The laws controlling HIV / AIDS in Mainland China, Taiwan and Hong Kong have adopted very different policy orientations. The article argues that, while the differences in laws manufacture different impacts on the level of discrimination against PLHAs, they all, in one way or another, fixate themselves on the past imaginary in relation to HIV / AIDS, and ignore the emerging future (for example: advanced medical technology); they do this so as to avoid revising the current laws, thus sustaining or intensifying the existing discrimination. The article, via investigating the respective time machines devised by Nāgārjuna, Nietzsche and Deleuze, attempts to suggests that future, present and past all exist and inter-influence each other in a singular mental dimension. The article also scrutinizes the role of law and possible law reform in re-formatting the time machine and redefining disease control.

Since 2005, the Hong Kong Government has proposed to replace the concept of 'parental rights' with 'parental responsibility' in the legal machine controlling and regulating child custody in divorce cases. However, it has again reduced 'children' to a powerless position, arguing that it can positively protect the 'best interests' of children. In this article, the author suggests that only by de-ageing law can the unequal power relationship between children and adults be challenged, and hence, can – and will – children's views and subjectivity be respected and constituted in family law proceedings.

AbstractIn Hong Kong, even though the Bill of Rights Ordinance (the localized version of ICCPR), Sex Discrimination Ordinance and a series of legal reforms were enacted and introduced respectively in 1991 and 1994, gender discrimination in legal discourse still persists. Chinese customary law, which only recognises the male's right to build small houses in the New Territories, remains an exception under the Sex Discrimination Ordinance; and the oppression of (female) sex workers is not yet recognized. Some politicians argue that discrimination is inherent in the Han-Chinese culture of harmony, which is impossible to understand from the Euro-American individual-centric perspective of gender equality. They further quote Daoist YIN-YANG cosmology where YANG/Male/Masculinity is supreme; and Confucian Constant Virtues where women are marginalized as examples showing that Han-Chinese culture, where harmony is hegemonized, cannot tolerate or accept gender equality. This paper adopts a critical perspective in examining the above arguments and points out not only that a "pure" version of patriarchal socio-legal culture in the name of harmony hegemony does not exist, but (indigenous) culture should always be meticulously and critically represented in order to reproduce "justice". I would also argue that it is possible to scrutinize and explore the spaces of resistance within the Hong Kong Han-Chinese socio-legal culture, where foreign theories of gender justice/equality and related legal reforms can be examined.

AbstractHong Kong law, following the Anglo-American liberal legal private/public dichotomy, through decriminalization, imposes strict regulations on the development of the sex work industry. The legal regulations, besides failing to suppress the industry, reproduce a context where female sex workers are (re)pathologized and (re)marginalized by the mainstream patriarchal society. In the article, I will critically examine the underlying theories of the contemporary Hong Kong legal discourse from both the Lacanian psychoanalytic and Buddhist vijnanamatra perspectives, and argue that the Foucauldian resistance subverting the patriarchal agenda on the representation of the sex work industry could be reproduced and localized within the specific cultural context of Hong Kong, which is a predominately (Han-)Chinese society.

This article adopts a postmodern/postcolonial feminist perspective in
analysing the effect of the cancellation of marital rape exemption in
Hong Kong in 2002. Besides exploring the patriarchal ideology which
underlies Hong Kong's legal system, the author argues that neither white
western feminist strategies nor Foucauldian de-sexualisation can easily
substantiate (gender) justice in Hong Kong. The author further argues
that any legal reforms in Hong Kong should be examined in the light of
Han Chinese culture.

In view of the 911 terrorist incident plus various cases regarding undeclared dangerous goods were happened, tightening security measure on air cargo was adopted by different governments. Additional requirement of cargo screening would involve extra cost and thus the competitiveness of Hong Kong in the industry may weaken. Concern about that the compliance of new security requirement would affect Hong Kong economy and adversely affect the position of Hong Kong International Airport as an international air cargo hub. There are implications of the trend of having tightening of security measures on air cargo in Hong Kong. This study will examine the development of international air cargo security requirement, focusing on the potential solutions and cost implications for Hong Kong air cargo industry. This study adopted a case-study approach to examine how associate degree sociology graduates evaluate their learning in a Hong Kong community college. Through focus group interviews, the learning experiences of sociology graduates were examined, specifically paying attention to their identification of enhancements in learning. The results of this examination indicate that the delivery of sociology education requires a strong emphasis on the integration of acquisition of sociology knowledge with social practice. It is important to consider how the curriculum engages the worldview of students beyond the personal and allows them to directly experience the social in a way that reflects what is going on around them. This study contributes to the discussion on the quality of associate degree education in Hong Kong and highlights the centrality of examining the issue from the point of view of students, particularly in the context of outcome-based education.
