In this article Michel Foucault's method of writing a "history of the present" is explained, together with its critical objectives and its difference from conventional historiography. Foucault's shift from a style of historical research and analysis conceived as "archaeology" to one understood as "genealogy" is also discussed, showing how the history of the present deploys genealogical inquiry and the uncovering of hidden conflicts and contexts as a means of re-valuing the value of contemporary phenomena. The article highlights the critical observations of present-day phenomena from which a history of the present begins, paying particular attention to Foucault's concept of " dispositif" and his method of problematization. Foucault's analyses of Bentham's Panopticon, of the disciplinary sources of the modern prison, and of the technology of confession are discussed by way of illustration.

The sociology of punishment has developed a rich understanding of the social and historical forces that have transformed American penality during the last 40 years. But whereas these social forces are not unique to the United States, their penal impact there has been disproportionately large, relative to comparable nations. To address this issue, I suggest that future research should attend more closely to the structure and operation of the penal state. I begin by distinguishing penality (the penal field) from the penal state (the governing institutions that direct and control the penal field). I then present a preliminary conceptualization of "the penal state" and discuss the relationship between the penal state and the American state more generally.

The Culture of Control procède à une étude historique des changements et des adaptations sociales, pénales et politiques intervenues au cours de la période allant des années 1960 aux années 1990, période qualifiée de «postmodernité». Les causes de ces transformations sont à chercher dans des forces structurelles sous-jacentes (l'arrivée de la modernité tardive, la liberté du marché, des politiques conservatrices, etc.) qui ont abouti à la reconfiguration de la justice pénale, du type welfare à un type nettement plus répressif, mais aussi à des changements sociaux et comportementaux. Ainsi les gouvernements des pays occidentaux, soutenus par leurs opinions publiques, ont développé des politiques pénales répressives, à l'instar des États-Unis et du Royaume-Uni, alors même que se structure, au sein de ces sociétés, un «complexe du crime».

Der Autor beleuchtet die Dynamiken der Todesstrafe als eine Form staatlicher Gewalt in den USA. Er geht insbesondere auf die Repräsentation des Staates bei der Ausübung dieser Strafe ein und diskutiert die performativen Aspekte des gerichtlich verordneten Tötens. Er interpretiert die Todesstrafe als das Ergebnis einer komplexen Beziehung zwischen verschiedenen Gruppen entlang der Konfliktlinien Rasse, Klasse und Religion, des Drucks der Bevölkerung auf staatliche Akteure, der Machtkämpfe zwischen dem Bund und den Einzelstaaten sowie den strategischen Entscheidungen politischer Akteure. Er zeigt anhand von Beispielen, dass diese Praktiken durch genau festgelegte politische Prozesse und institutionelle Abläufe strukturiert werden und Bestandteil einer komplexen Konfiguration sind, die sich aus staatlichen Funktionsträgem verschiedener Ebenen, aus vielfältigen Interessengruppen sowie aus den Wertvorstellungen der Bürger zusammensetzt. Diese Konfiguration erzeugt eine historisch und kulturell spezifische Rationalität, die die Todesstrafe als staatliche Gewaltpraktik unter bestimmten Bedingungen als legitim erscheinen lässt. Der Autor geht auch auf Michel Foucaults Überlegungen zum souveränen Staat in dessen Buch "Überwachen und Strafen" (1977) ein und zeigt Parallelen zwischen der modernen Todesstrafe, der Selbstjustiz und dem Lynchmord auf.
