"This book showcases how the People's Republic of China (PRC) has been utilizing the Belt and Road Initiative (BRI) to reshape the global order. Dissecting China's increasingly assertive international behaviour, the book demonstrates how the PRC projects its self-perception onto the international order. The book outlines five aspects of China's international role projection, which the PRC applies selectively, depending on its target audience: (1) The bearer of traditional Chinese culture; (2) The humiliated nation; (3) The socialist state with Chinese characteristics; (4) The developing state and promoter of international development; (5) The authoritarian globalization optimist. Drawing on an in-depth analysis of hundreds of primary BRI documents, the book offers a comprehensive overview of China's most crucial foreign policy agenda item. It demonstrates how, through the BRI, the PRC has introduced mechanisms to the international level, which reflect its domestic policy-making mode. In addition, the PRC has institutionalized the initiative by establishing China-centered BRI networks across a wide range of policy areas. Within those emerging China-centered BRI networks, the PRC systematically increases its international discursive power, for example, by inserting Chinese vocabulary into UN resolutions or by promoting Beijing's approaches vis-à-vis "the rule of law" across a range of developing states. International cooperation in the health sector has been a firm component of China's Belt and Road Initiative (BRI) for over five years. Since the outbreak of the Covid-19 pandemic, the Chinese leadership has been promoting this aspect of the initiative ("health silk road") as essential to building a "global community of common destiny". The pandemic has revealed the strengths of the BRI and the way it functions. China's health diplomacy is farsighted and strategic. Beijing has been linking measures to combat the Covid-19 pandemic in aid recipient countries with the prospect of post-pandemic cooperation within the BRI framework. Above all, Beijing wants to be perceived internationally as a "responsible great power". The West's often narrow focus on the qualitative defects of Chinese aid fails to recognise that, in the absence of traditional aid donors, Beijing has supported many third countries effectively and extensively. To counter China's increasing influence in regions that are strategically important for Germany and Europe, greater sensitivity is needed to the geopolitical implications of the pandemic, as well as specific European proposals for third countries for the post-pandemic period. In parallel with more commitment at the multilateral level (for instance within the World Health Organisation, WHO), other options include strengthening bilateral initiatives (e.g. via regional EU+x formats) and coordination with the new US government under Joe Biden.

Mit dem ersten 'Fünfjahresplan über den Aufbau von Rechtsstaatlichkeit (2020-2025)' konkretisiert Chinas Führung ihre Vision eines kohärenten, genuin chinesischen Rechtssystems. Im Mittelpunkt steht dabei der Begriff 'sozialistische Rechtsstaatlichkeit chinesischer Prägung'. Bis 2035 soll sie im Wesentlichen etabliert sein. Marxistisch-leninistische Rechtskonzepte bleiben fundamental. Durch das Recht als Instrument soll der Staat effizienter werden. Willkür bei der Rechtsfindung soll für den Großteil der Bevölkerung reduziert werden, unter anderem mit Hilfe von Hochtechnologie. In ausgewählten Teilbereichen, zum Beispiel bei prozessualen Fragen, lässt sich Beijing für den Aufbau der chinesischen 'Rechtsstaatlichkeit' vom Westen inspirieren. Eine unabhängige Justiz und das Prinzip der Gewaltenteilung aber lehnt die Parteistaatsführung weiterhin strikt als 'fehlerhafte westliche Gedanken' ab. Beijing geht es explizit darum, auch international für Chinas Rechtsvorstellungen zu werben, Standards zu etablieren und Interessen mittels des Rechts durchzusetzen. Daher sollten Berlin und Brüssel ihr besonderes Augenmerk auf chinesische Rechtsvorstellungen richten. Vertiefte Kenntnisse darüber sind zwingend notwendig, um die strategischen Implikationen von Chinas Rechtspolitik zu erfassen, die Handlungslogik besser zu verstehen und adäquat darauf zu reagieren

Internationale Kooperation im Gesundheitssektor ist seit über fünf Jahren ein fester Bestandteil der chinesischen Seidenstraßeninitiative (BRI). Seit Ausbruch der Covid-19-Pandemie wirbt die chinesische Führung für diesen Teilbereich der Initiative ('Gesundheitsseidenstraße') als einen Schlüssel für den Aufbau einer 'Weltschicksals­gemeinschaft'. Die Pandemie offenbart die Stärken der BRI und ihre Funktionsweise. Chinas Gesundheitsdiplomatie agiert weitsichtig und strategisch. Beijing verknüpft Maßnahmen der Pandemiebekämpfung in Hilfsempfängerstaaten mit der Aussicht auf Kooperation im Rahmen der BRI in der Zeit nach der Corona-Pandemie. Nicht zuletzt strebt Beijing danach, international als 'verantwortungsvolle Großmacht' wahrgenommen zu werden. Der im Westen vielfach verengte Fokus auf Qualitätsmängel chinesischer Hilfsleistungen lässt verkennen, dass Beijing viele Drittstaaten effektiv und umfassend unterstützt hat, bei Abwesenheit traditioneller Hilfsgeber. Um Chinas Einflussgewinn in Regionen entgegenzutreten, die für Deutschland und Europa strategisch relevant sind, wäre es notwendig, eine größere Sensibilität für die geopolitischen Implikationen der Pandemie zu entwickeln und Drittstaaten konkrete europäische Angebote für die Zeit nach der Pandemie zu machen. Parallel zu mehr Engagement auf multilateraler Ebene (etwa innerhalb der Weltgesundheitsorganisation [WHO]) sind auch verstärkte bilaterale Aktivitäten (zum Beispiel über regionale EU+x-Formate) oder die Koordinierung mit der neuen US-Regierung unter Joe Biden Handlungsoptionen.

In its first 'Plan on Building the Rule of Law in China (2020-2025)', the leadership in Beijing has set out its vision for a coherent and genuinely Chinese legal system. The focus here is on the term 'socialist rule of law with Chinese characteristics'. It should 'basically take shape' by 2035. Marxist-Leninist legal concepts remain fundamental. The aim is to use the law as a political instrument to make the state more efficient and to reduce the arbitrariness of how the law is applied for the majority of the popu­lation, among other things, with the help of advanced technology. In some areas, for example on procedural issues, Beijing continues to draw inspiration from the West in establishing its Chinese 'rule of law'. However, the party-state leadership rejects an independent judiciary and the principle of separation of powers as 'erroneous west­ern thought'. Beijing is explicitly interested in propagating China's conception of law and legal practice internationally, establishing new legal standards and enforcing its interests through the law. Berlin and Brussels should, therefore, pay special attention to the Chinese leadership's concept of the law. In-depth knowledge on this topic will be imperative in order to grasp the strategic implications of China's legal policy, to better understand the logic of their actions and respond appropriately.

Das Gesetz zur nationalen Sicherheit in der Sonderverwaltungszone Hongkong (Sicherheitsgesetz) wirft ein Schlaglicht auf Mängel der Chinesisch-Britischen Gemeinsamen Erklärung von 1984 und die inhärenten Konflikte des Prinzips 'Ein Land, zwei Systeme'. Das Arrangement war immer voller Widersprüche und Grauzonen. Mit dem Sicherheitsgesetz schafft die chinesische Führung nun Tatsachen. Der Schritt geht zu Lasten individueller Freiheitsrechte und beschleunigt die Verbreitung sozialistischer Rechtsvorstellungen in Hongkong. International ist Beijing allerdings nicht isoliert. Im Gegenteil, bei der Bewertung des nationalen Sicherheitsgesetzes als innere Angelegenheit erhält Beijing Zuspruch von wirtschaftlich abhängigen Staaten. Chinas Ambition, internationale Deutungshoheit bei Rechtsfragen zu erlangen, ist strategisch in die Seidenstraßeninitiative (BRI) eingebettet. Das Vorgehen in Hongkong ist bei diesem Bemühen ein Testballon. Bei Entscheidungsträgern in Deutschland und Europa ist das Problembewusstsein in Bezug auf die chinesischen Rechtsvorstellungen immer noch unzureichend. Mehr Expertise ist dringend erforderlich.

The Law of the People's Republic of China on Safeguarding National Security in the Hong Kong Special Administrative Region (Security Law) highlights the shortcomings of the 1984 Sino-British Joint Declaration and the inherent conflicts of the 'one country, two systems' principle. The arrangement has always been full of contradictions and grey areas. With the Security Law, the Chinese leadership has created facts on the ground. The move comes at the expense of civil liberties and accelerates the spread of socialist legal concepts in Hong Kong. But, on this issue, Beijing is not isolated internationally. On the contrary, it is supported by economically dependent states in its assessment of the Security Law as an internal affair. China's ambition to gain international discourse power in legal matters is strategically embedded in the Belt and Road Initiative (BRI). Beijing's course of action in Hong Kong serves as a test balloon in this endeavour. Decision-makers in Germany and Europe are still not sufficiently aware of the problems concerning Chinese legal concepts. More expertise is urgently needed.
