Aproximación al contenido constitucionalmente protegido del derecho de propiedad de los pueblos indígenas sobre sus territorios ancestrales

Abstract

The main purpose of this article is to develop the constitutional content of the right of property of the indigenous people over territories where they have lived historically, that regarding the problem of the Government compromise on granting property titles. In order to achieve this, first, it follows the national and international jurisprudence that develop this topic. Later on, this article makes an approximation to the content of this right of property in our constitutional context. Also, it suggests the protection the Government should provide to grant this right and the measures that have to be taken. Finally, it develops possible answers to the principal questions this topic brings on. ; El presente artículo tiene como principal objetivo desarrollar el contenido constitucional del derecho a la propiedad de los pueblos indígenas sobre los territorios que han habitado históricamente, en vista del problema que presenta la obligación impuesta por el Estado peruano de registrar su titularidad. Para ello, en primer lugar, se seguirá tanto la jurisprudencia nacional como internacional que ha desarrollado el derecho a la propiedad de los pueblos indígenas. Luego, se hará una aproximación a su contenido dentro del marco constitucional en nuestro país.Asimismo, se hablará del resguardo que debe brindar el Estado a este derecho y las medidas que está obligado a brindar para hacer efectiva su protección. Finalmente, se desarrollarán respuestas tentativas a las principales interrogantes que surgen con respecto a este derecho.
