Objective: The study is devoted to the protection of economic interests of the Russian Federation by criminal means, the article focuses on the problems of mistaken qualification of smuggling of cash, cash tools, alcohol products and tobacco products at the time of preparation for a crime, attempted crime and a completed crime. The goal of the work is to obtain objective data on the factors that influence the qualification of these crimes and the rationale for ways to improve the effectiveness of criminal legal measures to counter smuggling. Methodology: to prepare the article the author used the following methodological foundations: a set of general scientific and special methods of cognition of the social and legal reality. The methodological basis of the study is a comparative legal method with the inherent requirements of objectivity, comprehensiveness, historicism, and concreteness of truth. Conclusions: the study revealed contradictions in the qualification of smuggling at the stages of preparation, assassination and the completed crime; specific recommendations have been developed to eliminate the identified contradictions and problems. On the basis of the results obtained, it is possible to improve criminal legislation, improve the activity of law enforcement agencies in the qualification of crimes in the customs sphere. Value: Article can be useful to a wide range of specialists involved in countering smuggling. It can be used by scientists, teachers, students, graduate students and other categories of students, specialists of customs and other executive authorities in the member states of the EAEC. ; Задача: Исследование посвящено вопросам защиты экономических интересов РФ уголовно-правовыми средствами, в статье основное внимание уделяется проблемам ошибочной квалификации контрабанды наличных денежных средств, денежных инструментов, алкогольной продукции и табачных изделий в момент приготовления к преступлению, покушения на преступление и оконченного преступления. Цель работы - получение объективных данных о факторах, влияющих на квалификацию данных преступлений и обоснование путей повышения эффективности уголовно-правовых мер противодействия контрабанде. Методология: для подготовки статьи автором были использованы следующие методологические основы: совокупность общенаучных и специальных методов познания социально-правовой действительности. Методологической основой исследования является сравнительно-правовой метод с присущими ему требованиями объективности, всесторонности, историзма, конкретности истины. Выводы: в ходе исследования выявлены противоречия при квалификации контрабанды на стадиях приготовления, покушения и оконченного преступления; разработаны конкретные рекомендации по устранению выявленных противоречий и проблем. На основе полученных результатов возможно совершенствование уголовного законодательства, совершенствование деятельности правоохранительных органов квалификации преступлений в таможенной сфере. Ценность: Статья может быть полезна широкому кругу специалистов, занимающихся вопросами противодействия контрабанде. Она может быть использована научными работниками, преподавателями, студентами, аспирантами и иными категориями обучающихся, специалистами таможенных и иных органов исполнительной власти в государствах - членах ЕАЭС.

The article gives analysis of criminological measures of stock market crimes counteraction. Negative economic trends define criminal capacity development in society. This development as long as government long-term official neutral position led to wide-spread occurrence of new criminal behavior forms of economic subjects (including those on stock market). Recent changes introduced into criminal law couldn' t effectively counteract to crimes on stock market since they were only random and not based on scientific researches in economy and law. Significant difficulties rose in law enforcement process in terms of detection and legal evaluation of these crimes. Individual crimes are detected while organized groups' activity goes under the radar. Legal regulation and practical realization of national policy on stock market crimes and crimes against interests of investors counteraction are raised in the article. The authors reveal reasons of securities-related crimes, factors of general order and circumstances that lead to individual crimes. The article presents conditions that result in crimes against stockholder rights, securities register-related crimes and crimes related to securities transfer violations. The authors suggest complex of measures aimed at general and special prevention of crimes against interests of investors. © 2014, Criminology Journal of Baikal National University of Economics and Law. The paper reviews the development of the international legal framework for counter-trafficking in children as a form of human trafficking. It is stressed that the most important international acts to combat trafficking in children have been created under the auspices of the UN and regional international organizations. The authors note the need for an integrated approach to solving problems, in particular, through adopting national programs. The authors examine the influence of international legal acts on Russian criminal legislation and the need for its improvement.

Research of the issues of counteracting extremist crimes has recently become one of the most urgent tasks for both Russian and foreign criminologists. Russia is a multinational and multi-confessional state. This fact gives special importance to fighting extremist crimes, which is impossible without the analysis of the causal complex of murders motivated by political, ideological, racial, national or religious hatred of enmity, as well as hatred or enmity towards a particular social group. The motive is a crucial element for understanding specific characteristics of an extremism act. An ideologically-motivated murder is caused by intolerant or hateful attitude of the perpetrator towards the victim resulting from the disagreement with his views, convictions, principles. A politically-motivated murder is caused by intolerance or hatred of the perpetrator towards the victim as a representative of alternative political views regarding the existing social order, a country's economic structure, the political activity of public organizations, parties, movements. There are different levels of manifestations of extremist actions that differ in character and degree of public danger. The paper is devoted to researching specific traits and development trends for the factors that influence the contemporary condition and structure of extremism-motivated murders; the authors use them as a basis for the system of causes and conditions of such crimes. The paper analyses economic, political, legal, informational factors that define complex determinants of such crimes at the general social level. The authors suggest recognizing globalization and population migration (including illegal migration) that followed it as one of the determinants. They conclude that at the social and psychological level extremism-motivated murders are determined by the activities of organized small social groups. © 2016, Baikal National University of Economics and Law. In 2013 Russia ratified the Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse (CETS N 201) of October 25, 2007 (Lanzarote, Spain). The Council of Europe supports the One in Five campaign, based on the available data that one in five children in Europe are victims of some form of sexual or other violence, which often happens within the family circle. Although it is an urgent problem for Russia as well, full statistical data are unavailable and there is a lack of solid research. At present the co-signer countries are going though a complicated process of implementing the Convention's clauses in their criminal legislations, and practically all of them face similar lawmaking and law enforcement problems. The authors of the paper, who took part in the Lanzarote Committee meetings, have analyzed criminal legislation of Russia and authors' translations of the new versions of criminal codes of Austria, Turkey and Spain. They have thoroughly examined the latest publications on the topic and used court practice examples in their analysis of Russian criminal law. The authors conclude that Russian law, unlike foreign ones, has mainly incorporated Lanzarote convention's clauses. However, a number of clauses require an adequate response from Russian lawmakers, who should introduce changes and amendments to criminal laws of the Russian Federation, in particular, regarding increased penalties for offences against the sexual inviolability of minors by persons from a child's «circle of trust». © 2017, Baikal National University of Economics and Law. The article deals with the conditions for a comprehensive examination for the right of employment for foreign citizens with visual impairments and musculoskeletal system disorders. The psychophysical characteristics of persons with disabilities are described; the technique required for the successful execution of test tasks in the Russian language, Russian history and the basics of Russian legislation has been proposed.
