KEBIJAKAN GAMBIA KELUAR DARI MAHKAMAH INTERNASIONAL PADA ERA PEMNTAHAN YAHYA JAMMEH
This study aims at discussingwhat factors behind the Gambian policy to leave the International Criminal Court. Moreover, it will explain what forms of discrimination carried out by the International Criminal Court as well as Yahya Jammeh's policies that have become controversial and criticized by the Gambia people and the international community.Gambia withdrawalfrom the International Criminal Court in Yahya Jammeh's Era. The International Criminal Court is a permanent international court established to investigate, prosecute and try individuals accused of committing the most serious crimes of concern to the international community as a whole, namely the crime of genocide, crimes against humanity, war crimes and the crime of aggression. To date, almost all of its full-fledged investigations have focused on Africa. Gambia demanded the International Criminal Court to prosecute the European Union for the death of African migrants on the European Coast and sued former British Prime Minister Tony Blair for his suspicion in the Iraq War. In addition, the double standards imposed by the International Criminal Court against the UN Security Council led to criticism from African countries, especially the Gambia. The case of Sudan (Darfur) and Libya are referred to by the UN Security Council while 3 of the 5 veto holders are not members of the International Criminal Court. On the other hand, the Yahya Jammeh Government has come under fire from the international and national Gambia for the violence committed against the people, especially against the opposition members, human right defenders, journalists and the LGBT communties. The European Union, the United Nations, Amnesty International and Human Rights Watch, demand the International Criminal Court to investigate Yahya Jammeh's Government.

Don't do the crime if you can't do a man's time: examining sentencing disparities using offender demographics
Looking back, America has seen its fair share of differences among its population, so it should not come as a shock that sentencing disparities are a serious criminal justice issue in the United States. Each year, thousands of people are sent to Federal prisons where they receive sentences for crimes they have been convicted of committing. The United States Sentencing Commission publishes these results annually. No matter the number of persons entering the prison system on the federal level, the number of female offenders often remains about the same (8555 in 2000; 9451 in 2007; and 9302 in 2008). While it is illegal to openly discriminate against a defendant and give them a sentence based on his or her demographics, the laws are written in ways where discrimination can still be allowed. The current research examines the relationship between not only gender, but also looks to education, race, age, and the crime committed to explain this gap in sentencing. Methodology: The data for the current research are from the United States Sentencing Commission (USSC), an annual report comprised of details for every person who entered federal prison in the given year. The current research used data from the year 2016 and includes 67,660 cases. Findings: Findings are supportive of previous research. Whether or not a defendant will receive a sentence is influenced by gender, age, race, education, and offense type. Sex, race, and education also affected the length of the sentence received. Unlike previous studies, age did not appear to be significant when determining the length of a sentence. ; 2018-05-01 ; M.A. ; Sciences, Sociology ; Masters ; This record was generated from author submitted information.

Not only a crime but a tragedy […] exploring the murder of adults with disabilities by their parents
In: The journal of adult protection, Band 14, Heft 1, S. 6-21
ISSN: 2042-8669
PurposeThis paper seeks to reconcile society's need to apply strong sanctions to parents who are responsible for the murder of a disabled adult while also recognising the stresses present in their lives.Design/methodology/approachThe paper reviews six cases in which seven disabled adults were killed by a parent in the UK between 1999 and 2009.FindingsThe review found that these were no ordinary crimes and nor were they motivated by malice, but occurred against a backdrop of significant mental illness and distress. In addition, two of the parents killed themselves as well as their adult child and another attempted suicide. The explanations offered in court to account for the murders included a combination of caregiver stress and mercy killing and the courts struggled to find a consistent approach.Research limitations/implicationsThe review is limited to cases reported in the press and only considers information in the public domain. The portrayal of the issues in the media is integral to the study. The cases reported in this paper are a sub‐set of a larger sample of children and adults murdered by caregivers during this period.Originality/valueThe paper compares and contrasts some features of these high‐profile cases, commenting on the way they were addressed in the courts and making recommendations as to how the backdrop of significant mental ill‐health could be taken into account in the way families are offered support with a view to preventing further tragedies.
