Card Payments and Consumer Protection in Germany ; Kartenzahlungen und Verbraucherschutz in Deutschland
Während der Löwenanteil der Bezahlungen immer noch bar erfolgt, nimmt auch in der Bundesrepublik die Zahl der Kartentransaktionen im Einzelhandel stetig zu. Doch kennen viele Verbraucher ihre Rechte nicht, die ihnen zustehen, wenn ein Händler an die Bezahlung mit Karte Bedingungen knüpft. Der erste Teil dieses Beitrags führt in die deutsche Zahlungskultur ein, die sich von der in vielen EU-Nachbarstaaten stark unterscheidet. Der zweite Teil konzentriert sich auf den Verbraucherschutz im Karteninhaber-Händler-Verhältnis. Es werden Fragen über die Erfüllungswirkung einer Kartenzahlung und nach der Kartenakzeptanzpflicht des Händlers sowie der Zulässigkeit von Gebührenaufschlägen diskutiert. Auch wird die Praxis einiger Kommunen, kein Bargeld mehr in Bürgerämtern anzunehmen und nur die girocard zu akzeptieren, im Hinblick auf die europäische Rechtslage diskutiert. Abschließend erfolgt eine Gesamtbewertung des gesetzlichen Ordnungsrahmens. ; While the lion's share of consumer payments in Germany is still cash-based, card payments are steadily becoming more popular in retail. However, many consumers are unaware of their rights against merchants trying to impose unfair conditions on them. The first part of this article discusses the payments culture in Germany which differs significantly from the situation in many neighbouring EU countries. The second part focuses on consumer protection matters in the cardholder-merchant relationship, discussing the discharge of contractual debt by card payment as performance, potential contractual duties of merchants to accept cards and legal restrictions of surcharges on consumer payments. Furthermore, the practice of certain local government councils to require customers to pay with domestic cards of a specific brand (girocard) in place of cash or cards of other brands, is analysed with reference to European law. The article concludes with an overall evaluation of the statutory framework.

FINANCIAL LITERACY VERSUS FINANCIAL BEHAVIOR: Credit Card Payment
The topics on financial literacy, financial education and financial behavior has excelled in academia, this relevance is attributed to the increasing development of financial markets, demographic changes, economic, political and social factors which the company is exposed in recent decades. In this context, sought to investigate what financial performance, the effect of spending with a credit card and profile of income, the students of the Faculty of Economic Sciences, administrative and accounting (FEAC), the Universidade de Passo Fundo (UPF) in relation to the payment of the invoice of the credit card. The study is characterized as descriptive, data analysis was used for the statistical technique of ANACOR. Within the various findings highlights the fact that there occurs a significant relationship between age versus payment of the invoice credit card in relation to the commitment of the payment of the invoice of the card. It is expected that the study will contribute to promote economic and social improvements, in this way, allowing actions to be undertaken to reduce the levels of debt. ; Os temas sobre alfabetização financeira, educação financeira e comportamento financeiro tem se destacado no meioacadêmico, esta relevância é atribuída ao crescente desenvolvimento dos mercados financeiros, das mudançasdemográficas, econômicas, políticas e sociais que a sociedade está exposta nas últimas décadas. Diante deste contexto,buscou-se investigar qual o comportamento financeiro, a partir dos gastos com cartão de crédito e perfil de renda, dosestudantes universitários da Faculdade de Ciências Econômicas, Administrativas e Contábeis (FEAC), da Universidade dePasso Fundo (UPF) em relação ao pagamento da fatura do cartão de crédito. O estudo é caracterizado como descritivo,para análise dos dados foi utilizado a técnica estatística da ANACOR. Dentro os diversos achados destaca-se o fato denão ocorrer uma relação significativa entre a idade versus pagamento da fatura de cartão de crédito em relação aocomprometimento do pagamento da fatura do cartão. Espera-se que o estudo contribua para oportunizar melhoriaseconômicas, sociais, desta forma, possibilitando que ações sejam realizadas para reduzir os níveis de endividamento.

Price differentiation and menu costs in credit card payments

Purpose
– The purpose of this paper is to model a credit card market where the retailers may charge differential prices depending on the instrument of payment used by the consumer. According to the research agenda proposed by Rochet and Wright (2010), the authors find conditions for the existence of differential prices equilibrium and analyze the effects of that price differentiation on the consumer's welfare.
Design/methodology/approach
– This is done when the consumer has also the store credit as an alternative of payment. The equilibrium prices are computed assuming a Hotelling competition among retailers in both scenarios, when the cost of the store credit provided by the retailer is greater than that provided by the credit card and vice versa.
Findings
– From this, the authors prove that the average price under the price differentiation is lower than the single price under the no-surcharge rule; nevertheless, the retailer's margins remain the same in both situations. Furthermore, some cross-subsidies are expunged when price differentiation is allowed. The authors also conclude that the consumers' welfare is greater when the no-surcharge rule is abolished. Finally, if the retailers face menu costs whenever they differentiate prices, the authors provide sufficient conditions for differential prices remain as equilibrium.
Practical implications
– This is an important input for discussions among regulators and players of the credit card market.
Originality/value
– From the analysis the authors can conclude that price differentiation, according to the instrument of payment, is a welfare improving policy. The authors explicitly determine the average price in that setting and the differentiated prices even in presence of costs that arise from price differentiation. The obtained theoretical results can be used as an input for econometric modeling purposes.
