Artículo que repasa la evolución legislativa de la UE en materia migratoria para, finalmente, centrarse en los puntos más polémicos de la Directiva 2088/115/CE sobre el retorno de inmigrantes ilegales: el procedimiento de retorno y expulsión, el internamiento y el interés del menor. En este análisis, la autora parte de la perspectiva del respeto a los derechos fundamentales como base que debe cumplir cualquier normativa. En opinión de la autora, la regulación de la migración debe realizarse de acuerdo a los requerimientos que el nuevo panorama mundial exige, es decir, desde una perspectiva mucho más amplia.

The article reviews the evolution of EU legislation on migration to finally focus on the most controversial points of 2088/115/CE Directive on the return of illegal immigrants: the procedure or return and expulsion, the detention and the child interest. In this analysis, the author gives a fundamental rights perspective as the basic legislation to follow.
