Die einfachgesetzliche Umsetzung der österreichischen Neutralität
In: Sicherheit und Terrorismus: Rechtsfragen aus universeller und regionaler europäischer Sicht, p. 321-345
Es wird ein Überblick über diejenigen gesetzlichen Regelungen gegeben, die primär dazu geschaffen wurden, um die Verpflichtungen aus der österreichischen Neutralität umsetzen zu können. Es wird gezeigt, dass vor allem in der ersten Zeit nach Annahme des Neutralitätsgesetzes danach getrachtet wurde, eine Grundlage für neutralitätspolitische Maßnahmen zu schaffen. Mit der Wandlung der Vorstellungen über die Rolle und Aufgabe der Neutralität haben sich auch die gesetzlichen Bestimmungen gewandelt. Die heutige Gesetzeslage erlaubt es den politischen Entscheidungsträgern im wesentlich höheren Maße, allerdings unter Beibehaltung der gegenwärtigen verfassungs- und völkerrechtlichen Rahmenbedingungen, den Erwartungen der Staatengemeinschaft auf ein solidarisches Verhalten auch des neutralen Österreich gerecht zu werden.
