Der Portalverbund ist Gradmesser der Verwaltungsdigitalisierung. Der Fokus der Abhandlung liegt auf der Bestimmung der Reichweite des Art. 91c Abs. 5 GG. Sie lotet Grenzen des Kompetenztitels aus, warnt vor einem ausufernden legislativen Gebrauch. Der Verwaltungsleistungsbegriff wird untersucht und der Frage nachgegangen, inwieweit dadurch vom traditionellen Verwaltungsverfahrensbegriff abgerückt werden wird. Das Werk beweist Weitblick. Eng mit dem OZG verbundene Entwicklungen, wie solche des RegModG mit dem Datenschutzcockpits, werden betrachtet. Die Aussagen des Werks sind für die Verwaltung, Wissenschaft und aufgrund der gezogenen Kompetenzgrenzen angesichts der Dynamik des Rechtsgebiets auch für den Gesetzgeber und die Judikative von Interesse.

Die interpolierende Betrachtungsweise ist eine vom Bundesfinanzhof entwickelte Methode zur Anwendung von Steuerbefreiungen im Grunderwerbsteuerrecht, die hierbei über ihren Wortlaut hinaus zur Steuerfreiheit verbunden werden. Dies nimmt die Untersuchung zum Anlass, die Frage nach einer methodisch und systematisch tragfähigen Begründung der Interpolation aufzuwerfen und zu beantworten. Im Mittelpunkt der Arbeit steht neben der Anwendbarkeit von Steuerbefreiungen auf Gesamthandsgemeinschaften der Belastungsgrund der Grunderwerbsteuer, der ausführlich unter dem Aspekt wirtschaftlicher Leistungsfähigkeit untersucht wird. Besonderes Augenmerk liegt dabei auf dem für einen leistungsfähigkeitskonformen Steuerzugriff notwendigen Zusammenspiel von typisierenden Steuertatbeständen und Befreiungsvorschriften. Ausgehend davon entwickelt die Arbeit einen eigenen, lastengerechten Ansatz zur Interpolation, wofür die Steuerbefreiungen des Grunderwerbsteuerrechts nach ihrer Funktion kategorisiert werden. / »Interpolation as an Ability-to-Pay-Compliant Refrain from Taxation. An Analysis of the Interpolation of Tax Exemption Provisions in Real Estate Transfer Tax Law«: Interpolation is a method developed by the Federal Tax Court to apply tax exemptions of the Real Estate Transfer Tax Act beyond their wording. The work raises the question of a methodologically and systematically viable reasoning for this. Based on the justification of the real estate transfer tax against the constitutional background of the ability-to-pay principle, the work develops its own approach to interpolation, for which the tax exemptions are categorized according to their function.

Die EU-Datenschutzgrundverordnung steht im Blickpunkt der Rechtswissenschaft, wobei die verwaltungsorganisationsrechtlichen Regelungen bisher jedoch kaum beleuchtet wurden. Claudia Kawohl zeigt, dass nicht in den materiell-rechtlichen Regelungen, sondern gerade in der grundlegend neustrukturierten Datenschutzaufsicht aber der eigentliche Innovationsgehalt der Verordnung liegt. Ausgehend vom allgemeinen Konzept des Europäischen Verwaltungsverbundes unterzieht die Dissertation die Akteure und Verfahren einer detaillierten Analyse und beantwortet dabei zahlreiche rechtsdogmatische Fragen. Auf dieser Grundlage wendet sie sich aus einer unionsverfassungsrechtlichen Perspektive verbundstypischen Gefährdungen für rechtsstaatliche Sicherungen und der demokratischen Legitimation zu und untersucht dabei vor allem das Konzept der Unabhängigkeit der Datenschutzaufsicht. Die Arbeit leistet damit nicht nur einen Beitrag zu einer kohärenten und primärrechtskonformen Weiterentwicklung des Datenschutzrechts, sondern auch des europäischen Verwaltungsrechts insgesamt. -- Die Arbeit wurde ausgezeichnet mit dem Wissenschaftspreis 2021 der Gesellschaft für Datenschutz und Datensicherheit e. Structures, Legitimacy, Legal Protection«: With the adoption of the EU General Data Protection Regulation, data protection supervision was fundamentally restructured. Claudia Kawohl shows that the actual innovative content of the regulation does not lie in the substantive regulations, but rather in these administrative organization regulations. Starting from the general concept of the European integrated administration, the dissertation subjects the new administrative structure to a detailed analysis and examines it for typical threats to the rule of law and democratic legitimacy.

Da die EU ihre Zuständigkeit schnellstmöglich wahrnehmen sollten, werden in diesem Buch die Möglichkeiten erörtert und eine Lösung vorgeschlagen. In diesem Sinne ist der Vorschlag der Autorin für eine EU-Richtlinie zur Harmonisierung der wichtigsten Bestimmungen über öffentliche Investitionsversicherungen gegen politische Risiken für Auslandsdirektinvestitionen in Drittländern dem Buch angehängt.
