The Regional Autonomy Act 1999 started to give local government authority to regulate onhealth. This to be observed such as the implementation over local government's authority toregulate over health's issue and it's positive implications as the result. This research shows thatimplementation of Yogyakarta City government's authority to regulate over health's area have gone well since many healthcare's policies had been produced in accordance to society's needs and capabilities. Moreover, those regulations has significantly improved the healthcare's quality becausethe numbers of licensed health facilities and paramedics increased. Undang-Undang Nomor 22 Tahun 1999 memberikan kewenangan mengatur tentang kesehatan kepadapemerintah daerah sehingga menimbulkan dua hal yang perlu diteliti, yakni tentang pelaksanaan kewenangan mengatur pemerintah di bidang kesehatan dan implikasi positif dari peraturan yang dikeluarkan tersebut khususnya di Kota Yogyakarta. Hasil penelitian menyatakan bahwa: Pertama,pelaksanaan wewenang mengatur Pemerintah Kota Yogyakarta telah berjalan baik dengan dibentuknya kebijakan-kebijakan di bidang pelayanan kesehatan sesuai kebutuhan dan kemampuan daerah. Kedua, pengaturan mengenai pelayanan kesehatan di Kota Yogyakarta memiliki dampak signifikan bagipeningkatan pelayanan kesehatan, yang ditunjukan dengan peningkatan jumlah sarana dan tenaga kesehatan berizin pasca dikeluarkannya Peraturan Daerah oleh Dinas Kesehatan Kota Yogyakarta.

Nonetheless, there is a lack of clarity about how this intervention would occur. The private nature of migrant workers' remittances leads to the question of constitutional justification essential for the government's authority to intervene – particularly in Indonesia as a constitutional state in the form of a welfare state – besides skepticism concerning the applicability of the norm. This paper emphasizes the constitutional silence with regard to state intervention in human resources allocation, as it makes the deployment of Indonesian workers abroad constitutionally groundless. Consequently, the discretion infiltrates the remittance, a component of national income that is essentially a private transfer in which the management should be fully controlled by the families. Through review of the scientific literature and legal document analysis, this research found that the inclusion of a state intervention provision on human resources into the 1945 Constitution is still required. Whereas the importants of transpolitan itself could accelerate the development in Indonesia. In order to to accelerate the national development, the urgency of transpolitan regulation is needed where the transpolitan play a huge role in it. The normative research type are used in this research. It showed that the government had directed every type of Transmigration in each stage to Transpolitan. Apart from that, Transpolitan transmigration also has its challenges given the inadequate legal structure in Indonesia, so it requires regulations on Transpolitan. It is argued that the application of Transpolitan can significantly accelerate development in Indonesia through the development of science and technology-based transmigration areas. To distribute social aids during a time of a pandemic, red tapes or unnecessary bureaucratic layers needs to be eliminated because the situations demand flexibility. In fact, during the Covid-19 the Indonesian government struggled to hand the staple needs help due to various problems with the existing social aid system. The purpose of this study is to analyze the social and legal factors that create a red tape that hindered the implementations of distributions. This research uses a qualitative approach with data collection techniques of literature and statutory analysis. The result of this study shows that there is an interplay factor between administrative law on social policies and the bureau pathology(Bureaucratic disease) that infects the bureaucratic system of the Ministry of Social Affairs especially in the aspects of managerial, human resources, and tendencies to conduct unlawful actions aspects. The format of the law has proven to be ineffective to be used in a pandemic setting. Furthermore, there are tendencies of upholding the tight legal mechanism to share the responsibilities in between bottom-up government units which had created ineffective within the systems in times of a pandemic. Nevertheless, it shows that the law has already matured in governing the bureaucratic nature in the Ministry of Social Affairs.

The Regional Budget Implementation Accountability (PPAPBD) mechanism is a part of the regional financing management process applicable subsequent to the formulation of draft APBD, approval ofthe draft APBD by the Regional House of Representatives, validation by the Central Government,enactment of draft APBD to be APBD, and implementation of APBD. In a normative manner, the PPAPBDmechanism is a series of supervisory procedures performed by budget-supervisory institutions, amongothers include the Board of Financial Audit (BPK), the Ministry for Domestic Affairs, and the RegionalHouse of Representatives. Within the field of administrative law, the PPAPBD mechanism is a form of administrative supervision performed in order to establish good governance in accordance with the General Principles of Good Governance (AUPB). The enactment of Act Nr. 28 of 2009 on Local Taxes and Local Levies would allegedly pose some juridical impact on local tax collection at the provincial and district/cities throughout Indonesia. The juridical impact would at least occur to local regulations governing local taxes, Regional Government Revenue and Expenditure (APBD), and the oversight of local regulation by the provincial and district/ city governments. This research is a normative-empirical research, which aims to analyse changes of local taxes law in Act Nr. 28 of 2009. This study offers an insight of the impact of this Act on local tax collection in the special province of Yogyakarta. Pemberlakuan UU No. 28 Tahun 2009 tentang Pajak Daerah dan Retribusi Daerah disinyalir akan menimbulkan beberapa dampak yuridis terhadap pemungutan pajak daerah di tingkat provinsi dan kabupaten/kota di seluruh Indonesia. Dampak yuridis tersebut setidaknya terjadi terhadap produk hukum daerah yang mengatur tentang pajak daerah, Anggaran Pendapatan dan Belanja Daerah (APBD), dan pengawasan produk hukum daerah oleh pemerintah provinsi dan pemerintah kabupaten/kota. Penelitian ini merupakan penelitian normatif-empiris, yang bertujuan menganalisis perubahan pengaturan tentang pajak daerah dalam UU No. 28 Tahun 2009, sehingga melalui penelitian ini terlihat dampak yuridis penegakan UU ini pada pengumpulan pajak lokal di Provinsi DIY.

This study will discuss the implementation of General Principles of Good Governance (AUPB) in the One Stop Licensing System in the city of Yogyakarta. Some things that would be an important consideration in this study were changes to Local Government Law No. 22 of 1999 as Law No. 32 of 2004 and its consequence, the issuance of Government Regulation No. 84 of 2000 governing the organization's guidelines in the area of technical authority in issuing permits and Ministerial Decree No. PAN 63/KEP/M.PAN/7/2003 On Implementation Guidelines for Public Service and Administrative Reform Decree No. 26/KEP/M.PAN/2/2004 About Help Technical Transparency and Accountability. Penelitian ini akan membahas penerapan Asas Umum Pemerintahan yang Baik (AUPB) dalam Sistem Perijinan Satu Pintu di Kota Yogyakarta. Beberapa hal yang akan menjadi pertimbangan penting dalam penelitian ini adalah Perubahan UU Otonomi Daerah Nomor 22 Tahun 1999 menjadi UU Nomor 32 Tahun 2004 beserta konsekuensinya. Deregulation made by Government Regulation No. 40 of 1995 has intensified the competition in the aviation industry. As time passes by, many airlines implement the Low-Cost Carrier (LCC) concept. The negative effect of these LCC is that aviation companies compete to lower their prices, thus neglecting the safety factor. This research method employed in this research is normative research, whereas the material used is secondary data. The result of this research indicates that airplane ticket prices, especially economy class, are regulated in Ministry of Transportation Decree Number KM 106 of 2019 about The Upper Limit Tariff for Passengers in Economy Class Services for Scheduled Domestic Commercial Air Transport. On the other hand, this ministerial decree has not been able to solve the issues that arise in our society. Authors think that airplane ticket price as one of the essential production branches for the country needs to regulated thoroughly in order to achieve the greatest prosperity of the people in accordance with Article 33 of the 1945 Constitution.

AbstractThe preamble of 1945 Constitution have declared Indonesia as a welfare state. Post-amendment of the 1945 Constitution, the rights of Indonesian citizen to welfare is regulated in Article 28 H sections (1), (2), (3), and Article 34 sections (2) and (3), which then is subsequented by Law number 40 of 2004 on National Social Security System, followed by Law number 24 of 2011 on Social Security Agency (BPJS). However, both regulations instead created new problems: the government is monopolizing the business of security insurance, and the existence of double burden to the citizens in paying taxes as an obligation and paying insurance premium as contribution fee to get social security. This study will further elaborate: First, the concept of the welfare state of Indonesia; and Second, the consistency of social security regulations towards the effort to manifestation of Indonesia as a welfare state.IntisariPembukaan UUD NRI Tahun 1945 telah mendeklarasikan Indonesia sebagai negara kesejahteraan (welfare state). Namun kedua pengaturan tersebut justru menimbulkan permasalahan baru: pemerintah membuat monopoli dalam bisnis asuransi jaminan, dan ada beban ganda bagi warga negara dalam membayar pajak sebagai kewajiban membayar premi asuransi sebagai kontribusi untuk mendapatkan pertanggungan dari jaminan sosial. Penelitian ini akan mengkaji: Pertama, bagaimana konsepsi negara kesejahteraan Indonesia; dan Kedua, bagaimana konsistensi pengaturan jaminan sosial terhadap upaya mewujudkan konsepsi negara kesejahteraan Indonesia.

Oil and Gas is natural resources in Indonesia which is the business related to is regulated in Law Number 22 of 2001 about Oil and Gas. There are two kinds of business related to oil and gas that are upstream and downstream. In upstream oil and gas business, there still a lot problem faced by the government and the enterprises. Thus, it is needed simplification license for upstream oil and gas in order to increase investment which will lead into effective and efficient public services. Normative law here is applied as method to analyze the regulations related to oil and gas industry license. Furthermore, the approach used here are statute approach and conceptual approach. The results reveal that the Licensing for Utilization of Resources and/or Infrastructure of Upstream Oil and Gas Business does not yet have a synchronization of authority in the issuance of these licenses. In order to obtain effective and efficient upstream oil and gas business licensing services, it is necessary to synchronize and harmonize regulations and it is need a one-stop licensing service as referred to the Presidential Regulation Number 97 of 2014 concerning Implementation of One Stop Integrated Services. ; El petróleo y el gas son recursos naturales en Indonesia, cuyo negocio está regulado en la Ley número 22 de 2001 sobre el petróleo y el gas. Hay dos tipos de negocios relacionados con el petróleo y el gas que se encuentran aguas arriba y aguas abajo. En el negocio de petróleo y gas aguas arriba, el gobierno y las empresas aún enfrentan muchos problemas. Por lo tanto, se necesita una licencia de simplificación para el petróleo y el gas aguas arriba con el fin de aumentar la inversión que conducirá a servicios públicos eficaces y eficientes. La ley normativa aquí se aplica como método para analizar las regulaciones relacionadas con la licencia de la industria de petróleo y gas. Además, el enfoque utilizado aquí es el enfoque legal y el enfoque conceptual. Los resultados revelan que la Licencia para la Utilización de Recursos y / o Infraestructura de Upstream Oil and Gas Business aún no tiene una sincronización de autoridad en la emisión de estas licencias. Para obtener servicios de licencias comerciales de petróleo y gas aguas arriba efectivos y eficientes, es necesario sincronizar y armonizar las reglamentaciones y se necesita un servicio de licencias único como se indica en el Reglamento Presidencial Número 97 de 2014 sobre la Implementación de Servicios Integrados One Stop. ; Petróleo e Gás são recursos naturais na Indonésia, aos quais os negócios relacionados estão regulamentados na Lei Número 22 de 2001 sobre Petróleo e Gás. Existem dois tipos de negócios relacionados ao petróleo e gás que estão a montante e a jusante. Nos negócios de petróleo e gás a montante, ainda há muitos problemas enfrentados pelo governo e pelas empresas. Assim, é necessária uma licença de simplificação para o petróleo e gás a montante, a fim de aumentar o investimento que levará a serviços públicos eficazes e eficientes. A lei normativa aqui é aplicada como método para analisar os regulamentos relacionados à licença do setor de petróleo e gás. Além disso, a abordagem usada aqui é a abordagem estatutária e a abordagem conceitual. Os resultados revelam que o Licenciamento para Utilização de Recursos e / ou Infraestrutura dos Negócios de Óleo e Gás Upstream ainda não possui uma sincronização de autoridade na emissão dessas licenças. Para obter serviços de licenciamento de empresas de petróleo e gás a montante eficazes e eficientes, é necessário sincronizar e harmonizar os regulamentos e é necessário um serviço de licenciamento único, conforme referido no Regulamento Presidencial Número 97 de 2014, relativo à Implementação de Serviços Integrados de Uma Parada.
