Verbal means, as well as nonverbal means, including rules of concept scope division, are used in ascertaining the true sense of law.Division of concept scope should be done according to the rules, which are clearly defined in formal logic. Therefore, having the concept divided by the legislator in conformity with these rules, some conclusions concerning divided concept and elements of division can be made, that means receiving new knowledge about sense of legislative rule and concepts, used in it.But before applying such divisions in order to get new true knowledge, one should make sure that, firstly, whether the analyzed operation with concept scope is really its division, and, secondly, whether the legislator has followed the formal logic rules of such division while dividing the concept.It is worth mentioning that the legislator, providing the division of the concept scope, quite often does not follow the rules of such division.Only when the abovementioned two conditions are ascertained, the «additional» true knowledge about content and scope of generic and specific concepts can be obtained according to the rules of division. This knowledge includes:1) knowledge that the scope of all the elements of division is equal to (exhausts) the scope of the divided concept and makes possible the exact ascertaining of divided generic concept scope, which as well prevents a possibility of the Criminal Code of Ukraine applying by analogy, of different interpretation, discretion of a judge. Ascertaining the concept scope helps us in ascertaining its content and, of course, ascertaining the generic concept content means that generic characteristics of specific concepts become known;2) since the right division is provided according to one basis (characteristic) only, this very characteristic is considered to be the changeable and different specific characteristic of all division elements (specific concepts). All other characteristics of specific concepts should be the same;3) knowing that the division elements (specific concepts) exclude one another, one can come to the conclusion that the same one thing or one phenomenon for sure can't be simultaneously the element of different specific concepts scope, for example one action (crime) can't simultaneously belong to several kinds of concepts, each thing or each phenomenon, which belong to different specific concepts scope, can't get the same criminal law estimation and cause the same criminal law consequences etc;4) when the division is continuous, this indicates that obtained specific concepts belong to the same rank, have equal amount of common generic, as well as of distinctive specific characteristics. But such concepts can have different scopes.When it is clearly ascertained that the rules of concepts division have not been followed by legislator, or something, that is not the division, is concerned as division, in such cases the abovementioned new knowledge can be false. ; Встановленню істинного смислу закону служать як вербальні засоби, так і невербальні, в тому числі правила поділу обсягу понять на види. Маючи поділене законодавцем із дотриманням вказаних правил поняття, можна робити певні висновки як щодо діленого поняття, так і щодо членів поділу, тобто отримати нові знання про зміст законодавчого припису та понять, у ньому використовуваних. Так, 1) знання того, що обсяг усіх членів поділу дорівнює (вичерпує) обсягу діленого поняття, дає змогу точно встановити обсяг діленого родового поняття, а це своєю чергою запобігає можливості застосування КК України за аналогією, різнотлумаченням, суддівському угляду; 2) оскільки правильний поділ відбувається лише за однією основою (ознакою (-ами)), то ця ознака (-и) саме і буде (-уть) тією змінною і відмінною видовою ознакою у всіх членів поділу (видових поняттях). Усі інші ознаки видових понять повинні бути однаковими; 3) знання того, що члени поділу (видові поняття) виключають одне одного, дає підстави зробити висновки, що точно один і той же предмет чи явище не може входити одночасно до обсягу різних видових понять, кожен із предметів чи явищ, що належать до обсягу різних видових понять, не може одержувати однакову кримінально-правову оцінку і тягти за собою однакові кримінально-правові наслідки і т. д.; 4) якщо зроблено безперервний поділ, то це вказує на те, що виділені видові поняття є однопорядкові, мають рівну кількість як спільних родових, так і відмінних видових ознак.Якщо ж чітко встановлено, що правила поділу поняття законодавцем не дотримані або прийнято за поділ те, що таким не є, то описані нові знання можуть бути хибними.
The exercise of intellectual property rights is the realization bythe subject of intellectual property rights of moral and / or economic intellectual propertyrights, the content of which in relation to certain objects of intellectual propertyrights is determined by the Civil Code of Ukraine and other laws. The exercise of intellectualproperty rights is also the realization of economic intellectual propertyrights by other persons on the basis of the permission of the person who has the rightto allow the use of such object of intellectual property rights.The Law «On Amendments to Certain Legislative Acts of Ukraine ConcerningStrengthening the Protection and Protection of Rights to Trademarks and IndustrialDesigns and Counteraction to Patent Trolling» (which entered into force on August16, 2020) has аmended the Law of Ukraine «On Protection of Rights to Marks forGoods and Services» (hereinafter — the Law). The amendments have removed theprovision that a well-known trademark receives the same legal protection as thetrademark for which the certificate is issued. Such changes have created a gap in thelegislation in part of defining what does the exercising of intellectual property rightsto well-known trademarks include.In this connection the following questions arise: (1) can the right to use a wellknownmark (as well as the mark for which the certificate is issued) be the subject ofa license agreement, a commercial concession agreement; (2) whether it is possible tocontribute economic intellectual property rights to a well-known trademark to the authorizedcapital of a legal entity; (3) whether it is possible to transfer such rights onthe basis of an agreement on the transfer of economic intellectual property rights or to provide as collateral. We believe that these issues should be addressed through theadoption of appropriate amendments to Art. 25 of the Law.In our opinion, the right to use a well-known trademark may be the subject of licenseagreements and commercial concession agreements. The article deals with the problems of Ukrainian society's transformation. The changes that had been begun in the socio-political structure of Ukrainian society since the 90s of the 20th century did not have a directed development vector, because they were not based on Ukrainian values. Based on the works of L. Chupriya, P. Guy-Nizhnik, V. Gorbulin, A. Kachinsky, H. Sytnik, V. Rebkal, Yu. Kalinovsky, V. Bakirov, О. Babkina, I. Bekeshkina, E. Golovahi, N. Panina, A. Ruchka, etc., the author makes it a point to explore the axiological dimensions of the transformation of modern Ukrainian society and the possibility of its transition to democratic transit. Using the data of sociological surveys that are regularly done by the scientists of the Sociology Institute, the citizens value priorities of Ukraine are identified, which are important indicators of their perception, sensations and interpretation of the society transformation processes. People are disappointed in the changes, growing non-confidence to the institutions of power, lack of desire to participate in political processes. It is concluded that the causes of these problems are, on the one hand, the behavior of the authorities, which lacks democratic traditions, adapts the law to their needs, and uses state institutions for their own enrichment. On the other hand, low political and legal culture of citizens, blurring of public values, domination security values over the freedom values and self-realization. To solve the above problems, the priorities of the authorities are determined: – directing political activities to transform a person into a member of the political community, with a main focus on the rights and freedoms of the individual, its civic duty and emotional-sensory conviction in democratic values, readiness for lawful behavior; – return of trust to state institutions; – revival of national traditions, historical and spiritual values of Ukraine, created by the work of previous generations for the consolidation of Ukrainian society.Key words: values, transformation, identity, political culture, democratic transit. ; У статі розглянуто проблеми трансформації українського суспільства. Визначено ціннісні пріоритети громадян України, що виступають важливими індикаторами їхнього сприйняття, відчуття і тлумачення трансформаційних процесів суспільства. The article deals with the formation of value orientations of citizens under conditions of ambivalent public rhetoric. The system of values of civic culture, characterized by the motivation to create certain values, namely the attitude of the individual to himself as the subject of civil society, critical thinking, optimism, positive attitude to social reality, the need for active participation in social processes and significant changes.The theoretical factual paper describes the scientific approach to the definition of conceptual and categorical apparatus. The author examines the concept of "civic culture" as a special subsystem of general culture, from theperspective of evolutionism and functionality. Exploring the structure of culture the author isolates its relationship with modality, the maturity of society, thoughts and actions, characteristic of a society, social dependency, behavioral patterns, values and ideas that reflect the relationship of features that is specifically taken from society.Special attention is focused on the author's definition and characteristics under the concept of "value". The author argues that it is the value of organizing knowledge, motivating behavior and activities of the individual, makinghuman life filled with meaning.Summarizing scientific approaches to the definition of the concept the author identifies two main groups of values which are important in the formation of human beings, namely, material and spiritual, and concludes that valuesare ideas, norms, processes, relations material and spiritual order, having a positive objective value and are able to meet the specific needs of people. Human values is the link that connects its public and private life.Based on the scientific analysis of the author defines defines the value system of modern trends of Ukrainian state.The author believes that things that happened in Ukraine are caused by a break of certain social consciousnessof citizens, determined the transition from traditional society to an innovative type of paternalism to civic participation, from authoritarianism to democracy. This process is accompanied by the transformation of value systems that formed the basis of society and state.The author believes that Ukrainian society has undergone fundamental structural changes due to the destruction of the existing value system for decades. Social transformation led not only to changes in economic, political and cultural institutions, but also become a source of instability social environment caused blurring objects identification values. There is a contradictory process radical reassessment of the totality of values, which leads to difficulties inadapting to the individual requirements of modern times, strengthens the processes of social anomie.The author believes that the important form of expression of civic culture is law and morality. The law and morality form the model and the value-normative standards of society orientations.In the process of historical development of civic culture the ideals and norms of rationality have been absorbed.This active, rational-activist culture in my opinion, is today a prerequisite of social and cultural development of many Western countries. That culture directs people to actively mastering social reality in all its spheres.According to the author in the structure of civic culture stand stable values not subject to the passage of time, we can say, classic, universal primary function is to convert the objective imperatives of social activity in the subjectivegoals, motives actions and deeds. Civic values is to strengthen the existing system, they meet the criterion of generalsignificance and that is objectively serve the integrity of society by rationing behavior of the person.In conclusion, the author distinguishes four important basic components, namely cognitive, as the basis of sociopsychological, economic, political, legal, cultural and historical knowledge; axiological as important values, an ideal position; reflexive, as a special ability to think critically, the ability to explore and discuss the nature of events, using various sources of information, etc.; behavioral, as a way of socially transformative activities based on sustainable values.Characteristic features of civic culture is its autonomy, rationality, and rational-critical attitude to reality, democracy, tolerance and pluralism. The ability to exercise their rights, freedoms, availability of high responsibilitytowards society and the state, patriotism . Those are valuable principles on which is formed a high level of civic culture.The author argues that the purpose of civic culture is to build value orientations of members of civil society, aswell as symbolic and normative mediation of their interaction with each other. Tiraspol fortified area was equipped on the left (eastern) bank of the Dniester river, from the mouth of the Yahorlyk river to Kuchurhansky estuary. The left (northern) flank of the fortified area bordered and closely interacted with the right (southern) flank of the Rybnytsya FA, the right (southern) near the town Mayaky was built on the Dniester estuary. The major operational areas of the fortified area were: Tiraspol – Zatyshshya station; Bendery – Tiraspol – Rozdilna station, both areas derive to the railroad Kyiv – Odesa. The data' importance was determined with: dislocation of the Romanian army military units close to the border, broad valleys of the Reut and Byk rivers, the outputs of which are covered with gardens and forests, that allowed the enemy to come hiddenly to the Dniester, and to the dominant banks of the Dniester on the enemy's side, the possibility to counteract with enemy's land troops with its naval forces. Thus the fortified area covered an important strategic direction and took an important place in the southern defense complex of Stalin line, built on the river Dniester.On May 31, 1941 in Tyraspol fortified area mobilization measures were carried out. To the garrison's structure were included: the 64th, the 65th, the 66th, the 72nd, the 73rd and the 74th separate machine-gun battalions, the 397th Artillery Regiment, 11 platoons of casemate artillery, the 150th Separate Intercommunication Battalion, the 136th Separate Engineering Battalion, the 221st Separate Motor platoon.So after mobilization activities conducting the Tiraspol garrison fortified area personnel accounted more than ten thousand soldiers and commanders. The garrison of the fortified area was armed with: 632 heavy machine guns "Maxim", 285 Dehtyaryov light machine guns, about a hundred artillery cannons of various calibers, 26 MS-1 tanks (with 45-mm cannon), 100 tractors and nearly three thousand horses.It is known that because of enemy's breach on the Mohyliv Yampil fortified area main defense line, it got the opportunity to lead active offensive operations to the south along the left bank of the Dniester. This led to the release of significant enemy forces in the rear of the Rybnytsya and flank of the Tiraspol fortified areas. After breaking through the main defense line of the Tyraspol FA near Dubossary the 9th Army troops of Southern Front came under the threat of circulation near Kodym, Kotovsk, Dubossary. Therefore, the Southern Front command was forced to give the order to move away from the main defense line of the Tiraspol fortified area.The further actions of the Tiraspol garrison fortified area are described in the former chief engineer of the Southern Front, the Soviet Union Hero, Major General Arkady Khrenov's memoirs: ".If the Prymorska Army went beyond the Dniester in relative order, it was the great merit of the Tyraspol fortified area. Starting from July 25, 1941, the fortified area strongly beat continuous enemy attacks off. During twelve days the fortified area was kept - kept till the end, until the enemy began to bypass it from the right flank, pushing the 9th Army forces".The Tyraspol fortified area was holding the enemy in check for twelve days, providing retreat to the Dniester Prymorska Army's parts, as it was included to its stuff at the end of July. The length of the fortified area on the front was a hundred and fifty miles. On August 4, 1941, when troops of the 9th Army retreated, exposing its right flank, a real threat of encirclement appeared. The fortified areas could be attacked from the rear and captured by the enemy together with its arms and material property. Therefore, on August 5, 1941 the Military Council of Prymorska Army gave to the Tyraspol fortified area commandant Colonel G. Kochenov order to leave long-termed fire facilities, to take people with weapons, vehicles and all ammunition out, and to use it to replenish the field troops. Commandant of the Tyraspol fortified area completed the order: during the 6th of August, 1941 under the guise of one single machine-gun battalion, and one artillery battalion that beat off numerous enemy attacks, ammunition and numerous material resources were taken off to Karpov railway station, that were loaded into wagons and sent to Odesa to which was just forty miles. In the evening the fortified area garrison, removing mounted machine-guns from the long-term fire facilities, and having exploit forty seven 76-mm casemate cannons, hastily retreated with Prymorska Army parts. The machine-gun long-term fire facilities of the Tyraspol fortified area were not prepared in advance for undermining, and that's why they were failed to destroy."On August 7, 1941 all the units of the Tiraspol garrison fortified area retreated to the railway station Karpov. Hence, by order of the Chief of Front Headquarter, General Sheshenin, two separate gun battalions were sent to Odesa to overhaul, and before to the disposal of the Prymorska Army headquarter from the Tiraspol fortified area garrison were sent separate battalions – Sapper and Intercommunication. The remaining individual gun battalions and an artillery regiment joined the Prymorska Army infantry divisions. Thus, the Tyraspol fortified area ceased to exist. Instead the Prymorska Army has added eleven thousand well-trained gunners, artillery, engineers, signalers, intelligence, was about 500 machine-guns and 320 hand-held heavy machine guns with 3.5 million live rounds, the regiment of artillery guns with five fighting sets for each cannon. This significantly increased the combat power of two infantry divisions of Prymorska Army".Germans also left their memories associated with breakthrough of the Tyraspol FA. So they, in particular, wrote: The Russians fortified well the isthmus near the settlement Pogreby in the Tiraspol district, correctly assuming that the attacker, using the hidden beneficial opportunities of access to the water obstacle, in this very place and trying to make a break through and forcing a defensive position on the Dniester.At the isthmus 3 km wide, that was the sloping, open area behind the anti- tank ditch 2.5-3 m wide, polygonal obstacles and invisible barbed wires, there were four machine guns long-term defensive facilities with twelve machine guns that fired on the front and on the flanks, and a tank fire facility for combating armored targets and artillery on opened fire positions and infantry. Among them were located numerous well camouflaged positions of the field type. Artillery fire was opposed with artillery batteries that were hidden in the valley and on the reverse slopes of hills to the east of the road Tyraspol – Grigoriopol.Areas of heavy weapons firing were displayed after firing positions studying of defense positions, Russian drawings were not found. Field of fire from the long-term fire facilities were mostly well looked through, but facility 711 was not very favorably situated. Protection of terrains that were not covered by long-term defensive facilities and other tactically important points were provided with heavy machine guns, for them were made alternative firing positions.With typical for Germans thoroughness and a tendency to analyze the actions of the enemy, German experts summarized the Tyraspol FA breakout: "The fact that this attack has been completed successfully in a short time with relatively small losses is the result o, firstly, the training quality of the German troops, and secondly the failure of Russian command that could not use properly the high defense possibilities of the fortified area, combining concrete ramparts and defensive positions of the field type". The article analyses the attempt of socio-political rethinking of global climate change within Ulrich Beck's theory of the metamorphosis. Socio-political analysis of climate change requires clarification of its methodological foundations. This article states that at the beginning of the new millennium, the social sciences have come to a point of a deep methodology crisis. Without a new methodology, the social sciences would have to declare bankruptcy in the face of the tumult of the environment which surrounds us, where what was unthinkable yesterday is real and possible today. In this critical situation, Beck sets himself the ambitious task of developing a fundamentally new methodological basis for the analysis of the modern world - the theory of the metamorphosis of the world.It is emphasized that the concept of the metamorphosis is a landmark change in the focus of our attention and our worldview. It destabilizes all the definitions of modernity. Beck calls our attention to unintentional events and processes that go largely unnoticed, mostly outside the domains of politics and democracy, as side effects of radical technical and economic modernization. They are triggers for a fundamental shock that undermines the anthropological constants of our existence in the world and our understanding of the world. The distinction between nature and society has ceased to exist.The article notes that Beck explained the significant difference between the theoretical foundations of the theory of world risk society and the new theory of the metamorphosis of the world. Where the theory of world risk society had analysed the negative side effects of the good, the new theory focuses on the positive side effects of the bad, which do not, however, automatically create a better world. Beck is constantly focusing his attention on the lack of predetermined course of events: the metamorphosis is a process that has no end. It is an open, irreversible and highly ambivalent process.Stubbornly refusing the temptation to create a new horrific scenario of climate apocalypse, Beck proposes his own analytical approach of seeking to answer the question of how climate change affects society and politics. It is necessary to set free our political and social imagination, which now faces the daunting task of encompassing the interaction and interdependence of the human, society and nature in the conditions of globalization, and the corresponding changes in the political sphere.In terms of socio-political analysis, we are faced with situations of lack of understanding, because climate change can have different and possibly opposing impacts on people's lives even within a single region, let alone between geographically remote ones. Someone wins and someone loses in different ways (including ways as yet unknown today). Accordingly, a complex multilevel model of the metamorphosis of the world emerges, which takes into account the interaction of local, regional, national and global conditions which create specific structures as a consequence of social inequalities and power relations. In order to face the challenges and risks of climate change, global society needs a large-scale, cosmopolitan, planetary-level POLITICS in the face of powerlessness of the national-international politics.The open nature of the future gives reason to speak of the particular importance of political decisions taken in response to climate threats. Choosing cooperation between countries with different levels of development, we must distinguish between the theory of dependency and the theory of cosmopolitanisation in the context of socio-political rethinking of climate change. Indeed, both theories describe global forms of historical transcontinental inequalities and asymmetric power relations. However, cosmopolitanisation forms the normative horizon of equality and justice, including climate justice. Obviously, the new horizon does not automatically reduce the asymmetry in relations between countries (Beck emphasizes that global inequality may even increase), but it would lead to the implementation of global norms of equality. It is when we consider climate catastrophes in the context of justice that the question arises of whether existing patterns of inequality and vulnerability are fair and we leave the discourse of "how to manage our risks" behind. It is when we focus on the mechanisms of creation and dissemination of the negative effects that we will see the movements which are typically invisible to everyday perception. Our scientific perspective will combine what is nationally and geographically divided, becoming "the cosmopolitan perspective".Moving from theoretical to practical, Beck acknowledges that in the (in)human conditions of existence in the early 21st century, the imperialist interconnectedness of radically unequal worlds still dominates. The reality and prospects of the metamorphosis make possible the emergence of a new imperialist order and 'climate colonialism' against the background of the continued existence of colonial patterns. There is a fundamental distinction between decision makers and risk generators, and those who suffer from these decisions and risks. However, according to Beck, we can only see this imperialist structure if we change the optics of the nation-state to a cosmopolitan perspective in the socio-political rethinking of climate change in relation to the climate justice horizon for those already living in the global world and for those who are yet to be born into it. The main change Beck proposes is to see in people and communities not the victims of the effects of climate change, but citizens whose rights must be protected.We conclude that Beck's theoretical explorations and conclusions on socio-political understanding of climate change are of utmost importance for Ukraine, where rethinking climate change has not yet become a first-order issue on the socio-political agenda. Any country's lack of attention to the major issue of climate change can be abused. Статья посвящена анализу попытки социально-политического переосмысления климатических изменений в теории метаморфозиса У. Бека. Доказывается значение теории метаморфозиса для выяснения взаимозависимости человека, общества, природы в условиях глобализации и соответствующим изменениям в сфере политики. Подчеркивается, что только с позиции социально-политического анализа климатических изменений можно определить нормативный горизонт климатической справедливости для глобального мира, увидеть угрозы климатического колониализма.Ключевые слова: Бек У., климатическая справедливость, климатический колониализм, социально-политическое переосмысление климатических изменений, теория метаморфозиса. The article analyses the attempt of socio-political rethinking of global climate change within Ulrich Beck's theory of the metamorphosis. Socio-political analysis of climate change requires clarification of its methodological foundations. This article states that at the beginning of the new millennium, the social sciences have come to a point of a deep methodology crisis. Without a new methodology, the social sciences would have to declare bankruptcy in the face of the tumult of the environment which surrounds us, where what was unthinkable yesterday is real and possible today. In this critical situation, Beck sets himself the ambitious task of developing a fundamentally new methodological basis for the analysis of the modern world - the theory of the metamorphosis of the world.It is emphasized that the concept of the metamorphosis is a landmark change in the focus of our attention and our worldview. It destabilizes all the definitions of modernity. Beck calls our attention to unintentional events and processes that go largely unnoticed, mostly outside the domains of politics and democracy, as side effects of radical technical and economic modernization. They are triggers for a fundamental shock that undermines the anthropological constants of our existence in the world and our understanding of the world. The distinction between nature and society has ceased to exist.The article notes that Beck explained the significant difference between the theoretical foundations of the theory of world risk society and the new theory of the metamorphosis of the world. Where the theory of world risk society had analysed the negative side effects of the good, the new theory focuses on the positive side effects of the bad, which do not, however, automatically create a better world. Beck is constantly focusing his attention on the lack of predetermined course of events: the metamorphosis is a process that has no end. It is an open, irreversible and highly ambivalent process.Stubbornly refusing the temptation to create a new horrific scenario of climate apocalypse, Beck proposes his own analytical approach of seeking to answer the question of how climate change affects society and politics. It is necessary to set free our political and social imagination, which now faces the daunting task of encompassing the interaction and interdependence of the human, society and nature in the conditions of globalization, and the corresponding changes in the political sphere.In terms of socio-political analysis, we are faced with situations of lack of understanding, because climate change can have different and possibly opposing impacts on people's lives even within a single region, let alone between geographically remote ones. Someone wins and someone loses in different ways (including ways as yet unknown today). Accordingly, a complex multilevel model of the metamorphosis of the world emerges, which takes into account the interaction of local, regional, national and global conditions which create specific structures as a consequence of social inequalities and power relations. In order to face the challenges and risks of climate change, global society needs a large-scale, cosmopolitan, planetary-level POLITICS in the face of powerlessness of the national-international politics.The open nature of the future gives reason to speak of the particular importance of political decisions taken in response to climate threats. Choosing cooperation between countries with different levels of development, we must distinguish between the theory of dependency and the theory of cosmopolitanisation in the context of socio-political rethinking of climate change. Indeed, both theories describe global forms of historical transcontinental inequalities and asymmetric power relations. However, cosmopolitanisation forms the normative horizon of equality and justice, including climate justice. Obviously, the new horizon does not automatically reduce the asymmetry in relations between countries (Beck emphasizes that global inequality may even increase), but it would lead to the implementation of global norms of equality. It is when we consider climate catastrophes in the context of justice that the question arises of whether existing patterns of inequality and vulnerability are fair and we leave the discourse of "how to manage our risks" behind. It is when we focus on the mechanisms of creation and dissemination of the negative effects that we will see the movements which are typically invisible to everyday perception. Our scientific perspective will combine what is nationally and geographically divided, becoming "the cosmopolitan perspective".Moving from theoretical to practical, Beck acknowledges that in the (in)human conditions of existence in the early 21st century, the imperialist interconnectedness of radically unequal worlds still dominates. The reality and prospects of the metamorphosis make possible the emergence of a new imperialist order and 'climate colonialism' against the background of the continued existence of colonial patterns. There is a fundamental distinction between decision makers and risk generators, and those who suffer from these decisions and risks. However, according to Beck, we can only see this imperialist structure if we change the optics of the nation-state to a cosmopolitan perspective in the socio-political rethinking of climate change in relation to the climate justice horizon for those already living in the global world and for those who are yet to be born into it. The main change Beck proposes is to see in people and communities not the victims of the effects of climate change, but citizens whose rights must be protected.We conclude that Beck's theoretical explorations and conclusions on socio-political understanding of climate change are of utmost importance for Ukraine, where rethinking climate change has not yet become a first-order issue on the socio-political agenda. Any country's lack of attention to the major issue of climate change can be abused. Global climate risks threaten, according to Beck, both the lives of individual citizens and the sovereignty of nation states.Key words: Beck U., climate justice, climate colonialism, socio-political rethinking of climate change, the theory of the metamorphosis.
