El artículo reflexiona sobre las ventajas de la asociación/cooperación y de la organización solidaria en un mundo complejo que exige retomar los presupuestos del paradigma asociativo y de la necesidad de una pedagogía política para contrarrestar al escenario societario de ambigüedad e incertidumbre de la contemporaneidad; pensar solidaridad implica en cambiar de matriz analítica de la modernidad y señala que la no-banalización de los principios de la participación y del compromiso necesitan se concretizar en un conjunto de medidas políticas que buscan la democratización y socializar los saberes que de hecho pasa por una pedagogía solidária.
This paper reflects on the advantages of the association/cooperation and the solidarity organization in a complex world. It requires reestablishing the presuppositions of cooperative paradigm and the necessity of a political pedagogy to contradict the society stage of ambiguity and contemporaneity uncertainty because to think solidarity implies changing the analytical base of modernity. It points that the non-trivialization of participation and commitment principles need to be concretized in a set of policy measures that search for the democratization and socialization of knowledge that per pass solidarity pedagogy.

In einer Welt, wo die Veränderungen kaum allgemeingültige normative Muster anerkennen lassen, wird das rechtstheoretische Denken gefordert, adäquate, strukturierte Modelle zu entwickeln, um die komplexer gewordenen Beziehungen zwischen Rechtstheorie und Rechtspraxis zu erklären und zu verstehen. Dafür müssen unmittelbare Erkenntnisinteressen, rhetorische Argumentationen und soziale Ansprüche als verschiedene Momente der rechtlichen Sinngebungs- und Sinndeutungsprozesse gedacht werden. Die Frage wird auch in diesem Sinne gestellt werden müssen, was man von den jeweiligen Institutionen nicht erwarten kann, bevor die vielfältigen Rechtskommunikationen über das systemische Repertoire des Rechts betätigt werden können. -- Die Rechtsprechung zeigt sich in diesem Sinne als eine wichtige, unerläßliche evolutionäre Errungenschaft des Rechtssystems, um seine eigene Identität gleichzeitig stabilisieren und Änderungen verwalten zu können - Prozesse, die stark mit ihrer klassischen Darstellung als "periphär" kontrastieren. Auf die Rechtsprechung werden deswegen im modernen, demokratischen Rechtsstaatsmodell - auch wenn man die bestehenden regionalen Eigenschaften mitrechnet - neue Gefahren und Möglichkeiten zukommen, die weit über nationale Grenzen und kulturelle Partikularitäten hinausgehen. -- Die Arbeit wurde ausgezeichnet mit dem Harry-Westermann-Preis 1999 der Universität Münster.

This open access book discusses the state of rule of law protection in Europe, by considering recent challenges to judiciary independence in EU countries. The purpose of the book is to advance solutions to such challenges. It looks at the challenges from the perspective of EU law and ECHR law and puts forward solutions for its improvement and paths of action to be taken by EU political institutions to solve the problems. The book consists of communications presented by leading European scholars, judges and prosecutors, in a conference in Lisbon, organised by Prof. Paulo Pinto de Albuquerque and Judge Filipe Marques.

The article intends to show the vibrant and constant relationship between memory and the experience of the present; taking care to bring memory, truth and justice closer to the contemporary assumptions of human rights. Based on an analysis of the resurgence of an ultra-conservative ideology in Brazil in the last decade, we seek to demonstrate the importance of not forgetting the recent past in the country to point out relevance and paths that expand our network of meanings, and help us to recognize the risk of present and future experiences that attempt to suppress political and civil rights. ; O artigo tem a intenção de mostrar a relação viva e constante entre a memória e a experiência do presente; cuidando para aproximar a memória, a verdade e a justiça dos pressupostos contemporâneos dos direitos humanos. Buscamos, a partir de uma análise do recrudescimento de uma ideologia ultra-conservadora nesta última década no Brasil, demonstrar a importância do não esquecimento do passado recente no país para se apontar relevâncias, caminhos e percursos que ampliem nossa rede de significados, e nos ajudem a reconhecer o risco de experiências presentes e futuras que intentem em suprimir direitos políticos e civis.
