In Europe and in Germany, climate change will bring about additional environmental risks against which precautionary measures will have to be taken. Against this backdrop, it is analyzed whether existing environmental and planning laws are providing for sufficient precautionary action or in how far they ought to be adapted to the impacts of climate change. The first part of the study explores the strategic challenges and basic constitutional conditions of such regulatory adaptation. The second part then focuses on those fields of environmental and planning law that are probably most affected by the impacts of climate change, i.e., flood protection, coastal protection, water quality, water availability, soil protection, plant safety, spatial planning, environmental impact assessment and monitoring

Mit der EG-Wasserrahmenrichtlinie haben sich die EU-Mitgliedstaaten auf den Ansatz der integrierten Flussgebietsbewirtschaftung verpflichtet. Im deutschen Bundesstaat fällt die damit geforderte Kooperation zwischen den Ländern allerdings bis heute schwer und es bleibt oft bei unabgestimmten Bewirtschaftungsentscheidungen mit z.T. erheblichen Verlagerungswirkungen im Flussgebiet. Ein prominentes Beispiel dafür sind die Schadstoffbelastungen in Sedimenten des Hamburger Hafens, die aus dem Oberlauf der Elbe eingetragen werden und die Unterhaltung des Hafens erheblich erschweren. Anhand dieses Beispiels untersuchen die Autoren, wie unter dem Regime der Wasserrahmenrichtlinie mit flussgebietsrelevanten Schadstoffbelastungen umzugehen ist. Es wird aufgezeigt, dass die bisherige Bewirtschaftung den Integrations- und Koordinierungsanforderungen nicht genügt und es werden Vorschläge unterbreitet, wie das geforderte Miteinander von Bund und Ländern effektiver zu gewährleisten wäre

Der vorliegende Band enthält erste Ergebnisse aus dem Forschungsprojekt "Herausforderungen für ein zukunftsfähiges Umweltrecht", das im Auftrag des Umweltbundesamtes im Sommer 2020 begonnen wurde. Gegenstand der Untersuchung sind die Herausforderungen, die sich dem Umweltrecht im Anthropozän stellen. Das Projekt nähert sich diesen Herausforderungen durch eine gründliche Bestandsaufnahme der nationalen und der internationalen rechtswissenschaftlichen Literatur zu den Aufgaben des Umweltrechts im Anthropozän und es setzt darüber hinaus einen Schwerpunkt bei den Aufgaben und der Leistungsfähigkeit, die dem Vorsorgeprinzip im Prozess der Politik- und Rechtsentwicklung zukommt bzw. zukommen sollte.

The European Green Deal is a comprehensive initiative aimed at reshaping the functioning of the European Union towards sustainable development. While the immediate trigger for this initiative of the newly appointed European Commission under Ursula van Leyen was the need to address the challenges associated with climate change and to move towards carbon-free and circular economy – its goals seem to be much more ambitious: to put into practice the concept of sustainable development. Against the background of the concept of sustainability and its various ambiguities and interpretations, the article provides a brief description and analysis of the key pillars of the Green Deal, namely: the financial framework for promoting sustainability, the climate and energy strategy, and the strategy for industry and circular economy. It also presents and critically assesses the horizontal goals of the Green Deal i.e. improving involvement of the public into the decision-making and assuring equal opportunities for marginalised groups.

Podczas gdy bezpośrednim powodem dla tej inicjatywy nowo wyznaczonej Komisji Europejskiej pod przewodnictwem Ursuli van Leyen była potrzeba rozwiązania wyzwań związanych z zmianami klimatycznymi oraz zapoczątkowania tworzenia niskoemisyjnej gospodarki o obiegu zamkniętym - jego cele wydają się być znacznie bardziej ambitne: realizacja w praktyce koncepcji zrównoważonego rozwoju. Na tle koncepcji zrównoważonego rozwoju i różnych sposobów jej rozumienia i interpretacji, artykuł zawiera krótki opis i analizę kluczowych filarów Zielonego Ładu, a mianowicie: ram finansowych promowania zrównoważonego rozwoju, strategii klimatycznej i energetycznej oraz strategii dla przemysłu i branży i gospodarki o obiegu zamkniętym. Prezentuje również i krytycznie ocenia horyzontalne cele Zielonego Ładu, mające na celu poprawę zaangażowania społeczeństwa w podejmowanie decyzji i zapewnienie równych szans dla grup marginalizowanych.
