Money is the most needed resource by people, becoming a reference for each transaction or individual maneuver and as a medium of exchange.Money is an urgent factor that is useful to boost one's personal power and to control the strategic discourse associating with a political interest and power.The nomination process is often inseparable from the use of money to attract the sympathy of citizens.Supposedly, the candidates should not rely on money politic as a way to win the election, but they must demonstrate their ability to be representative of the people. This research is a qualitative study. It was located in Sangtombolang District, Bolaang Mongondow Regency, North Sulawesi. The data obtained were processed and verified in order to obtain descriptive findings of money politic in the election perspective of Islamic law. The practice of money politic occurred in some people due to ignorance of the law on money politic, habits, and economic urgency. In Islamic values,money politicor risywah is something that is given to cancel the truth and to justify the falsehood,risywah in Islamic law is considered as confiscation of other people's property, as mentioned in Surah Al Baqarah verse 188. MUI also explained that people who give and receive risywah are haram (forbidden). Keywords: Money politic; election; Islamic law

Money politics is a political disease that is increasingly prevalent today. Money politics is a part of the bribery offense. In general, the criminal act of bribery is considered a violation in the world of politics, thus requiring money politics to also be considered a violation. In absolute terms, state laws and regulations explicitly prohibit this action, but this practice is rampant nonetheless. In Sharia law there is often discussion about risywah which is in the form of the millennial period which is reflected in the money political mechanism. However, Jurisprudence scholars in general still disagree over the law of certainty risywah. The editor of the Prophet's Hadith said that Rasulullah Saw. cursing the perpetrator and the recipient of the bribe. However, various interpretations of the scholars have resulted in an imbalance between positive legal regulations and Islamic law. By combining two legal decisions through the study of Ushūl Fikih with Saddu ad-Dzāriah's approach. This study will discuss legal decisions regarding risywah from a different perspective and prove that there is no imbalance between the two.

This article aims to explain the debate about money politics from an istishlahy perspektif. Money politics is an effort to influence the electoral masses in exchange for certain materials that someone does not exercise their right to vote or exercise their rights in a certain way. This practice make the stability of the political climate is disrupted. That is why, positive law prohibits the practice of money politics. The discourse on money politics is very interesting in the fiqh literature, if there is a concern that not giving money in a contestation of positions will fall to the wrongdoer. So the majority of scholars give privileges to do this practice, and this is not included in the category of bribery. The researcher is interested in examining more deeply the discourse on the debate about the provisions of the practice of money politics. This qualitative research using the ushul fiqh approach aims to examine methodologically more deeply the discourse on the debate about the provisions of the practice of money politics.This debate will be examined using the istishlahy method. The result of this article is: First, this practice can be applied to risywah. Due to the similarity 'illat (logical ratio), namely khauf al-mail. Second, there is a privilege in conditions that are very far from idealism in practicing money politics, as long as the indicators which are the prevailing factors of money politics practice are found in the socio-political reality.

Penyelenggaraan pemilihan umum suatu wujud dari sistem demokrasi yang dianut oleh setiap negara yang demokratis. Kegiatan pemilu tidak hanya dijadikan suatu kebutuhan kekuasaan pemerintah, melainkan dijadikan sarana prasarana bagi rakyat untuk mengartikulasikan aspirasi dan kepentingan dalam kehidupan bersama. Pemilu yang dilaksanakan secara transparan dan damai dan pemimpin yang terpilih dihasilkan oleh suara terbanyak, maka negara tersebut bisa disebut dengan negara yang demokrasi. Namun, jika negara yang diadakan membuat suatu negara menjadi kekacauan maka negara tersebut dapat dikatakan sebagai negara yang gagal dalam melaksanakan demokrasi. Seorang wakil rakyat harus memenuhi kriteria yakni intelektualitas, berakhlak, dan beragama. Tujuan dari penelitian ini yakni untuk menunjukkan bahwasanya fungsi dari partai politik dalam memilih calon anggota legislatif berdasarkan Undang-Undang Nomor 7 tahun 2017 tentang pemilu. Jenis penelitian ini adalah penelitian hukum normatif, dengan menggunakan pendekatan konseptual. Metode pengumpulan yang digunakan yaitu kepustaan. Hasil penelitian ini menunjukkan Penerapan pada sistem proporsional terbuka memiliki pengaruh besar setiap penentuan kualitas anggota legislatif, serta diberlakukannya sistem proporsional terbuka menimbulkan banyaknya calon anggota legislatif yang populer dapat terpilih tanpa mempertimbangkan kapasitas dari kemampuan para calon anggota legislatif yang akan menaiki jabatan, serta berkemungkinan bagi setiap calon yang akan menjadi legislatif berlompa untuk mendapatkan sipati dan dukungan dari masyarakat yang akan memicu terjadinya polemik politik uang.

Tulisan ini mengkaji permasalahan pandangan tokoh agama Islam di Kota Ambon mengenai hibah dan money politic dalam Pemilu dan Pilkada perspektif sosiologi dan politik hukum. Data dikumpulkan melalui wawancara dan dianalisis secara kualitatif deskriptif. Hasil penelitian menunjukkan, bahwa secara sosiologi, tokoh agama Islam di kota Ambon memandang adanya peluang dukungan dan penggalangan dukungan dari tokoh agama Islam kepada calon dalam Pemilu dan Pilkada. Namun, pengaruh dukungan tersebut tidak signifikan. Sebab pemilih masih cenderung memberikan hak pilihnya kepada calon yang memberikan hibah atau money politic. Sebab itu dibutuhkan solusi untuk mengeliminir praktek money politic tersebut. Sedangkan secara politik hukum, tokoh agama Islam di kota Ambon memandang kuatnya pengaruh pemberian hibah dan money politic terhadap partisipasi pemilih dalam Pemilu dan Pilkada, sehingga kebanyakan pemilih lebih tertarik memberikan suaranya karena pertimbangan pragmatis, bukan berdasarkan kriteria calon. Padahal calon yang tidak memiliki integritas dan kredibelitas,tidak akan memperhatikan kesejahteraan rakyatnya.

Money politic in regional head election in Indonesia is the serious crime. Money politic perpetrators can be sentenced to prison. The practice of money politic harms democracy in Indonesia. For this who is proven to have committed the criminal act of money politic in the criminal event, repressive criminal law enforcement effort can be imposed on the person concerned. The procedure for repressive law enforcement against perpetrators of money politic in it is by referring to the Indonesian Criminal Law.

Money politic merupakan tindakan melanggar hukum, serta akan berdampak negatif bagi keberlangsungan demokrasi di Indonesia. Saat ini penegakan hukum money politic sangat rendah, dikarenakan pengawasan yang kurang, perilaku masyarakat yang mendukung serta sistem pemilihan umum proporsional terbuka membuat tindakan money politic semakin berkembang di Indonesia. Penelitian ini menggunakan pendekatan hukum-normatif yang bertujuan mengetahui pada aspek sejarah serta konsep tindakan money politic. Hasil yang diperoleh menunjukan bahwa dengan semakin berkembangnya tindakan money politic membuat kondisi demokrasi tidak sesuai dengan tujuan idealnya, sehingga perlu adanya pendekatan non penal yang bersifat pencegahan dalam menghilangkan tindakan money politic. Law enforcement is carried out on candidates for regional heads and representatives who are caught giving money or other materials known as money politics to win their partners in a transparent manner, let alone reaching the Court. So far, only certain individuals who happen to be caught giving money or distributing basic necessities from a candidate pair of regional heads to the community undergoing the legal process, while the intellectual actors have never been revealed, so Law Number 8 of 2015 is needed.

ABSTRAK Tujuan penelitian ini adalah untuk mendeskripsikan tanggapan masyarakat tentang praktik money politic yang terjadi di Desa Rejosari, Kecamatan Jatirejo Kab. Mojokerto. Penelitian ini menggunakan pendekatan kuantitatif dengan metode deskriptif. Lokasi penelitian di Desa Rejosari Kecamatan Jatirejo Kabupaten Mojokerto. Data penelitian ini diperoleh melalui angket dan wawancara. Teknik analisis data yang digunakan dalam penelitian ini adalah deskriptif kuantitatif dalam bentuk prosentase. Hasil penelitian ini menunjukkan bahwa pendapat masyarakat tentang praktik money politic dari berbagai tingkat pendidikan bervariasi dalam menjawab. Dari kriteria penilaian yang ditentukan masyarakat menjawab kategori buruk, cukup baik, baik dan sangat baik. Penelitian ini diharapkan dapat mengevaluasi sistem pemilu agar kebijakan tersebut nantinya dapat meminimalisir terjadinya praktik money politic yang sekarang marak terjadi di setiap berlangsungnya pemilu. This research uses quantitative approach with descriptive method. Location of the research is on Village of Rejosari District of Jatirejo Regency of Mojokerto. Date of the research is collected by questionnaire and interview. Data analysis technique used in this research is descriptive quantitative in percentage form. Result of the research indicates that opinion of the people about money politic practices from various level of education is vary in their answers. Based on community assesment criteria said bad, enoug, good, best. Through this research, we can evaluate system of general election so that policies to regulate the system can minimalize incident of money politic practices which is growing up in every general election moment. Proses pelaksanaan dmokrasi di Indonesia masih ditemukan pelanggaran, salah satu elanggaran yang terjadi adalah money politic. Upaya yang dapat dilakuakn untuk mencegah money politic salah satunya adalah penyuluhan hukum kepada masyarakt atau kelompok masyarakat, termasuk juga kelompok Pencak Silat Cempaka Putih Cabang Kota Semarang. Pelaksanaan pengabdian dibagi menjadi tiga tahapapan, yaitu pra kegiatan, pelaksanaan, dan evaluasi. Pasca diberikannya penyuluhan berdampak sangat baik terhadap Pendekar Pencak Silat Cempaka Putih Cabang Kota Semarang. Hal ini ditunjukan adanya komitmen untuk menolak praktik money politic. Komitmen tersebut tidak terlepas dari pengaruh peningkatan mental dan karakter yang sudah ditanamkan kepada seorang pendekar pencak silat.

Introduction to The Problem: The election is a way to choose leaders in both the legislative and executive fields. An election mechanism is also a form of power distribution and its limitation, so elections are an important activity for national development. Through this election, there are evil sparks that can be lit by those who have an evil character; one of these sparks is money politics. Therefore, the implementation of elections required law enforcement agencies to deal with election violations and election disputes under applicable rules.Purpose/Objective Study: The purpose of this study is to find out how law enforcement in violations of money politics in Indonesia and how to deal with its violations.Design/Methodology/Approach: This article is a doctrinal one and using normative legal research methods with a statutory approach. The statutory course referred to is an approach based on legal reviewers related to the problem being discussed.Findings: In this study, the authors found that law enforcement of money politics in general elections in Indonesia must be based on established conditions. Such conditions are like implementing the regulations and force them to be implemented right away. Efforts that must be made in overcoming this violation in general elections in Indonesia are by making pre-eventive efforts. These efforts address election violations from the preparation step until the election implementation step. The second act is preventive actions, namely prevention efforts or non-penal measures before election crime. The third is a repressive effort that deals with corruption and focuses on the nature of the action, eradication, or suppression after the crime.Paper Type: Research Article

Penelitian ini membahas mengenai perikau masyarakat terhadap praktek Money politic pada pemilu serentak 2019 di desa sumarrang. Maka yang menjadi pokok permasalahan adalah melihat seperti apa perilaku masyarakat terhadap praktek Money politic. Penelitian ini bertujuan untuk melihat sikap serta tidakan masyarakat dalam melihat praktek Money politic yang terjadi di sekitarnya. Adapun metode penelitian yang digunakan adalah penelitian jenis kualitatif dengan metode desktiptif atau memberikan gambaran yang jelas dan mendalam tentang perilaku masyarakat terhadap praktek Money politic. adapun teknik penelitian yang digunakan adalah Wawancara dan juga observasi untuk mengumpulkan data dan juga informasi yang akurat dan terpercaya. Berdasarkan hasil penelitian penulis menunjukan bahwa masyarakat masih banyak yang menerima uang dari praktek Money politic, bersikap seolah itu adalah hal yang wajar dan bertindak tidak sesui ketentuan yang ditetapkan.

Money politics is a crime against democracy as aspired by the Indonesian state, especially against money politics crimes committed by Regional Representative Council Candidates. This study aimed to examine the forms of money politics in general elections and to reveal sanctions against candidates for Regional Representative Council Candidates who committed money politics. This study is normative research with a statutory approach. The sources of data used were primary and secondary data. Data were collected through reading activities, which were carried out by collecting existing legal materials or studying documents from existing laws and regulations and other supporting instruments. The results of the study indicated that the regulation of money politics is regulated in the constitution and some special legal regulations. The form of money politics is in the form of money, public facilities, basic needs, and projects. The sanctions applied are imprisonment and fines or imprisonment instead of fines. Criminal sanctions are applied to perpetrators who gave or received all forms of money politics, which is used as a strategy to win political contestations

Fokus penelitian ini adalah mendeskripsikan : 1) Peran dari Bawaslu dalam mencegah terjadinya money politic tahapan kampanye pada pemilu tahun 2019 di Kabupaten Tulungagung. 2) Rencana strategi Bawaslu dalam pencegahan money politic tahapan kampanye pada Pemilu Tahun 2019 di Kabupaten Tulungagung. Penelitian dalam skripsi ini menggunakan jenis penelitian empiris dengan pendekatan penelitian yuridis sosiologis. Penelitian ini dilakukan di Kantor Bawaslu Kabupaten Tulungagung, KPU Tulungagung. Dalam pengumpulan data skripsi dilakukan wawancara kepada Komisioner Bawaslu, Komisioner KPU, Caleg DPRD Kabupaten Tulungagung dan Masyarkat. Pengolahan data penelitian dilakukan dengan cara pengeditan, klasifikasi, pembuktian kemudian dianalisis untuk mendapatkan kesimpulan. Hasil penelitian yang diperoleh dari Peran Bawaslu dalam pencegahan money politic tahapan kampanye pada pemilu tahun 2019 di Kabupaten Tulungagung : 1) Peran Bawaslu dalam pencegahan money politic tahapan kampanye masih kurang maksimal dengan tugas Bawaslu sesuai dengan ketentuan Pasal 101,103 dan 104 Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilu 2) Rencana strategi Bawaslu dalam pencegahan money politic tahapan kampanye belum memenuhi tahap-tahap kebijakan publik melliputi Penyusunan agenda, formulasi, adopsi kebijakan, implementasi kebijakan dan penilaian kebijakan.

ABSTRAK Permasalahan politik uang dalam pesta demokrasi (Pemilu) merupakan tindakan yang kerap terjadi. Isu ataupun memang benar nyata terjadi, setidaknya mengharuskan ruang pikir bagaimana dengan aturan hukum yang ada, yang mengatur hal tersebut, serta bagaimana sebenarnya alur penyelesaian tindakan tersebut. Penelitian ini bertujuan untuk mengetahui proses penanganan perkara tindak pidana politik uang yang ditangani pada Badan Pengawas Pemilu (Bawaslu) Provinsi Jambi pada Pemilu 2019 dan fakor penghambat penanganan tindak pidana tersebut. Adapun hasil penelitian, bahwa proses penanganan tindak pidana politik uang pada Pemilu 2019 melalui sembilan tahap yang setiap tahap dibatasi waktu yaitu, Tahap temuan dan laporan, pembahasan pertama di Sentra Gakkumdu, pembahasan kedua di Sentra Gakkumdu, rapat pleno, tahap penyidikan, pembahasan ketiga di Sentra Gakkumdu, tahap penuntutan, tahap pengadilan, dan pembahasan keempat di Sentra Gakkumdu. Faktor penghambat dalam penanganan tindak pidana politik uang, yaitu pengaturan alur penanganan yang panjang dengan waktu yang terbatas, sulitnya menemukan alat bukti karena waktu terlalu singkat. ABSTRACT The problem of money politics in democratic parties (elections) is an act that often occurs. The issue, or indeed it really happened, at least requires a space to think about how the existing legal rules, which regulate it, as well as how exactly the flow of completion of the action. This study aims to determine the process of handling cases of money politics criminal acts handled by the Election Supervisory Body (Bawaslu) of Jambi Province in the 2019 Election and the factors which hamper the handling of these criminal acts. As for the results of the study, that the process of handling money politics in 2019 Election through nine stages, each phase limited by time, namely, the stages of findings and reports, the first discussion at the Gakkumdu Center, the second discussion at the Gakkumdu Center, the plenary meeting, the investigation stage, the third discussion at Gakkumdu Center, the prosecution stage, the court stage, and the fourth discussion at the Gakkumdu Center. Inhibiting factors in handling money politics crime, namely setting a long flow of handling with limited time, difficulty in finding evidence because the time is too short.
