Purpose: Ensuring the rule of law, human rights, the principles of constitutionalism and the democratization of society, the factor analysis of legislation remains relevant during the period of transformation of state and public institutions. Methodology: The study of factors is present at the theoretical and applied levels: the subject of the theory of law traditionally captures the laws and trends in the formation of the legislative system, primarily in connection with the factors that determine the boundaries and scope of legal regulation. 50 surveys conducted to investigate the factors of impact on content and dynamic of legislation evolution Result: The analysis of the impact factors of influence on the content, structure, and dynamics of the legislation, which is always conditioned by the development of objective and subjective circumstances, is in the focus of the paper. The study of factors is especially relevant in the period of society's and its legal system transformation in the direction of ensuring the rule of law and human rights. Research puts emphasis on the development of forecasting principles of legislation evolution dynamics. Applications: This research can be used for the universities, teachers, and students. Novelty/Originality: In this research, the model of the factors of impact on content and dynamics of legislation evolution is presented in a comprehensive and complete manner.

Researching the history of the establishment and development of the European integration process, as well as the legal nature of the European Union, we have seen that in the scientific literature there is very little information not only on the use of imperial experience in the integration process, but also on the concept of imperial federalism, which used to be rather popular at the end of ХIX and in the early twentieth century in the European empires. If in the English-language literature one can find a lot of literature on the theory and practice of imperial federalism in Great Britain, similar studies concerning the German and Austro-Hungarian empires practically had not been not carried out. Much more often it is possible to find out books about the German or Austrian federalism, but they generally deal with selected current issues or with the functioning of German or Austria federalism overall. In consideration of the importance of Germany in the European Union's development and functioning, it seems clear that the study of the German experience of integration within the framework of the German Empire under the Constitution of 1871 is long overdue. The purpose of the paper is to provide an overview and to close another gap in the literature on the role of the imperial concept of federalism in the development of modern integration process in Europe.
The modern approaches to the evolution of the concepts of state and state power in a globalizing world is a subject of the paper. State power as the state evolves because of the need to address the systemic problems of society, requiring the development of new quality management resources. State power, like the political system, formulates and implements the collective goals of society or groups existing in it. The authors focus on the use of system-structural, functional methods of analysis of the state and state power, which makes it possible not only to explain state and political changes, but also to predict them. The authors substantiate the relevance of the methodological approaches of prominent economists and sociologists Schumpeter and Hayek to analyze contemporary problems of democracy, when the adaptive capacity of a state is aimed at reducing and reducing its role in the life of modern global society.

The authors show that many different theories and doctrines, various schemes for typologizing the evolutionary forms of the state have been developed over the long history of the existence of legal, philosophical and political sciences. The work content includes the discussion of the difficulties of developing rigorous theories of the evolution of state forms associated with the complexity and ambiguity of particular historical processes of state formation and development.The authors distinguish and consider the evolutionary features of the modern state, justify that the modern state as a historical type possesses a number of features that are not inherent (or inherent only in part) in both the traditional and the proto-modern state, which form its evolutionary features, specificity of functioning and evolutionary transformation. In addition, the article identifies and analyzes four main innovative stages in the political and legal institutionalization of modern political domination: civil state, rule-of-law state, democratic rule-of-law state and social rule-of-law state.

The authors consider the phenomenon of power as one of the most important types of social interaction. The authors show that during this evolution, along with the preservation of universal (essential) characteristics due to the nature and social purpose of the state, there is a modification of those properties and characteristics of state power that have a specific historical character and depend on many factors affecting ways of implementing state power. The article reveals the main types of state power and methods of its implementation. According to the authors, the power is not the result of only violence, the suppression of one person by another, but comes from the very nature of man. The authors reveal the category of "state power" by examining its content, characteristics, elements, subjects, and objects. They examine the ways of expressing political power as a type of domination of the corresponding social group depending on a particular historical type of society. ; Este artículo analiza los problemas fundamentales de la evolución de los enfoques a la categoría legal del poder estatal. Los autores consideran el fenómeno del poder como uno de los tipos más importantes de interacción social. Авторы показывают, что в ходе этой эволюции наряду с сохранением универсальных (существенных) характеристик, обусловленных природой и социальным предназначением государства, происходит модификация тех свойств и характеристик государственной власти, которые имеют специфический исторический характер и зависят от множество факторов, влияющих на способы осуществления государственной власти. В статье раскрыты основные виды государственной власти и методы ее реализации. По мнению авторов, власть не является результатом только насилия, подавления одного человека другим, а исходит из самой природы человека. Авторы раскрывают категорию «государственная власть», изучая ее содержание, характеристики, элементы, предметы и объекты. Они исследуют способы выражения политической власти как тип доминирования соответствующейсоциальной группы в зависимости от определенного исторического типа общества.
