Constitutional Bricolage
In: Princeton Legacy Library
Uniquely blending anthropological and exchange theory, Professor Garvey offers a new interpretation of American constitutional development. His thesis: judicial reliance on a limited stock of received forms has inhibited the development of new concepts that could adequately reflect fundamental changes in society. Professor Garvey reviews the history of the Supreme Court in light of the ""bricolage"" theory. The Court, by interpreting the Constitution to effect laissez-faire and Social Darwinism, helped bring about a society ostensibly patterned on the buyer-seller model, marked by free exchan
Democratic Bricolage

Despite their dominance and control over police, courts, state institutions, media, and civil society, authoritarian governments face multifaceted internal and external contestation over their right to rule and the boundaries of autocratic control. Analysis of this opposition is wanting in the literature on democratic backsliding. Societal groups, institutions, and individuals regularly contest governments' claim to legitimate rule, and they seek opportunities to raise their voices and be heard. These efforts, which we call democratic bricolage, are mostly uncoordinated, accidental, disconnected, and dependent on opportunities as these arise. But they undermine the government's claims to authority and legitimacy. They maintain instead the moral claim to democracy, the right to be heard and consulted. We argue that democratic bricolage is the story of democratic resilience in an authoritarian context and an under-studied and little-noticed part of the story of autocratization.

Piecing Together - A Methodological Bricolage

Bricolage, Bullshit, and Bustle
Blog: Verfassungsblog
On 15 December 2023, the Swiss Federal Council (Government) announced that it intended to start formal negotiations with the EU on the conclusion of a Framework Agreement (FA) 2.0. Five existing and two new treaties between the EU and Switzerland are to be subject to dynamic alignment and institutionalised, i.e. provided with a monitoring and judicial mechanism. The project, which is practically fixed in the decisive questions by a "Common Understanding" ("CU") between the two parties, is based on a triple B approach: in substance, it consists of unsuccessful bricolage, the foundations were laid by bullshit, and because elections and a change of the Commission are imminent in the EU, bustle is supposedly of the essence. The CU summarizes what the Parties have informally agreed on.
(ICI)
