This study extends the research on corporate financial fraud by developing a new perspective on the deterrence effects of vicarious punishments premised on social learning theory. We posit that firms vicariously learn about punishments from their peers by picking up modeling cues, environmental cues, and social cues in the inhibitive learning process, thus being deterred from committing future fraudulence. Using a matched sample of 604 observations of Chinese listed firms between 2002 and 2008, our findings show that an observing firm is deterred from committing fraud if the peers in its industry are caught and punished. We further find that such deterrence effects are subject to how the observing firm evaluates the possibility of being caught and the likelihood it will be punished the same way if it violates similar prohibitions. In particular, inhibitive learning effects are positively moderated by punishments of prominent firms and model–observer similarity but negatively attenuated by the development of the legal system. Our study sheds light on the corporate fraud literature by illuminating the indirect, inhibitive learning process from vicarious punishments and identifying the conditions for differential learning/deterrence outcomes of the observing firms.

Political conflicts have been extensively studied by political scientists, but criminal conflicts have received much less attention, especially by theorists in the field. Focusing on the latter type of conflict, we address why an individual crime across an ethnic or tribal border can lead to large-scale violence. Building on rational choice theory, we present three hypothetical mechanisms which may account for criminal conflicts: (1) Avengers penalize suspects in the culprit's social group because they cannot identify the culprit; (2) avengers inflict vicarious punishment because such punishment can be more severe for the culprit than a penalty on the culprit himself; (3) by demanding collective responsibilities, avengers urge the target group to police itself and to suppress deviant behavior against outsiders. Drawing on historical incidents and recent case studies, our third mechanism appears the most compelling.

This article examines the relationship between experiencing the homicide of a family member, friend, or acquaintance and the likelihood of support for capital punishment. Homicide victims'family and friends are often portrayed as strong advocates of the death penalty. Yet, the effect of vicarious homicide victimization on support for capital punishment has never been systematically examined, and in fact, Donald Black's theory of law suggests an inverse relationship between the two variables. Using data from the 1988 General Social Survey, this research tests hypotheses derived from Black's theory regarding the relationship among social intimacy, cultural status, and the use of law in response to conflict. Multivariate logistic regression models suggest that the experience of personally knowing a homicide victim significantly affects one's likelihood of support for the death penalty, but the effect of vicarious victimization varies for black and white respondents. The empirical patterns indicate that in addition to race, religious orientation and gender also play important roles in determining the relationship between vicarious homicide victimization and support for the death penalty.

Abstract
Punishment avoidance occurs when a person commits an offence but is not punished for it. The aim of this article was to explore how young drivers experience punishment avoidance. New drivers aged between 17 and 25 years participated in 11 focus groups held in both metropolitan and regional areas in two Australian states: Queensland and Victoria. Thematic analysis identified that young drivers experience punishment avoidance in one of three ways. First, they can attempt to actively avoid punishment by engaging in deliberate actions to circumvent policing activities. Secondly, they can experience either direct or vicarious punishment avoidance of police enforcement. An example of this would be 'talking their way out of a ticket' after they had been caught by a police officer. Finally, their parents may help them avoid punishment by, for instance, paying the traffic fine on their child's behalf. This article increases our understanding of how punishment avoidance occurs in practice.

The research method used is normative juridical with a statutory approach. This study concludes that first, political parties as legal entities which are also legal subjects can be held accountable for acts of human rights violations, based on the theories and formulations of the laws and regulations that have been regulated in the Republic of Indonesia. In The Sense of Justice, distinguished legal author Markus Dirk Dubber undertakes a critical analysis of the "sense of justice": an overused, yet curiously understudied, concept in modern legal and political discourse. Courts cite it, scholars measure it, presidential candidates prize it, eulogists praise it, criminals lack it, and commentators bemoan its loss in times of war. But what is it? Often, the sense of justice is dismissed as little more than an emotional impulse that is out of place in a criminal justice system based on abstract legal and political norms equally applied to all.Dubber argues against simple categorization of the sense of justice. Drawing on recent work in moral philosophy, political theory, and linguistics, Dubber defines the sense of justice in terms of empathy-the emotional capacity that makes law possible by giving us vicarious access to the experiences of others. From there, he explores the way it is invoked, considered, and used in the American criminal justice system. He argues that this sense is more than an irrational emotional impulse but a valuable legal tool that should be properly used and understood

Over seven percent of all children in the United States have experienced a parental incarceration. Children and other dependents suffer the collateral consequences of "preventive justice" measures increasingly used by liberal democratic countries to combat a broad range of suspected crime and anti-state activities. But what does the state owe to the innocent dependents of accused caregivers? In Born Innocent, Michael J. Sullivan explores the impact of vicarious punishment on children, with a particular focus on children subject to family separation based on their identity, allegiances, and immigration status. The book provides one of the first unified treatments of state-sponsored family separation and its impact on disadvantaged citizens and immigrants.

In December 2007, random roadside drug testing commenced in Queensland, Australia. Subsequently, the aim of this study was to explore the preliminary impact of Queensland's drug driving legislation and enforcement techniques by applying Stafford and Warr's [Stafford, M.C., Warr, M., 1993. A reconceptualization of general and specific deterrence. Journal of Research in Crime and Delinquency, 30, 123-135] reconceptualization of deterrence theory. Completing a comprehensive drug driving questionnaire were 899 members of the public, university students, and individuals referred to a drug diversion program. Of note was that approximately a fifth of participants reported drug driving in the past six months. Additionally, the analysis indicated that punishment avoidance and vicarious punishment avoidance were predictors of the propensity to drug drive in the future. In contrast, there were indications that knowing of others apprehended for drug driving was not a sufficient deterrent. Sustained testing and publicity of the legislation and countermeasure appears needed to increase the deterrent impact for drug driving.

This paper explores the relationship between liberalism, victimization experience (both direct and vicarious), fear of victimization, and attitudes towards purposes of incarceration. The study makes use of a national public opinion poll conducted for ABC News in 1982. The major findings are that both fear and liberalism contribute to punitiveness but, more importantly, individual demographic characteristics are ambiguously related to punitiveness. It appears that demographic characteristics are related to punitiveness through a complex of other attitudinal associations—in this instance, fear and liberalism. Neither direct nor vicarious victimization had a direct effect on punishment attitudes. To the extent that victimization experience affects punitiveness, the effects are indirect through fear.
