Just war theorists who argue that war is morally justified under certain circumstances infer implicitly that establishing the military institutions needed to wage war is also morally justified. In this paper, I mount a case in favor of a standing military establishment: to the extent that going to war is a way to discharge duties to protect fellow citizens and distant strangers from grievous harms, we have a duty to set up the institutions that enable us to discharge that duty. I then respond to four objections drawn from Ned Dobos's recent book Ethics, Security, and the War-Machine.
Treason is one of the most serious legal offences that there are, in most if not all jurisdictions. Laws against treason are rooted in deep-seated moral revulsion about acts which, in the political realm, are paradigmatic examples of breaches of loyalty. Yet, it is not altogether clear what treason consists in: someone's traitor is often another's loyalist. In this paper, my aim is twofold: to offer a plausible conceptual account of treason, and to partly rehabilitate traitors. I focus on informational treason, as the act of passing secret intelligence to foreign actors without authorization. I argue that informational treason is sometimes justified, indeed morally mandatory; even when it is morally wrong, its beneficiaries are sometimes justified, indeed obliged, to make use of the intelligence thereby provided.
This article seeks to show that the rights which protect people's autonomy should be entrenched in the constitution of a democratic state. It is firmly located in egalitarian liberal tradition, as it takes for valid the following claims: (1) people have a fundamental interest in autonomy; (2) people have rights that their interest in autonomy, and the interests to which it gives rise, be protected and promoted; (3) people's respective interests in autonomy must be protected equally. The argument for a bill of rights unfolds as follows: first, it is argued that we have autonomy-protecting rights not only against private individuals but also against the state, and the meaning of having such rights against the state is explained; then it is shown that it is legitimate to turn certain autonomy-protecting moral rights into legal rights, and that doing so in the case of the rights we have against the state amounts to turning them into constitutional rights; lastly, two objections to the argument deployed earlier are countered.
It is widely alleged that President Putin's regime attempted to exercise influence on the 2016 U.S. presidential election. It is known that its Soviet predecessors funded Western communist parties for decades as a means to undermine noncommunist regimes. Similarly, the United States has a long history of interfering in the institutions and elections of its Latin American neighbors, as well as (at the height of the Cold War) its European allies. More recently, many believe that, absent U.S.-driven assistance, the Democratic Opposition of Serbia would have lost the 2000 Yugoslavian presidential election to Slobodan Milošević. As those examples suggest, attempting to subvert the democratic elections of a putatively sovereign country is a time-honored way of bending the latter's domestic and foreign policy to one's will. In this paper, I focus on the state-sponsored, nonviolent, nonkinetic subversion of nationwide elections (for short, subversion) through campaign and party financing, tampering with electoral registers, and conducting disinformation campaigns about candidates. I argue that, under certain conditions and subject to certain constraints, subversion is pro tanto justified as a means to prevent or end large-scale human rights violations.
THIS ARTICLE ARGUES THAT IF ONE IS COMMITTED TO CIVIL AND POLITICAL RIGHTS, ONE MUST ALSO ADVOCATE THE CONSTITUTIONALIZATION OF SOCIAL RIGHTS. IT MAKES A CASE FOR CONSTITUTIONAL SOCIAL RIGHTS AND CLARIFIES THE RELATIONSHIP BETWEEN CIVIL, POLITICAL, AND SOCIAL RIGHTS, AND BETWEEN NEGATIVE AND POSITIVE RIGHTS. IT ARGUES THAT A DUTY DISTINCTION IS VALID AND THAT THE JUDICIARY CAN LEGITIMATELY DEAL WITH CONSTITUTIONAL SOCIAL RIGHTS.
