The concerns are the order of the day, lack of clarity in the conduct regulated by this law has paved the way to long for a Constitutional Court ruling in order to protect and safeguard the integrity of our political charter ; En la actualidad el tema del derecho de autor, se encuentra en el ojo del huracán, debido a la promulgación de la ley 201 de 2012, que más que aclarar el tema, crea una verdadera inseguridad frente a sus alcances.Es así, como surge la tarea de analizar la norma, con el fin de establecer en qué términos se aprobó y cual es su trascendencia jurídica, frente a la conducta desarrollada por los usuarios de Internet.Sorprendió en días pasados, la prontitud con que se resolvió una ley tan polémica, como la denominada por algunos Ley lleras 2.0. Ley que regula la responsabilidad de los proveedores de servicios de Internet, frente a las infracciones de derecho de autor de los usuarios.Se oyen posiciones encontradas, hay quienes aseguran que se trata de una exigencia del gobierno norteamericano, a raíz de la entrada en vigencia del TLC suscrito entre los dos países; otros señalan, que es parte integrante del Plan Nacional de Desarrollo propuesto por el gobierno de Juan ManuelSantos. Diversos puntos se esgrimen a favor y en contra. La realidad presente, es que la opinión públicase encuentra muy confundida, sin saber con claridad que conducta es legal y cual no lo es, si están incurriendo en conductas delictivas o si por el contrario, su actuar está dentro de los parámetrospermitidos por el legislador.Pero más allá de las verdaderas motivaciones que impulsaron la aprobación de esta ley por parte del Congreso de la República, la confusión reinante en torno a los alcances de esta disposición, es el comúndenominador ¿Cómo se vigila a los cibernautas para saber si están vulnerando el derecho de autor?, ¿Qué ocurre con las descargas de música y video?, ¿Los PSI tienen el deber de retirar el contenido divulgado a través de sus redes? ¿En qué situación particular un usuario de Internet podría ser privado de la libertad?, ¿Existe conducta delictiva cuando se comparten 'links' de otras páginas, por ejemplo en una red social?
