How do intellectual propriety rights (IPRs) help firms profit from their innovation? Innovation literature frequently turns to patents to measure innovative IPR, but more recent work shifts focus to the other side of IPR, namely, trademarks. This article therefore discusses the effects of trademark strategies when companies decide to introduce their product portfolios in a new foreign market. Entrants might opt for a common trademark across different country markets (integration) or use several country-specific trademarks (responsiveness). This empirical study exploits the quasi-natural experiment created by the tariff shock that affected Spain when it joined the European Union in the 1990s. Data from the automotive industry reveal how non-European companies that already operated in other European countries sought to enter Spain rapidly, using various trademark strategies. The product portfolio characteristics are fixed at entry, so this study can specify how and when trademark responsiveness versus integration affects firm performance. The results reveal that trademark responsiveness increases firm performance if the firms suffer high liabilities of foreignness or newness.

This paper analyzes the birth of the Encryption Software Industry (ESI), a new market niche in the software industry. This work will report the main facts of entry and exit process, focusing on firm post-entry performance, on the different phases of competition during the industry evolution, and on the strategic actions of main actors. ESI represents an interesting case study. It originated during the mid-1970s when market opportunities, arising from the military sector, spurred established electronic firms like IBM and Motorola to accumulate knowledge in encryption software technology.Empirical evidence shows that years later, despite their early entry into the technological race, the large firms were slow or late to enter into the civilian market, leaving new comers the opportunity to dominate the product market for this fast growing demand. In order to analyze ESI development, we have collected a wide series of data on introduction of products, patents granted by the US Patent Office, worldwide alliances in the sector and some biographical data about founders of startups and their executives. This paper highlights two different topics that emerge from the history of the ESI.First, the study of startups dynamics and factors spurring startup growth, where size is an important determinant of firm ability to survive in young and competitive industries. Second, the rationality behind the motivations of incumbent behavior arises an interesting puzzle to decipher: was the adoption of a wait-and-see strategy a rational and optimal decision by incumbents, or maybe, were large firms affected by problems of organization inertia and strategic myopia?

Transaction costs strongly influence diversification dynamics, as predicted by resource theory. A mainstream view links the profitability of diversification with the existence of transaction costs that prevent a firm from trading in fungible, scale-free resources. This study applies a neo-Penrosian perspective to transaction costs, with the notion that diversification may be driven by the redeployment of non-scale-free resources. An empirical analysis, using tax changes in the drink sector as a measure of exogenous demand variation, offers results consistent with the prediction that redeployment is particularly relevant when retailing is concentrated and single-product competition within a focal product niche (e.g., beer) is fragmented. This study also measures redeployment across a portfolio of a multiniche firm when changes in its sales-growth rates for a particular product niche might imply contrasting changes in other product niches. The resulting evidence is consistent with predictions that demand uncertainty, and transaction costs create viable redeployment opportunities for multiniche companies.

This article analyzes the effects of diversification and brand breadth on firm performance for professional service firms (PSFs). The research aim is two-fold. First, we test whether moving into products may put at risk the core resources that sustain PSFs' competitive advantage. Second, we study which branding strategies best match their diversification attempts. Broad (narrow) brands characterize a branding strategy with scarce (plentiful) associations to specific product characteristics. We analyzed trademark portfolios of 47 U.S.-based management consulting firms in the 2000 to 2009 time period. Panel regression results suggest that (1) PSFs always benefit from diversification when they remain pure-service providers; (2) performance is positively related to a strategy of specialized narrow brands.

This paper introduce a list of desirable efficiency properties that any a patent system should have in order to enhance innovation, trade competitiveness, employment mobility and economic growth. We briefly overview the literature on patents and discuss the advantages and disadvantages of the present and recent proposals for the future of the European Union Patents System. In particular, we discuss the costinefficiencies observed in the current design of the EU Patent System based in a double structure layer divided in a central European Patent Office (EPO) and several nationalbased patent offices. This paper analyzes the likely backlashes of creating a third layer for a sub‐sample of EU countries. The paper suggests an alternative more efficient Patent System together with some policy implications.

This paper expands the organization theory and evidence on regional industrial agglomerations. We define regional economic activities according to the attributes of the organizations that populate a region and investigate how organizational characteristics influence macro-outcomes at a regional economic level. We focus on two dimensions emerging from two widely known organizational forms: the managerial corporation and the knowledge cluster with a marked orientation toward interfirm knowledge spillovers. We use an original data set of 146 U.S. cities to obtain variations in the extent to which they are populated by managerial firms or knowledge clusters. By utilizing city-level measures of managerial salaries, we test how the intensity of managerial corporation versus knowledge cluster characteristics affects the mean and dispersion of the "rewards" of cities. Our evidence suggests that higher managerial corporate characteristics lower the variability of rewards, while they have no effect on the mean of rewards. Higher-knowledge cluster characteristics produce both higher dispersion and higher expected rewards. We explain these results by looking at the different learning mechanisms of the two organizational types. In so doing, we highlight the role of intra- and interfirm knowledge processes as important sources of differences in the rewards of the two models. From an empirical point of view, results are confirmed using both patent-based and skill mobility-based measures of knowledge spillovers.

Organization scholars have recently studied the internal challenges and opportunities faced by companies that combine business and social logics (i.e., social business hybrids). By adopting a demand-side perspective, this paper addresses the implications of hybridity for strategic choices with products and businesses by focusing on the role of social business hybrids' customers. In the conceptual framework, social identity theory explains how hybridity generates both positive and negative demand-side externalities. Thus, hybridity can be a source of competitive advantage in the marketplace, but also create hurdles to firms' ability to scale up their business. Diversification represents a potential choice that simultaneously generates growth, preserves hybridity, and avoids negative demand-side externalities. This paper analyzes the optimal type, timing, and scope of such diversification.

Previous literature on open source software (OSS) mostly analyzes organizational issues within communities of developers and users. This paper focuses on for-profit organizations that release software products under OSS licenses, and argues that variations in their endowments of intellectual property rights, namely patents and trademarks, help to determine which firms will tend to incorporate OSS into commercial products. We explain whether and under what conditions preexisting stocks of intellectual property rights can be useful complementary assets that allow firms to benefit directly or indirectly from commercializing OSS products, and test our hypotheses on a novel data set built on firms' announcements of OSS product releases in the specialized press between 1995 and 2003. We find three robust results: (a) firms with large stocks of software patents are more likely to release OSS products; (b) firms with large stocks of software trademarks are less likely to release OSS products; (c) firms with large stocks of hardware trademarks are more likely to release OSS products.
