Rights, Democracy and the Constitution ; Derechos, democracia y constitución
It is often taken for granted that whoever endorses the thesis of the "coto vedado" is committed to that specific institutional structure that is constitutionalism in the "strong" form that results from the combination of two main pieces: the primacy of a constitution that includes a catalog of basic rights and the existence of a judicial control mechanism of the constitutionality of ordinary legislation. In any case, constitutionalism has a thorny unfinished business in relation to what is usually called a "counter majority objection." If, as moral ideals, one starts not only from rights but also from the value of democracy, then the road to constitutionalism is perhaps less smooth than it seems. I will try to show that, if, as supporters of the moral ideal of the forbidden preserve, we understand that one of our rights is to participate on equal terms in collective decision-making, then an adequate balance between procedural and substantive values recommends, in my opinion, the adoption of the kind of institutional design that we can call "weak constitutionalism." ; Normalmente se da por sentado que quien haga suya la tesis del coto vedado queda comprometido con esa específica estructura institucional que es el constitucionalismo en la forma "fuerte" que resulta de la combinación de dos piezas maestras: la primacía de una constitución que incluya un catálogo de derechos básicos y la existencia de un mecanismo de control jurisdiccional de constitucionalidad de la legislación ordinaria. De todos modos,el constitucionalismo tiene una espinosa cuenta pendiente en relación con lo que es usual denominar «objeción contramayoritaria». Si como ideales morales se parte no sólo del de los derechos, sino también del valor de la democracia, entonces el camino hacia el constitucionalismo es quizá menos llano de lo que parece. Intentaré mostrar que, si como partidarios del ideal moral del coto vedado entendemos que uno de nuestros derechos es el de participar en términos igualitarios en la toma de decisiones colectivas, entonces un balance adecuado entre valores procedimentales y sustantivos recomienda a mi juicio la adopción de la clase de diseño institucional que podemos denominar "constitucionalismo débil".
