"Native American Roots: Relationality and Indigenous Regeneration Under Empire, 1770-1859 explores the development of modern Indigenous identities within the settler colonial context of the early United States. With an aggressively expanding United States that sought to displace Native peoples, the very foundations of Indigeneity were endangered by the disruption of Native connections to the land. This volume describes how Natives embedded conceptualizations integral to Indigenous ontologies into social and cultural institutions like racial ideologies, black slaveholding, and Christianity that they incorporated from the settler society. This process became one vital avenue through which various Native peoples were able to regenerate Indigeneity within environments dominated by a settler society. The author offers case studies of four different tribes to illustrate how Native thought processes, not just cultural and political processes, helped Natives redefine the parameters of Indigeneity. According to the theory of Effectively Maintained Inequality (EMI), economically advantaged individuals not only enter each level of education at higher rates than do their less advantaged peers, but also enjoy qualitative advantages at each level that position them more favorably to continue to the next level. Governments may play a role in facilitating or limiting EMI because they allocate appropriations to public universities; the more between-university variability in these funds, the more horizontal differences high-income students may exploit. I ask whether Wisconsin's unequal pattern of appropriations across its institutions of higher education exacerbates income-based disparities in college persistence. I test two hypotheses: (1) Economically advantaged students sort into the universities with greatest appropriations; (2) Appropriations promote first-to-second-year persistence. Evidence in favor of both hypotheses would support the claim that an unequal pattern of appropriations exacerbates college persistence disparities and, accordingly, suggest that unequal allocation facilitates EMI. Results support hypothesis (1) but not hypothesis (2). The results do not present evidence that the Wisconsin state government facilitated or limited EMI based on its allocation of funds across universities.

Durch Säkularisation und Mediatisierung nahm der bayerische Staat in den Jahren 1803 bis 1806 etliche Reichsstädte und mehrere Haupt- und Residenzstädte geistlicher bzw. weltlicher Fürstentümer in Besitz. Die Frage, welcher der beiden Stadttypen sich besser an die neuen Bedingungen innerhalb Bayerns in den Jahrzehnten vor der Industriellen Revolution anpassen konnte, ist bislang in der Forschung unbeantwortet. Deswegen wurde in der Dissertation die wirtschaftliche Entwicklung früherer Reichs- und Residenzstädte anhand von vier Fallbeispielen in den Jahren 1803 bis 1848 verglichen. Die untersuchten Städte waren Ansbach und Bamberg als ehemalige Residenzstädte sowie Lindau und Nördlingen als frühere Reichsstädte. Verglichen wurde die Veränderung der wirtschaftlichen Zentralität der Städte. Dafür wurde untersucht, inwieweit sich die Reichweite der Handelsbeziehungen und die Ausdehnung der Absatzmärkte des städtischen Gewerbes veränderten. Entscheidenden Einfluss darauf hatte der Funktionswandel der Städte zu zentralen Verwaltungsorten des bayerischen Flächenstaates, dessen Gewerbe- und Handelspolitik sie ab 1803/06 unterworfen waren. Die bayerische Wirtschaftspolitik war trotz der Schaffung eines einheitlichen Wirtschaftsraumes nicht in der Lage, entscheidende Impulse zu setzen, so dass die neuen Rahmenbedingungen innerhalb Bayerns sich eher bremsend auf das städtische Gewerbe auswirkten. Die wirtschaftlichen Grundstrukturen der Vormoderne veränderten sich kaum. Denn die Frühindustrialisierung erfasste die Städte nicht. Im Fall der Residenzstädte war die Aufhebung der Höfe dafür nicht entscheidend. Ausschlaggebend waren bei beiden Stadttypen vielmehr die vorhandenen gewerblichen Strukturen sowie die Einbindung in die Handelsnetze. In dieser Hinsicht passten die Strukturen in Bamberg und Lindau besser als die der beiden anderen Städte zu den neuen Rahmenbedingungen.

This study investigates collaboration among missionaries, evangelicals, Quakers, Cherokee, Choctaw, and Seneca that developed in opposition to Indian removal. In 1829, a vigorous national antiremoval movement arose dedicated to the prevention of Cherokee removal. Nearly a decade later, a coalition of Seneca, Quakers, and New York citizens lobbied to prevent Seneca dispossession. Anglo antiremovalists worried removal would interrupt Indian evangelism; while Natives feared forced emigration from their ancestral homelands and erosion of tribal sovereignty. Why did these varied groups join forces against removal? Despite their divergent motivations, Native and Anglo antiremovalists shared a belief that Indian incorporation of Anglo cultural practices would bring Natives rights. They hoped Native adoption of formal education, family farming, and Christianity would yield social and political rights that could be leveraged to prevent removal. My story develops through examinations of Native-Anglo political alliances, mission Indian schools, black slavery in the Cherokee and Choctaw Nations, and Native cultural change in the post-Removal era. Scholars have created an increasingly sophisticated narrative in which the Native-Anglo military and trade alliances of the colonial era gave way in the late eighteenth century to brutal, coerced dispossession. However, the story of Native history is not only about force and power. I describe how a complex process of cooperation helped to foster American empire, yet also enabled Natives to maintain tribal identity and sovereignty

Das World Economic Forum hat 2003 die Effizienz von 102 Steuersystemen untersucht und Deutschland auf den letzten Platz gesetzt. Dabei dürfte auch die Kompliziertheit des deutschen Steuerrechts eine nicht zu unterschätzende Rolle gespielt haben. Die Forderung nach Steuervereinfachung richtet sich auch an die Rechtsprechung. Der VIII. Senat des BFH möchte die bisherigen Grundsätze der Nutzungsentnahme weiter entwickeln. Anlass ist der Alltagsfall eines privat veranlassten Unfalls mit einem betrieblichen PKW. Der VIII. Senat hält in diesem Fall die Bewertung der (Nutzungs-) Entnahme mit dem Teilwert für geboten. Entscheidend für den VIII. Senat ist in diesem Zusammenhang, dass andernfalls die stillen Reserven vernichtet würden, die sich im Wirtschaftsgut PKW angesammelt haben. Diese Grundüberlegung der Versteuerung von stillen Reserven als gewissermaßen übergesetzliche, aber gleichwohl bindende ultima ratio liegt auch der umstritten gebliebenen finalen Entnahmerechtsprechung des BFH zu Grunde, die bislang allerdings ausschließlich auf Sachentnahmen angewendet wurde. Ausgehend von der Frage, ob Sachentnahmegrundsätze – dogmatisch gesehen - auch auf die Bewertung der Nutzungsentnahme Anwendung finden sollen, werden zunächst die historischen Wurzeln des Entnahmetatbestandes untersucht, um dann die einzelnen Tatbestandsmerkmale des § 4 Abs. 1 Satz 2 EStG im Einzelnen zu beleuchten. Im Vergleich dazu wird auch die umsatzsteuerliche Behandlung und die Entnahme bei Kapitalgesellschaften (= verdeckte Gewinnausschüttung) dargestellt. Die Arbeit befasst sich sodann mit dem Gewinnbegriff im Einkommensteuerrecht. Die Entnahme ist Teil des in § 4 Abs. 1 Satz 2 EStG geregelten einkommensteuerlichen Gewinnbegriffes, so dass diesem Begriff auch Aussagen über ihren Zweck abgeleitet werden können. Im Anschluss werden die verfassungsrechtlichen Vorgaben der Besteuerung von stillen Reserven erläutert. Die Arbeit stellt die bisherigen Grundsätze der finalen Entnahmerechtsprechung und ihrer Umsetzung durch den Gesetzgeber im Detail dar. Diese Grundsätze werden am Beispiel des gemischtgenutzten Personenkraftwagens erprobt und mit der vorgeschlagenen Systematik des VIII. Senats verglichen. Der Verfasser entwickelt eine dogmatisch stimmige Lösung der Nutzungsentnahme – in systematischer Abgrenzung zum Tatbestand der Sachentnahme – auf der Basis des Veranlassungsprinzips. Hierzu werden auch Grundsätze des österreichischen Rechts zum Tatbestand der Entnahme rechtsvergleichend herangezogen. ; The World Economic Forum has explored the effectiveness of 102 tax systems worldwide in 2003 and Germany was set on the last place. One important reason therefore could have been the complexity of the German tax system. The demand for simplification is also addressed to the courts. The VIII. Senate of the federal fiscal court has indicated, that the established principles for the legal classification of the withdrawal of utilizations [Nutzungsentnahme] (by contrast of the withdrawal of assets) for private or non operating purposes have to be reconsidered. The cause is the everyday life case of a car accident. The car was part of the operating assets of an entrepreneurial entity and the accident itself was caused by private reasons. By meaning of the VIII. Senate the withdrawal – in this case - has to be evaluated by the going concern value. Otherwise undisclosed reserves of the asset automobile are possible to withhold from taxation. These basic principle for the taxation of undisclosed reserves is also basis for the contentious jurisdiction by the federal fiscal court, known as "finale Entnahmerechtsprechung". But this legal practice was - so far - only applied on matters concerning the withdrawal of assets (Sachentnahme). Based on the question, if the legal principles of the withdrawal of assets can be disposed on the valuation of the withdrawal of utilizations, the historic roots of the statutory law, regulated in § 4 Sec. 1 Cl. 2 of the German income tax act, will be examined. The author will also illuminate the legal principles of the value added tax act and the legal handling of withdrawals by joint-stock companies (disguised dividends). The author discusses the legal term "profit" by meaning of the income tax act, regulated in § 4 Sec. 1 Cl. 2 German income tax act. According to this law the withdrawal is part of the calculation of the taxable profit for a specific entity. Therefore the examination of the legal term "profit" could give conclusions for a further understanding of the intended legal purpose. Following the constitutional principles for the taxation of undisclosed reserves will be elaborated. The author determines the existing principles of the "finale Entnahmerechtsprechung" by the federal fiscal court and the adaptation of these principles by the legislator. These principles will be proved by the example of a "shared used" car, which is part of the working capital of an entrepreneurial entity. This was also basis for the decision of the VIII. Senate. The author develops a dogmatic system for the taxation of the withdrawal of utilizations (Nutzungsentnahme) on the basis of the constitutional doctrine of inducement (Veranlassungsprinzip). Comparative principles of the Austrian law on these subjects will be adopted.
