De zgn. kriminele statistieken vormen een geheel van gegevens waarop men vrij regelmatig beroep doet, maar niet steeds op het juiste ogenblik. Schrijver tracht te verduidelijken volgens welke regels men die statistieken op een juiste manier kan gebruiken. Hij toont aan, door het onderzoek der omstandigheden van hun totstandkoming, dat zij geen meetinstrument voor misdadigheid kunnen zijn. Daar zij statistieken zijn m.b.t. de produktie van strafrechtsbedeling moeten zij dan ook enkel en alleen gebruikt worden om dat strafrechtssysteem te ontleden.

Kriminalstatistiken sind grundsätzlich Statistiken iiber gerichtliche Aktivitäten. Im franzosischen Fall bezieht sich ihre Entwicklung im 19. Jahrhundert besonders auf die Bewegungen innerhalb des Justizsystems. Die besondere Betonung individueller Eigenschaften der Verurteilten in der Kriminologie ignoriert diese Beschränkungen. Diese Ignoranz führte nach 1932 zu einem zusammenbruch der statistischen Produktion.

Jaak Van Kerckvoorde was involved in the study of the official Belgian statistics (legal, and police statistics) and with self-reported delinquency and victim surveys. He on the validity and the reliability of the official Belgian statistics, with the aim of improving them. Taking the point of view that criminal statistics will always represent the result of a series of decision making processes (the institutionalist criminological position), rather than being a series of «facts», he showed how decision making processes at different levels determined the final counted result. He launched a series of research projects from 1986 onwards to develop statistics which allowed both vertical and horizontal integration. He also pleaded in favour of creating prosecutorial statistics and for improved criminal statistics.

After the diffusion of the « Compte général de l'administration de la justice » in France and before its declaration of indépendance (1830), Belgium creates a statistical record of the administration of justice. During the 19 th century, the publication of criminal statistics has a chaotic development in relation to the series of annual French accounts. It seems to be subjected to the influence of concerns of different environments which take part in its realization. In the perspectives of a history of representations, the study of misadventures of Belgian criminal statistics shows us the evolution of the sight of authorities about the Belgian judicial structure and the crime. We will study in this way the Belgian criminal statistics not as the reflect of the activity of Justice or crime but as the reflect of the worries of a society towards the efficiency of its judicial system.

German criminal statistics which covered the whole of Germany started in 1882. There were a number of events which precipitated them : the foundation of the German empire in 1871, and the introduction of the Imperial penal code in 1871, as well as that of the penal procedural code and legislation concerning judicial organisation in 1879. During the first half of the nineteenth century, penal statistics from different states of the German Federation were not comparable. None the less, even during this period, German intellectuals, including judges and statisticians, were questioning the validity and reliability of the penal statistics in a relatively modern fashion. The aim of the article is to analyse this discussion and to show its impact on contemporary views about criminality.
