Upravo na temelju ovog načela treba ocijeniti kombinaciju odgovarajućih sudskih praksi Državnog savjeta i Ustavnog vijeća u tom pogledu. L'influence de la construction européenne sur le modèle français de fonction publique résulte non seulement du principe de libre circulation des travailleurs mais aussi de la diffusion des principes modernes de la gestion publique dans l'ensemble des administrations des États membres. Le principe de libre circulation a certes pour effet de contribuer à des réformes portant sur la structuration de la fonction publique par corps ; mais surtout à une remise en cause du système français des écoles administratives. Malgré ces réformes inévitables, il serait excessif d'en conclure que le modèle statutaire français est condamné : il ne faut pas confondre modernisation de la gestion publique et privatisation de la fonction publique.
