The bank insolvency framework in Poland should be modernized to ensure financial stability, maintain the continuity of critical functions in the banking system, and protect depositors and creditors, while assigning losses according to a pre-established creditor hierarchy. Several country experiences in Europe and elsewhere have demonstrated the effectiveness of new bank resolution measures by the European commission. A key aspect of the resolution process is for the authorities to swiftly assess and revalue the balance sheet of the intervened bank. Other particularities of modern resolution procedures relate to maintaining the integrity of secured financial contracts to prevent disruptions in financial market transactions including in payments and settlements systems. The treatment of systemically important institutions should rely on extraordinary resolution tools which are necessary if a bank is too large to be purchased or for its liabilities to be readily assumed. The purpose of this paper is thus to describe and recommend new features that can be added to strengthen the Polish legislation for handling commercial bank insolvencies. The paper focuses on the legal issues related to insolvency of banks (including commercial banks and cooperative banks). The banking sector's share in the total assets of the credit sector amounts to 89 percent while cooperative banks control 6 percent. The only wholly-owned state bank is the development bank Bank Gospodarstwa Krajowego (BGK) which is subject to supervision by the Polish Financial Supervisory Authority (KNF).

In a scientific article, the author conducted a scientific study of the concept and content of legal liability of spouses for non-performance of alimony obligations in family law. Based on the study, the author concluded that the Family Code of Ukraine does not contain a rule on the liability of the obligated spouse for failure to maintain an incapacitated spouse or a spouse in need of maintenance in connection with the upbringing of young children. From the content of Art. 196 of the Family Code of Ukraine, it is not clear whether it applies only to cases of non-performance of child support obligations, as follows from the finding of this rule in the relevant section of the Family Code of Ukraine. It is necessary to agree with the opinion expressed in the legal doctrine on the application of the provisions of Art. 196 of the Family Code of Ukraine for all alimony relations, in this regard, we propose to make appropriate changes to this article. In this case, in case of arrears due to the fault of the spouse, who is obliged to pay alimony by court decision or under the maintenance agreement, the spouse-recipient of alimony has the right to collect a penalty (penalty), and in case of late payment, due to illness or injury of the other spouse due to the payer's fault, such payer is obliged to pay the amount of arrears at the request of the recipient of expenses, taking into account the established inflation index for the entire period of delay, as well as three percent per annum of the overdue amount. Although Art. 78 of the Family Code of Ukraine defines only three conditions of the spousal maintenance agreement: conditions, amount and terms of alimony, however, as stated in legal doctrine, such a condition as liability for non-performance of the maintenance agreement may also be determined by the parties. Unfortunately, the Family Code of Ukraine does not provide for a contractual procedure for determining alimony obligations to actual and former spouses, in this regard, in the scientific literature it is proposed to supplement the relevant provisions of Art. Art. 78 and 91 of the Family Code of Ukraine. In addition, the legislation of Ukraine in some cases provides for administrative liability for non-payment of alimony for the maintenance of one of the spouses, as well as liability in the form of one of the temporary restrictions set by the Law of Ukraine "On Enforcement Proceedings". ; В науковій статті автор провів наукове дослідження поняття та змісту юридичної відповідальності по-дружжя за невиконання аліментних зобов'язань у сімейному праві. На підставі проведеного дослідження автор дійшов висновку, що в Сімейному кодексі України відсутня норма про відповідальність зобов'язаного подружжя за невиконання обов'язку щодо утримання непрацездатного подружжя або подружжя, яке по-требує утримання у зв'язку із вихованням малолітніх дітей. Із змісту ст. 196 Сімейного кодексу України не зрозуміло, чи вона поширюється лише на випадки невиконання аліментних зобов'язань щодо дитини, як це випливає виходячи із знаходження цієї норми у відповідному розділі Сімейного кодексу України. Слід пого-дитися із висловленою у правовій доктрині думкою про застосування положень ст. 196 Сімейного кодексу України на усі аліментні відносини, у зв'язку із цим пропонуємо внесення відповідних змін до цієї статті. В такому разі, у разі виникнення заборгованості з вини подружжя, який зобов'язаний сплачувати аліменти за рішенням суду або за договором про утримання подружжя, подружжя-одержувач аліментів має право на стягнення неустойки (пені), а у разі прострочення оплати витрат, пов›язаних із хворобою або каліцтвом другого з подружжя з вини платника такий платник зобов'язаний на вимогу одержувача витрат сплатити суму заборгованості за витратами з урахуванням встановленого індексу інфляції за весь час прострочення, а також три проценти річних із простроченої суми. Хоча ст. 78 Сімейного кодексу України визначає лише три умови договору подружжя про надання утримання: умови, розмір та строки виплати аліментів, однак, як зазначається в правовій доктрині, така умова як відповідальність за невиконання договору про надання утримання, також може визначатися сторонами. На жаль, Сімейний кодекс України не передбачає договір-ного порядку визначення аліментних зобов'язань фактичним та колишнім подружжям, у зв'язку із чим, в науковій літературі пропонується доповнити відповідні положення ст. ст. 78 та 91 Сімейного кодексу Укра-їни. Крім того, законодавство України в окремих випадках передбачає адміністративну відповідальність за несплату аліментів на утримання одного з подружжя, а також відповідальність у вигляді одного з тимчасо-вих обмежень, визначених Законом України «Про виконавче провадження».

The article is dedicated to the research of the institution of representation in courts, in particular self-representation of the legal entity. This problem has become relevant in connection with the changes in the Constitution of Ukraine under which was introduced so-called monopoly of the attorney. Such changes provide for representation in court solely by attorneys exception of cases listed in articles 131-2 Constitution of Ukraine. At the same time physical persons and the legal entities can represent themselves independently. To that end in the procedural law introduces the concept of self-representation that is the representation different from the attorney representation. The concept of self-representation is enshrined in code of civil procedure art.58, code of commercial procedure art. 56, administrative code art. 55. With the promulgation of Law of Ukraine "On the amendment of some legal acts of Ukraine regarding expansion of possibilities of self-representation in court of the public bodies, authorities of the Autonomous Republic of Crimea, local authorities, other legal entities regardless of the order of creation" dated December 18, 2019 №390-IX significantly expanded circle of persons that can represent legal entity in accordance with the self-representation. According to the author such legislative position establishes the right to represent legal entity in the court not only by the director or by member of the Executive Committee of the legal entity but also by the people who are in an employment relationship. The author considers despite the legal certainty of the norms of Law №390-IX it contains no complete list of persons that can undertake self-representation and the complete list of required documents that is necessary to provide the court. The author suggests which documents can confirm the authorization of the person that exercise self-representation of the legal entity. According to the author self-representation of the legal entity includes participation of the representative of the legal entity which has direct relationship to the legal entity and its powers already exist by internal documents in particular by labor contract. Regarding the attorney representation of the legal entity it arises by force of power of attorney. The author also claims that personal participation in the proceedings which provides self-representation of the legal entity doesn't waive the right of the legal entity to have the representative in the case i.e. the attorney. ; Стаття присвячена дослідженню інституту представництва в суді, зокрема самопредставництву юридич-них осіб. Ця проблема стала актуальною у зв'язку зі внесенимидо Конституції України, згідно з якими було введено так звану «адвокатську монополію». Такі зміни передбачали здійснення представництва в судах виключно адвокатами, за винятком справ, перелічених в статті 131-2 Конституції України. Водночас фізичні та юридичні особиможуть представляти себе в суді самостійно. Для цього в процесуальне законодавство вводиться термін «самопредставництво», тобто представництво відмінне від представництва адвокатом. Поняття «самопредставництво» закріплене впроцесуальних кодексах: у ЦПК (ст. 58); ГПК (ст. 56); КАС (ст. 55). З прийняттям Закону України «Про внесення змін до деяких законодавчих актів України щодо розши-рення можливостей самопредставництва в суді органів державної влади, органів влади Автономної Респу-бліки Крим, органів місцевого самоврядування, інших юридичних осіб незалежно від порядку їх створення» від 18.12.2019 р. №390-IX значно розширено коло осіб, які можуть представляти юридичну особу в порядку самопредставництва. На думку автора, така законодавча позиція закріплює право представляти юридичну особу в суді не тільки керівнику або члену виконавчого органу юридичної особи, а й особам, які перебува-ють з нею в трудових правовідносинах. Автор вважає, що незважаючи на правову визначеність норм Закону №390-1Х, в ньому відсутній повний перелік осіб, які можуть здійснювати «самопредставництво» юридич-ної особи та не встановлений перелік документів, які необхідно подати особі до суду. Автором статті вислов-люється думка щодо того, якими документами можуть бути підтверджені повноваження особи, що здійснює самопредставництво юридичної особи. На думку автора, самопредставництво юридичної особи передбачає залучення як її представника особи, яка має безпосереднє відношення до юридичної особи, а її повноважен-ня вже передбачені внутрішніми документами, зокрема трудовим договором(наприклад, юрисконсульти). Щодо представництва юридичної особи адвокатом, то воно виникає на підставі довіреності. Також автор статті нагадує, що особиста участь у справі особи, яка здійснює самопредставництво юридичної особи, не позбавляє юридичну особу права мати в цій справі представника, тобто адвоката.

This article aims to demonstrate that the "reconstruction of facts" ordered and practiced within the processes carried out and concluded in the different dependencies, offices or disciplinary facilities of the Office Procuraduría General de la Nación in Colombia (PNG), either in the investigation stage preliminary or disciplinary investigation, it is treated as an alleged means of evidence, with the aim of trying to clarify possibly irregular facts in military or police operations; and in other cases, this activity is equated to a means of proof by the disciplinary operator, especially in those, where it is presumed the commission of homicide conducts in protected persons in military or police missions. Also, when public servants who carry out administrative actions (police inspectors, traffic guards, guards of the National Penitentiary and Prison Institute -INPEC- and other state employees) assume behaviors contrary to the duties entrusted or in which they have left a cloak of doubt and uncertainty in their actions; or because it is presumed existence of disciplinary offenses committed on the occasion of the constitutional mission in proceedings contrary to the duties entrusted. The practice of this evidentiary activity, in the author's opinion, leads to affirming that it violates the fundamental and procedural rights of the people or public servants involved in the disciplinary action. Therefore, to achieve the proposed objective, an exploration with a qualitative approach was developed, using documentary research methodology, focusing the analysis on the single Disciplinary Code (law 734, 2002) of the evidence. ; El presente artículo pretende demostrar que la reconstrucción de hechos, ordenada y practicada dentro de los procesos adelantados y concluidos en las diferentes dependencias, oficinas o instalaciones disciplinarias de la Procuraduría General de la Nación en Colombia (PNG), ya sea en etapa de indagación preliminar o investigación disciplinaria, es tratado como medio de prueba innominado, tendiente a esclarecer hechos en operaciones militares o policiales, y en otros casos esta actividad es equiparada a un medio de prueba por el operador disciplinario; especialmente, en aquellos donde se presume la comisión de conductas de homicidio contra personas protegidas en misiones militares o policiales. También, cuando servidores públicos que desarrollan actuaciones administrativas (inspectores de policía, guardas de tránsito, guardianes del Instituto Nacional Penitenciario y Carcelario [INPEC] y demás empleados estatales) asumen comportamientos contrarios a los deberes encomendados, o en los cuales estos han dejado un manto de duda e incertidumbre en sus actuaciones, o porque se presume existencia de faltas disciplinarias cometidas con ocasión de la misión constitucional en procederes contrarios a los deberes encomendados. La práctica de esta actividad probatoria, a juicio del autor, conduce a afirmar que es violatoria a los derechos fundamentales y procesales de las personas o los servidores públicos que intervienen en la actuación disciplinaria. Por consiguiente, para lograr el objetivo propuesto, se desarrolló una exploración con enfoque cualitativo, utilizando la metodología de investigación documental y centrando el análisis en el Código Disciplinario Único (Ley734 de 2002) de los medios de prueba. ; Este artigo visa demonstrar que a "reconstrução dos fatos" ordenada e praticada dentro dos processos adiantados e concluídos nas diferentes dependências, escritórios ou instalações disciplinares da Procuradoria Geral da Nação na Colômbia (PNG), seja na investigação fase de investigação preliminar ou disciplinar, é tratada como meio de prova alegada, com o objetivo de tentar esclarecer fatos possivelmente irregulares em operações militares ou policiais; e, nos demais casos, essa atividade é equiparada a meio de prova pelo operador disciplinar, especialmente naqueles em que se presume a prática de homicídios em pessoas protegidas em missões militares ou policiais. Além disso, quando servidores públicos que realizam atos administrativos (fiscais de polícia, guardas de trânsito, guardas do Instituto Penitenciário e Penitenciário Nacional -INPEC- e demais funcionários do Estado) assumem comportamentos contrários às funções atribuídas ou de que tenham deixado dúvidas e incerteza em suas ações; ou porque se presume a existência de infracções disciplinares cometidas por ocasião da missão constitucional em processos contrários às atribuições cometidas. A prática desta atividade probatória, na opinião do autor, leva a afirmar que ela viola os direitos fundamentais e processuais das pessoas ou servidores envolvidos na ação disciplinar. Portanto, para atingir o objetivo proposto, foi desenvolvida uma exploração com abordagem qualitativa, utilizando metodologia de pesquisa documental, enfocando a análise no Código Disciplinar único (lei 734, 2002) das evidências.

Такі зміни передбачали здійснення представництва в судах виключно адвокатами, за винятком справ, перелічених в статті 131-2 Конституції України. Водночас фізичні та юридичні особиможуть представляти себе в суді самостійно. Для цього в процесуальне законодавство вводиться термін «самопредставництво», тобто представництво відмінне від представництва адвокатом. Поняття «самопредставництво» закріплене впроцесуальних кодексах: у ЦПК (ст. 58); ГПК (ст. 56); КАС (ст. 55). З прийняттям Закону України «Про внесення змін до деяких законодавчих актів України щодо розши-рення можливостей самопредставництва в суді органів державної влади, органів влади Автономної Респу-бліки Крим, органів місцевого самоврядування, інших юридичних осіб незалежно від порядку їх створення» від 18.12.2019 р. №390-IX значно розширено коло осіб, які можуть представляти юридичну особу в порядку самопредставництва. На думку автора, така законодавча позиція закріплює право представляти юридичну особу в суді не тільки керівнику або члену виконавчого органу юридичної особи, а й особам, які перебува-ють з нею в трудових правовідносинах. Автор вважає, що незважаючи на правову визначеність норм Закону №390-1Х, в ньому відсутній повний перелік осіб, які можуть здійснювати «самопредставництво» юридич-ної особи та не встановлений перелік документів, які необхідно подати особі до суду. Автором статті вислов-люється думка щодо того, якими документами можуть бути підтверджені повноваження особи, що здійснює самопредставництво юридичної особи. На думку автора, самопредставництво юридичної особи передбачає залучення як її представника особи, яка має безпосереднє відношення до юридичної особи, а її повноважен-ня вже передбачені внутрішніми документами, зокрема трудовим договором(наприклад, юрисконсульти). Щодо представництва юридичної особи адвокатом, то воно виникає на підставі довіреності. Також автор статті нагадує, що особиста участь у справі особи, яка здійснює самопредставництво юридичної особи, не позбавляє юридичну особу права мати в цій справі представника, тобто адвоката.

The article is devoted to the consideration of the essence of the concept of "licensing" that is one of the regulating means of the state to influence the activity of managerial subjects regarding the beginning, proceeding of separately defined activities and further control over its implementation in order to ensure the protection of rights and legitimate interests of citizens, the state and society. The author highlighted the role of the state as a guarantor of ensuring rights and meeting the educational needs, ensuring the compliance of educational activities for the needs of society under the conditions of globalization and the internationalization of higher education, strengthening of competition and development of the autonomy of higher education institutions. It is thus well-рroven that government control is the prevailing form of influence on development of higher education in Ukraine, as the state, coming forward as one of subjects of macroeconomics, the main function of that is organization of production of public benefits, provides adjusting of economy, determines terms and rules of conduct of economic activity, sets certain requirements and limitations of activity of subjects of menage, including their responsibility for offence in the field of a menage. While licensing is one of instruments of regulative influence of the state on establishments of higher education and refers to the administrative methods, when a necessary result is arrived at by means of direct influence of central public authority in the sphere of education on establishments of education. The role of educational activity licensing as a element of the system of external quality assurance in higher education are researched. By an author determination of function of licensing: regulatory, legitimation, supervisory, fiscal, permissive, informative, registration, statistical, guard, and disclosed content of every function. ; Статья посвящена рассмотрению сущности понятия «лицензирование», что является одним из средств регулирующего воздействия со стороны государства на деятельность субъектов хозяйствования относительно начала, производства отдельных видов деятельности и последующего контроль ее осуществления в целях обеспечения защиты прав, законных интересов граждан, государства и общества. Автором представлена роль государства как гаранта обеспечения прав и удовлетворения потребностей в сфере образования, обеспечения соответствия образовательной деятельности запросам общества в условиях глобализации и интернационализации высшего образования, усилении конкуренции и развития автономии высших учебных заведений. При этом доказано, что государственное регулирование является преобладающей формой влияния на развитие высшего образования в Украине, поскольку государство, выступая одним из субъектов макроэкономики, главной функцией которого является организация производства общественных благ, обеспечивает регулирование экономики, определяет условия и правила ведения хозяйственной деятельности, устанавливает определенные требования и ограничения деятельности субъектов хозяйствования, включая их ответственность за правонарушения в сфере хозяйствования. Тогда как лицензирование является одним из инструментов регулирующего воздействия государства на высшие учебные заведения и относится к административным методам, когда необходимый результат достигается с помощью прямого воздействия центрального органа государственной власти в сфере образования на учебные заведения. Исследована роль лицензирования образовательной деятельности как элемента системы гарантии качества высшего образования. Автором определены функции лицензирования, в частности: регулятивная, легитимационная, контролирующая, фискальная, разрешительная, информационная, учетная, статистическая, охранная и раскрыто содержание каждой функции. ; Стаття присвячена розгляду сутності поняття «ліцензування», що є одним із засобів регулюючого впливу з боку держави на діяльність суб'єктів господарювання щодо початку, провадження окремо визначених видів діяльності та подальшого контролю за її здійсненням з метою забезпечення захисту прав, законних інтересів громадян, держави і суспільства. Автором висвітлена роль держави як гаранта забезпечення прав і задоволення потреб у сфері освіти, забезпечення відповідності освітньої діяльності запитам суспільства в умовах глобалізації та інтернаціоналізації вищої освіти, посиленні конкуренції та розвитку автономії закладів вищої освіти. При цьому доведено, що державне регулювання є переважаючою формою впливу на розвиток вищої освіти в Україні, оскільки держава виступаючи одним з суб'єктів макроекономіки, головною функцією якого є організація виробництва суспільних благ, забезпечує регулювання економіки, визначає умови і правила ведення господарської діяльності, встановлює певні вимоги і обмеження діяльності суб'єктів господарювання, включаючи їх відповідальність за правопорушення у сфері господарювання. Тоді як ліцензування є одним із інструментів регулюючого впливу держави на заклади вищої освіти та відноситься до адміністративних методів, коли необхідний результат досягається за допомогою прямого впливу центрального органу державної влади в сфері освіти на заклади освіти. Досліджено роль ліцензування освітньої діяльності як елемента системи зовнішнього забезпечення якості вищої освіти. Автором визначенні функції ліцензування, зокрема: регулятивна, легітимаційна, контролююча, фіскальна, дозвільна, інформаційна, облікова, статистична, охоронна, та розкритий зміст кожної функції.

Seit dem hohen Flüchtlingszuzug der Jahre 2015 und 2016 ist die Zahl der nach Deutschland kommenden Geflüchteten deutlich gesunken. Insgesamt wurden im Jahr 2017 rund 187.000 Asylsuchende registriert. 223.000 Personen stellten einen formalen Asylantrag, was nach den Jahren 2015 und 2016 sowie 1991 bis 1993 der sechsthöchste Wert in der Geschichte der Bundesrepublik ist. Dabei deutet sich aktuell nur ein leichter weiterer Rückgang an. So liegen die monatlichen Asylbewerberzahlen bereits seit Mitte 2016 durchweg auf einem Niveau zwischen 10.000 und 20.000. Allerdings haben sich die Herkunftsländer deutlich verschoben. Stammte im Jahr 2016 mit 49,1 Prozent noch rund die Hälfte der Asylbewerber aus Syrien und dem Irak, war es im Jahr 2017 mit 33,2 Prozent nur noch ein Drittel. Hingegen ist der Anteil der Afrikaner von 11,0 Prozent auf 23,8 Prozent gestiegen. Insgesamt sind die Herkunftsländer deutlich vielfältiger geworden. Damit einhergehend ist die Anerkennungsquote von 62,4 Prozent im Jahr 2016 über 43,4 Prozent im Jahr 2017 auf nur noch 32,3 Prozent im ersten Quartal 2018 gesunken. Derzeit erhält also die deutliche Mehrheit der Asylsuchenden keinen Schutzstatus. Allerdings hat die Ablehnung des Asylantrags nicht unbedingt zur Folge, dass die betroffenen Personen auch unmittelbar wieder ausreisen. Im Jahr 2017 wurden rund 232.000 Asylanträge abgelehnt, aber nur 52.000 Ausreisen von abgelehnten Asylbewerbern registriert. Der Hauptgrund hierfür dürfte sein, dass ein großer Teil der abgelehnten Asylbewerber Rechtsmittel einlegt. So ist die Zahl der Verfahrensneuzugänge an den Asylkammern der Verwaltungsgerichte zwischen 2015 und 2017 von rund 50.000 auf rund 328.000 gestiegen. Erledigt wurden im Jahr 2017 rund 146.000 Fälle. Dies ist ein ungünstiger Zustand, da grundsätzlich das Bundesamt für Migration und Geflüchtete (BAMF) über die Asylanträge entscheiden sollte und nicht die Verwaltungsgerichte. Daher sollten die Prozesse beim BAMF so optimiert werden, dass die Ansatzpunkte für Klagen minimiert werden, ohne den Geflüchteten dabei den Zugang zu den Rechtsmitteln, der für sie von existenzieller Bedeutung sein kann, zu verbauen. Auch wären Verbesserungen bei der europäischen Zusammenarbeit in der Asylpolitik dringend wünschenswert. Bei den Dublin-Verfahren zeigt sich ein sehr eindrückliches Bild. Im Jahr 2016 hat Deutschland insgesamt rund 54.000 Gesuche auf Übernahme von Asylbewerbern gestellt. 29.000 wurden in den Partnerländern positiv und 20.000 negativ beschieden. Überstellungen erfolgten jedoch im Jahr 2016 nur 8.512. Bei der Integration der Geflüchteten in den Arbeitsmarkt zeigen sich erste Fortschritte. So ist die Beschäftigungsquote von syrischen Staatsangehörigen zwischen März 2016 und Dezember 2017 von 6,9 Prozent auf 19,4 Prozent gestiegen und hat sich damit nahezu verdreifacht. Auch bei Irakern und Afghanen sind seit Mitte letzten Jahres deutliche Anstiege zu verzeichnen. Dennoch liegen die Werte immer noch weniger als halb so hoch wie bei allen Ausländern. Um die Lage weiter zu verbessern, sollte die Integrationspolitik konsequent weiterentwickelt werden. Dabei sollte eine kritische Evaluation der bestehenden Integrationsmaßnahmen erfolgen, um sicherzustellen, dass sie auch tatsächlich effektiv und effizient sind. Ist dies der Fall, sollten sie dauerhaft institutionalisiert werden, soweit nicht bereits geschehen. ; Since the strong influx of refugees in 2015 and 2016, the number of refugees coming to Germany has significantly decreased. In total, 187,000 asylum seekers were registered in 2017 and 223,000 people filed a formal application for asylum. This is the sixth highest value in the history of the Federal Republic after the years 2015 and 2016 and 1991 to 1993 and a slight further decline can currently be expected. However, the countries of origin have shifted significantly. In 2016, around half of the asylum seekers came from Syria and Iraq, whereas it were only one third in 2017. In contrast, the proportion of Africans has risen from 11.0 percent to 23.8 percent. Overall, the countries of origin have become much more diverse. As a result, the recognition rate dropped from 62.4 per cent in 2016 and 43.4 per cent in 2017 to just 32.3 per cent in the first quarter of 2018. Currently, the clear majority of asylum seekers does not get a refugee status. However, the rejection of an asylum application does not necessarily mean that the persons concerned immediately leave the country. In 2017, around 232,000 asylum applications were rejected, but only 52,000 exits by rejected asylum seekers were registered. The main reason for this may be that a large proportion of rejected asylum seekers files a suit. The number of new cases in the asylum chambers of the administrative courts has risen from around 50,000 in 2015 to around 328,000 in 2017. The number of completed procedures amounted to 146,000. This is an unfavorable situation as in principle the Federal Office for Migration and Refugees (BAMF) should take the decision on the procedures and not the courts. Therefore, the BAMF should improve its processes to make the decisions less disputable. Also, improvements in European cooperation on asylum policy would be highly desirable. The Dublin proceedings deliver a very impressive picture. In 2016, Germany submitted a total of around 54,000 applications for the takeover of asylum seekers. 29,000 were granted positive and 20,000 negative in the partner countries. However, only 8,512 were transferred to other member states in 2016. The integration of refugees into the German labor market is making some progress. For example, the employment rate of Syrian nationals rose from 6.9 per cent to 19.4 per cent between March 2016 and December 2017, nearly tripling. Iraqis and Afghans have also recorded significant increases since the middle of last year. Nevertheless, the values are still less than half as high as for all foreigners. In order to further improve the situation, integration policy should follow the model of demanding and promoting people. Moreover, a critical evaluation of the integration measures should be conducted out to ensure that they are actually effective and efficient.

Modernization processes in Russian Empire, which took place in the second half of the nineteenth century, were distinguished by changing of social and economic life. The main changes in economic life stipulated the necessity of changes in the whole state system. Therefore during 60–70 years series of administrative and political reforms were conducted. They covered the basic components of life of the empire (provincial, judicial, military, educational, censorial, etc.). Modernization processes made a great impact on the increase of the number and significance of intellectuals. The demand for educated people, particularly in the South, stimulated the development of the educational sector. After the approval of the «Regulations of notarial part» (1866) notaries became very important for society because they were not only educated persons, but also had to fulfill a number of requirements in order to be able to engage in notary. Before taking the oath at a session of the District Court the notary had to comply with some requirements which related to various spheres of notary's life. In particular, the person has to be a Russian citizen who is elder than 21. Also security deposit was compulsory. It was intended to provide compensation for damages caused by the notary professional activities. A special test was conducted by the head of the District Court, a senior notary and the prosecutor. During this test a person who claimed to occupy the position of the notary had to be tested in terms of the ability to expound notarial acts, knowledge of notarial proceedings' forms, civil laws and various statutes required for notarial work. Modernization processes of Russian Empire in the second half of XIX century led to the reforms that positively influenced the next aspects: active development of cities, particularly in southern Ukraine, raising the prestige of intellectual work, increase of the number of notary institutions and strengthening of the notaries role in private and public affairs ; Модернизационные процессы в Российской империи, которые проходили во второй половине XIX века отличились изменением общественной и экономической жизни насе- ления. Серьезные изменения в экономической жизни обусловили необходимость преоб- разований во всей государственной системе. Спрос на образованных людей, в частности на юге, стимулировал развитие образовательной сферы. Важную роль после утверждения «Положения о нотариальной части» (1866) играли нотариусы, которые были не толь- ко образованными, но и должны были выполнить ряд требований для того, чтобы иметь возможность заниматься нотариальной деятельностью. Требования, которые должен был соблюсти нотариус перед принятием присяги на заседании окружного суда касались различных сфер жизни нотариуса. В частности, данное лицо должно было быть российским подданным, достигшим 21-летнего воз- раста, обязательным было внесение залога, также человек, претендовавший на за- нятие должности нотариуса, должен пройти проверку на предмет умения правильно излагать нотариальные акты, знание форм нотариального производства, граждан- ских законов и различных уставов, необходимых для совершения нотариальных дей- ствий. Модернизационные процессы Российской империи второй половины XIX века приве- ли к осуществлению реформ, которые положительно повлияли на активное развитие городов, в частности на Юге Украины, к поднятию престижа умственного труда и увеличению количества нотариальных учреждений и роли нотариата в частных и гос- ударственных делах ; Модернізаційні процеси в Російській імперії, які проходили в другій половині ХІХ сто- ліття відзначилися зміною суспільного та економічного життя населення. Вимоги, яких повинен був дотриматися нотаріус перед складанням присяги на засі- данні окружного суду стосувалися різних сфер життя нотаріуса. Зокрема, дана особа повинна бути російським підданим, який досяг 21-річного віку, обов'язковим було вне- сення застави також особа, яка претендувала на зайняття посади нотаріуса мала пройти перевірку на предмет вміння правильно викладати нотаріальні акти, знання форм нотаріального провадження, цивільних законів і різних статутів, необхідних для вчинення нотаріальних дій. Mención Internacional en el título de doctor ; The topic of the slump of the Imperial religious system in Hispania has been mainly approached through the study of councils' proceedings, martyrial acts, Imperial or Visigothic laws (e.g. the Codex Tehodiosanus or the Lex Visigothorum), and a bunch of Christian texts written during the 5th and 6th centuries CE by Hydatius, Orosius, Saint Martin of Braga and few others. Since these sources present an unstructured and very simplified image of what is basically reduced to the category of "paganism", the actual features of polytheism in 4th century Hispania has remained mostly unexplored. The silence of "pagan" sources has led to the assumption that religion did not substantially change until the end of the 4th century, when Christianity was consolidated into the State religion, political power ordered the closure of the temples and the prohibition of sacrifices. Likely this large due to the fact that, as Javier Arce warned more than a decade ago in his book Bárbaros y romanos en Hispania (2005), archaeological studies mainly focused on the phenomenon of urban Christianisation rather than on the "depaganisation" of public and religious buildings (p. 248). However, during the last two decades, the intensification of archaeological excavations in numerous Spanish sites has provided new data that allow us to approach the process of religious change in Hispania from a new perspective. The aim of this study is to shed light on this debate through the examination of the disappearance of polytheism in different regions of the Iberian Peninsula by analysing the conditions of discovery and the circumstances of abandonment of sanctuaries and related epigraphic sources in Hispania Citerior Tarraconensis. A further study of 10 cities from Baetica and 8 from Lusitania has been intended to offer a wider vision of this process. In addition, comparative analyses have been also carried out in Roman Britain, Gaul and North Africa. The most important finding to emerge from this study is that in 80 % of the cities that provided enough information to establish reliable chronologies of the process of abandonment of temples, sanctuaries were derelict between the end of the 2nd and the end of the 3rd centuries. Imperial religious system seems to have survived until the 4th century solely in large administrative centres, such as the provincial capitals of Tarraco and Augusta Emerita. The causes for the decay of the sanctuaries that settled in the Iberian Peninsula for two centuries can be found in the recession of certain economic sectors that affected most of Hispania's territories. The maintenance of these sacred spaces largely depended on the munificence of the aristocracies and on the financial contribution of public institutions, which were interested in sustaining a system that provided them with prestige and possibilities of social promotion. However, the economic difficulties and the structural transformations which operated in Hispania from the end of the 2nd century to the beginning of the 4th resulted in a municipal crisis, which led to the collapse of this religious system in many parts of the Iberian Peninsula. When comparing Hispania to other regions of the Roman West, one might say these changes took place prematurely. In contrast to some scholar's statements, the abandonment of sanctuaries did not lead to a privatisation of the religious practices that previously belonged in the public or collective sphere. There was no increase in the number of lararia, votive figurines, or domestic altars. Nor was there any construction of private temples that could have filled the religious wilderness resulting from the collapse of the religious system. And yet, this process did not lead to the end of polytheism. It was not The Last Pagans. It was a change in mentalities which led to desist from the use of the traditional Early Imperial religious' materiality and, consequently, the transformation of rituals. The closure of the temples and the failure of the Early Empire's 'administrated religion' was not initiated by the introduction of Christianism, but by a crisis of the own religious system. The evolution of Christianity in Hispania was slow. The first major Christian religious complexes did not begin to be built until the 5th century. This illustrates that, up until that moment, the Spanish Church did not start to have a certain economic solvency, derived from a widespread acceptance among the population. Furthermore, an actual Christianisation of the rural territory did not begin until the 6th century. In light of this data, we are able to assert that in Hispania, during the 4th century, there was no clash between the structured polytheism and an emerging Christianity. If there ever was a religious repression, it must have been after the 5th century, when peninsular Christianity had strong institutional support. National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes (abbr. – Asset Recovery and Management Agency or ARMA) is a special governmental body, authorized to formulate and implement state policy in the sphere of tracing, finding of assets that are subject to seizure and that are aimed to be seized, as well as management of seized assets in criminal proceedings.In the article are analyzed the principles of legal support for the implementation and functioning of modern information processes in the institutional and administrative activities of the ARMA. Internal and external preconditions for establishment of the National Agency are the following: to improve mechanisms for tracing and finding of assets which illegally withdrawn from Ukraine as a result of corruption and other crimes, and development of transparent and effective mechanisms for managing of seized assets; obligations within Visa Liberalization Action Plan, obligatory recommendations within OECD dialog, and other inter-national obligations of Ukraine. The mechanism of detection, search and management of assets are public functions, the implementation of which is impossible without the following processes of information activity: creation, exchange and dissemina-tion of information; protection of information and data protected by law; data administration, data digitization; analysis and statistics, etc. ARMA is one of the key elements of the anti-corruption mechanism both to counteract corruption and to eliminate its negative effects. Asset detection, search and asset management procedures are carried out within the framework of an integral information activity, which at the same time accompanies interdepartmental management processes. One of the key principles of the implementation of the state policy of management of corrupt assets in the activities of ARMA is wide powers of: obtain, process and disclose information about assets; access to information resources, including those held by entities of foreign jurisdiction; providing relevant responsibilities of authorities, local governments, individuals and legal entities to provide information, as well as coercive mechanisms in case of failure to provide information; wide publicity of the facts and procedures for the seizure of assets in criminal proceedings; processing of other criminal information requiring security and safety; generalization and rapid exchange of information on assets obtained by crime. ARMA information activity includes: accumulation, structuring of information; selecting the necessary data in the context of a specific search criteria; monitoring of data entry, correction and publication; control and comparison of performance of the department, contractors; automation of the formation of certificates, reports maintenance of statistics and accounting of correspondence; ensuring the integrity and reliability of information, etc.Administering the Register of seized assets is a special type of complex information work that requires special regulatory support in the form of a separate Regulation on the Unified Register of Arrested Assets. ; У статті проаналізовано засади правового забезпечення впровадження та функціонування сучасних інформаційних процесів в інституційній та управлінській діяльності АРМА. Механізм виявлення, розшуку та управління активами – це публічні функції, реалізація яких є неможливою без таких процесів інформаційної діяльності, як: створення, обмін та поширення інформації; захист відомостей та даних, що охороняються законом; адміністрування даних, оцифровування відомостей; аналіз та статистика тощо. Діяльність АРМА є одним із ключових елементів антикорупційного механізму як з метою протидії корупції, так і ліквідації її негативних наслідків. Процедури виявлення, розшуку та управління активами здійснюються в межах невід'ємної інформаційної діяльності, яка водночас супроводжує внутрівідомчі управлінські процеси. Одним із ключових принципів реалізації державної політики менеджменту корупційних активів у діяльності АРМА є широкі повноваження щодо: отримання, обробки та розголошення інформації про активи; доступу до інформаційних ресурсів, у тому числі тих, які містяться у розпорядженні суб'єктів іноземної юрисдикції; забезпечення відповідними обов'язками органів влади, місцевого самоврядування, фізичних та юридичних осіб надавати інформацію, а також механізмами примусу у разі ненадання інформації; широкого поінформування громадськості про факти та процедури арешту активів у кримінальних провадженнях; обробки інших відомостей у сфері кримінального процесу, які потребують захищеності та безпеки; узагальнення та оперативного обміну інформацією щодо активів, одержаних злочинним шляхом. Інформаційна діяльність АРМА є різнотиповою та включає: накопичення, структурування інформації; здійснення відборів необхідних даних у розрізі конкретно заданого критерію пошуку; проведення моніторингу внесення, коригування та видання даних; контроль та порівняння показників роботи відділу, виконавців; автоматизацію формування довідок, звітів; ведення статистики та обліку кореспонденції; забезпечення цілісності та достовірності інформації тощо. Адміністрування Єдиного реєстру арештованих активів – це спеціальний вид складної інформаційної роботи, що потребує спеціального нормативного забезпечення у формі окремого Положення про Єдиний реєстр арештованих активів. Досягнення високих показників під час виявлення, розшуку та управління активами, а також їх повернення з іноземних юрисдикцій у взаємодії з органами досудового розслідування, слідства та суду, іноземними партнерами, а також бізнес-спільнотою, громадянами вимагає від АРМА впровадження не тільки сучасних інформаційних технологій, їх обслуговування, а й якісного інформаційно-правового забезпечення зазначених процесів.

Запропоновано власну модель консенсусного громадсько-державного управління, в якій провідну роль відведено громадським організаціям. Despite the attempts of state authorities to emphasize the readiness for constructive cooperation, the current state of relations between the state and society in Ukraine does not improve the situation in this direction. Therefore, the necessity of applying different models and approaches to the coordination of management activities between the institutions of society and the state is precisely within the context of public administration.Recent research and publications analysis. The issue of management activity of government institutions occupies a prominent place in state-management research studies. Some aspects of the interaction between the institutions of society and the state were investigated in the works of T. Andriychuk, S. Teleshun, V. Gelston, O. Kornievsky, E. Kuznetsov, M. Latsybi. The foreign experience in this field has been introduced by I. Belyi.Highlighting previously unsettled parts of the general problem. Taking into account the current interaction between authorities and citizens, it is worthwhile to focus on specific mechanisms for optimizing the coordinated management activities of public and state institutions. In particular, the question of the place and role of civic organizations as the key elements of civil society and their managerial potential in these processes has not been studied yet.Paper main body. In this case, we propose a consensus-based public-government model that can be used as a mobilization-integration tool for organizing citizens in any territorial environment – whether it is a united territorial community, a specific region, or a country as a whole.Government bodies and local self-government bodies, while implementing the process of decentralization of public administration at all levels, create favorable conditions for publicity and openness of communication with civil society institutions and public organizations in particular. Proceeding from the fact that the process of decentralization is aimed at the end-to-end democratization of institutional relations and affirms the admission of certain administrative powers of representatives of civil society, we consider it appropriate to reformat the nature of relations in the direction of promoting civil society organizations, where their role will be tangible and public, not superficial.This concerns the practical involvement of representatives of civil society into the cooperation with authorities, through a synthesis of the distribution of managerial powers and the adoption of consolidated decisions. This, in our understanding, is the introduction of a consensus model.The key category in this research is the term "consensus", which is understood as the fact of the consent of the main socio-political forces (entities) regarding the distribution of power and management values. It can be also understood as the search for mutually acceptable solutions that can satisfy all stakeholders in the management process. In this model, it is important to have an equitable distribution of functions performed by its subjects, as well as a balance of interests and relationships that operate on the principles of consensus-based democracy.The most important incentive for the conscious and systematic adoption of this model is the desire and ability to find a common language and units on the way of realizing socially important tasks. The following principles, such as trust, respect, consistency, persuasion, purposefulness, serve as incentives for using this model in public administration. The experimental platform for such a model is an open discussion platform, which we regard as a modern approach in public administration, indicating the refusal of the monological way of obtaining the true result and the recognition of the dialogue in achieving the results. Consequently, one should speak about the awareness of each participant of the managerial process of the subjectivity of state-public relations.Management procedure that would implement this model should be democratic, since dictates and excessive control over the functioning of the consensus structure overturns the conceptual nature of this form of cooperation. The key role of the state in this context is to give the initiative to public organizations, public leaders, managers, insiders, which we would call agents, to offer the field of activity on parity, stimulating conditions.Conclusions of the research and prospects for further studies. The use of a consensus model in practice will facilitate the establishment of close partnerships between the institutions of society and the state. The stereotypes of the managerial superiority of state authorities over public initiatives and functional inability of civic organizations to influence the implementation of state policy are the real obstacles in this process. Therefore, the model is one of the many opportunities for attracting institutions to the national context, an important content of social communication, the basis of coordination and management activities, which generally has a real and effective impact on the development of democratic governance.
