[Resumen] El presente texto realiza una aproximación al fenómeno de las detenciones de Guantánamo, diez años después de su lamentable puesta en marcha. Esta aproximación pretender indagar el sentido de este fenómeno como hecho materialmente jurídico-sancionador y, en particular, como expresión del excepcionalismo penal contemporáneo, momento del Derecho penal del enemigo realmente existente. Al mismo tiempo, y aprovechando la perspectiva que otorga una década de historia, el texto pretende hallar el sentido del fenómeno de Guantánamo como elemento de un golpe de fuerza en la constitución del emergente espacio soberano global, que hoy sólo cabe entender fallido. ; [Abstract] This paper makes an approach to the phenomenon of the Guantanamo's detainees, ten years after the beginning of this regrettable event. This perspective seeks to research the material meaning of this phenomenon as an act of punishment, and especially as an expression of the current penal exceptionalism, also known as Criminal Law of the Enemy. By the same token, and taken advantage of the knowledge supplied by one decade of Guantanamo's history, the paper seeks to find the meaning of the phenomenon as an element of a 'tour de force' within the framework of the constitution of an emergent global sovereignty, a political movement which now shows apparently its failure.
