The current Salvadoran criminal legislation and its effectiveness in the control of gang crime in the city of Santa Tecla ; La legislación penal salvadoreña vigente y su eficacia en el control de la delincuencia de pandillas en la ciudad de Santa Tecla
The gangs or gangs in El Salvador appeared strongly in the 1980s, but particularly in 2003 the criminal wave manifested itself in heinous and inhuman crimes such as beheadings, rapes, dismemberment of people, which seemed to be a mechanism to call society's attention to the marginalization they were in; This in turn resulted in a response from the authorities carrying out repressive measures and the formulation of special laws, in order to reduce the criminal boom of the gangs. The investigation was descriptive and the types of crime that are usually committed by gang members, which are regulated in the Criminal Code and in the so-called Anti-maras Law, are taken as a sample. The hypothesis stated that the Criminal Code does not diminish the criminal actions of gangs, but that all it does is punish unlawful behaviors constantly committed by theseindividuals The results showed that the type of crime most frequently committed by gang members are those related to personal integrity such as non-serious injuries and serious injuries; heritage crimes such as: aggravated robbery and aggravated robbery, aggravated theft and aggravated theft; crimes related to individual freedom and public peace such as: threats, illicit associations, belonging to a mara or gang. Regarding the Judicial Resolutions pronounced by the Judges consulted at the time of applying the Criminal Legislation to the gang members were: formal instruction, definitive dismissal, provisional dismissal and conciliation. In general, it was concluded that the Criminal Legislation in force during the course of the investigation was not effective in controlling gang crime in the city of Santa Tecla. ; Las maras o pandillas en El Salvador aparecieron con fuerza en la década de los ochentas, pero particularmente en el año 2003 la ola criminal se manifestó en crímenes atroces e inhumanos como decapitaciones, violaciones, descuartizamientos de personas, lo cual pareci6 ser un mecanismo para llamar la atención de la sociedad ante la marginación en que se encontraban; esto a su vez trajo como consecuencia una respuesta por parte de las autoridades Llevando a cabo medidas represivas y la formulación de Leyes especiales, con el fin de disminuir el auge delictivo de las pandillas. La investigación fue de tipo descriptiva y se tome como muestra los tipos de delito que usualmente son cometidos por los pandilleros, los cuales se encuentran regulados en el Código Penal y en las Llamadas Leyes antimaras. La hipótesis planteada sostenía que el Código Penal no disminuye ni mucho menos erradica el accionar delictivo de las pandillas, sino que lo único que hace es sancionar conductas antijurídicas cometidas constantemente por estos individuos. Los resultados mostraron que el tipo de delito que con mayor frecuencia cometen los miembros de pandillas son los relativos a la integridad personal coma lesiones no graves y lesiones graves; delitos relativos al patrimonio como: robo no agravado y robo agravado, hurto no agravado y hurto agravado; delitos relativos a la libertad individual y a la paz pública como: amenazas, asociaciones ilícitas, pertenencia a una mara o pandilla. En cuanto a las Resoluciones Judiciales pronunciadas par los Jueces consultados al momento de aplicar la Legislación Penal a los miembros de las pandillas fueron: instrucción formal, sobreseimiento definitivo, sobreseimiento provisional y conciliación. En general se concluy6 que la Legislación Penal vigente durante el desarrollo de la investigación no era eficaz en el control de la delincuencia de pandillas en Ia ciudad de Santa Tecla.
