Justice Scalia has described an originalist approach to interpretation as a prerequisite to faithful application of a written Constitution. If, says he, constitutional judicial review is implicit in the notion that the Constitution is paramount law, as has been settled in this country at least since Marbury v. Madison, then that review must be guided by the ordinary tools of legislative interpretation. In a democracy, serious legislative interpretation requires that judges keep faith with the meaning of the text as understood at the time of enactment, not as desired by those judges or by anyone else who does not, in the relevant way, represent the will of the People. To pledge allegiance to the understandings or the will of contemporary majorities – or, worse, of contemporary judges – is to subvert the aim of higher lawmaking. "The purpose of constitutional guarantees," Justice Scalia has written, "is precisely to prevent the law from reflecting certain changes in original values that the society adopting the Constitution thinks fundamentally undesirable.

The main objective of this research article is to analyze the effectiveness of the regulations and jurisprudence for the protection of the minimum subsistence of elderly people in the department of Risaralda during the period 2016-2018. Aging is a natural human process in which there is a deterioration of psychomotor and inter-subjective capacities that, in terms of quality of life and dignity, generates a condition of vulnerability and therefore an urgency for care and attention. This reality makes it necessary to demonstrate the fulfillment of objectives by the Colombian State in relation to this challenge. Insofar as it is the guarantor of the rights related to the protection and inclusion of the elderly as a special group in a society that defines itself according to the principles of the social rule of law and redistributive justice, the State must strive to guarantee the minimum level of subsistence requirements of this population. Objective: to determine the level of protection of the minimum subsistence of elderly people as subjects of special constitutional protection in relation to public policy for aging and older adults attached to public institutional care centers in the department of Risaralda. Methodology: the selected approach was socio-legal with a mixed method. The data collection techniques and instruments were applied based on the analysis and review of documentary sources of the standard and jurisprudence. The initial categories proposed are "minimum subsistence," "fundamental rights" and "social justice." Results: it was evidenced throughout the methodological application that, although in the legislation there is a whole regulation of norms in protection of the minimum subsistence and the rights of said population, it is not evident how well they are cared for, since the different statistics show that the best protected older adults, with a good quality of life are those who are part of private homes. Tax shelters and aggressive planning derive in part from a structural imbalance in our tax system that has not been adequately explored: In important respects, the private tax bar outmatches their counterparts in government. Although a strong policy case can be made for remedying this mismatch, this Article emphasizes two institutional barriers that complicate any solution, rooted in the political economy of taxation and the economics and professional norms of the legal profession. First, although it would be enormously helpful to dramatically increase the staffing levels and pay of government tax administrators, this is a politically daunting task. Second, a fallback strategy is to look to the private bar for help, but they face a significant conflict. Both market pressure and professional norms motivate them to serve their clients, who generally do not have an interest in improving government tax enforcement. In light of these two challenges, what can be done to mitigate the mismatch between the government and private bar? This Article offers two sets of proposals. First, a number of suggestions focus on the government, offering ways to improve recruiting and reinforce the expertise at their disposal without dramatically increasing funding or raising pay substantially across the board. For example, the government should focus on recruiting senior lawyers out of retirement (whose financial demands will be limited) and having them mentor junior lawyers directly from law school (whose private sector pay is high, but not nearly as high as it will become in later years). The government should also consider a loan forgiveness program for these recent graduates, and should also enlist academics to assist with discrete projects. The government should also retain private law firms to litigate tax controversies with extraordinary precedential value. Second, this Article offers guidance about the right way (and the wrong way) to tap the expertise and information possessed by the private bar. It is more effective, whenever possible, to ask lawyers to help the government in a way that also helps their clients. Using this principle, this Article identifies promising opportunities that have been overlooked, and critiques unpromising initiatives that have attracted significant government support. For example, clients do not want their own tax deals shut down, but they feel differently about their competitor's deals, so the government should make more systematic use of this opportunity. Likewise, although clients are less motivated to help the government identify bad transactions that are inadvertently permitted, they are highly motivated to identify good transactions that are inadvertently prohibited. As a result, the government can look to the private bar for help in narrowing overbroad anti-abuse measures. On the other hand, in asking tax advisors to disclose their clients' aggressive transactions – in effect, to "rat" on their clients – the government is asking for something that clearly is not in the clients' interest. This reality is likely to undercut this initiative, which has been one of the centerpieces of the government's efforts to date.

У результаті дослідження одержано низку наукових положень, які мають важливе значення для практики застосування кримінального закону. Проаналізувавши наукові роботи щодо розглядуваного питання, було доведено, що дослідження принципу рівності є актуальним з огляду викривлене розумінням розглядуваного принципу в Україні. У статті доведено тези про роль принципу рівності перед кримінальним законом під час кримінально-правової кваліфікації. Їх можна описати такими положеннями: 1) дотримання правил кримінально-правової кваліфікації діяння та застосовувати їх щодо осіб, незалежно від їх расового, національного, соціального походження, релігійної приналежності, суспільних або політичних поглядів, професійного статусу тощо; 2) разом з тим, правозастосовним органам під час кримінально-правової кваліфікації необхідно враховувати як об'єктивні, правові відмінності осіб, діяння яких кваліфікується, так й індивідуальні ознаки самого діяння. Таке врахування об'єктивних відмінностей вимагає диференційована рівність. Порушенням принципу рівності перед кримінальним законом будуть помилки або зловживання правозастосовних органів. Такі помилки або зловживання бувають двох видів: 1) різна кримінально-правова кваліфікація діяння у випадку подібних юридичних ситуацій; 2) однакова кримінально-правова кваліфікація діяння у випадку різних юридичних ситуацій; 3) ігнорування ознак, які мають правове значення для кваліфікації. Ці помилки або зловживання можуть вважатися порушенням принципу рівності перед кримінальним законом лише тоді, коли вони дискримінують окремі категорії суб'єктів за певними ознаками. Тому, не будь-які помилки або зловживання у кваліфікації можуть вважатися порушенням принципу рівності перед кримінальним законом, а лише дискримінуючі. Такі помилки мають ненавмисний характер. Проанализировав научные работы по рассматриваемому вопросу, было доказано, что исследование принципа равенства является актуальным, учитывая искаженное понимание рассматриваемого принципа в Украине. В статье доказано тезисы о роли принципа равенства перед уголовным законом при уголовно-правовой квалификации. Их можно описать следующими положениями: 1) соблюдение правил уголовно-правовой квалификации деяния и применять их в отношении лиц, независимо от их расового, национального, социального происхождения, религиозной принадлежности, общественных или политических взглядов, профессионального статуса и т.д.; 2) вместе с тем, правоприменительным органам при уголовно-правовой квалификации необходимо учитывать как объективные, правовые различия лиц, действия которых квалифицируется, так и индивидуальные признаки самого деяния. Такое учета объективных различий требует дифференцированная равенство. Нарушением принципа равенства перед уголовным законом будут ошибки или злоупотребления правоприменительных органов. Такие ошибки или злоупотребления бывают двух видов: 1) разная уголовно-правовая квалификация деяния в случае подобных юридических ситуаций; 2) одинаковая уголовно-правовая квалификация деяния в случае различных юридических ситуаций; 3) игнорирование признаков, имеющих правовое значение для квалификации. Зато, злоупотребление всегда является умышленным, часто обусловлено неправовыми материальными факторами ; In the article under consideration, the author proves facts in a number of scientific provisions that are important for the practice of criminal law. After analyzing the scientific works on this issue, it was proved, that the study of the principle of equality is relevant given the distorted understanding of the principle in Ukraine. The article proves the thesis about the role of the principle of equality before the criminal law during the crime qualification. They can be described by the following provisions: 1) compliance with the rules of criminal law qualification of the act and application them to persons regardless of their racial, national, social origin, religion, social or political views, professional status, etc .; 2) at the same time, law enforcement bodies during the criminal-legal qualification must take into account both the objective, legal differences of the persons, whose action is qualified, and the individual characteristics of the act itself. Such consideration of objective differences requires «differentia equality». Violations of the principle of equality before the criminal law will be errors or abuses of law enforcement agencies. Such errors or abuses are of two types: 1) different criminal-legal qualification of the act in the case of similar legal situations; 2) the same criminal-legal qualification of the act in the case of different legal situations; 3) ignoring the features that have legal significance for the qualification. These errors or abuses can be considered a violation of the principle of equality before the criminal law only if they discriminate against certain categories of subjects on certain grounds. Therefore, not any errors or abuses in qualifications can be considered a violation of the principle of equality before the criminal law, but only discriminatory. Such errors are unintentional. Instead, abuse is always intentional, often due to non-legal material factors

What is the meaning of sentences of the form 'X is the lawful government of the country Y,' and what kinds of statements are normally -made by using them? Most answers to these questions can be classified as legalistic, moralistic, or compromise solutions. The gist of the legalistic approach is that the lawful government is that authorized by the positive law of the land. Critics of the legalistic approach point out that disagreement about the lawful government is not always solved when agreement is reached about the positive law of the land. For example, two people may disagree as to whether the Colonels' Government is the lawful government of Greece, while being in complete agreement that the post-coup law is the positive law of Greece. From this fact, which indeed should be admitted and explained by any theory on the subject, the moralists conclude that the lawfulness of a government is a matter of morality and not of law. It is determined by moral rules, by personal commitments, etc. Those who favor a compromise solution claim that in certain contexts sentences about lawful governments are used to make legal statements, while in other contexts they are used to make moral statements or express moral positions or attitudes. In this paper I will first criticize one moralistic solution, that presented by R. M. Hare, and one compromise solution, the one put forward by J. G. Murphy, and then proceed to formulate and defend a variant of a legalistic position.

Abstract: "Although the United States has relied on the ICJ's doctrine of specially-affected states to claim that it and other powerful states in the Global North play a privileged role in the formation of customary international law, the doctrine itself has never been systematically developed by the ICJ or by legal scholars. This article fills that lacuna by addressing two questions: (1) what makes a state "specially affected"?; and (2) what is the importance of a state qualifying as "specially affected" for the formation of custom? It concludes that a theoretically coherent understanding of the doctrine would give states in the Global South significant power over custom formation." (Seite 191)
