There has recently been an upsurge in anthropologists' interest in law, with North Africa and the Middle East taking a prominent position. One of the foci is the coexistence of multiple sets of legal practices, and the ways in which people negotiate between different legal "systems." This emphasis closely mirrors the more general shift in anthropology from "discourse" to "practice," and shares both its strengths and weaknesses. Among the latter is that the resulting emphasis on "legal pluralism" (Griffith 1986) runs the danger of eroding the concept of law as such, subsuming it within more general and all-encompassing notions of "conflict resolution." Similarly, there is a risk that one of the most striking aspects of legal procedure, namely the value placed on the act of making rules, is being neglected, and the actual content of local law codes and their underlying principles are receiving less attention than they deserve. As a result, "customary law" is more often implicitly defined by what it is not. Here, my aim is not to shift the focus from "practice" to "discourse," but rather to understand the internal logic of one such set of 'customs,' and to consider the act of making law in itself as a special kind of practice (see also Comaroff and Roberts 1981: 15–16).

Pierre Bourdieu conducted ethnographic research in his native region
of Béarn and in Algeria during the late 1950s and early 1960s. He
rarely drew explicit comparisons between the two sites, despite striking
parallels in themes such as notions of honor in Mediterranean peasant
ethos, the habitus as internalized dispositions, and peasant malaise
in the face of socioeconomic change. Bourdieu called his Béarn
ethnography an inversion of Lévi-Strauss' Tristes Tropiques,
as a way to "objectify" the familiar. I suggest that constructions
of traditional and modern that informed Bourdieu's early research in
both sites led to a nostalgic view of "tristes paysans."
International audience A recurrent paradox accompanies Pierre Bourdieu's description of his relation to his earliest field site: the people of Kabylia are frequently evoked as 'at once exotic and familiar'. In the present article I ask what conditions must prevail for such a depiction to be possible. Taking up work conducted in recent years concerning the details of Bourdieu's fieldwork, its theoretical presuppositions, and its place within the declining French empire, I propose that Bourdieu's depiction is predicated on what Herzfeld calls 'practical Mediterraneanism': an ideology of the Mediterranean as a cultural region that permits Bourdieu to negotiate his colonial position, by transmuting a power relation into a relation of cultural similarity. Yet I aim to avoid imputing to Bourdieu a subjective failing in this regard, whether through cynical manipulation or simple error. Instead, pausing on the performative dimension of Bourdieu's texts, I examine what his representations of the Kabyle do throughout his oeuvre and how these are bound by particular intellectual, existential, and political problems that arise at different times.

The region of Kabylia was one of the difficult regions where colonialism had not been able to penetrate, due to the constancy of its population, so its occupation was delayed until 1857. France decided to reorganize the region and set up a new method, which he said respected 'democratic tribal customs'. Camille Sabatier proposed a new policy called "The Kabyle Question". This policy aimed to integrate the region, eliminating its traditions and social structure. But this policy failed because of the opposition. ; كانت منطقة القبائل من المناطق الصعبة التي استعصى على الاستعمار دخولها، بسبب صمود سكانها، فتأخر احتلالها إلى سنة 1857، قررت فرنسا إعادة تنظيم المنطقة وتطبيق طريقة جديدة فيما قال أنها تحترم "العادات الديمقراطية القبائلية". وأتى كاميل صابتيي بسياسة جديدة سمَها "المسألة القبائلية". كانت هذه السياسة تهدف إلى إدماج المنطقة، بالقضاء على تقاليدها وبنيتها الاجتماعية، ولكن هذه السياسة فشلت بسبب المعارضة.

Vers 2000, des travaux ont signalé une mutation silencieuse de l'élevage pastorale au Maghreb. Afin de saisir ces dynamiques, nous avons mené plusieurs études en zones steppiques des trois pays. Des facteurs de perturbations génériques se sont révélés à la fin du 20ème siècle : forte croissance démographique, périodes de sécheresses sévères, accaparement des terres de parcours pour développer les cultures, transformation des habitats, politique publique agricole mettant plus l'accent sur l'agriculture que sur l'élevage, évolutions socioculturelles (e.g. scolarisation, poids en diminution des Arch pour la régulation des accès aux ressources, etc.). Dès les années 1990, les éco-pastoralistes ont souligné l'augmentation des surfaces cultivées, la diminution des surfaces de parcours et la baisse de leur productivité. )l s'avère néanmoins que les cheptels ont une nette tendance à augmenter pour tenter de couvrir les besoins des trois pays. Les parcours naturels ne permettent de couvrir que 40 à 50 % des besoins des animaux (en Tunisie Central < à 20%.). Les chaumes, les "céréales sinistrés" les repousses de céréales en automne etc., sont pâturés. Mais il se révèle nécessaire d'apporter des concentrés, environ 30 à 45 % des besoins des animaux. L'obtention en concentré (e.g. orge, son de blé, etc.) est devenu un facteur majeur de vulnérabilité. Notre questionnement porte sur les potentialités à valoriser les ressources fourragères, par des usages ajustés des parcours et le recours à de nouvelles ressources. L'objectif est de diminuer la part des concentrés qui augmente l'incertitude dans les élevages et les coûts de production.
