Dans "D'autres vies que la mienne", Emmanuel Carrère décrit minutieusement le combat mené par quelques juges français contre les abus des sociétés de crédit à l'encontre de clients surendettés. In this a priori repulsive context, Carrère manages to deconstruct the myths, which form the fundament of legal science, of axiological universality and neutrality of law and jurists. Carrère's book thus reveals what legal dogmatism seeks to mask : the preponderant place that judges occupy in the construction and evolution of law and power relations which characterize the legal field. In doing so, Carrère's non-fiction allows us to show the preponderance of fiction contained in the law, which is a condition sine qua non of the acceptability, and therefore of the efficiency, of the violence that the agents of legal systems are able to exercise. ; Peer reviewed

The paper adopts the perspective of "law and literature" studies to investigate how the French novel 'Lives others than my own (D'autres vies que la mienne)' by Emmanuel Car-rère addresses the evolutions of European Union law on unfair terms in consumer con-tracts. By looking at European Union law from the perspective of individual lives, the essay compares the way in which literature and EU law conceive three categories of individuals involved: consumers, moneylenders and judges. Carrère's novel is taken as an example to challenge the stereotype according to which literature expresses a sym-pathetic and partisan conception of social reality compared to the one of law.

September 2021: In Paris beginnt ein Jahrhundertprozess. Am Freitag, den 13. November 2015 (vendredi 13), hatten sich in der Konzerthalle Bataclan, auf den Terrassen mehrerer Cafés und vor dem Stade de France sieben IS-Kämpfer in die Luft gesprengt, dabei 131 Menschen in den Tod gerissen und fast 700 verletzt. Nach diesen Attentaten wurde in Frankreich der Ausnahmezustand ausgerufen – er blieb zwei Jahre lang verhängt –, und das Bild des Landes und der Gesellschaft veränderte sich von Polizeimethoden bis Parteienspektrum nachhaltig: ein nationales Trauma. Im von den Insidern »V13« genannten exemplarischen Prozess sollte dieses Trauma bearbeitet, sollten Hunderte von Perspektiven abgewogen und schließlich ein Urteil gefällt werden. Emmanuel Carrère besuchte den Prozess über neun Monate lang Tag für Tag, schrieb wöchentlich eine Kolumne aus dem Gerichtssaal, berichtete über Akteure, das Grauen, unverhoffte Menschlichkeit und die Maschine der Rechtsprechung. V13 ist das vielstimmige Porträt eines Prozesses, mit dem eine in ihren Grundfesten erschütterte Gesellschaft nach Heilung sucht. Die Bühne des eigens gebauten Gerichtssaals ließ alle Beteiligten zu Wort kommen, und so erzählt Carrère, was er gehört und erfragt hat: Wer waren die Opfer und die Täter? Wie entsteht Terrorismus? Warum ist passiert, was passiert ist? Mit V13 gelingt Carrère ein weiteres großes Buch, das durch tiefstes Dunkel geht, um genau dort Liebe, Hoffnung und Licht zu finden.
