"This book conducts a gendered critique of the 'principle of distinction' in international humanitarian law (IHL), with a focus on recent conflicts in Africa. The 'principle of distinction' is core to IHL, and regulates who can and cannot be targeted in armed conflict. It states that civilians may not be targeted in attack, while combatants and those civilians directly participating in hostilities can be. The law defines what it means to be a combatant and a civilian, and sets out what behaviour constitutes direct participation. Close examination of the origins of the principle reveals that IHL was based on a gendered view of conflict, which envisages men as fighters and women as victims of war. Problematically, this view often does not accord with the reality in 'new wars' today in which women are playing increasingly active roles, often forming the backbone of fighting groups, and performing functions on which armed groups are highly reliant. Using women's participation in 'new wars' in Africa as a study, this volume critically examines the principle through a gendered lens, questioning the extent to which the principle serves to protect women in modern conflicts and how it fails them. By doing so, it questions whether the principle of distinction is suitable to effectively regulate the conduct of hostilities in new wars. How do women's rights groups campaign for vital institutional reform of archaic laws on sexual violence in new democracies? How can they best 'work politically' to achieve positive outcomes? What lessons are there for donors and supporters? The National Working Group on Sexual Offences (NWGSO), established to influence the progressive reform of national rape laws, became the largest civil society coalition to have collaborated on law reform in South Africa. It emerged at a time of profound change to South Africa's political settlement, and was a product of the new political processes that unfolded in the early years of the democratic transition. This research paper uses findings from a study of this women's coalition to demonstrate how civil society coalitions may draw on and expand their elite networks and exploit political and institutional arrangements to build developmental partnerships. It examines the strategies used by the coalition to broaden its support base and to achieve its objectives, as well as the factors influencing those areas where the coalition was less successful. In analysing the successes and setbacks of this groundbreaking coalition, this study offers lessons for civil society leaders, policy makers and developmental partners in how best to support developmental coalitions and strengthen their capacity to promote long-term, sustainable social change.

"As in many post-conflict countries, the roles played by women during Sudan's long-lasting liberation struggle continue to go unrecognised. Thousands of women joined the southern liberation struggle in response to a political situation that affected whole communities, leaving the comfort and security of their homes not just to accompany their husbands but to fight for freedom, democracy, equity, justice, rights and dignity. As well as playing roles in the fighting, women acted as mothers, teachers and nurses, and filled numerous other roles during the war. The long-standing struggle for the liberation of South Sudan severely altered traditional gender roles as well as the societal structure as a whole. Women also suffered during the war. An increase in HIV, hunger and violence, particularly sexual violence, characterised their lives in Sudan as well as in exile for many years. Life in the post-conflict period continues to be challenging, as women try to carve out a meaningful life in a tenuous peace. This volume documents the lives of different groups of women in South Sudan. It seeks to understand the contributions made by a range of women both during the conflict and today. It describes the women of South Sudan: who they are, what they have experienced, what they hope and feel, what they experienced in the war, and whether the end of the war has brought meaningful change"--Back cover
