Criminal law should synchronize with spirit and soul of the constitutionto respect human rights and democracy. But history proof that criminallaw is more often to be use for violate human rights and silentdemocracy. That cause is one of the reason for constitutional court toestablish to guard law specially criminal law in order to match with theconstitution. Base on the authority gave by the constitution so farconstitutional court had done the role maximally in examination thesynchronization criminal law act with the constitution, but that authorityis limited and passive. In implementation phase, it has not been anypositive changed in spirit and soul of the law enforcement to be matchedwith spirit for respecting human rights and democracy to establish thecriminal law.
AbstractLand availability is an important factor to ensure the availability of food and a place to carry out other economic activities outside of agriculture. The occurrence of population growth and the development of economic activity affects the demand side for land, whose area is fixed. The problem of changing the function of agricultural land to non-agricultural is currently increasing. There is an increasing need for land for development, while the relative availability of land has led to competition in land use. Sidoarjo Regency has also changed the function of agricultural land, especially rice fields. From 2009 to 2018, the rice field area has decreased by 5,750 hectares. Sidoarjo Regency is one of the areas that experienced the highest shrinkage in East Java Province. This is the focus of serious attention for the Sidorajo Regency government to ensure the availability of agricultural land by protecting the environment and environmental development governance which has changed the paradigm of agricultural land into residential land. In the end, between the environment and the settlement, there must be a natural balance in maintaining a sustainable environment and based on the principle of an environment of sustainable development. This type of research used in this research is normative legal research. By using primary and secondary legal materials, along with tertiary legal materials as supporting materials. Based on research results and findings, agricultural land in Sidoarjo Regency is getting narrower and more rigid. This is because there is a form of development for settlements by changing the function of agricultural land and buying and selling agricultural land for housing and housing investment. Approximately 52,000 ha of chopped agricultural land were converted into housing and housing investment. At the level of environmental development on agricultural land in Sidoarjo district, it can be said that it violates the management of the agricultural environment, where it should be for water absorption and agricultural land ecosystems, then misused into residential and housing land for investment and housing. Permasalahan alih fungsi lahan pertanian menjadi non pertanian saat ini terus mengalami peningkatan. Adanya peningkatan kebutuhan lahan untuk pembangunan, sementara ketersediaan lahan relatif tetap menyebabkan persaingan dalam pemanfaatan lahan. Kabupaten Sidoarjo juga mengalami alih fungsi lahan pertanian terutama sawah. Dari tahun 2009- 2018 luas lahan sawah mengalami penyususutan sebesar 5.750 hektar. Kabupaten Sidoarjo merupakan salah satu daerah yang mengalami penyusutan tertinggi di Provinsi Jawa Timur. Hal inilah menjadi fokus perhatian yang serius bagi pemerintah Kabupaten Sidorajo untuk menjamin ketersedian lahan pertanian dengan cara menjaga lingkungan hidup dan tata kelola pembangunan lingkungan yang mengalami perubahan paradigma lahan pertanian menjadi lahan pemukiman. Pada akhirnya antara lingkungan hidup dan pemukiman itu harus ada keseimbangan alam dalam menjaga lingkungan hidup yang berkelanjutan dan berprinsip pada environment of sustainable development. Jenis penelitian yang digunakan dalam penelitian ini ialah penelitian hukum normatif. Dengan menggunakan bahan hukum primer dan sekunder, beserta bahan hukum tersier sebagai bahan pendukung. Berdasarkan hasil penelitian dan temuan bahwa lahan pertanian di Kabupaten Sidoarjo sudah semakin sempit dan rigid. Hal ini dikarenakan ada suatu bentuk pembangunan untuk pemukiman dengan cara alih fungsi lahan pertanian serta jual beli lahan pertanian untuk perumahan dan investasi perumahan. Kurang lebih 52.000 ha lahan pertanian yang terpangkas berubah alih fungsi menjadi pemukiman dan investasi perumahan. Pada tataran pembangunan lingkungan hidup terhadap lahan pertanian di kabupaten Sidoarjo sudah dapat dikatakan menyalahi tata kelola lingkungan pertanian, di mana seharusnya untuk resapan air dan ekosistem lahan pertanian, kemudian disalahgunakan menjadi lahan pemukiman dan perumahan untuk investasi maupun tempat tinggal. Pada akhirnya, harus ada perlindungan hukum lingkungan lahan pertanian untuk masyarakat Sidoarjo dan penerapan sanksi administrasi, serta sanksi pidana apabila beberapa investor maupun pengembang, sebagaimana dalam aturan Peraturan Daerah (Perda) Nomor 6 tahun 2009 tentang Rencana Tata Ruang Wilayah (RTRW) Kabupaten Sidoarjo.
Combating Human Trafficking Through Criminal Law. In modern day slavery does not exist anymore. However, the practice of slavery in modern times transforms into human trafficking. Trafficking in persons in general can be defined as a condition where people, especially women and children, are for sale to work and they are forced to be involve in prostitution. Then the question is, how is it necessary to criminalize human trafficking? This article concludes that the actions to criminalize human trafficking is right based on the theory of crime. The regulation of prevention and eradication of crime of Crime in Business Investment activity has been changed will change the level of corruption, Narcotics and other crimes are still relatively high. Abstrak Sebagai alat negara, TNI Angkatan Laut memiliki standart yang telah ditentukan dalam proses penerimaan anggota. Begitu banyaknya masyarakat yang berminat menjadi anggota TNI menjadikan proses tersebut mengandung persaingan yang cukup ketat. Persaingan ini dinilai sarat akan praktek nepotisme, oleh karena itu penelitian ini membahas tentang praktek nepotisme perekrutan tersebut. Tujuan dalam penelitian ini adalah untuk mengetahui bagaimana praktek nepotisme perekrutan calon anggota TNI Angkatan Laut ini berlangsung. Dalam penelitian ini menggunakan metode penelitian deskriptif kualitatif dengan teknik pengambilan data secara observasi dan didukung dengan hasil wawancara. Dari hasil wawancara diketahui ada empat unsur yang berperan dalam praktek nepotisme ini. Unsur yang pertama adalah trust kepercayaan, aktor yang berperan, kekuasaan dan imbalan. Kepercayaan merupakan modal awal hubungan antara peserta dan oknum TNI yang membantunya dapat terjalin. Sedangkan aktor yang berperan melibatkan peserta dan oknum TNI baik yang bertugas menjadi panitia secara langsung maupun tidak dengan menggunakan tiga pola, yaitu pola kedekatan, pola pemanfaatan modal ekonomi dan pola penipuan. Dalam hubungan yang terjalin terdapat relasi kuasa yang mengikat. Dalam hubungan ini terdapat imbalan yang dipertukarkan baik secara intrinsik maupun ekstrinsik. The purpose of this research is to find how to practice nepotism candidates for members of the Indonesian Navy this goes. In this study using a descriptive qualitative methods with technique adoption of data in observation and supported with interview. From the interview find there are four elements that play a role in the practice of nepotism. The first element is trust, actor, powers and reward. Trust is initial capital of the relation between participants and army soldier who helped it could be entwined. actor who played imortant roles involving member and army soldier who served as committee directly or not by using three patterns, patterns of proximity, economic capital utilization patterns and patterns of fraud. In a relation which is interwoven there is a mutual power of attorney that bind. In this relationship there are reward for which it is interchangeable are intrinsically and extrinsically. Special otonomy is a solution to respons radical movement to separate fromUnitary State system of Republic of Indonesia. As far as, there are 2 provincedecided as a special otonomy province, they are Aceh and Papua. Specialotonomy for 2 province make stimulation for the other province to be decided asspecial otonomy for example Riau. It is interest to study how 1945 Constitutionregulate special otonomy . There are 2 conclusion of this paper. The first, 1945Constitution is not strict regulate special otonomy. Decision about a province tobe a special otonomy is implicated social and politic situation. And the second,Special otonomy for Riau is not relevance for this time.
