The article is dedicated to the problems of European political identity and European identity as a whole conception and as a foundation for European integration. Before 24 February 2022, European political identity had been in crisis. The contradictions between the EU member states seemed to be hardly resolvable. The Russian aggression against Ukraine gave a strong impetus to the formation of European identity. However, it is still a negative incentive for unity and solidarity rather than cohesion around positive values, as well as from the outset the European integration was caused by devastating World War II as a negative experience, which should never be repeated. The text makes use of methods peculiar to the philosophical sciences, i.e. critical textual analysis, historical-analytical and comparative methods.

Alexander Heinze untersucht die unterschiedliche Interpretation der Beweisoffenlegungsregelungen vor dem Internationalen Strafgerichtshof (IStGH) und schlägt ein neues System der Beweisoffenlegung vor, in dem die Parteien die Konsequenzen ihres Handels im Allgemeinen und der Verletzung ihrer Offenlegungspflichten im Speziellen in Grundzügen voraussehen können. Durch eine kritische Rechtsprechungsanalyse weist er nach, dass die uneinheitliche Einordnung des geltenden IStGH-Prozesssystems über die Anwendung der systematischen Auslegungsmethode direkte Auswirkungen auf die Lösung prozessualer Fragestellungen hat, von denen die Beweisoffenlegung das prominenteste Beispiel darstellt. Aus diesem Grund klassifiziert der Autor den IStGH-Prozess neu und kommt zu dem Schluss, dass es sich bei dem IStGH um ein »hierarchisch« strukturiertes Gericht in Form einer internationalen Organisation handelt, dessen Prozesssystem dem »programmatischen« Ideal gleicht. Diese Klassifizierung wird nun als allgemeine Rechtslehre im technischen Sinne für eine weite systematische Auslegung fruchtbar gemacht und direkt auf die bestehenden Beweisoffenlegungsregelungen angewendet. Aufwendige philosophische und rechtstheoretische Überlegungen werden so mit einer hoch relevanten und praktischen Fragestellung verknüpft. »International Criminal Procedure and Disclosure« analyses the different interpretations of disclosure rules at the International Criminal Court (ICC) and introduces a new disclosure regime, where the parties will be able to actually foresee the consequences of their conduct (i.e. non-disclosure). Through a critical case law analysis Heinze illustrates that an inconsistent classification of the nature of the ICC-process has – via the application of a contextual interpretation – a direct impact on decisions about concrete procedural issues, of which disclosure is the most prominent example. For this very reason Heinze re-classifies the ICC-process and concludes that the ICC is a hierarchically structured international organisation with a »policy-implementing« form of procedure, that nevertheless contains adversarial elements usually found in a system of coordinate authority with a »conflict-solving« form of justice. This classification serves as a »general jurisprudence« in its technical sense, which enables the Judges to conduct a coherent contextual interpretation. The book thereby establishes a connection between legal theory, philosophy, sociology and comparative law on the one hand and a highly relevant procedural question on the other hand. Alexander Heinze wurde im Februar 2014 promoviert und erhielt für seine Arbeit im selben Monat den Fakultätspreis des Jahres 2013 für die beste Dissertation. Alexander Heinze, born in Borna/Germany in 1983, graduated from Georg-August-University of Göttingen School of Law in 2008. In the same year, he became research assistant at the Institute of Criminal Law, Criminal Procedure and International Criminal Law, Department for Foreign and International Criminal Law to Prof. Dr. Dr. h.c. Kai Ambos. He is lecturer of the course »Einführung in die deutsche Rechtssprache und juristische Arbeitsmethoden« (Introduction to the German legal language and methodology) at the University of Göttingen and member of the ICC's Legal Tools Project. In February 2014, Alexander Heinze received a doctor's degree for his thesis »International Criminal Procedure and Disclosure« and was awarded with the University of Göttingen School of Law Prize for the best dissertation in 2013.
The intertwinement of EC law and national law may create unforeseeability in situations where EC law invades the national cases, which gives rise to the very question of legal certainty in EC law. This study contributes to the contemporary discussion, which wrestles with the following questions in particular: - What have been the visions and objectives for European integration in the last decades? - How to describe European Union as a political entity and a legal system? - What is the relationship between legal certainty, rule of law, various general principles and human rights? - What is the core of legal certainty on the basis of the case study? - What kind of legal arguments and patterns of justification are there from a comparative perspective? - How has the term 'legal certainty' been defined in the Nordic legal theory? - How predictable and acceptable are the interpretations of the European Court of Justice - is it "running wild"? Legal certainty relates to the principle of non-retroactivity and the protection of legitimate expectations in particular, but more profoundly it can be related to the conceptual scale for weighing up and balancing between formal justice and material fairness in legal decision-making. This scale is illustrated by presenting the terms 'formal', 'factual' and 'substantive' legal certainty
