The article examines the problem of delimitation of legal status: official and official. The category of legal status is an important component for every participant in public relations, because such a status will depend on the scope of his civil rights and responsibilities, which is especially relevant for an official or official.It was found that today the issues of the studied categories, namely «legal status of an official» and «legal status of an official» still remain relevant because there is no unanimous position for their delimitation. It is clear that the categories of «official», «official» occupy a leading position in the field of public administration, criminal law, litigation, other areas of law and legislation. These categories should be key in the preparation of regulations relating to the civil service, regulation of law enforcement agencies, determining the legal responsibility of persons holding certain positions in the civil service.Conclusions are made where, given that at the legislative level there is no single definition of «official» and «official», and the proposed definitions in legal science are mainly sectoral in nature, the priority is: first, the definition in the Law «On basics of civil service», which must be adopted, the concepts of «official» and «official» and their features. The task of today's legislator is the need to differentiate them. Therefore, when determining the grounds for assigning persons to the categories of officials or officials should be guided by the relevant legislation governing certain relations.Regarding the legal status of officials and officials, the conclusion was that a significant factor in distinguishing these categories, unfortunately, is not legal status, because without a clear distinction between the basic concepts of «official» and «official», we can not fully describe the differences in this status.Keywords: service, position, legal status, civil service, official, employee, official ; У статті досліджується проблема у здійсненні розмежування правового статусу: службової та посадової особи.Категорія правового статусу є важливим компонентом для кожного учасника суспільних відносин, адже від такого статусу буде залежати і його обсяг цивільних прав та обов'язків, що особливо є актуальним для посадової чи службової особи.З`ясовано, що на сьогоднішній день питання досліджуваних категорій, а саме «правовий статус посадової особи» та «правовий статус службової особи» і досі залишаються актуальними адже одностайної позиції для їхнього розмежування не існує. Визначно, що категорії «посадова особа», «службова особа» посідають провідне місце у сфері державного управління, кримінального права, процесу, інших галузей права та законодавства. Зазначені категорії повинні бути ключовими в підготовці нормативних актів, що стосуються державної служби, регулювання діяльності силових структур, визначення юридичної відповідальності осіб, які обіймають певні посади в системі державного апарату.Зроблено висновки, де зважаючи на те, що на законодавчому рівні відсутнє єдине визначення понять «посадова особа» і «службова особа», а запропоновані визначення в юридичній науці мають переважно галузевий характер, першочерговим завданням є: по-перше, визначення в Законі «Про основи державної служби», який необхідно прийняти, понять «посадова особа» і «службова особа» та їхніх особливостей. Завданням сьогоднішнього законодавця і є необхідність проведення їхнього розмежування. А тому, при з'ясуванні підстав для віднесення осіб до категорій посадових або службових осіб слід керуватися відповідним законодавством, що регулює певні відносини.Щодо правового статусу посадової та службової особи, то висновком стало те, що вагомим чинником для розмежування цих категорій нажаль правовий статус не є, адже не провівши чіткого розмежування між основними поняттями «посадова особа» та «службова особа», ми не зможемо повноцінно охарактеризувати відмінності у цьому статусі.Ключові слова: служба, посада, правовий статус, державна служба, посадова особа, службовець, службова особа

The level of functioning of the legal system in any state directly depends on the improvement of the mechanism of legal regulation as well as the mechanism of law enforcement activities. The accuracy of the transition of normative provisions within the framework of specific subjective rights and legal obligations, in the context of criminal law, the definition of grounds for criminal prosecution of an individual is one of the guarantees of consolidation of the rule of law. The central place among the means that facilitate to this is occupied by legal technique.The peculiarities of constructing the dispositions of articles 111, 114, 132, 145, 159, 163, 168, 182, 209-1, 232, 232-1, 328, 330, 361-2, 381, 387, 422 of the Criminal Code of Ukraine from the technical and legal point of view have been analyzed in the article. It is determined that in a number of situations that are the subject of criminal law protection, regulatory legislation provides for cases of lawful dissemination of information with limited access, using different legal terms to mark illegal and lawful conduct. The authors concluded that the indication of «illegality» of disclosure of information in the text of the criminal law has been used incorrectly, as other factors (local regulations, law enforcement acts, the will of the owner of information, etc.) can become regulators of legality of an individual's behavior. It is proposed to exclude from dispositions of Articles 145, 182, 232, 232-1, 361-2 of the Criminal Code of Ukraine the relevant feature, as well as to unify the terminology of the criminal law in terms of designation of the action.Keywords: information with limited access, secret information, disclosure of information, blanket disposition, mixed illegality ; Рівень функціонування правової системи у будь-якій державі напряму залежить як від удосконалення механізму правового регулювання, так і механізму правозастосовної діяльності. Точність переводу нормативних положень в русло конкретних суб'єктивних прав і юридичних обов'язків, визначення підстави для кримінального переслідування особи є однією із гарантій забезпечення верховенства права. Центральне місце серед засобів, які сприятимуть цьому, посідає юридична техніка.У статті з техніко-юридичної точки зору проаналізовані особливості конструювання диспозицій статей 111, 114, 132, 145, 159, 163, 168 , 182, 209-1, 232, 232-1, 328, 330, 361-2, 381, 387, 422 КК України. Визначено, що у ряді ситуацій, які є предметом кримінально-правової охорони, регулятивне законодавство передбачає випадки правомірного поширення інформації з обмеженим доступом, використовуючи різні юридичні терміни для позначення протиправної та правомірної поведінки. Автори дійшли висновку, що вказівка на «незаконність» розголошення інформації у тексті кримінального закону вжито некоректно, оскільки регуляторами правомірності поведінки особи можуть стати і інші фактори (нормативні акти локальної дії, правозастосовні акти, воля володільця інформації тощо). Запропоновано виключити із диспозицій статей 145, 182, 232, 232-1, 361-2 КК України відповідну ознаку, а також уніфікувати термінологію кримінального закону у частині позначення діяння.Ключові слова: інформація з обмеженим доступом, таємна інформація, розголошення інформації, бланкетна диспозиція, змішана протиправність

In today's reality, the issue of combating and preventing domestic violence is extremely important, as a large number of women and children are victims of such violence, although there are cases of domestic violence against men as well. In this paper, the issue of the role of the prosecutor's office in preventing and combating domestic violence was considered. The problems of legislative regulation of prosecutorial activity in the system of prevention and counteraction to domestic violence are also studied. In the process of writing the paper, the method of analysis and synthesis, empirical method and method of comparison were used. And, indeed, it is rightly noted in the topic of this article that this is still a problem. First of all, due to the fact that the current legislation does not clearly regulate what actions prosecutors can prevent or counteract domestic violence, as their powers include direct procedural support of such criminal cases, ie after such violence has already occurred.In our opinion, in order for the prosecutor's office to be able to effectively prevent and combat domestic violence, we propose to amend Article 131-1 of the Constitution of Ukraine, which defines the functions of the prosecutor's office in general and the prosecutor in particular. It is appropriate to supplement this article with a part that would give the prosecutor's office the right to take preventive measures to prevent and combat domestic violence. The research conducted in this paper can form the basis of legislative activity in the adoption of amendments to legislation governing the legal relationship in the field of preventing and combating domestic violence.Keywords: prosecutor's office, prosecutor, prosecutor's office, domestic violence, violence against women, violence against children, prevention of violence, counteraction to violence ; В реаліях сьогодення питання протидії та запобіганню домашньому насильству має вкрай важливе значення, оскільки велика кількість жінок та дітей стають жертвами такого насильства, хоча трапляються випадки домашнього насильства і щодо чоловіків. У даній роботі було розглянуто питання щодо проблематики ролі органів прокуратури в запобіганні та протидії домашньому насильству. Також досліджено проблеми законодавчого врегулювання прокурорської діяльності в системі запобігання та протидії домашньому насильству. В процесі написання роботи було застосовано метод аналізу та синтезу, емпіричний метод та метод порівняння. І, дійсно, вірно підмічено в темі цієї статті, що це є все ж таки проблемою. В першу чергу через те, що нормами діючого законодавства чітко не врегульовано якими ж діями прокурори можуть запобігати чи протидіяти домашньому насильству, адже в їх повноваження входить безпосередньо процесуальний супровід таких кримінальних справ, тобто після того як таке насильство вже відбулось.На нашу думку, щоб органи прокуратури могли ефективно запобігати та протидіяти домашньому насильству пропонуємо внести зміни у статтю 131-1 Конституції України, яка визначає функції прокуратури в цілому, та прокурора зокрема. Доцільним вбачається доповнити цю статтю частиною, яка б надавала право органам прокуратури здійснювати превентивні заходи щодо запобігання та протидії домашньому насильству. Abstract
This article explores issues of gender inequality in Ukraine. Gender-related issues have been exacerbated due to the full-scale invasion of the country by the Russian Federation on 24 February 2022. This tragic event has led us to adapt our research by addressing gender challenges before and after the invasion. Deploying the social quality approach, we distinguish gender processes in four dimensions: socioeconomic/financial (e.g., participation in labor activities), sociopolitical/legal (e.g., political inclusion), and sociocultural/welfare (e.g., deprivation and daily discrimination). We pay particular attention to legal aspects of gender equality and equal rights and opportunities in international and Ukrainian legislation. Finally, we clarify and substantiate the specific features of gender issues in Ukraine amid the current reality of military conflict.

The article considers the advantages and disadvantages of using artificial intelligence (AI) in various areas of human activity. Particular attention was paid to the use of AI in the legal field. Prospects for the use of AI in the legal field were identified. The relevance of research on the legal regulation of the use of AI was proved. The use of AI raises an important problem of the compliance with general principles of ensuring human rights. Emphasis is placed on the need to develop and use a Code of ethics for artificial intelligence and legislation that would prevent its misapplication and minimize possible harmful consequences.

The article provide an overview of EU waste legislation, main EU investment policy and its contributions to municipalities in the area of solid municipal waste management. The ways of ecological modernization of the management of solid municipal waste were investigated. Proposals for implementation of experience of EU member states, which has proved itself in practice, were made. The purpose of our scholarly work is to explore actual problems of harmonization of legislation of Ukraine in the sphere of environmental policy integration with EU law and development of proposals for the improvement of Ukrainian legislation. The state of environmental policy integration in Ukraine was assessed. Government strategies, programmes, concepts and plans in Ukraine and EU were analyzed. Based on comparison analysis differences and common problems of environmental policy integration in Ukraine and EU member states were determined and recommendations on the measures to be taken to ensure better integration of environmental policies in sectoral policies in Ukraine were made. This scholarly work examines the environmental protection legislation of Ukraine and its application in practice, aiming to identify the main challenges it faces in the context of the required harmonization of Ukrainian environmental legislation with EU law according to the Association Agreement, while also making suggestions on how to better respond to these issues. This paper also refers to the experience of EU member states in the field of environmental liability. Legal nature, content and meaning of the criminal liability of legal persons in the environmental sphere according to the law of EU member states were studied in order to determine the appropriateness and mechanism of implementation of such responsibility in Ukraine. Arguments for establishment of criminal liability of legal persons were presented. The article is devoted to the analysis of the features of legal protection of victims of domestic violence, with the purpose of identifying the positive experience that has been proved in practice and, therefore, is worth following in Ukraine as in other countries to prevent this form of violence. To achieve this purpose, general and special scientific research methods were used, in particular dialectical, historical-legal, systematic, comparative legal methods. In this regard, international experience in dealing with cases related to domestic violence was also studied using the examples of European countries and Canada and the United States. The legal provision for the protection of persons who have suffered domestic violence was also considered. As a contribution of the research, the problems of legal provision of judicial protection of victims of domestic violence in Ukraine were revealed and, at the same time, suggestions were made to improve the legislation regulating the killing. It is concluded that it is necessary to strengthen the position of the victim of domestic violence by giving her the opportunity to claim compensation for moral damages within the framework of a given criminal proceedings.

The relevance of the study is due to the increase in the number of actors in the field of preventing and combating domestic violence, among which the growing role of public administration. The purpose of the article is to carry out a comprehensive analysis of the legal framework for the activities of public administration entities that implement measures in the field of preventing and combating domestic violence. The leading methods for research have become dialectical - when considering the subjects of public administration; general methods (namely analysis and synthesis) - in the study of the concept of "domestic violence" and its varieties; comparative legal method - in the review and study of legal literature, the main scientific approaches to solving research problems, issues of classification of subjects and their administrative and legal status, analysis of foreign legislation. It is determined that domestic violence is a very important problem for Ukrainian society, characterized by imperfect legislation, difficult socio-economic situation and widespread ignorance of the population in their rights, as well as in ways to protect them. This is primarily due to the lack of resources of actors involved in measures to prevent and combat domestic violence. The need for tougher sanctions, the creation of specialized units of public administration and the creation of an effective mechanism for domestic violence based on the experience of the United States and Canada was also argued.

It is an indisputable fact that one of the most important problems today is global climate change. Climate change affects everyone and requires a concerted effort at regional, national and international levels. The most intensive legal regulation of environmental protection, including climate change, which has an extremely negative impact on the environment, is carried out on the European continent. The European Union is a leader in climate change prevention and an example for other countries. The state policy of Ukraine on legislative adaptation is formed as an integral part of legal reform in Ukraine and is aimed at ensuring common approaches to rule-making, mandatory consideration of European Union legislation in rule-making, training of qualified specialists, creating appropriate conditions for institutional, scientific, educational, technical, financial support of the process of adaptation of the legislation of Ukraine. In the scholarly work global and European trends in climate change prevention policy were revealed. The adaptation of Ukrainian legislation in the field of climate change to EU law was analyzed. The conceptual foundations of the environmental policy of Ukraine in the context of climate change were considered. The challenges and problems on the way to the implementation of climate policy were determined.
