Cash waqf is a movable waqf which serves to promote benefitd to people. Cash waqf plays an important role in helping to solve social and humanitarian problems, such as: poverty alleviation and people's economic empowerment. The success of waqf management by nazhir (a party who takes responsibility to manage the waqf) is not only indicated by the amount of waqf managed, but also by the extent to which the empowerment of waqf can provide added value for the productive activities of the community. Using a qualitative approach, this study seeks to explore the management of cash waqf by waqf institutions in Pemalang Regency, Central Java. Data collection was carried out using interview technique. To increase the validity of the data, method and data source were triangulated by involving several relevant data collection methods. Furtehrmore, it also involved various parties as informants, including: key persons from the Indonesian Waqf Board of Pemalang and Central Java branches, local government, ACT (Aksi Tanggap Cepat) of Central Java and Jakarta branches, to triangulated the data sources. The results of this study provide an overview of the implementation of waqf principles and governance, transparency and accountability of waqf management, and the urgency of coordination of various parties in implementing cash waqf in waqf institutions in Pemalang Regency.Keywords: Waqf; Cash Waqf; Waqf Management; Transparency; Accountability

Waqf has important role in the life of Muslims. In Indonesia, the issue of waqf management optimalization in promoting the welfare of the poor has long been practiced collectively by various community organizations and educational institutions. The Indonesian government has issued various regulations about function optimally of waqf. This research is descriptive analytical, using normative legal research methods, namely legal research conducted by researching library materials. The research was conducted by analyzing the laws and regulations related to waqf in Indonesia. This study concluded that state regulations in Indonesian waqf management have been started since the Dutch Colonial Government, followed by the Old Order, New Order and Reform Order governments. Waqf regulations are not only based on one school of jurisprudence (mazhab), but are based on various schools of thought by taking opinions that are considered relevant in the development of contemporary waqf.

Poverty alleviation can be done through the social function of Baitul Maal wat Tamwil (BMT) such as the management and development of cash waqf. In this case, the government has issued several regulations to support the management and development of cash waqf. This study aims to analyze the social function of BMT Artha Amanah Bantul based on the management and development aspects of cash waqf in accordance with the Indonesian laws and regulations. This research is descriptive qualitative research with interview data collection methods conducted on the administrator of BMT and wakif. The results showed that the management and development of cash waqf in BMT Artha Amanah Bantul has included planning, organizing, leadership, and controlling, while the development of cash waqf covered management patterns, the welfare of nazir, and transparency and accountability. But some efforts to manage and develop the cash waqf undertaken by BMT Artha Amanah Bantul were still not in accordance with the applied laws and regulations. These incompatibilities have implications for the management and development of cash waqf. However, it can be concluded that the management and development of cash waqf in BMT Artha Amanah Bantul based upon the laws and regulations in Indonesia has reflected the social function of BMT.

This article examines the management of waqf in Indonesia where most of the management in is done with a manual system or a computerized system. This system is limited to inputting data on Microsoft Excel, while the waqf and the government sometimes cannot access information about assets that are represented and managed by nadzir. In fact, the management of waqf by the legal entity or company management is minimal in neglecting the waqf assets assigned to them. However, if the management of the waqf is done by individuals, it is sometimes found that management is not transparent, and it is not uncommon for waqf assets surrendered by the endowment to be claimed as private property by the private heirs of the individual nadzir. Therefore, based on the cases of waqf management, a waqf management system is needed that can provide transparency in its management so that Nadzir, waqif, and the government easily access information about the development of waqf management and for nadzir itself, it will be easier to record and account for all waqf assets that he manages.

Abstract: Waqf is an economic tool that can bring prosperity to the community. Therefore, good and proper management is required to realize the best interests of wakaf property. As the manager and developer of waqf property, Nazhir must have the ability and skills to manage waqf property. For this reason, special standardization is required to obtain a capable Nazhir based on the wealth of the waqf under management. When the management of the wakaf property works well and produces the best benefits, then these benefits can be used as the beneficiaries of the wakaf property to prosper the community. In the Law on Waqf No. 41 of 2004 and Government Regulation No. 42 of 2006 it has been stated about the responsibilities, roles, and functions of Nazhir. In addition to the law, there are also minimum requirements and abilities that an individual or group of Nazhir must possess. It is hoped that Nazhir in the future will have special abilities. Even though he did not have special skills, Nazir must have a strong desire to learn something related to the management, management and development of Waqf. Abstrak: Wakaf merupakan alat ekonomi yang dapat membawa kesejahteraan bagi masyarakat. Oleh karena itu, diperlukan pengelolaan yang baik dan benar untuk mendapatkan manfaat yang terbaik dari harta wakaf. Sebagai pengelola dan pengembang harta wakaf, Nazhir harus memiliki kemampuan dan keterampilan dalam mengelola harta wakaf. Abstract: The Development of Waqf Management Throught Waqf Act in Indonesia (Note on Republic of Indonesia Act Number 41 of 2004 regarding Waqf). Waqf is an Islamic endowment of property to be held in trust and used for a charitable or religious purpose. The development of waqf law in Indonesia, as one of religious institutions, is the realization of Muslim community needs to fulfill their religious life. The object of waqf that formerly was focused on immovable objects, with the presence of the Act has been broader to movable property, especially money waqf. This paper describes the urgency of civilization and the dynamics of waqf both from the side of law and its management in the context of people prosperity. By using library research that use qualitative data, this paper found the existence of waqf, normatively lies not only in the individual obligations, but also in social meaning in the context of collective obligations involving mawqûf bih (the property), wâqif (the person creating a waqf), nazir (the supervisor/manager of waqf), mauqûf 'alayh (waqf users), and the government through legislation. Basically, the Republic of Indonesia Act Number 41 of 2004 regarding Waqf is based on the philosophical, sociohistorical, and juridical foundation.

This paper discussed the implementation and management of cash waqf during the Ottoman Empire. During the reign, waqf has become an instrument that is very successfully implemented in various sectors such as religion, education, social, and health. Waqf assets continued to increase and not only provided facilities for public but also assisted people who need capital to do business. Nazir as waqf institution (individual or institution waqf manager) have administered waqf with different schemes, such as providing loans in the form of qard hasan, mudharabah, bai'ul-inna, and bidaa. Management waqf institutionally was evaluated by the government in 1823, this evaluation led to the reformation of waqf institution and founded the new waqf institution which was known as Evkaf-I Hümayun Nezareti. This institution was the Ottoman sovereign wealth fund which functioned to manage all waqf assets. All waqf assets, as well as cash waqf, were managed by this institution with various schemes that are not much different from what has been done before. However, in this period the management of cash waqf was only carried out by this institution as the authority for managing waqf assets. The management of waqf assets under this institution lasted until the end of the Ottoman Turkish government. The establishment of cash waqf institutions in the Ottoman empire has shown an important step that has been taken to ensure the effectiveness of cash waqf development. Cash waqf management in the Ottoman empire has proof waqf as Islamic social finance in Islamic economic theory shown a significant contribution to society and the Ottoman government.

The aims of this study was to determine the effectiveness of waqf management after the enactment of the waqf management law in Indonesia. As we all know that waqf is not only normative worship but also has a social element in it, thus making it one of the keys to the welfare of Muslims. Therefore, the management of waqf property is very important to be known together. This research used normative juridical research that examines the legal provisions of waqf property management in Indonesia and the study of legal instruments in classical fiqh books regarding waqf management. The potential of waqf in Indonesia is very large, for that the Indonesian government must establish a regulation that regulates the procedures for the collection and management of waqf assets as regulated in Act No. 41 of 2004 concerning waqf. The regulation had led to the birth of an independent institution in charge of collecting and managing waqf assets which are called the Indonesian Waqf Board (BWI). Therefore, there is a need for synergy from various parties regarding the collection and management of waqf assets. If so far BWI is an independent institution in charge of managing waqf, so it is necessary to coordinate with the Agrarian Office, waqf asset management institutions operating in the private sector such as the Indonesian Waqf Savings Account or non-governmental organizations (NGOs). This is done with the hope that Indonesia can optimize its waqf assets and the result of waqf can become an instrument that can reduce poverty.

This study aims to determine the practice of waqf, productive waqf management of sengon Plantations until the time of harvest and development of productive waqf in Sengon plantation. This study uses qualitative methods, then the results of the analysis using SWOT analysis. The results of this study indicate that the fund of productive waqf assets will be received in 2020 and fully submitted to the Republika Dompet Dhuafa. In the SWOT analysis, the strength are the land is fertile, the ability of Dompet Dhuafa management to appoint farmer is good, and as nazhir Dompet Dhuafa has an excessive experiences in productive waqf management. The weaknesses are the planting space is too close and the lack of spraying of pests in the sengon tree. The opportunities are the opening of cooperation with timber companies / traders, the opening of export opportunities to increase government foreign exchange and the good market price of sengon trees. While the threat faced is the presence of natural factors such as bad weather which causes the sengon tree to collapse.

Purpose – The aim of this research is to find out the financing mechanism or the waqf assets funding done by nazhir and to find the ideal mechanism for the development of waqf assets.Method – This is a qualitative research with a case study approach. The research object was selected using purposive sampling, namely nazhir waqf in Central Java which manages productive waqf including: Sultan Agung Waqf Foundation (YBWSA), Semarang Grand Mosque Management Agency (BPMAS), and Pekalongan City Muslimin Foundation (YMKP).Result – This study found that the Sultan Agung Waqf Foundation (YBWSA) implements a mechanism for waqf financing in the form of public funding, government assistance, murabahah, and ijarah. BPMAS implements a waqf financing mechanism in the form of donations alms, government assistance, ijarah, and cash waqf. Meanwhile, YMKP provides financing for the development of its waqf assets in the form of government assistance and qardul hasan. Implication – This study can be used by government, policy maker, business party, or scholar to create an optimal and ideal mechanism in developing waqf assets.Originality – In the past, studies of waqf asset management were performed in the context of middle east, mostly Kuwait. This study provides waqf asset management in context of South East region.
