В статье автором поднимаются проблемы института брака, которые необходимо решать на законодательном уровне. Проводится анализ норм семейного права Российской Федерации в части исследования института расторжения брака. Автор на основании аргументации предлагает подвергнуть редакции ряд статей Семейного кодекса РФ, что будет способствовать позитивному развитию семейного права в целом. Исходя из данного анализа, проводимого в статье, делается вывод о том, что закрепление только судебного порядка как единственного способа расторжения брака будет содействовать охране прав и законных интересов не только супругов, но и их несовершеннолетних детей. ; In the present article the author raises the problem of the institution of marriage that must be addressed at the legislative level. The analysis of family law in the Russian Federation is carried out in the course of the research of divorce institute. On the basis of the argument, the author proposes to amend several articles of the Family Code of the Russian Federation, and this will contribute to the positive development of family law in general. Based on this analysis the author concludes that the only binding legal order as the only way of divorce will promote the protection of the rights and legitimate interests of not only the couple, but their minor children. In pursuing the noble goal of preserving the family and marriage, we believe that it is necessary to borrow the rules governing the separation of spouses from foreign family law. The institute is known to many foreign legislations and helps to overcome differences between spouses and to preserve the ultimate marriage and family. Judicial Procedure marital separation will provide more time to weigh and consider its decision on the dissolution of marriage. The article raised not all the problems of the institution of marriage, which must be addressed at the legislative level, but even the solution of these problems that will contribute to the positive development of family law in general.

В статье анализируется сложившаяся практика разрешения семейных споров в судах общей юрисдикции в части злоупотреблений участниками гражданского процесса своими субъективными процессуальными правами и выделяются основные направления злоупотребления правом при рассмотрении семейных споров. Проводится сравнительный анализ норм Гражданского процессуального кодекса Российской Федерации и Арбитражного процессуального кодекса Российской Федерации в части исследования института процессуальных злоупотреблений. Исходя из данного анализа делается вывод, что действующее арбитражное процессуальное законодательство может послужить источником идей по реформированию гражданского процессуального законодательства для предотвращения процессуальных злоупотреблений участников процесса. В свете грядущих значительных изменений процессуального законодательства, вызванных слиянием высших судебных инстанций, автором предлагается заимствование норм, направленных на борьбу со злоупотреблениями процессуальными правами, из действующего Арбитражного процессуального кодекса Российской Федерации и введение их в гражданский процесс России. Это будет способствовать скорейшему и правильному разрешению семейных споров, что имеет важное общественное значение и является одной из главных задач гражданского судопроизводства. ; The article analyzes the existing practice of resolving family disputes in courts of general jurisdiction regarding the abuse by the civil process participants of their subjective procedural rights and highlights the main areas of law abuse when considering family disputes. The author carries out the comparative analysis of norms of the Civil Procedure Code of the Russian Federation and the Arbitration Procedure Code of the Russian Federation regarding the research of procedural abuses institute. The author makes conclusion that the current arbitration procedural legislation may serve as a source of ideas on reforming the civil procedural law in order to prevent procedural abuse by process participants. In the light of upcoming major changes in the procedural legislation, caused by the merger of higher courts, the author suggests borrowing the norms aimed at preventing the procedural rights abuse in the Arbitration Procedure Code of the Russian Federation and introducing them into the Russian Civil Process. This measure will facilitate fast and proper resolution of family disputes that is of great public importance and is one of the main tasks of civil proceedings.

Данная статья посвящена выявлению проблем реализации принципа надлежащего исполнения обязательств в современном гражданском обороте. Автор, анализируя действующее законодательство и судебную практику, ищет пути решения данных проблем. ; The article focuses on identifying problems of the principle of proper fulfillment of the obligations in the modern civil circulation. Введение: незавершенность в стране процессов по совершенствованию действующих норм права при их постоянном динамическом развитии формирует постоянную актуальную проблему юридико-технического характера. Целью данной статьи стало выделение роли современных справочных правовых компьютерных систем в реализации принципов систематизации действующего российского законодательства. Методы: комплексность выделенной проблемы предполагает использование как юридического, так и «машинно-логического» инструментария, необходимого специалистам при их разрешении. Результаты: отмеченные в статье недостатки развития нормотворческой сферы, основываясь на приведенных актуальных данных учетно-электронного характера, позволили обосновать значимость электронных систем в совершенствовании используемых норм права при реализации правоприменительной практики страны и предложить ряд форм по их устранению. Выводы: в результате проведенного исследования формируются следующие рекомендации по совершенствованию действующего законодательства, в частности: 1) создание государственно поддерживаемого информационного банка данных о нормативных правовых актах страны и региона; 2) введение единообразных в рамках государства форм совершенствования практики кодификации на субъектном уровне норм права; 3) определение на федеральном уровне юридического статуса наиболее популярных справочно-правовых компьютерных систем страны. ; Introduction. The incompleteness of the processes on improving the existing legal norms in their constant dynamic development in Russia forms a continuous urgent problem of legal and technical nature. The aim of this article is the allocation of the role of modern legal reference computer systems in the implementation of the principles of systematization of the existing Russian legislation. Methods. The complexity of this problem involves the use of both legal and "machine-logical" instruments which are required by experts to resolve the problem. Results. The shortcomings of the regulative sphere are marked in the article on the basis of current recording and electronic data, allowing to prove the importance of electronic systems in improving the country's law enforcement practices and offering a number of legal forms to remove them. Conclusions. The authors worked out the following recommendations on improving the existing legislation, in particular: 1) the creation of state-supported data bank of regulatory legal acts of the country and the region; 2) the introduction of common forms of improving the practice of codification on the level of subjectivity of the law within state; 3) the definition of legal status of the most "popular" legal reference computer systems of the country on the federal level.
