Over recent years it has become increasingly clear that the European Union is falling short of its promise to enhance social cohesion across the continent. Welfare state modernization has been at the centre of divisive debates over the redistribution of wealth and imbalances between a wealthy European core and its peripheries. Some see the policies and governance of the EU as part of the problem, others rather as the solution.This book examines the key issues facing the EU's social policy-making. Each chapter focuses on a single challenge and explores the arguments and considerations that coalesce around it. The book helps students and researchers alike to understand how the EU operates and shapes social policy on multiple levels, and to better assess the EU's role in supporting social cohesion.

L'Europe sociale recouvre les politiques publiques européennes liées à l'emploi et au chômage, aux conditions de travail, à l'égalité hommes-femmes, à la protection sociale… Si ces domaines d'action relèvent avant tout de la compétence des États membres, ceux-ci cherchent toutefois à harmoniser certains aspects de leurs législations sociales. L'Union européenne intervient donc de manière indirecte, parcellaire et parfois contradictoire dans le champ de la politique sociale. Elle a néanmoins récemment relancé son agenda social pour faire face aux conséquences de la pandémie de Covid-19 et tenter d'opérer une transition écologique socialement juste .

L'intervention de l'Union européenne (UE) sur le social est aussi complexe que fragmentaire et se déploie de manière à la fois directe et indirecte. On peut distinguer quatre grands champs d'action européens : la réglementation (mobilité, droit du travail, non-discrimination) ; le dialogue social européen ; la redistribution par les fonds ; et la coordination souple des réformes des systèmes sociaux. Cet article s'intéresse plus particulièrement aux questions de la coordination de la sécurité sociale des travailleurs en situation de mobilité et de l'ouverture mutuelle des systèmes nationaux. Si les droits des travailleurs tendent à s'accroître avec le temps, même de manière marginale, l'accès des non-actifs aux prestations sociales est, lui, remis en question. Au-delà des débats politiques, la coopération administrative s'intensifie via la création de commissions, de réseaux numériques d'échange de documents, de réseaux d'experts et même d'une Autorité européenne du travail.

Loin d'être un État-providence européen en devenir, l'Europe sociale se présente aujourd'hui sous les traits d'une gouvernance parcellaire des politiques sociales en Europe. Cette contribution part de la prémisse que l'idée d'Europe sociale telle qu'elle a été défendue au 20ème siècle a fait long feu. Du fait des divergences socio-économiques et politiques entre les pays membres de l'UE, l'exigence de solidarité en Europe ne peut plus s'incarner dans un dans un ensemble uniforme de règles qui constitueraient progressivement un Etat providence européen. Comment peut-on, dès lors, concevoir des formes de solidarité qui mèneraient à une convergence par le haut ?Trois axes de réflexion sont ici proposés. Premièrement, du point de vue de la solidarité transnationale entre Européens, l'Union européenne doit s'attacher à empêcher la mise en concurrence des systèmes socio-économiques grâce à des règles communes, par exemple la mise en place – et convergence progressive – de salaires minimums partout en Europe. Il s'agit également de fixer les principes régissant la dimension sociale de la citoyenneté européenne, notamment en matière d'accès des Européens non-nationaux aux prestations sociales des Etats-membres. Deuxièmement, du point de vue de la solidarité entre Etats, il est temps de reconnaître que la création d'un marché et d'une monnaie communs n'impliquent pas les mêmes risques et opportunités pour tous les pays. Dès lors, il est à la fois juste et efficace de se doter d'outils permettant de mitiger et d'équilibrer ces risques, que cela soit dans une logique assurantielle ou redistributive. Troisièmement, du point de vue de la solidarité nationale, l'Union ne peut se contenter d'agir comme un carcan fiscal ou un accélérateur de réformes « structurelles » contribuant à affaiblir les Etats-providence nationaux, comme cela est trop souvent le cas aujourd'hui. Les institutions européennes devraient, au contraire, s'employer à promouvoir avec vigueur un agenda véritablement de modernisation progressiste centrée, par exemple, sur le paradigme d'investissement social qui reste aujourd'hui introuvable. ; info:eu-repo/semantics/published
