Abstract: The present essay starts from the premise that many private lawyers share my intuition that the research field has received relatively little attention. There is an abundant debate about the Common Frame of Reference and the Common European Sales Law; but the influence of primary Community law on private law as well as the visible European regulation of private law in all its facets have been neglected. The structuring of the different levels of relations between EU and private law discloses specific deficiencies. In the final part of the essay the reasons are investigated which may lie behind this limited attention. Résumé: Le point de départ de cette contribution est un constat partagé par de nombreux privatistes – l'importance limitée du sujet. Alors que le projet de cadre commun de référence et le droit commun européen de la vente ont été abondamment débattus, tant l'influence du droit européen primaire sur le droit privé que la régulation européenne de toutes les facettes du droit privé ont été négligées. L'analyse structurelle des différents niveaux de la relation entre le droit de l'Union européenne et le droit privé met en évidence les défaillances spécifiques à chacun de ces niveaux. La dernière partie de l'étude est consacrée aux raisons qui peuvent expliquer l'attention limitée portée à ces questions.

Abstract: The European Union (EU) is playing an ever stronger role in the regulation of private law since the adoption of the Single European Act. This is true if one broadens the perspective and includes regulatory private law that is developing in selected fields of law, mainly in the area of regulated markets. This harmonized private law must be applied by the Member States. Under the architecture of the Treaty, the Member States enjoy procedural autonomy. They are free to choose and to determine the appropriate institutions and the remedies. The multilevel governance structure of the EU, however, challenges the seemingly clear-cut division of responsibilities and competences. This contribution aims to analyze the transformation of enforcement in private law. Three parameters are used to give shape to the transformation: the distinction between minor and major infringements, the changing functions of enforcement institutions, regulatory agencies, courts, Alternative Dispute Resolution (ADR) bodies, non-governmental organizations, collective entities, such as standard or certification bodies, and last but not least the emergence of new remedies. The contribution concludes with an outlook to the possible consequences of the transformation process: on the sharing of responsibilities between the institutions, on the entanglements in the multilevel governance structure, and on the impact on the law and its integrity, which seems to be undermined. Zusammenfassung: Die Europäische Union hat sich seit der Verabschiedung der Einheitlichen Akte im Jahre 1985 immer stärker in die Gestaltung des Europäischen Privatrechts eingeschaltet, jedenfalls wenn man dem hier zugrunde gelegten Verständnis von Privatrecht folgt. Europäisches Privatrecht ist regulatorisches Privatrecht, das sich von den Rändern her, vor allem über die Regelung von sektorialen Märkten sukzessive dem Kern traditionellen Privatrechts nähert. Dieses Privatrecht soll nach der Architektur der EU Verträge von den Mitgliedstaaten angewendet werden. Sie sind autonom in der Wahl der Institutionen und der Rechtsbehelfe. Tatsächlich hat die Mehr-Ebenen Struktur der EU eine Verschränkung der scheinbar klaren Aufteilung der Verantwortung zur Folge. Der Beitrag zielt darauf, die Transformationsprozesse im regulatorischen Privatrecht nachzuzeichnen. Dies erfolgt anhand dreier Parameter: (1) der Unterscheidung zwischen minimalen und schwerwiegenden Rechtsverletzungen, (2) dem Funktionswandel der Institutionen, die in die Rechtsdurchsetzung eingeschaltet sind: Gerichte, Behörden, Alternative Streitbeilegungsforen, Nicht-Regierungsorganisationen, sowie kollektive Entitäten, die von der EU auch mit Aufgaben der Überwachung des Rechts beauftragt werden, wie Standardisierungs- und Zertifizierungseinrichtungen; (3) schließlich dem Wandel der Rechtsbehelfe. Der Beitrag schließt mit einem Ausblick auf die sich abzeichnenden Konsequenzen des Transformationsprozesses: für die Aufgabenverteilung zwischen den Institutionen, für die Zentralisierungs- und Fragmentierungstendenzen innerhalb des Mehrebenensystems und für das Recht selbst, dessen Integrität auf dem Spiel zu stehen scheint.
