Discrimination against the Child in Access to Education Based on Ethnic Origin as Examplified by the Roma Minority in Selected Countries Summary The aim of this study is to draw attention to the common problem of discrimination against children in access to education due to their ethnic origin. This problem affects particularly children of the Roma minority, who are subject to practices prohibited by anti-discrimination law, in particular school and class segregation and the practice of improper placement of Roma children in special schools. The article presents an analysis of the situation of Roma children in three selected countries: Poland, the Czech Republic and Slovakia, based on source data, in particular research on discrimination and minorities conducted by the European Union Agency for Fundamental Rights and other collected data. The study also presents methods and attempts by states to combat practices that discriminate against children of Roma origin.

The commented judgement concerns an allegation of discrimination in the recruitment process for studies preparing to become a military doctor, when the national authorities denied a female-applicant the right to take the military medical school entrance exam on the basis of her height (she was 150 cm tall and weighed 44 kg). The Ministry of National Defence argued that the law required all military personnel to be able to perform any mission, and that this meant being able to carry a standard soldier's kit weighing around 57 kg. The European Court of Human Rights found that the reasons why the applicant was treated differently from other women – who met the weight and height requirements – were not "relevant and sufficient". In particular, the national courts accepted the MND's argument equating size with strength. Even though size had recently been eliminated from the list of selection criteria and that the applicant was now free to apply to the military academy of her choice, the Court found that she had been unfairly disadvantaged at the time of her application. The co-authors of the gloss agree with the position of the Court and the reasoning presented, while addressing both: the philosophical grounds of the equality principle and the evolution of the judicial dialogue between the ECHR and the CJEU.
Nowadays interpersonal safety in social interactions is becoming increasingly significant. Words and phrases such as hatred, hate speech, discrimination, contempt, verbal aggression, and bias-motivated crimes have been constantly present in our daily life and public discussions, which led to the new forms of social pathology. These phenomena pose a considerable danger to the social continuity, especially to the constantly evolving democracy in Poland. The main aim of the article is to attract the reader's attention to the danger triggered by verbal aggression, which has a detrimental impact on people's safety and their interactions in different spheres of social life. ; Bezpieczeństwo interpersonalne w relacjach społecznych nabiera w dzisiejszych czasach szczególnego znaczenia. Nienawiść, mowa nienawiści, dyskryminacja, pogarda, agresja werbalna czy przestępstwa z nienawiści to słowa, które nieustannie pojawiają się w naszym życiu i dyskursie publicznym, przybierając postać nowej patologii społecznej. Są to zjawiska, które w chwili obecnej stanowią bardzo poważne zagrożenia dla trwałości społeczeństwa obywatelskiego, a przede wszystkim dla ciągle kształtującej się demokracji w naszym kraju. Głównym celem artykułu jest zwrócenie uwagi czytelnika na zagrożenia, jakie niesie za sobą agresja werbalna dla poczucia bezpieczeństwa człowieka i jego relacji interpersonalnych występujących w różnych dziedzinach życia społecznego.

This work deals with discrimination in recruitment against people with hearing impairment. The work defines basic concepts of the discrimination, hearing impairment and the Czech sign language including the basic legislation on this issue. In this context, research has been carried out in order to identify attitudes and experience of people with hearing impairment and the reactions of employers to a hearing-impaired job seeker. ; Niniejsze opracowanie dotyczy dyskryminacji w zakresie rekrutacji osób z wadami słuchu. W artykule zdefiniowano podstawowe pojęcia dotyczące dyskryminacji, upośledzenia słuchu oraz czeskiego języka migowego, w tym podstawowe akty prawne w tym zakresie. W tym kontekście przeprowadzono badania mające na celu określenie postaw i doświadczeń osób z wadami słuchu oraz reakcji pracodawców na poszukującego pracy z wadą słuchu.

W badaniujako perspektywę teoretyczną przyjęto teorię europeizacji. Analizy przeprowadzono w oparciu o dane ilościowe. Badanie wykazało, że Komisja nadzorując implementację równościowego i antydyskryminacyjnego prawa UE wychodziła z roli egzekutora nakładającego sankcje i chętnie toczyła dialog z państwami członkowskimi. Badanie ujawniło ponadto preferencje Komisji,tzn. większe zainteresowanie dwoma dyrektywami (2000/43/WE i 2000/78/WE) oraz mniejszą skłonność do patrzenia na naruszenia zasady równości i niedyskryminacji z perspektywy ekonomicznej, a bardziej ujmowanie ich w kategorii pogwałcenia praw jednostki. Przeprowadzone badanie pokazało ponadto, że w nadzorowaniu implementacji równościowego i antydyskryminacyjnego ustawodawstwa UE można odnaleźć elementy governance, do których zaliczyć należy współpracę z partnerami zewnętrznymi (sieci ekspertów) posiadającymi zasoby (informację), których brakuje Komisji, a które są niezbędne do prowadzenia kontroli. ; The main research problem of the article consists in a question on the method of supervising implementation of equality and anti-discrimination law by the European Commission in the years 2002–2015. The study showed that the Commission, overseeing implementation of the equality and anti-discrimination law of the EU, used to come out of the role of "the guardian of the treaties" and was discussing problems of infringements in dialogue with Member States. The survey also revealed preferences of the Commission, i.e. greater interest in the two directives (2000/43/EC and 2000/78/EC), and less likely to look at the infringement of the principle of equality and non-discrimination from an economic perspective but more in terms of violation of individual rights. Moreover the study revealed that elements of governance could be found in Commission's activity, namely cooperation with external partners (network of experts) who had resources (information) that the Commission needed for the inspection. Analysis was based onthe quantitative data. The theory of Europeanization has been applied to the analysis.
