattato possa contribuire o meno allo sviluppo del fair trade all'interno delle democrazie occidentali. Nel dettaglio l'articolo analizza le clausole del CETA alla luce dei core labour standards dell'ILO, con un focus sulle clausole arbitrali di risoluzione delle controversie (Investor-State Dispute Settlement), sulle forme di partecipazione della società civile e sui meccanismi di eccezione. Nelle conclusioni, nonostante la tendenziale omogeneità socio-economica tra Canada e Unione Europea, viene sostenuto come il CETA non sia in grado di assicurare automaticamente il rispetto dei diritti sociali nel contesto del commercio internazionale, con il rischio di una corsa al ribasso delle tutele. ; The present work analyses the Comprehensive Economic and Trade Agreement (hereinafter CETA), recently signed among the European Union and the Canadian government, and currently in the process of ratification within the European Member States: the fil rouge is represented by the possible impact of such a "mega treaty" on labour rights at a transnational level, and in particular if it could contribute or less – under a labour law point of view – to develop fair trade among multinational corporations belonging to certain targeted Western democracies. Therefore this paper provides with a brief overview of the most significant labour provisions contained in the CETA in the light of ILO legal framework: a particular attention is given to the complaint and dispute settlement mechanisms, essentially the InvestorState Dispute Settlement Clause (ISDS); the mechanisms without binding effects, such as civil society dialogue and inter-state initiatives; and the exception clauses. In the final section it is argued that despite a certain social and economic homogeneity among the EU Member States and Canada, the CETA is not able to automatically ensure that labour rights will be maintained without bottom-down changes.

This article investigates how Canada's trade with the EU-27 and the UK might be affected by Brexit. As the transition period foreseen in the 2019 UK Withdrawal Agreement has ended, the EU and the UK are no longer one customs area. The EU–Canada Comprehensive Economic and Trade Agreement (CETA), like other EU agreements, has ceased to apply to the UK. Henceforth, the policies and legislation of the UK and the EU-27 will invariably diverge. Taking into account both the EU–UK Trade and Cooperation Agreement as well as the Canada UK Trade Continuity Agreement concluded in late-2020, the article shows that the agreements reached, while providing immediate stopgaps for some of the fallout of Brexit, also represent potential for a new departure.

ABSTRACTCETA has a great influence in the economic progress of European countries, especially in the free trade flow between countries in the world. The removal of large-scale barriers between the EU and Canada has become an important point in this agreement. On the other hand, the CETA is considered a challenge in the politics of European countries because in reality not all European societies give full support to CETA because it is perceived to only provide the economic decline of European countries and is considered to be only going into the same hole, given the Union Europe, which has also had economic cooperation with other countries and not produce results. L'Accord conclu contient 30 chapitres, dont les plus importants concernent la mise en place d'une zone de libre-échange entre les parties, la libéralisation du commerce des services, les investissements, les marchés publics et la protection de la propriété intellectuelle. This thesis examines the Comprehensive Economic and Trade Agreement (CETA) between Canada and the European Union (EU) through the lens of intellectual property law. The thesis considers the discussions that lead to the deal and provides an overview of the impact of this important international economic agreement between two major actors in the industrialised world. The impact of this agreement on the domain of intellectual property law is demonstrated in a discussion of its effect on the everyday consumer goods. In addition, this thesis explores CETA's impact on the procedures to be followed in the case of infringements of intellectual property rights. The thesis concludes with an examination of the nature of the cooperation between the two Parties and CETA's potential impact on their economy. ; February 2021
