La novela de Álvaro Pombo de 1999, "La cuadratura del círculo", es una meditación de una actualidad sorprendente sobre los límites de la ideología, sean dentro del terreno de la política, de la religión, de la filosofía o de la combinación de las tres. El presente estudio examina la imposibilidad de que una ideología dada ofrezca una interpretación consistente de la realidad, puesto que se reduce a una construcción, a una fabulación que es en gran parte una proyección egocéntrica de un sujeto poderoso y carismático. Para el individuo sustancioso, la interpretación de la realidad mediante un proceso racional es parecida a la cuadratura de un círculo. Tal es el caso no sólo de Acardo, el protagonista de la novela de Pombo, sino también del lector en su exégesis literal y alegórica del texto. El resultado final, paradójicamente, es la seguridad por parte de ambos de que el elemento verdaderamente eterno en la novela no se encuentra en las verdades de la ideología sino en la búsqueda individual para encontrar una vía que se adapte coherentemente a la naturaleza proteica de la realidad en la cual la incomprensión, no la comprensión, parece ser la única constante. ; Álvaro Pombo's 1999 novel, "La cuadratura del círculo", is a timely meditation concerning the pitfalls of ideology within the realm of politics, religion, philosophy, or a combination of the three. The present study examines the impossibility of ideology by offering a cogent interpretation of reality as it is merely a construction, a fabulation that is mostly an egocentric projection of a strong-willed individual. For the substantive individual, interpreting reality rationally through these ideologies is akin to "squaring the circle". This is the case not only of Pombo's protagonist Acardo, but also of the reader in the literal and allegorical exegesis of the text. Paradoxically, the final product is the realization by both parties that the truly timeless element present in the novel is not found in the truths of ideology but in the individual quest to find one that coherently adapts to the ever-changing nature of reality in which incomprehension, not comprehension, seems to be the only constant. ; peerReviewed

Does copyright violate the First Amendment? Professor Melville Nimmer asked this question forty years ago, and then answered it by concluding that copyright itself is affirmatively speech protective. Despite ample reason to doubt Nimmer's response, the Supreme Court has avoided an independent, thoughtful, plenary review of the question. Copyright has come to enjoy an all-but-categorical immunity to First Amendment constraints. Now, however, the Court faces a new challenge to its back-of-the-hand treatment of this vital conflict. In Golan v. Holder the Tenth Circuit considered legislation (enacted pursuant to the Berne Convention and TRIPS) "restoring" copyright protection to millions of foreign works previously thought to belong to the public domain. The Tenth Circuit upheld the legislation, but not without noting that it appeared to raise important First Amendment concerns. The Supreme Court granted certiorari. This article addresses the issues in the Golan case, literally on the eve of oral argument before the Court. This article first considers the Copyright and Treaty Clauses, and then addresses the relationship between copyright and the First Amendment. The discussion endorses an understanding of that relationship in which the Amendment is newly seen as paramount, and copyright is newly seen in the image of the Amendment.
