Yeni Sağ siyasal anlayış ile birlikte devlet bir anlamda asli sınırlarına çekilmiş, temel görevleri olan kamusal hizmetler dışında kalan diğer hizmetleri piyasa koşullarına bırakmıştır. Devletin bu kararı sonrası boşalan alanlara piyasa koşullarında faaliyet gösteren finans sahipleri girmeye başlamıştır. Yeni dönemde oluşan bu yeni durum devlet toplum iç içe geçmesini de bir anlamda hızlandırmıştır. Toplumun devlete sirayet aracı demokrasi iken, devletin topluma sirayet aracı ise bürokrasidir. Karşılıklı ilişki sarmalında bir birini besleyen bu iki kutbun ilişkisinden modern bir kavram olan "Siyasetin Finansmanı " doğmuştur. Siyasetin Finansmanı, seçimleri kazanarak seçmeni temsil etmek isteyen parti ve adayların kampanyalarını sürdürmek için ihtiyaç duydukları nakdi ve nakdi olmayan bütün olanakları kapsayan geniş bir kavramdır. Günümüz koşullarında siyasal faaliyetlerin sürdürülebilmesi için olmazsa olmaz bir araç haline gelen finansman desteğinin elde ediliş biçimi konumuz açısından dikkate değerdir. Demokrasi ile yönetilen hemen hemen her ülkede parti ve adaylara kamusal finansman olanağı sunulmaktadır. Ancak bu kaynağın yetersiz kalması parti ve adayları özel bağışlara başvurmaya zorlamaktadır. Özel bağışların siyasal alana girişi düzenleme ve yaptırıma tabi tutulmaz ise demokrasi kurumuna ciddi zarar verme potansiyeli bulunmaktadır. Alınacak tedbirlerin başarılı olması için bütün paydaşların ortak sorumluluk alması gerekmektedir. Köklü bir demokrasi geleneğine sahip olan ve bu geleneği halen sürdürdüğüne inanılan ABD'de siyasi parti ve adayların özel kişiler tarafından finanse edilmesi artık yerleşik bir gelenek haline gelmiştir. Türkiye'de ise bu konu hakkındaki tartışmalar halen oturmuş sayılmaz ve olgunlaşarak kabul görmesi zaman alabilir. Alan araştırmasındandan elde edilen verilerin analiz edilmesi sonucunda da Türkiye'deki seçmenin bu konu hakkında nispeten olumsuz bir görüşe sahip olduğu görülmektedir. The modern concept of "Financing of Politics" was born from the relationship of these two poles that feed each other in the spiral of mutual relationship. Political financing is a broad concept that covers all financial and non-cash opportunities that parties and candidates who want to represent the voter by winning the elections need to continue their campaigns. The way in which financial support is obtained, which has become an indispensable tool for the continuation of political activities in today's conditions is remarkable in terms of our subject. In almost every country governed by democracy, parties and candidates are offered public funding. However, the inadequacy of this resource forces parties and candidates to apply for private donations. If the entry of private donations into the political arena is not regulated and sanctioned, it has the potential to seriously damage the institution of democracy. In order for the measures to be taken to be successful, all stakeholders must take joint responsibility. In the USA, which has a deep-rooted tradition of democracy and is believed to continue this tradition, financing of political parties and candidates by private individuals has now become an established tradition. In Turkey, on the other hand, the debates on this issue are still not settled and it may take time for it to mature and be accepted. As a result of the analysis of the data we obtained from our field research, it is seen that the voters in Turkey have a relatively negative opinion on this issue. In other words, according to the people who participated in the research, the financing of politics by private individuals can mostly be based on an interest, even if it is for the purpose of participation.

Hutsuliak O. A. ON THE NATURE OF SECURITY OF THE TERRITORIAL COMMUNITY CONCEPT The article states that the ongoing administrative reform in Ukraine focuses on all the new law-making and law- enforcement challenges, which require the attention of both legal scholars and researchers. A wide range of vague issues hinders the effectiveness of the reform and causes shortcomings in ensuring the rights and freedoms of the citizens. One of the key aspects, highlighted in the paper, is the conceptual framework, which should define the nature of certain administrative and legal institutions, their effectiveness, the course of development, and other such issues. The epistemological and legal nature of the concept of territorial community security is one of them. The issues of the organisation of power on the territory, the formation of an effective local government, and the status of territorial communities in Ukraine are analysed on the basis of the works of such Ukrainian scholars as: M. Baimuratov, Ol. Batanov, Ih. Drobot, V. Kampo, A. Kovalenko, V. Kuybida, V. Mamonova, Ol. Moroz, M. Orzikh, M. Pukhtynskyi, Ol. Sushynskyi. Following this, it is concluded that the administrative and legal scientific literature lacks theoretical developments in the interpretation of the issue of security of the territorial community, which can lead to the occurrence of gaps in law enforcement practice and to an ineffective guarantee of the constitutional rights and freedoms of the citizens. The article examines the nature of the concept of security of the territorial community in the context of the key concepts of its formation, such as the concept of security and the concept of territorial community. The author defines the concept of security as a philosophical and legal phenomenon, and the concept of the territorial community as a primary subject of local self-government with special features, functions and purpose of its formation. Based on the analysis of normative documents, international standards and scientific works of the Ukrainian scholars, the author specifies the scope of these concepts, as well as gives his own vision regarding the special concept of security of the territorial community. The conclusion is that this problem requires a thorough further study involving the development of a comprehensive legal and theoretical framework for its resolution. ; У статті автор зазначає, що триваюча в Україні адміністративна реформа звертає увагу на все нові правотворчі та правозастосовні виклики, котрі привертають увагу правників та науковців. Широкий спектр невизначених питань гальмує ефективність реформи, сприяє недосконалості забезпечення прав та свобод громадян. Одним із ключових аспектів, на котрому акцентується увага, є понятійний апарат, котрий повинен визначати зміст окре­мих адміністративно-правових інститутів, їх дієвість, вектор розвитку тощо. Гносеологічний та правовий зміст поняття безпеки територіальної громади є одним із них. Проаналізовано ступінь дослідження питання територіальної організації влади, формування ефективного міс­цевого самоврядування та статусу територіальних громад в Україні в роботах таких вітчизняних учених: М. Бай- муратова, О. Батанова, І. Дробота, В. Кампо, А. Коваленка, В. Куйбіди, В. Мамонової, О. Мороза, М. Орзіха, М. Пухтинського, О. Сушинського та зроблено висновок, що в адміністративно-правовій науковій літературі бра­кує теоретичних розробок тлумачення питання безпеки територіальної громади, що у свою чергу є передумовою створення прогалин у правозастосовній практиці та неефективному забезпеченні конституційних прав і свобод громадян. У статті досліджено зміст поняття безпеки територіальної громади через призму ключових понять його фор­мування - поняття безпеки та поняття територіальної громади. Надано авторське визначення поняття безпеки як філософсько-правового явища, а також поняття територіальної громади як первинного суб'єкта місцевого самоврядування з особливими ознаками, функціями та метою утворення. На основі аналізу нормативних доку­ментів, міжнародних стандартів та наукових досліджень вітчизняних науковців визначено зміст цих понять, а також надано авторське бачення спеціального поняття «безпека територіальної громади». Сформовано висно­вок, що дана проблема потребує ґрунтовного подальшого вивчення з формуванням комплексного правового та тео­ретичного підґрунтя для її врегулювання.

THEORETICAL AND LEGAL CHARACTERISTICS OF LEGAL LIABILITY FOR OFFENSES IN THE BUDGETARY SPHERE Reforms of the financial system and economy in Ukraine have given impetus to the creation of a new approach to the legal regulation of financial relations, in general in the budget sphere. In modern conditions, the sphere of budgetary legal relations is the main one of the most important among the spheres of economic activity. A well-established mechanism for the functioning of the budget system is one of the main criteria of any legal democratic state, including modern Ukraine. Any failure or violation can lead to the inability to centralize funds, and therefore a failure to implement a common financial policy throughout the country. In order to effectively solve the most important economic and social problems, the legislation on financial responsibility requires not only the improvement or clarification of certain rules, but also the development of new conceptual approaches. Many other issues in the field of budgetary relations and such responsibility have not been studied by scholars and have not been enshrined in current legislation, as the study of administrative, legal and financial aspects of liability for budget violations in Ukraine is at an early stage. The key point in overcoming the crisis in the state economy is the formation of the legal framework for compliance by participants in the budget process with the relevant legislation and further bringing them to justice in case of violation. Issues in the field of budget law regarding control and responsibility are becoming relevant. The state of legality in the budget system of the state directly depends on the legality of the formation, distribution and use of budget funds. Due to the existence of the institution of legal responsibility (regardless of the type of sphere), stability in the state is ensured, guarantees, rights and freedoms of man and citizen, protection of society from illegal encroachments, etc. are observed. In practical and theoretical activities, the following types of legal liability are usually distinguished: criminal, administrative, civil, commercial, substantive, disciplinary, but recently in various independent and complex areas of law, scientists have begun to distinguish financial liability. ; Реформування фінансової системи та економіки в Україні дали поштовх створенню нового підходу до правово­го регулювання фінансових відносин, загалом у бюджетній сфері. У сучасних умовах сфера бюджетних правовід­носин є основною з найбільш значимих серед сфер економічної діяльності. Чітко налагоджений механізм функціонування бюджетної системи є одним із головних критеріїв будь-якої правової демократичної держави, в тому числі й сучасної України. Будь-який збій або порушення може призве­сти до неможливості централізувати кошти, а отже, і спричинити збій у здійсненні єдиної фінансової політики на території всієї країни. З метою ефективного вирішення найважливіших економічних і соціальних завдань законодавство про фінан­сову відповідальність потребує не лише вдосконалення чи уточнення окремих норм, а й розроблення нових кон­цептуальних підходів. Ще багато питань у сфері бюджетних правовідносин і такої відповідальності не були досліджені науковцями та не знайшли свого закріплення в чинному законодавстві, адже дослідження проблем адміністративно-правових та фінансово-правових аспектів відповідальності за правопорушення у бюджетній сфері в Україні знаходиться на початковому етапі. Ключовим моментом з подолання кризових явищ в економіці держави є формування правового поля в питан­нях дотримання учасниками бюджетного процесу відповідного законодавства та в подальшому притягнення їх у разі порушення до відповідальності. Актуальності набувають питання у сфері бюджетного права щодо контролю і відповідальності. Стан законності в бюджетній системі держави напряму залежить від законності формування, розподілу і використання бюджетних коштів. Завдяки існуванню інституту юридичної відповідальності (незалежно від різновиду сфери) забезпечується стабільність у державі, дотримуються гарантії, права та свободи людини і громадянина, охорона суспільства від протиправних посягань тощо. У практичній та теоретичній діяльності зазвичай виділяються такі види юридич­ної відповідальності: кримінальна, адміністративна, цивільно-правова, господарсько-правова, матеріальна, дис­циплінарна, але останнім часом у різних самостійних та комплексних галузях права науковці почали виділяти і фінансово-правову відповідальність.

The article focuses on the interpretation of the features of the journalistic style of R. Menasse – the world famous Austrian writer, the discoverer of the European Union asa subject of aesthetic comprehension in world literature, who sharply raised a number of problematic issues of the political reality of the coexistence of European states. These include such as the ratio of the concepts of national interest, national power, nationalism; the possibility of the existence of democracy at the supranational level; the relationship between the elite and democracy; the national bureaucracy and the administrative apparatus of the EU and others, which are practically not affected so far in literary journalism. The concept of the article proceeds from the idea of Menasse's mentality as a European writer as Europeanist, rooting in the minds of contemporary readers the realities of a new, supranational thinking. In undertaking a revision of the prevailing stereotypes of the EU as a restrictive and bureaucratic institution, Menasse draws on his own research undertaken to create an independent view of the EU's activities. The writer's vivid impressions are combined with reflections on the history of European countries and reliable judgments about the practical functioning of the EU. The engaged narrator Menasse sets out his objective concept of an intellectual and an independent thinker, relying on the evidence-based logic of facts and figures, which nowhere become an end in themselves, but illustrate a consistent and rigorous argumentation. The narrator-educator Menasse is characterized by completeness of formulations, frankness of position, honest attitude towards the reader. Thanks to the stylistic skill of the author, the essay develops into an analytical and journalistic compendium in which political objectivism and the power of persuasion dominate. ; Исследование сосредоточено на интерпретации особенностей публицистического стиля Р. The article analyzes the development of the legal sys­tem of Ukraine in the field of tax benefits and its impact on the transition from a socialist planned economy to a market one. The processes of improvement of the tax legislation in difficult conditions of formation of the State which required not only the balanced and effective decisions of subjects of the legislative initiative, but also their most exact and effective execution by the state institutions ad­ministering taxes were considered. The works of leading Ukrainian scholars, who thoroughly researched the legal provision of benefits in that period and the preconditions for the relevant legislative changes, were analyzed. Five stages of development of legal regulation of tax benefits in Ukraine were highlighted. Examples of the first legislative and regulatory acts, which established benefits for enterprises and industries of goods, were given. Certain mistakes in the develop­ment and implementation of these acts, which negatively affected the development of the Ukrainian economy and investment attractiveness of Ukraine, as well as created the preconditions for corruption abuses were indicated. The influence of the adoption of the Constitution and the Tax Code of Ukraine on the further formation of tax legislation and instruments for implementing state policy in the field of taxation aimed at achieving stable indica­tors in filling the State and local budgets while complying with tax discipline and providing tax incentives (benefits, preferences) for business development was researched. The types of taxes in the EU and the powers within the EU to form them were given, the practice of regulat­ing the economies of EU member states by applying tax benefits as state aid, thus ensuring the competitiveness of individual industries and service providers and achieving sustainable development in a broader sense was analyzed. Ukraine's commitments in the field of taxation and competition were considered and the sources of EU law that need to be implemented in accordance with the Ukraine-EU Association Agreement were given, as well as the possible impact on the development of Ukraine's tax system and strengthening the competitiveness of the Ukrainian economy as a result of the implementation of European law were forecasted. Approaches to legislative support and practical appli­cation of tax benefits in order to effectively implement their goals to promote the development of Ukraine's econ­omy were recommended. ; У статті проаналізовано розвиток правової системи України у галузі податкових пільг та її вплив на пере­хід від соціалістичної планової до ринкової економіки. Розглянуто процеси вдосконалення податкового законодавства у складних умовах становлення Дер­жави, які потребували не лише виважених та ефек­тивних рішень суб'єктів законодавчої ініціативи, а й максимально точного та ефективного їх виконання державними інституціями, які адмініструють подат­ки. Проаналізовано роботи провідних українських науковців, які ґрунтовно дослідили правове забез­печення надання пільг у той період та передумови до відповідних законодавчих змін. Виокремлено п'ять етапів розвитку правового регулювання податкових пільг в Україні. Наведено приклади перших законодавчих та норма­тивно-правових актів, якими встановлювалися пільги для підприємств і галузей. Указано на певні помилки під час розроблення та реалізації вказаних актів, які негативно вплинули на розвиток української економі­ки та інвестиційної привабливості України, а також створювали передумови для корупційних зловживань. Досліджено вплив ухвалення Конституції та По­даткового кодексу України на подальше формування податкового законодавства та інструментів реалізації державної політики у сфері оподаткування, спрямова­ної на досягнення стабільних показників у наповненні Державного та місцевих бюджетів з одночасним дотри­манням податкової дисципліни та наданням податко­вих стимулів (пільг, преференцій) для розвитку під­приємництва. Наведено типи податків у ЄС, проаналізовано прак­тику регулювання економік держав-членів ЄС шляхом застосування податкових пільг як державної допомоги, забезпечуючи тим самим конкурентоздатність окремих галузей та надавачів послуг та досягнення показників сталого розвитку в більш широкому розумінні. Розглянуто зобов'язання України у сфері оподат­кування та конкуренції та вказано джерела права ЄС, які потребують імплементації відповідно до Угоди про асоціацію Україна-ЄС, а також зроблено прогнози стосовно можливого впливу на розвиток податкової системи України та посилення конкурентоспроможно­сті української економіки. Рекомендовано підходи до законодавчого забезпе­чення та практичного застосування податкових пільг із метою ефективної реалізації їх цілей щодо сприяння розвитку економіки України.

The object of research is public relations that arise and develop in connection with the functioning of the forensic service as a unique institution in the modern system of law enforcement agencies of Ukraine. The subject of the article is a study of organizational and legal aspects of the status and features of the investigator-criminologist. The methodological basis of the article is a set of general and special methods and techniques of scientific knowledge, where the leading place is given to a systematic approach and integration method of research. The directions of de­velopment of the forensic service in the modern system of The expediency of considering the organizational and legal aspects of the functioning of the forensic service as a set of theoretical provisions and derived practical recommendations, and therefore in digital conditions, one of the important participants in the new informa­tion relations is a investigator-criminologist. Attention is focused on the fact that the communicative activity of the forensic investigator consists of informational, in­teractive and relational.law enforcement agencies are described. It is noted that the idea of differentiation of investigative units has been introduced into the legal system of Ukraine, where the forensic service has undergone significant organizational changes. It is noted that investigator-criminologists are currently serving in the bodies of the Ministry of Internal Affairs, the Security Service of Ukraine and the State Bu­reau of Investigation. It was found that the organizational activities of the forensic investigator are aimed at streamlining both their work and the relevant procedural actions regulated by law, as well as the implementation of planning, informa­tion support, analytical work and control. It was stated that the investigator-criminologist is a procedural figure, who requires the need to legislate his rights and responsi­bilities. However, it is concluded that the uncertainty of its status leads to the erosion of tasks, functions and pow­ers. Based on the hypothesis that all human knowledge about the real world is a set of information models, the author's vision of the problem of creating an information and legal concept of professional activity of a investiga­tor-criminologist is proposed. A theoretical (logical) sub­jective model of the forensic service has been built, which includes three main links of formal administrative com­munication and informal communication channels. ; Коваль С. М. Слідчий-криміналіст у системі право­охоронних органів України: організаційні та правові аспекти. - Стаття. Об'єкт дослідження - суспільні відносини, що виникають та розвиваються щодо функціонуван­ня служби криміналістки як унікальної інституції в сучасній системі правоохоронних органів України. Предметом статті є дослідження організаційних та правових аспектів статусу та особливостей діяльно­сті слідчого-криміналіста. Методологічною основою статті є сукупність загальнонаукових та спеціальних методів і прийомів наукового пізнання, де провідне місце належить системному підходу та інтеграційному методу дослідження. Охарактеризовано напрями роз­витку служби криміналістики в сучасній системі пра­воохоронних органів. Зазначено, що у правову систему України впроваджено ідею диференціації слідчих під­розділів, де служба криміналістики зазнала суттєвих організаційних змін. Указується, що нині слідчі-кримі- налісти проходять службу в органах МВС, СБУ та ДБР. Наголошується на доцільності розгляду органі­заційно-правових аспектів функціонування служби криміналістики як сукупності теоретичних положень та похідних від них практичних рекомендацій, тому в цифрових умовах одним із важливих учасників нових інформаційних відносин є слідчий-криміналіст. Увага акцентована на тому, що комунікативна діяльність слідчого-криміналіста складається з інформаційної, інтерактивної та реляційної. З'ясовано, що організаційна діяльність слідчо- го-криміналіста спрямована на впорядкування як сво­єї роботи, так і проведення відповідних процесуальних дій, регламентованих законом, а також здійснення планування, інформаційного забезпечення діяльності, аналітичної роботи та контролю. Констатовано, що слід- чий-криміналіст є процесуальною фігурою, яка вима­гає необхідності законодавчого закріплення його прав і обов'язків. Утім підсумовується, що невизначеність його статусу призводить до розмивання завдань, функ­цій та повноважень. Спираючись на гіпотезу про те, що всі знання людства про реальний світ є безліччю інфор­маційних моделей, запропоновано авторське бачення проблеми створення інформаційно-правової концепції професійної діяльності слідчого-криміналіста. Вибу­довано теоретичну (логічну) суб'єктну модель служби криміналістики, що включає три основні ланки фор­мальної адміністративної комунікації та неформальні комунікаційні канали.

The scientific article is devoted to the genesis of the development of the Institute for International Cooperation in the Criminal Process of Ukraine in Soviet and Modern Periods. It is noted that in the twentieth century, the criminal-procedural legislation was formed under the influence of historical events that took place in the territory of the Soviet Union. The tendency of the development of criminal-procedural relations is considered as тhe necessary means of organizing which has been codification. Despite the fact that the Criminal Procedural Codes of the USRR of 1922 and 1927 did not contain provisions on international cooperation in the criminal process, but they consolidated important principles of legal proceedings, observance of which are necessary for establishing cooperation with foreign states. There was emphasized that from the second half of the twentieth century, in criminal procedural legislation some changes took place, they positively affected the formation and approval of the Institute for International Cooperation. And with the adoption of the Criminal Procedural Code of Ukraine in 1960, where the provisions for the implementation of international cooperation were first established, the process of its improvement has began. Attention is drawn to the fact that the development of international relations with foreign states, ratification of numerous international treaties, proclamation of Ukraine's independence, adoption of the Constitution of Ukraine played a decisive role in bringing domestic legislation in accordance with international standards. The study has revealed that Ratification of the European Convention on the Issuance of Offenders in 1957, the Additional Protocol of 1975, the Second Optional Protocol of 1978, the Second Optional Protocol to the European Convention about mutual assistance in criminal cases of 2001 and adopting a new Criminal Procedural Code of Ukraine in 2012 is established international cooperation as an independent institution in criminal procedural legislation. It is noted that the proper legal regulation of international cooperation with foreign states in the criminal process, implementation of international norms in domestic legislation are the necessary conditions that contribute to the establishment of the principles of legality and rule of law, compliance with the rights and legitimate interests of man and citizen, help in fighting crime, and most import they serve to the achievement of tasks in criminal proceedings. ; Статтю присвячено ґенезі розвитку інституту міжнародного співробітництва у кримінальному процесі України в радянський та сучасний періоди. Зазначається, що у ХХ столітті кримінально-процесуальне законодавства формувалось під впливом історичних подій, які відбувалися на території Радянського Союзу. Розглянуто тенденцію розвитку кримінально-процесуальних відносин, необхідним засобом упорядкування яких стала кодифікація. Незважаючи на те, що Кримінально-процесуальні кодекси УСРР 1922 та 1927 років не містили положень щодо міжнародного співробітництва у кримінальному процесі, вони закріпили важливі засади здійснення судочинства, дотримання яких є необхідним для налагодженої співпраці з іноземними державами. Наголошено, що з другої половини ХХ століття в кримінально-процесуальному законодавстві відбуваються зміни, які позитивно позначились на формуванні та утвердженні інституту міжнародного співробітництва. А з прийняттям Кримінально-процесуального кодексу України 1960 року, де вперше було закріплено положення щодо здійснення міжнародного співробітництва, розпочався процес його удосконалення. Звернено увагу, що розвиток міжнародних відносин з іноземними державами, ратифікація численних міжнародних договорів, проголошення Незалежності України, прийняття Конституції України відіграли вирішальну роль у приведенні вітчизняного законодавства відповідно до міжнародних стандартів. Встановлено, що ратифікація Європейської конвенції про видачу правопорушників 1957 року, Додаткового протоколу 1975 року, Другого додаткового протоколу 1978 року, Другого додаткового протоколу до Європейської конвенції про взаємну допомогу у кримінальних справах 2001 року та прийняття нового Кримінального процесуального кодексу України 2012 року закріпили міжнародне співробітництво як самостійний інститут у кримінальному процесуальному законодавстві. Зазначено, що належне правове регулювання міжнародного співробітництва з іноземними державами у кримінальному процесі, впровадження міжнародних норм у вітчизняне законодавство є тими необхідними умовами, які сприяють утвердженню принципів законності та верховенства права, додержанню прав та законних інтересів людини і громадянина, допомагають у боротьбі зі злочинністю, а головне – слугують досягненню завдань кримінального провадження.

Zaiats O. S. Substantiation of the funda­mental principles of the lawyer - fairness and responsibility. - Article. The article is devoted to substantiation of the fundamental principles of justice and responsibility within the framework of philosophical and legal discourse. It 14 was found that among the derivatives of the axiological principles of human rights advocacy, it is necessary to single out the idea of justice in the administration of justice. Thus, it is proved that, like humanism, justice is a moral and legal category. However, it is stated that although the idea of justice permeates the entire criminal process, influencing the qualitative nature not only of the decisions made, but also the choice of ways to achieve them, still today it remains, to a greater extent, a declarative principle. It is noted that the uniqueness of social status, legal consciousness and the specifics of the activities directly affect the formation of a lawyer's specific sense of justice, which, a priori, has an equivalent effect on his professional characteristics. Therefore, in view of this, one of the conditions for the successful activity of a lawyer, both in professional and human rights, and in the representative areas is the acquisition of a high political culture. Thus, it is the level of political culture of the lawyer that influences his understanding of personal responsibility for the formation and establishment in society of such a principle as justice. This principle is directly related to another axiological principle of the lawyer's activity, namely responsibility, as compliance of the lawyer's behavior with social and normative requirements, his professional duty, subordination of his behavior to social control, etc. Thus, it is reflected in the text of the article that the responsibility of a lawyer is a kind of social and legal responsibility. Therefore, it is argued that given the specifics of the institution of professional responsibility of a lawyer should think about its further development, prospects and problems, which in the current rules of legal ethics are not set out sufficiently and not systematically. It is suggested that in order to start the process of amending this code, it is still necessary to find out whether the current legal community is satisfied with the situation that has arisen around bringing lawyers to professional respon­sibility? Стаття присвячена обґрунтуванню основополож­них в адвокатській діяльності принципів справедли­вості й відповідальності в межах філософсько-право­вого дискурсу. З'ясовано, що з-поміж похідних від аксіологічних принципів правозахисної діяльності адвоката необхідно виокремити передусім ідею спра­ведливості в здійсненні правосуддя. Отже, доведено, що, як і гуманізм, справедливість є морально-юридич­ною категорією. Утім, констатується, що, хоча ідея справедливості й пронизує весь кримінальний процес, впливаючи на якісний характер не лише прийнятих рішень, а й вибору способів їх досягнення, все ж нате­пер вона залишається більшою мірою декларативним принципом. Відзначено, що своєрідність соціального статусу, правової свідомості й специфіки виконуваної діяльності безпосередньо впливають на формування в адвоката особливого відчуття справедливості, що апріорі еквівалентно впливає на його професійні осо­бливості. Тому з огляду на це однією з умов успішної діяльності адвоката, як у професійно-правозахисно- му, так і в представницькому напрямах є набуття ним високої політичної культури. Отже, саме рівень полі­тичної культури адвоката впливає на розуміння ним особистої відповідальності за формування та утвер­дження в суспільстві такого принципу, як справедли­вість. Цей принцип безпосередньо пов'язаний із ще одним аксіологічним принципом діяльності адвоката, а саме з відповідальністю як відповідністю поведінки адвоката соціально-нормативним вимогам, його профе­сійному обов'язку, підпорядкованістю його поведінки соціальному контролю та інше. Таким чином, в тексті статті зображено, що відповідальність адвоката є різ­новидом суспільно-правової відповідальності. Отже, стверджується, що, зважаючи на специфіку інститу­ту професійної відповідальності адвоката, слід заду­матися про його подальший розвиток, перспективи й проблеми, які в чинних правилах адвокатської етики викладені не достатньою мірою та не системно. За­пропоновано для початку процесу внесення змін у цей кодекс все ж таки з'ясувати, чи влаштовує сучасну адвокатську спільноту ситуація, що виникла навколо притягнення адвокатів до професійної відповідально­сті? Вочевидь ні. Що й зумовлює актуальність проведе­ного дослідження.

Theconvicted person acquires the procedural status at thestage of cassation proceedings. From that moment, theperson has a set of procedural rights and responsibilities,including the right to apply for a forensic psychiatricexamination. This right can be exercised by the convictthrough a defense counsel and, accordingly, this rightgives rise to the obligation of the court to consider theissue of determining the state of mental health of such aconvict. Since one aspect of the purpose of punishment isthe correction of a convict, it is certainly not appropriateto apply punishment to convicts who are unaware of thesignificance of their actions and are socially dangerousdue to mental illness for other convicts or for themselves.In this case, it is usually necessary to apply to suchperson's coercive measures of a medical nature, providedby criminal law. However, the procedure for imposingsuch measures requires consideration of the issue ofsanity in court. Оскільки одним з аспектів метипокарання є виправлення засудженого, то, звичайно,немає доцільності застосовувати покарання до засу-джених, котрі не усвідомлюють значення своїх діяньі є суспільно небезпечними через психічну хворобудля інших засуджених чи для самих себе. The global COVID-19 pandemic has clearly demonstrated all the «pain points» of countries, regardless of the type of government and the degree of socio-economic development. It is determined that the economies of most countries have already entered a deep recession, growing public debt. There are no prospects for the expected growth in the coming years, which has already emerged since the global financial crisis of 2008, but currently the progress of the last decade to overcome the financial crisis is offset, due to events related to COVID-19 and its global consequences in the socio-political sphere of any state. Countries and regions are developing new social policy strategies, tactics and strategies for further development that are adaptable to the demands of the times, for example, at the EU level the need for even a new «Marshall Plan» has been voiced. Equally important is the issue of human mental health, the deterioration of which is associated with social isolation, distancing, and sometimes with job loss, which, of course, has a destructive effect on people and requires increased attention of state institutions to these important issues. A new wave of populism is expected, caused by the rise of economic inequality against the background of the effects of the pandemic, which is clearly demonstrated by most countries. There is every reason to believe that the global pandemic COVID-19 has become a determining factor in socio-political life and social interactions. Thus, it can be argued that the global pandemic COVID-19 has opened «windows of opportunity» in the global political space, in which the state, depending on the level of democracy, sociality and lawmaking, make certain decisions to restrict certain rights of the population. and negative consequences. Thus, the «windows of opportunity» during the global pandemic opened all the «Achilles' heel» states, demonstrating their capabilities / inability to find adequate events-responses to the complex challenges of the world, which depended on the development of the country as a whole, its important civic attribute. society, the vector of direction of public policy, tools for exercising control over power, the focus on identifying priorities and the ability of states to overestimate their citizens from these challenges. ; Глобальна пандемія COVID-19 наочно продемонструвала усі «больові точки» країн, незважаючи на тип державного устрою та ступень соціально-економічного розвитку. Визначено, що економіки більшості країн уже увійшли в глибоку рецесію, зростають показники державного боргу. Відсутні перспективи очікуваного зростання на найближчі роки, яке вже намітилося після глобальної фінансової кризи 2008 року, але у теперішний час прогрес останнього десятиліття для виходу з фінансової кризи є знівельований, у зв'язку з подіями, пов'язаними з COVID-19 та його глобальними наслідками у соціально-політичній сфері будь-якої держави. Країни та регіони розробляють нові стратегії соціальної політики, тактики та стратегії подальшого розвитку, адаптивні до вимог часу, наприклад, на рівні ЄС було озвучено потребу навіть нового «Плану Маршалла». Не менш важливим є і питання стану психічного здоров'я людини, погіршення якого пов'язане з соціальною ізоляцією, дистанціюванням, а порою і з втратою робочого місця, що, безумовно, деструктивно впливає на людину і потребує посилення уваги державних інституцій до цих важливих питань. Очікуваною є нова хвиля популізму, породжена піднесенням економічної нерівності на тлі наслідків пандемії, що наочно і продемонструвала більшість країн світу. Є всі підстави вважати, що глобальна пандемія COVID-19 стала визначальним чинником суспільно-політичного життя та соціальних взаємодій. Отже, можна стверджувати, що глобальна пандемія COVID-19 відкрила «вікна можливостей» у світовому політичному просторі, в якому державі в залежності від рівня розвитку демократії, соціальності та правотворчості приймають ті чи інші рішення щодо обмеження певних прав населення, що має як позитивні, так і негативні наслідки. Отже, «вікна можливостей» у період глобальної пандемії розкрили всі «Ахіллесові п'яти» держав, продемонструвавши їх можливості / неможливості знайти адекватні події–відповіді на складні виклики часу світового масштабу, що цілком залежало від розвиненості країни в цілому, її важливого атрибуту громадянського суспільства, вектору спрямованості державної політики, інструментів здійснення контролю за владою, спрямованістю визначати завдання першочергового значення і можливістю держав завищити своїх громадян від цих викликів.

The article is devoted to the political and historical analysis of the elections of deputies of the State Duma of the second convocation in 1995. The political context of these elections is assessed as a confrontation between the "party in power" and the anti-reform opposition. To counteract the opposition, the "party in power" created its own political structure to participate in the elections — the movement "Our Home-Russia" (NDR), headed by Prime Minister Viktor Chernomyrdin. An analysis of the process of creating the PDR movement, which took place under the auspices of the Presidential Administration, confirms the use of the administrative resource of the presidential and executive powers in this process. The creation of the NDR movement led to the erosion of the reformist-democratic wing. The weakening of this flank was also facilitated by the fact that the political organizations forming it could not unite. Two leading political organizations with a reformist-democratic orientation — Yegor Gaidar's Democratic Choice of Russia party and Grigory Yavlinsky's Yabloko public association did not create a common electoral bloc, although there were objective prerequisites for this. A significant aspect of the 1995 election campaign was the fact that Russian industry corporations and financial and industrial groups began to show an active interest in the elections of deputies. They began to incorporate lobbyists of their interests into the parliamentary corps. At the elections of deputies of the State Duma of the second convocation in 1995. success accompanied the anti-reform opposition and, above all, the Communist Party of the Russian Federation, failure befell the "party of power" represented by the NDR movement, and the reformist democrats who failed to unite suffered a crushing defeat. The State Duma of the second convocation had a pronounced anti-reform and oppositional character to the incumbent president and the executive branch, but at the same time it was a fairly independent political institution, which retained certain opportunities for competitive legislative activity and the search for compromises in crisis situations. The 1995 elections cannot be assessed as completely fair and free, and, starting with these elections, the bacillus of electoral corruption was introduced into the organism of Russian politics. ; Статья посвящена политико-историческому анализу выборов депутатов Государственной Думы второго созыва в 1995 году. Политический контекст этих выборов оценивается как противостояние «партии власти» и антиреформаторской оппозиции. Для противодействия оппозиции «партия власти» создала для участия в выборах собственную политическую структуру — движение «Наш дом — Россия» (НДР) во главе с председателем правительства Виктором Черномырдиным. Анализ процесса создания движения НДР, который проходил под эгидой Администрации президента, подтверждает использование в этом процессе административного ресурса президентской и исполнительной власти. Создание движения НДР привело к размыванию реформаторско-демократического фланга. Ослаблению этого фланга способствовало и то, что образующие его политические организации не смогли объединиться. Две ведущие политические организации реформаторско-демократической ориентации — партия «Демократический выбор России» Егора Гайдара и общественное объединение «Яблоко» Григория Явлинского не создали общий избирательный блок, хотя для этого были объективные предпосылки. Значимым аспектом предвыборной кампании 1995 года было и то, что к выборам депутатов активный интерес стали проявлять российские отраслевые корпорации и финансово-промышленные группы. Они стали инкорпорировать лоббистов своих интересов в состав депутатского корпуса. На выборах депутатов Государственной Думы второго созыва в 1995 года успех сопутствовал антиреформаторской оппозиции и, прежде всего, КПРФ, неудача постигла «партию власти», представленную движением НДР, и сокрушительное поражение потерпели не сумевшие объединиться демократы-реформаторы. Государственная Дума второго созыва имела выраженный антиреформаторский и оппозиционный действующему президенту и исполнительной власти характер, но при этом представляла собой достаточно самостоятельной политического института, в котором сохранялись определенные возможности для конкурентной законодательной деятельности и поисков компромиссов в кризисных ситуациях. Выборы 1995 года нельзя оценить, как в полной мере честные и свободные, и, начиная именно с этих выборов, в организм российской политики была занесена бацилла электоральной коррупции.

As more and more political systems acquire signs of hybridity, and as the cycle of accountability and decision making for society becomes narrower, processes of de-democratisation emerge in democracies. Also, the result of the connection between processes of democratisation and de-democratisation becomes even more unclear. The analytical construction of post-democracy has appeared in the scientific discourse. In this article, the connection between democratisation and de-democratisation in a post-democratic environment is analysed through the concept of C. Tilly's methodologically presumed analysis of democracy. For the purpose of theoretical statement operationalisation, an analysis of the Ukrainian practice is used. Methods: scientific literature and publication analysis, statistical analysis, case study. Research results: The theorisation of the connection between processes of democratisation and dedemocratisation which was highlighted and updated in C. Tilly's democracy research is an effective analytical tool for the development of democracy. The famous analytical triad formulated by C. Tilly (an increase or decrease in integration between interpersonal networks of trust and public politics; an increase or decrease in the insulation from public politics of the main categorical inequalities; an increase or decrease in the autonomy of major power centres) allows us to reveal the many nuances of democracy. Despite this, Tilly stresses the processes of democratisation and de-democratisation as negating each other, and multiple political hybrids unfold under post-democratic conditions. We respond to Tilly's call for those who want the worldwide establishment of democracy not to waste their time preaching about the benefits of democracy, creating constitutions and NGOs, or even expressing sympathy for undemocratic countries; but instead, to make a significant effort at integrating politics into networks of trust, insulating the main categorical inequalities from public politics, and fighting against autonomous power centres. In a world full of processes of democratisation and de-democratisation, the number of undemocratic political regimes and undemocratic tendencies does not decrease, even in old democracies. Different cases of trust network insulation from politics or the relationship between politics and categorical inequalities, power centres autonomous from the state, still exist. The inclusion of trust networks in public hearings and other public processes is a welcome and necessary ingredient for sustaining democracy, or at least for the beginning of its consolidation. Despite this, the process still does not guarantee democratisation, because fundamental democratic principles, such as government control, equivalence of representation and participation, are not guaranteed by formally democratic institutions themselves. This is partly because democracies cannot significantly reduce social and economic inequality. The inability to limit the growth of social inequality has evolved into mass protest movements. They do not necessarily propose violent conflict, but rather raise doubts about the potential of democracy to solve current problems in people's daily lives. Moreover, it means that the configuration of processes of democratisation and dedemoratisation remains a complex issue. The latter significantly complements autonomous power centres, which occurs both in a globalised, post-democratic world and in free and partly free countries. They have the potential to continue to get stronger and limit state power and authority even more. A partial analysis of recent processes in Ukraine using C. Tilly's concept of the connection between democratisation and de-democratisation showed that democratisation and de-democratisation in this country take place in parallel, they coexist, and do not contradict each other in principle. More detailed research and comparative studies are needed in order to find out whether it is a random situation, or a universal current situation. The study conducted of processes of democratisation and de-democratisation shows that it is meaningful to continue research not only into the radical opposition of these processes, but also their parallel opposition, when they do not contradict each other, but rather hybridise; and also to test the assumption of simultaneous, one-directional processes of democratisation and de-democratisation.

In France as in other European countries, access to education for immigrants beyond compulsory schooling is selectively achieved, through a triage implemented by education administrations. Support organizations are increasingly solicited on this matter. Considering the twofold policy role of non-profits which both act as advocates and providers, this paper sheds light on the reciprocal relationship between the way activists manage enrollment in education and the way this issue is framed in the public sphere. Indeed, militants play a gatekeeping role and can discretely negotiate the access to school at the margins of the official institution. Nevertheless, because this struggle for education is individualized and silent, this issue is not likely to become a public and visible cause, around which a political reaction from public authorities could be claimed. Hence, while they largely counteract the infringement of the right to education, the actions of activists paradoxically participate in making it socially acceptable. That is why, beyond the case of immigrant education, the analysis eventually provides an empirical understanding of the social conditions of the construction of education public problems. ; En Francia, como en otros países europeos, el acceso a la educación de los inmigrantes más allá de la escolaridad obligatoria se realiza de forma selectiva, mediante un proceso de selección por parte de las administraciones educativas. Las organizaciones de apoyo son cada vez más solicitadas en esta materia. Teniendo en cuenta el doble papel de las organizaciones sin ánimo de lucro, que actúan a la vez como defensoras y proveedoras de la acción pública, este trabajo arroja luz sobre la relación recíproca entre la forma en que los militantes gestionan la matriculación en la enseñanza superior y la forma en que esta cuestión se enmarca en la esfera pública. En efecto, los militantes desempeñan un papel de guardianes y pueden negociar discretamente el acceso a la escuela en los márgenes de la institución oficial. Sin embargo, como esta lucha por la educación es individualizada y silenciosa, no es probable que esta cuestión se convierta en una causa pública y visible, en torno a la cual se pueda reclamar una reacción política de los poderes públicos. De ahí que, si bien contrarrestan en gran medida la vulneración del derecho a la educación, las acciones de los activistas participan paradójicamente en hacerla socialmente aceptable. Por eso, más allá del caso de la educación de los inmigrantes, el análisis acaba por aportar una comprensión empírica de las condiciones sociales de la construcción de los problemas públicos de la educación. ; Em França como noutros países europeus, o acesso à educação para os imigrantes para além da escolaridade obrigatória é alcançado selectivamente, através de um processo de selecção pelas administrações educativas. Considerando o duplo papel das organizações sem fins lucrativos que actuam como defensores e prestadores de serviços em relação à acção pública, este documento lança luz sobre a relação recíproca entre a forma como os activistas gerem a matrícula no ensino superior e a forma como esta questão é enquadrada na esfera pública. De facto, os militantes desempenham um papel de guardiões e podem negociar discretamente o acesso à escola à margem da instituição oficial. No entanto, como esta luta pela educação é individualizada e silenciosa, não é provável que esta questão se torne uma causa pública e visível, em torno da qual uma reacção política das autoridades públicas possa ser reivindicada. Assim, embora contrariem em grande medida a violação do direito à educação, as acções dos activistas participam paradoxalmente para a tornar socialmente aceitável. É por isso que, para além do caso da educação dos imigrantes, a análise acaba por proporcionar uma compreensão empírica das condições sociais da construção dos problemas públicos da educação.

The purpose of the article is to identify the features of national and regional party influence, the specifics of political and ideological fragmentation of the regions of Ukraine. This goal can be achieved by solving the following tasks: to analyze the motivation of voters to participate in elections; to study the results obtained by local and national parties; assess changes to the Electoral Code. The hypothesis of the article is that significant changes are planned in the political and party space of Ukraine, namely, some parties that have the status of national, are gradually leaving the political life of the country. They are still claimed by regional parties, which have shown convincing results in the 2020 local elections and have ambitions to become parliamentary parties. Ukrainians were indifferent to this election campaign, which resulted in an extremely low turnout. The reason is that in Ukraine people are less and less involved in elections due to the high level of distrust in politics and state institutions. Unlike people in democracies, they believe that their lives will not change for the better. The article, based on the analysis of the results of the 2020 local elections in Ukraine, concludes that the local political elites have been strengthened, and the role of regional parties claiming to run for parliament in the upcoming (possibly early) parliamentary elections. It is shown that local political parties have shown a high level of electoral support, which is explained by the impact of the decentralization reform in Ukraine on the regional political process. The ruling Servant of the People party lost the phenomenal advantage it had over the parliamentary parties in the parliamentary elections. The reason is that after the presidential and parliamentary elections, there was a disappointment of voters in the "Servant of the People" party. Just over a year has passed since voters were ready to vote for any candidate from this party. At that time, this party was supported by almost all regions of Ukraine. Ukraine's Electoral Code needs to be further improved to make the electoral process even more understandable, transparent and effective. ; Мета статті – виявити особливості національного і регіонального партійного впливу, специфіку політико-ідеологічної фрагментації регіонів України. Цієї мети можна досягти завдяки вирішенню таких завдань: проаналізувати мотивацію виборців до участі у виборах; дослідити результати, отримані місцевими та загальнонаціональними партіями; оцінити зміни Виборчого кодексу. Гіпотезою статті є те, що в політико-партійному просторі України намічаються істотні зміни, а саме деякі партії, що мають статус національних, поступово йдуть із політичного життя країни. На їхні місця претендують поки ще регіональні партії, які показали переконливі результати на місцевих виборах 2020 р. і мають амбіції стати парламентськими партіями. Українці віднеслися до цієї виборчої кампанії байдуже, що виразилося в надзвичайно низькій явці. Причина у тому, що в Україні люди все менше беруть участь у виборах через високий рівень недовіри до політики і державних інститутів. На відміну від жителів демократичних країн, вони вважають, що їхнє життя не зміниться на краще. У статті на основі аналізу результатів місцевих виборів 2020 року в Україні робиться висновок про зміцнення місцевих політичних еліт, підвищення ролі регіональних партій, що претендують на проходження в парламент на майбутніх (можливо, позачергових) парламентських виборах. Показано, що місцеві політичні партії продемонстрували високий рівень електоральної підтримки, що пояснюється впливом реформи децентралізації влади в Україні на регіональний політичний процес. Правляча партія «Слуга народу» втратила ту феноменальну перевагу перед парламентськими партіями, яку мала на парламентських виборах. Причина у тому, що після президентських і парламентських виборів з'явилося розчарування виборців у партії «Слуга народу». Всього трохи більше року минуло з того моменту, як виборці були готові голосувати за будь-якого кандидата від цієї партії. Тоді цю партію підтримали практично всі регіони України. Виборчий кодекс України потребує подальшого вдосконалення, щоб виборчий процес став ще більш зрозумілим, прозорим і ефективним.

The article considers the essence of civil society and its transformation in the conditions of active development of information technologies. Criteria for the effectiveness of civil society through the functions of the latter are defined. The role of the Internet and social networks and the latest digital technologies in the establishment and development of interaction between state and civil society institutions has been clarified. The principles of the mechanism of interaction between the state and civil society are determined and five levels of such interaction are investigated, namely: the level of complex analysis of the problem, the level of development of the system of measures and draft programs, the level of decision making, the level of joint decision implementation. Evaluation of the effectiveness of interaction between the parties. The features of digital tools used at each level are analyzed. It is substantiated that thanks to the Internet, political processes and governance have acquired a new meaning, which has led to the emergence of new actors in civil society – online communities that promote the formation of "network civil society", which aims to communicate online to address existing social problems. The main characteristics of a networked civil society include openness and spontaneity. It is determined that under the influence of network technologies an open space-space is formed, in which new opportunities for the development of civil society are opened (overcoming alienation, underdeveloped communications, etc.). It has been proven that the transfer of public structures to cyberspace promotes more productive interaction between government and citizens on the basis of "digital democracy", the practical expression of which was the technology "GOV 2.0" or "government 2.0", based on the principle of open government and citizen participation. Solutions at all levels. It is shown that such technology is implemented through the arrival of officials in social networks and the blogosphere, community education, access to existing laws and bills online and other online practices. It has been found that, in addition to traditional technologies, such practices as Network Democracy, Social Bar, Global Voices Online and others have become increasingly popular in recent years. ; У статті розглянуто сутність громадянського суспільства та його трансформацію в умовах активного розвитку інформаційних технологій. Визначено критерії ефективності громадянського суспільства через функції останнього. З'ясовано роль мережі Інтернет та соціальних мереж і новітніх цифрових технологій в налагодженні та розвитку взаємодії інститутів держави та громадянського суспільства. Визначено принципи механізму взаємодії держави та громадянського суспільства та досліджено п'ять рівнів такої взаємодії, а саме: рівень комплексного аналізу проблеми, рівень розробки системи заходів і проектів програм, рівень прийняття рішень, рівень реалізації спільно прийнятого рішення та рівень контролю і перевірки виконання рішення, оцінки ефективності взаємодії сторін. Проаналізовано особливості цифрових інструментів, що використовуються на кожному рівні. Обґрунтовано, що завдяки мережі Інтернет політичні процеси і управління набули нового змісту і зумовило появу нових суб'єктів громадянського суспільства – мережевих спільнот, які сприяють формуванню «мережевого громадянського суспільства», метою якого є спілкування в режимі он-лайн для вирішення існуючих соціальних проблем. До головних характеристик мережевого громадянського суспільства віднесені відкритість і спонтанність. Визначено, що під впливом мережевих технологій формується open space-простір, в якому відкриваються нові можливості для розвитку громадянського суспільства (подолання відчуженості, нерозвиненості комунікацій та ін.). Доведено, що перенесення громадських структур у віртуальний простір сприяє більш продуктивній взаємодії органів влади та громадян на основі «цифрової демократії», практичним вираженням якої стала технологія «GOV 2.0» або «уряд 2.0», яка ґрунтується на принципі відкритості влади та участі громадян в прийнятті рішень на всіх рівнях. Показано, що ця технологія реалізується через прихід чиновників в соціальні мережі і блогосферу, просвіту спільнот, доступ до чинних законів та законопроектів в режимі он-лайн та інші практики. З'ясовано, що в останні роки все більшої популярності набувають такі практики, як Network Democracy («мережева демократія»), Social Bar, Global Voices Online та інші.
