The purpose of the research aims to analyse the validity of the decision by Panwaslih Aceh number 001/PS/SN.20/VII/2018 as opposed to article 60 section (1) letter j under KPU regulations number 14 in 2018. KPU regulations do not allow individual prospective candidates to participate in the regional representative board election whose former drug convicts, had committed sexual crimes against children, or had corruption before. the research is normative juridic research using theory and legislation approach. The result of the research showed the moment of decision was made, KPU regulations still applied. The decision of Panwaslih Aceh has already exceeded its own authority as a result of not accommodating KPU regulations. KPU regulations should be changed at first or being said by the supreme court that KPU regulations are contrary to the law. DKPP as electoral management body ethics council was expected to run its function more actively without a complaint first.
Pasal 60 ayat (4) Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintah Aceh dinyatakan bahwa masa kerja Panitia Pengawas Pemilihan (Panwaslih) berakhir 3 (tiga) bulan setelah pelantikan kepala daerah tepilih, sementara dalam regulasi yuridis lainnya khususnya Undang-Undang Nomor 15 Tahun 2011 tentang Penyelenggara Pemilihan Umum dan Pemilihan menegaskan berakhir paling lambat 2 (dua) bulan setelah seluruh tahapan penyelenggaraan Pemilihan Umum selesai. Ketua Badan Pengawas Pemilihan Umum (Bawaslu) Republik Indonesia mengeluarkan Surat Edaran Nomor: 0240/K.Bawaslu/TU.0001/III/2017 tentang Penegasan Masa Tugas Lembaga Pengawas Pemilihan Umum Ad Hoc dalam Rangka Pemilihan Gubernur dan Wakil, Bupati dan Wakil Bupati dan/atau Walikota dan Wakil Walikota Tahun 2017. Surat Edaran tersebut disimpulkan bahwa masa kerja Panwaslih di Aceh berakhir pada bulan Mei bagi daerah yang terdapat penyelesaian sengketa di Mahkamah Konstitusi dan bulan Juni bagi daerah yang vakum sengketa. Hal ini mengakibatkan ketidakpastian hukum bagi penyelenggara Pemilihan Kepala Daerah dan menimbulkan kegaduhan dalam internal Panwaslih di Aceh. Penelitian ini mengkaji bagaimanakah kedudukan dan kekuatan hukum Surat Edaran Bawaslu, mengkaji kepastian hukum masa kerja Panwaslih di Aceh atas keputusan Bawaslu Republik Indonesia yang telah mengeluarkan Surat Edaran yang dijadikan rujukan Pemerintah Aceh untuk merevisi Peraturan Gubernur sebelumnya mengenai masa kerja Panwaslih di Aceh. Metode Penelitian yang digunakan adalah penelitian normatif atau penelitian hukum kepustakaan.The article 60 paragraph (4) of the Act Number 11, 2006 concerning the Government of Aceh stated that the working period of the Election Committee ends 3 (three) months after the inauguration of the elected regional head, while in other juridical regulations especially the Act Number 15, 2011 concerning the General Election Organizer and the Election stipulates to expire no later than 2 (two) months after all stages of the election are completed. Chairman of the Election Supervisory has issued the Circular Letter Number: 0240/K.Bawaslu/TU.0001/III/2017 on the Affirmation of Ad Hoc Election Observer Period of Governor and Deputy Regent, Deputy Regent and Deputy Regent, and or Mayor and Deputy Mayor 2017. Based on the Circular Letter, it states that the working period of the Committee in Aceh ends in May for the area where there is a dispute resolution at the Constitutional Court and in June for the vacuum of the dispute. This has resulted in legal uncertainty for the election organizers and caused frenzy within the internal the Election Advisory in Aceh. This research aims to explore the position and legal power of the Election Supervisory Board Circular Letter, to review the legal certainty of the working period of the Election Committee in Aceh on the decision of General Election Supervisory Board of the Republic Indonesia which has issued a Circular Letter as the reference of the Government of Aceh to revise the previous Governor Regulation concerning the working period of the committee in Aceh. Demokrasi ditingkat lokal tidak akan berjalan dengan baik kalau aspek-aspek fundamental dari penyelenggaraan Pilkada tidak diperhatikan. Tahapan program dan jadwal Pemilihan Bupati dan Wakil Bupati Tahun 2017 di Kabupaten Buleleng adalah salah satu bagian dari pelaksanaan penyelenggaraan Pilkada di Kabupaten Buleleng yang dilakukan oleh KPUD Buleleng, dalam pelaksanaanya tersebut tentunya perlu dilakukan pengawasan untuk untuk menciptakan proses pilkada berkualitas, demokratis, yang sesuai dengan peraturan dan perundang-undangan serta berkepastian hukum. Lembaga pengawas yaitu Panwaslih Kabupaten Buleleng melakukan tugas pengawasan terhadap penyelenggaraan Pemilihan Bupati dan Wakil Bupati Tahun 2017 di Kabupaten Buleleng , dan untuk mengetahui bagaimana peran, kendala dan upaya yang dilakukan oleh Panwaslih Kabupaten Buleleng dalam menjalankan tugasnya sebagai pengawas maka penulis melakukan penelitian ini dengan menggunakan metode jenis penilitian hukum empiris, yang diantaranya harus berdasarkan fakta-fakta yang ada dalam masyarakat, menggunakan data primer dan data skunder. Pengumpulan data menggunakan studi pustaka dan penelitian lapangan. Data dikumpulkan dengan melakukan studi dukumentasi dan wawancara. Data di analisis dengan menggunakan metode kualitatif dan disajikan secara deskritif analisis.
This research aims to analyze election violations committed by election organizers in Aceh Besar Regency in 2019. The violation of this election occurred at several points in the sub-district of aceh regency, where the violation of the law is contained in the administration of the election file and also in the part of the organizer that is the election implementation team. This is one of the indicators in this study. Using empirical juridical research methods and qualitative data analysis, the study found that there were only 5 (five) unlawful actions in aceh besar district elections, among which there were un registerable reports, muted reports and follow-up reports to the Jantho District Court. It is recommended to the government, Bawaslu, Panwaslih to conduct more checking or control and also full supervision on a scale to minimize the on-the-process election violations in Aceh Besar Regency in particular as well as other districts.
Abstract: Article 1/ No.5/ Act No. 15/ Year 2011 on the Implementation of General Election states that "the implementation of general election at the national level is the responsibility of organizations, the so called the General Election Commission (or known as KPU in bahasa) and the General Election Controller (or the national BAWASLU in bahasa). Both of them have an integrated function in implementing the election for choosing the member of the House of Parliaments (DPR in bahasa), the Regional Representative Council (or DPD in bahasa), the House of Parliaments at regional level (or DPRD in bahasa), the President and Vice President elected directly by the people, as well as to elect governors, regents, and city-majors, democratically". Furthermore, Article 60 (3) letter a Law Number 11/ Year 2006 regarding the Government of Aceh states that "members of the General Election Controller as being referred in paragraph (1) and paragraph (2) could be proposed by the House of Parliaments of Aceh Province (or DPRA in bahasa)/ the House of Parliaments at the District Level (or DPRK in bahasa) up to a maximum of 5 (five) person". This may cause disharmony and may impede the election itself. The objective of this study is to determine which institution is actually being authorized to choose the member of General Election Controller in Aceh province. Methodology applied in this research was juridical normative research (or juridical normative). Results showed that the national BAWASLU has the highest authority to choose its member at the provincial level, including in Aceh. Moreover, the Election Supervision Committee (PANWASLIH) is merely authorized to supervise election for choosing provincial leaders. This study suggests the Government of Aceh and the national BAWASLU to understand and to fulfill their responsibilities according to their authorities so that disharmony and misinterpretation can be avoided.Keywords : Government of Aceh, general election, election controller, election committee.Abstrak: Pasal 1 angka 5 UU Nomor 15 Tahun 2011 tentang Penyelenggaraan Pemilihan Umum menyatakan bahwa: "Penyelenggaraan Pemilu adalah lembaga yang menyelenggarakan Pemilu yang terdiri atas Komisi Pemilihan Umum (KPU) dan Badan Pengawas Pemilu (BAWASLU) sebagai satu kesatuan fungsi penyelenggaraan Pemilu untuk memilih anggota Dewan Perwakilan Rakyat (DPR), Dewan Perwakilan Daerah (DPD), Dewan Perwakilan Rakyat Daerah (DPRD), Presiden dan Wakil Presiden secara Langsung oleh Rakyat, serta untuk memilih Gubernur, Bupati, dan Walikota secara demokratis". Selain itu, Pasal 60 ayat (3) huruf a Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh menyebutkan bahwa "anggota Panitia Pengawas Pemilihan sebagaimana dimaksud pada ayat (1) dan ayat (2), masing-masing sebanyak 5 (lima) orang yang diusulkan oleh DPRA/DPRK". Hal ini dapat menyebabkan disharmonisasi aturan sehingga dapat menghambat tahapan pemilu itu sendiri. Tujuan penelitian untuk mengetahui lembaga mana yang sebenarnya dapat mengisi anggota BAWASLU Aceh. Metode penelitian yang digunakan penelitian hukum normatif (yuridis normative). Hasil penelitian menunjukkan bahwa BAWASLU pusatlah yang berwenang mengisi anggota BAWASLU di tingkat provinsi, termasuk di provinsi Aceh. Selain itu, panitia pengawas pemilihan (PANWASLIH) hanya berwenang mengawasi PILKADA. Disarankan kepada pemerintah aceh dan BAWASLU pusat untuk memahami dan mengisi tanggung jawabnya sesuai kewenangan sehingga disharmonisasi dan misinterpretasi dapat dihindari. This study explores and discusses the phenomenon of a single candidate in the local leaders' election or Pemilihan Kepala Daerah (Pilkada) in Deli Serdang Regency, North Sumatra Province, in 2018. The study is motivated by the phenomenon of a single candidate in the local leaders' election. In Deli Serdang, the local leaders' election should have a multi-candidate pattern, either independent or 3-4 political party candidates. This study has focused on the mechanism of the emergence of a single candidate. According to Dahl, the theoretical approach is the candidacy mechanism, and according to Norris, the significance of the right to vote. The study was conducted qualitatively with an ongoing explorative, independent, and case-oriented study approach. The data collected through in-depth interviews with nine key informants consisting of the Political Party Branch Management Board or Dewan Pimpinan Cabang (DPC), the General Elections Commission or Komisi Pemilihan Umum (KPU), the Election Supervisory Committee or Panitia Pengawas Pemilihan (Panwaslih), independent, failed, and incumbent candidates. The sixteen secondary informants consisted of eight voting behaviors and eight non-voting behaviors randomly selected and interviewed to determine their perception of a single candidate. The study found that a single candidate is the logical consequence of ambiguity in an internal political party candidacy. The study's novelty is the exclusion of incumbent ruling candidates incentivizing a political party monopoly to ensure victory in contestation. The study concluded that the dysfunction of the candidacy and exclusion in power has implications for a single candidate in the local leaders' election. Contestation with a single candidate's presence is an uncontested election, and it is contrary to the theoretical paradigm referred to in this study.
