British cases used to be widely relied upon to show that courts were entitled to hear criminal proceedings against defendants brought before them without having to enquire into the process by which custody over them had been obtained: and specifically, that there was no bar to proceeding where the allegation was made that custody had been obtained in breach of international law.1 The consistency of the doctrine was breached by Mackeson2 when the English court refused to hear the case against a defendant who, it accepted, had been brought to England by a collusive process between the English and Zimbabwean authorities, which arguably breached both national laws, even if it did not involve a breach of international law. While the previous orthodoxy soon reasserted itself in Driver,3 the edifice of authority was substantially undermined in Bennett4 when the House of Lords acceded to the claim of the applicant that proceedings against him would be an abuse of process, given the circumstances in which his presence in the United Kingdom had been achieved. Outside the United Kingdom, the practice in other States continued in different directions, sometimes confirming the old position of male captus, bene detentus,5 sometimes the reverse.6
With occasion of the most recent crisis between Colombia and Venezuela, in re the capture of the so-called "chancellor" of the FARC, the author of this paper proposes a scientific reading of the case that muddled the relationships among both States, but that at the same time has left important lessons for all. Since the V enezuelan government' s perception in this case was so quick and confused as well as the resolution with its Colombian homologous, a theoretical framework of analysis is required. That, because, excepting journalistic covering, up to now, we don't know in our milieu a politico-juridical study that allows to apprehend the international crises and, in what concerns us, the imposition of a new equilibrium. Therefore, the first part of the essay makes reference to the elements of the international crises, its definition, classes and phases for those that cross usually, that is: from the previous uneasiness to the rupture moment, going by the escalade and the distension, until the impact of the crisis, of where all its pedagogic character arises. In addition, next to the observation of the socio-political phenomena, it proceeds, in a second part, to the juridical study of the question, if we accept the failure of one of the paradigms of the foundation and of the of the international law as such, which is that of the sovereignty of the States, in a horizontal system, but in of a permanent evolution. To the point that the territorial sovereignty is not appreciated as absolute and maybe finds in the principle male captus, bene detentus, one of their most revealing exceptions. Are those characteristic or symptom of the international law? Only a critical reading of this dissertation, will allow each one to extract its own conclusions. ; Con ocasión de la más reciente crisis entre Colombia y Venezuela, a propósito de la captura del llamado "canciller" de las FARC, el autor del ensayo sugiere una lectura científica del asunto que enturbió las relaciones entre los dos estados, pero, que al mismo tiempo, ha dejado importantes enseñanzas para todos. Dado que tan rápida y confusa fue la percepción del Gobierno venezolano en este caso, como la resolución con su homólogo colombiano, se requiere un marco teórico de análisis, pues, abstracción hecha de la cobertura periodística, hasta ahora no conocemos en nuestro medio un estudio político-jurídico que permita aprehender las crisis internacionales y, en lo que nos concierne, la imposición de un nuevo equilibrio. En consecuencia, la primera parte del estudio hace referencia a los elementos de las crisis internacionales, su definición, clases y fases por las que normalmente atraviesan, a saber: desde el malestar previo al momento de ruptura, pasando por la escalada y la distensión, hasta el impacto de la crisis, de donde surge todo su carácter pedagógico. En adición, junto a la observación de los fenómenos sociopolíticos, se procede, en una segunda parte, al estudio jurídico de la cuestión, si aceptamos el rompimiento de uno de los paradigmas de la fundación y del funcionamiento del derecho internacional, cual es el de la soberanía de los estados, en un sistema horizontal, pero de permanente evolución. Al punto que la soberanía territorial no se a aprecia como absoluta y encuentra, quizás, en el principio male captus bene detentus, una de sus más reveladoras excepciones. ¿Característica o síntoma del derecho internacional? Sólo una lectura crítica de esta disertación, permitirá a cada cual extraer sus propias conclusiones.
