Der EWVG rezipiert völkerrechtliche Verträge der EWG in ihren Innenbereich; sie bleiben formell Völkerrecht, sind materiell Gemeinschaftsrecht. Es gibt einen generellen Geltungs- und Anwendungsbefehl. Die völkerrechtlichen Verträge der EWG genießen Vorrang vor dem nationalen Recht. (BE)

Wie unabhängig sind Nationalstaaten heute noch von Entscheidungen internationaler Organisationen? Wie stark wird nationales Recht von Völkerrecht beeinflusst? Welche Übernahmemechanismen gibt es und wie wirken sie? Wie verhält sich das postsowjetische Russland zum Völkerrecht? Welche Gemeinsamkeiten und Unterschiede gibt es zur Völkerrechtsdoktrin der Bundesrepublik Deutschland? Wie offen ist das heutige Rechtssystem der Russländischen Föderation für Einflüsse aus dem Ausland? Nach einer Erläuterung der Grundbegriffe für die Übernahme internationalen Rechts untersucht Manja Hussner die deutsche und die russische Verfassung daraufhin, wie völkerrechtsfreundlich sie jeweils sind. Die dabei betrachteten relevanten Verfassungsnormen geben Aufschluss über die Grundprinzipien des Umgangs mit internationalem Recht in den beiden Staaten. Die Analyse bezieht sich auf die innerstaatliche Bedeutung der völkerrechtlichen Verträge, des Völkergewohnheitsrechts und der allgemeinen Rechtsgrundsätze.
