Competition has been claimed to be a very liberal economic tool where market players are meant to be free in arranging their technologies, production and sales on a particular market. In this paper we are developing a new hypothetical of the functioning of market economies which are in a global sense and considering new markets very different and specific. All the global powers, whose centre of influence might change in time, are trying to gain a bigger share regarding raw materials and potential markets. In post-conflicts societies and in particular in our case study of Kosovo and Serbia we can see the more clear market interests of all local, regional and global powers. The research of post-conflict societies is providing us with some answers regarding the possible future developments in certain societies and regions. The EU made Brussels Agreements in Kosovo has managed to establish new enterprises as a solution of a political compromise where energy, telecommunication and natural resources played a key role. The Washington Agreement has liberalized the infrastructure achievements but in some aspects limited the use of energy and telecommunication infrastructure from certain sources. In this sense we can observe the limited capacity of competition rules application in post-conflict societies and in particular Kosovo in this case. These agreements have therefore limited the influence of economic, strategic and energy related influence from main USA competitors which have not been named in the agreements, but are well known. In both agreements it is visible how economic activities and cooperation is encouraged with various non-economic incentives. Competition is accordingly more of a political will than an economic reality for some in post-conflict societies. The introduction of various companies into the Kosovo legal framework and their control by Serbia is an obvious tool how natural resources could be shared for a benefit of citizens where conflict is resolved using free market and competition rules.

Kosovo and its citizens need trade liberalization in order to get quality goods and also decrease the imbalance in foreign trade. Recent agreements with the European Union and future trade preferences will certainly help the trade between EU and Kosovo. With this step in hand and the already used CEFTA Agreement Kosovo will be in a much better situation than ever. As every other country after finishing its trade liberalization with its neighbors Kosovo will have to start to negotiate with the WTO since its membership is a prerequisite to join the EU. Rule of law is a very problematic issue which lacks some basic standards in this territory, until now this state responsibility was highly supported by the European Union Law Enforcement Mission in Kosovo (EULEX). Knowing this it is hard to understand why some basics of the WTO such as Intellectual property rights, Sanitary and Environmental issues are lagging far behind the WTO standards. As a non member of the UN Kosovo will have a specific status in negotiating with the WTO, certainly this will be determined mainly by the EU as it is under its interest sphere. Multilateral agreements for joining the WTO in this case will be determined mainly by negotiations with the EU. Certainly the outcome of this process will be in line with EU policies and WTO requirements as a constitutional and legal power. In this case EU will serve the function of the executive power in the system where WTO is a global trade authority. As an organization with the power to change state policies and laws the WTO will certainly reshape the Kosovo economy which will certainly be a benefit to its citizens and the end of illegal imports, sales and production.

In this Interdisciplinary work we will deal with the Legal and Economic status of the North Kosovo region which has a very unique status and since recently its gaining more attention. It is even more interesting if we know that this small region has a very important role in European Union (hereinafter EU) politics as well. We will focus on the long debated questions for which not just the two countries Serbia and Kosovo, can't reach an agreement, but the EU and other International actors also have unclear and different opinions. For this region it is very hard to find relevant and applicable rules, since rules which could be applied have either no real power or could not be enforced. Applicable laws are the ones of Serbia and Kosovo but enforcement power is in the hands of European Union made body, EULEX (European Union Rule of Law Mission) (Eulex-Kosovo), so how it is possible that such a strong political body like the EU can't enforce them? From an Economic and Finance perspective we will deal with the questions which are of tremendous importance not just for the people from the region but as well for Serbia, Kosovo, EU and the International community. It has to be outlined that even after reaching some Agreements between the Serbian and Kosovo governments, like the one from 19th April 2013 (1) (2) many important questions still lay unanswered and untouched. The most important questions are the ones related to enforcement, rule of law, social welfare, taxes and security. The pressure is now with the Agreement transferred from EULEX (Mission) to the Governments of Serbia and Kosovo. As professionals we have to approach these issues with no biases and as reasonably as possible also we have to focus on the on field situation and facts which are of crucial importance for anything what is happening and can happen.
