Election law enforcement is a necessity in an election that is democratic and has legal provisions. Election law enforcement agencies are the key to the implementation of democratic and fair elections. No matter how small the violations that occur, it is important to follow up, so that substantial democracy can be achieved and carried out. The reconceptualization of institutions authorized to enforce election law is important to be formulated in the revision of the Election Law. Activists and stakeholders who are concerned about electoral studies are obliged to provide contributions, ideas for the realization of elections and electoral justice in subsequent elections.
Abstract: Article 1/ No.5/ Act No. 15/ Year 2011 on the Implementation of General Election states that "the implementation of general election at the national level is the responsibility of organizations, the so called the General Election Commission (or known as KPU in bahasa) and the General Election Controller (or the national BAWASLU in bahasa). Both of them have an integrated function in implementing the election for choosing the member of the House of Parliaments (DPR in bahasa), the Regional Representative Council (or DPD in bahasa), the House of Parliaments at regional level (or DPRD in bahasa), the President and Vice President elected directly by the people, as well as to elect governors, regents, and city-majors, democratically". Furthermore, Article 60 (3) letter a Law Number 11/ Year 2006 regarding the Government of Aceh states that "members of the General Election Controller as being referred in paragraph (1) and paragraph (2) could be proposed by the House of Parliaments of Aceh Province (or DPRA in bahasa)/ the House of Parliaments at the District Level (or DPRK in bahasa) up to a maximum of 5 (five) person". This may cause disharmony and may impede the election itself. The objective of this study is to determine which institution is actually being authorized to choose the member of General Election Controller in Aceh province. Methodology applied in this research was juridical normative research (or juridical normative). Results showed that the national BAWASLU has the highest authority to choose its member at the provincial level, including in Aceh. Moreover, the Election Supervision Committee (PANWASLIH) is merely authorized to supervise election for choosing provincial leaders. This study suggests the Government of Aceh and the national BAWASLU to understand and to fulfill their responsibilities according to their authorities so that disharmony and misinterpretation can be avoided.Keywords : Government of Aceh, general election, election controller, election committee.Abstrak: Pasal 1 angka 5 UU Nomor 15 Tahun 2011 tentang Penyelenggaraan Pemilihan Umum menyatakan bahwa: "Penyelenggaraan Pemilu adalah lembaga yang menyelenggarakan Pemilu yang terdiri atas Komisi Pemilihan Umum (KPU) dan Badan Pengawas Pemilu (BAWASLU) sebagai satu kesatuan fungsi penyelenggaraan Pemilu untuk memilih anggota Dewan Perwakilan Rakyat (DPR), Dewan Perwakilan Daerah (DPD), Dewan Perwakilan Rakyat Daerah (DPRD), Presiden dan Wakil Presiden secara Langsung oleh Rakyat, serta untuk memilih Gubernur, Bupati, dan Walikota secara demokratis". Selain itu, Pasal 60 ayat (3) huruf a Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh menyebutkan bahwa "anggota Panitia Pengawas Pemilihan sebagaimana dimaksud pada ayat (1) dan ayat (2), masing-masing sebanyak 5 (lima) orang yang diusulkan oleh DPRA/DPRK". Hal ini dapat menyebabkan disharmonisasi aturan sehingga dapat menghambat tahapan pemilu itu sendiri. Tujuan penelitian untuk mengetahui lembaga mana yang sebenarnya dapat mengisi anggota BAWASLU Aceh. Metode penelitian yang digunakan penelitian hukum normatif (yuridis normative). Hasil penelitian menunjukkan bahwa BAWASLU pusatlah yang berwenang mengisi anggota BAWASLU di tingkat provinsi, termasuk di provinsi Aceh. Selain itu, panitia pengawas pemilihan (PANWASLIH) hanya berwenang mengawasi PILKADA. Disarankan kepada pemerintah aceh dan BAWASLU pusat untuk memahami dan mengisi tanggung jawabnya sesuai kewenangan sehingga disharmonisasi dan misinterpretasi dapat dihindari. Kata kunci : Pemerintah Aceh, pemilihan umum, pengawas pemilihan, komiti pemilihan.
Bawaslu telah mengeluarkan rekomendasi untuk mendiskualifikasi terhadap 7 (tujuh) calon petahana pada pilkada 2020. Alasannya adalah 3 diantaranya merupakan petahana yang menyalahgunakan bantuan sosial untuk kepentingan pribadi dan/atau golongan, sedangkan yang lainnya adalah melakukan mutasi jabatan. Padahal kedua hal tersebut dilarang dalam hukum. Namun, memang perihal penyalahgunaan jabatan berkaitan dengan kepentingan bantuan sosial belum diatur secara spesifik dalam hukum pemilu, karena sifatnya adalah kondisional (mengikuti keadaa) yakni misalnya bencana non alam covid-19. Hal tersebut tidak menutup Bawaslu untuk melakukan terobosan hukum salah satunya adalah dengan penemuan hukum menggunakan metode interpretasi teologis-sosiologis, tujuan utamanya adalah untuk mewujudkan keadilan pemilu serta tercapainya kesejahteraan rakyat sebagaimana tujuan Negara, untuk mendapatkan progresivitas keadilan. Metode penelitian ini adalah penelitian yuridis-empiris dengan menganalisis hukum terkait dengan pemilu yang dihubungkan dengan kondisi lapangan terkait dengan pelanggaran-pelanggaran pemilu. Hasil penelitian menununjukan Bahwa Bawaslu sebagai lembaga penyelenggara pemilu berusaha mewujudkan suatu cita demokrasi yaitu keadilan pemilu. Adanya rekomendasi diskualifikasinya 7 calon petahana dalam pilkada membuktikan eksistensi bawaslu dalam menemukan keputusan yang mengedapankan kepentingan rakyat.
Tulisan mengelaborasi perselisihan antara KPU dan Bawaslu dalam pemilihan umum 2014. KPU dan Bawaslu adalah aktor yang diamanatkan oleh UU sebagai penyelenggara pemilu. Karena itu kedua lembaga ini memiliki peran yang berbeda dalam menyelenggarakan dan mengawal prsoses pemilu. Sekalipun demikian, dalam praktekknya kedua lembaga ini tidak selalu berjalan beriringan. Terkadang diantara keduanya saling berselisih paham dalam menentukan partai politik mana saja yang lolos mengikuti pemilu. Misalnya, dalam menentukan lolosnya PKPI pada pemilu 2014 ternyata terjadi perbedaan pandangan antara KPU dan Bawaslu. Perselisihan pandangan ini nampak dari sikap egoisme masing-masing lembaga penyelenggara. Hal ini tentunya sangat disayangkan. Sebab kedua lembaga ini sebenarnya didisain untuk saling bermitra dan bekerjasama dalam mengawal proses pemilu di Indonesia.
Law Number 7 of 2017 concerning on General Elections now has given strong authority to the Election Supervisory Agency (Bawaslu). The Election Supervisory Agency now does not only become a recommendation institution as stated in the previous Election law. Now the Election Supervisory Agency is the executor agency or case breaker. This was stated expressly in the formulation of Article 461 paragraph (1) of Law No.7 / 2017, that the Election Supervisory Agency, Provincial Election Supervisory Agency, Regency Election Supervisory Agency receive, examine, review, and decide election administration violations. Then paragraph 6 states that the decision of the Election Supervisory Agency, Provincial Election Supervisory Agency, Regency Election Supervisory Agency is to resolve election administration violations in the form of: first, administrative improvements to systems, procedures, or mechanisms in accordance with the provisions of the legislation; second, written warning; third, dissociate of certain stages in organizing elections; and fourth, other administrative sanctions in accordance with the provisions of the law. Based on that, this paper seeks to provide an analysis of the Election Supervisory Agency as an Election Supervisory Institution on the one hand, and as a judicial institution on the other side. The reason is that the Election Supervisory Agency now has a judicial function in implementing its authority, so that the procedure for resolving cases of election administration violations carried out in the Election Supervisory Agency is also in accordance with the judicial model of judicial institution in general. This paper also tries to confirm the performance of the Election Supervisory Agency as an institution that no longer needs to depend on the commitment of other institutions such as the KPU, the Police, and the prosecutor. Law No. 7/2017 has made the Election Supervisory Agency as the "real" supervisory institution. That is, the Election Supervisory Agency should be an institution that has an important role in realizing the implementation of the legitimate election system.
Demokrasi adalah sebuah proses yang terus menerus memiliki gagasan yang berkembang dengan perubahan. Jika suatu negara mampu menerapkan kebebasan, keadilan dan kesejahteraan sempurna, maka negara tersebut adalah negara yang sukses menjalankan demokrasi. Sebagai salah satu perwujudan negara republik Indonesia dalam hal menjalankan demokrasi adalah melalui pemilihan umum dalam memilih Presiden, Gubernur, Bupati atau Wali Kota, maupun pemilihan umum DPR, DPD, DPRD Provinsi dan DPRD Kabupaten/Kota yang berlangsung secara langsung, umum, bebas, rahasia, jujur dan adil. Sejak berlakunya Undang-Undang Nomor 15 Tahun 2011 yang kemudian diubah menjadi Undang-Undang Nomor 10 Tahun 2016 Tentang Pemilihan Umum Kepala Daerah Gubernur, Bupati, dan Wali Kota dan Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum Presiden dan Wakil Presiden, Dewan Perwakilan Rakyat Republik Indonesia (DPR RI), Dewan Perwakilan Rakyat Daerah (DPD), DPRD Provinsi dan DPRD Kabupaten/Kota, eksistensi dan prosfek Badan Pengawas Pemilihan Umum dalam hal penanganan pelanggaran Pemilihan Umum cukup besar yakni dapat melakukan fungsi sebagaimana tugas-tugas kepolisisan dalam proses penyelidikan dan penyidikan terhadap pelanggaran pemilu seperti yang tercantum dalam dalam Undang-Undang No. 10 Tahun 2016 Tentang Pemilihan Umum Tentang Perubahan Kedua atas Undang-Undang Nomor 1 Tahun 2015 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2014 Tentang Pemilihan Gubernur, Bupati, dan Wali Kota menjadi Undang-Undang dalam Pasal 135 A ayat (2) yang mengatakan bahwa " Bawaslu Provinsi menerima, memeriksa, dan memutus pelanggaran administrasi pemilihan sebagaimana dimaksud pada ayat (1) dalam jangka waktu paling lama 14 (empat belas) hari kerja.
The birth of the Election Organizing Honorary Council as one of the institutions which tasked with creating and overseeing a democratic election process is a new history and an important breakthrough in the political system in this country. The presence of the Election Organizing Honorary Council is expected to be able to give new hope for the creation of a democratic election. In addition, it is being able to create elections that fulfill a sense of fairness, credibility, accompanied by integrity of implementation. The Election Organizers Honorary Council in the dismissal of General Elections Commission and Election Supervisory Agency is regulated in Law Number 15 of 2011 concerning General Election Organizers. The Election Organizers Honorary Council not only takes action against members of election organizers who are clearly proven to have violated the election code of ethics, but also provides sanctions for the ranks of the secretariat of election organizers through their respective superiors based on the disciplinary provisions of the staffing code of ethics. Based on the discussion, it was concluded that the mechanism for imposing sanctions against General Elections Commission and Election Supervisory Agency given by the Election Organizing Honorary Council is that if there are complaints and reports or recommendations, they can be submitted to the Election Organizers Honorary Council to examine and decide on alleged violations of the Code of Ethics. Complaints or reports are submitted accompanied by at least 2 (two) pieces of evidence and after fulfilling administrative verification, the Election Organizers Honorary Council convenes to determine and prove the report or complaint. The legal consequences of the decision of the Election Organizing Honorary Council in dismissing the commissioners of General Elections Commission and Election Supervisory Agency are final and binding so that no other legal remedies or further legal remedies are available after the Election Organizers Honorary Council decision takes effect since it was stipulated and pronounced in an open plenary session. The decision is immediately binding and coercive in nature so that all institutions administering state power and including judicial bodies are bound and obliged to carry out the Election Organizers Honorary Council decision as it should. Penyelenggaraan Pemilu tidak bisa lepas dari lembaga pemiluan, salah satunya adalah Bawaslu. Jenis penelitian yang digunakan dalam penelitian ini adalah menggunakan pendektan yuridis normatif dan didukung oleh empiris. Adapun teknik pengumpulan data yang digunakan adalah studi kepustakaan. Data tersebut kemudian dianalisis dengan cara kualitatif. Hasil penelitian menunjukkan bahwa, bawaslu mempenyai kedudukan dominan dalam penanganan penindakan pelanggaran pemilu. Bawaslu berwenang menerima dan menindak lanjuti laporan yang berkaitan dengan dugaan adanya pelanggaran terhadap pelaksanaan peraturan perundang-undangan yang mengatur mengenai Pemilu, memeriksa, mengkaji dan memutus pelanggaran administrasi Pemilu, memeriksa, mengkaji, dan memutus pelanggaran politik uang. Kedua, Berbagai Permasalahan dalam pelaksanaan pemilu sebelumnya, memerlukan tindakan penyelesaian yang dapat dilakukan oleh otoritas pembentuk Undang-undang melalui revisi perundang-undangan, atau melalui tindakan yang dilakukan oleh penyelenggara Pemilu Bawaslu atau KPU) melalui pembentukan peraturan tekhnis Penyelenggara Pemilu.
AbstractThe presence of additional independent state institutions is becoming increasingly important in order to keep the process of democratization being developed by a state that has just detached itself from the authoritarian system. It is in this context that Bawaslu is positioned as a driver of the democratization process through election activities. In this study, the authors formulate two (2) problems are (1) How Bawaslu position in the structure of state institutions of Indonesia? (2) How Bawaslu's tasks, functions and authorities are. The research method used is normative method. From the results of research that the authors do. Bawaslu position in Indonesian citizenship structure is as an auxiliary state organs institution. The presence of Bawaslu because the government no longer has the credibility to hold a fair and democratic elections. With Law No. 7 of 2017 on the new General Election has strengthened both the composition, duties, and authority of Bawaslu. First, Article 89 shows the Regency / Municipal Panwaslu has been changed to Bawaslu Kabupaten / Kota. Second, Article 93 indicates that Bawaslu is also responsible for overseeing the neutrality of the State Civil Apparatus (ASN), TNI and Polri. Third, Section 95 shows Bawaslu as an executing agency or breaks off administrative violations, money politics violations, and dispute resolution. (2) Bagaimana tugas, fungsi, dan kewenangan Bawaslu. Metode penelitian yang digunakan adalah metode normatif. Dari hasil pembahasan yang penulis lakukan. Kedudukan Bawaslu dalam struktur kelembaganegaraan Indonesia adalah sebagai lembaga negara tambahan negara independen (auxiliary state organs).Kehadiran Bawaslu dikarenakan pemerintah tidak lagi memiliki kredibilitas untuk menyelenggarakan pemilu yang adil dan demokratis. Dengan UU Nomor 7 Tahun 2017 tentang Pemilu yang baru telah memperkuat baik susunan, tugas, serta kewenangan Bawaslu. Pertama, Pasal 89 menunjukkan Panwaslu Kabupaten/Kota telah berubah menjadi Bawaslu Kabupaten/Kota. Kedua, Pasal 93 menunjukkan Bawaslu juga bertugas mengawasi netralitas Aparatur Sipil Negara (ASN), TNI dan Polri. Ketiga, Pasal 95 menunjukkan Bawaslu sebagai lembaga eksekutor atau memutus pelanggaran administrasi, pelanggaran politik uang, dan penyelesaian sengketa.Hasil penelitian ini penulis memberikan saran agar diberikan pembekalan yang mumpumi kepada anggota Bawaslu baik Pusat, Provinsi maupun Kabupaten/Kota agar bisa dengan baik menjalankan tugas dan wewenang yang baru. Tujuan daripada dibuatnya studi ini adalah untuk mengkaji lebih dalam mengenai peran Badan Pengawas Pemilu (Bawaslu) ketika terjadinya sengketa dalam proses Pemilihan Umum (Pemilu) yang dilaksanakan oleh Komisi Pemilihan Umum (KPU). Metode penelitian hukum normatif digunakan pada studi kali ini dengan melakukan pengkajian studi dokumen dan pendekatan terhadap peraturan perundang-undangan. Hasil studi menyimpulkan bahwa fungsi pengawasan yang dilaksanakan oleh Bawaslu merupakan salah satu langkah pasti demi mewujudkan keberlangsungan pemilu yang sesuai dengan asas Luber dan Jurdil, dan secara sah telah diatur dalam bab IV Undang-Undang Nomor 15 Tahun 2011 tentang Penyelenggara Pemilihan Umum yang secara garis besar menyatakan bahwa Bawaslu merupakan lembaga pengawas yang berkompeten dalam melaksanakan fungsi pengawasan dan bukan merupakan bagian dari partai politik manapun. Disamping fungsi pengawasan, Bawaslu juga memiliki kewenangan untuk menindak lanjuti beberapa jenis sengketa yang terjadi dalam proses Pemilu. ABSTRACT The purpose of this study is to examine more deeply the role of the Election Supervisory Body (Bawaslu) when a dispute occurs in the General Election (Pemilu) process carried out by the General Election Commission (KPU). The normative legal research method used in this study is to examine document studies and approaches to laws and regulations. The results of the study conclude that the supervisory function carried out by Bawaslu is one of the definite steps in order to realize the continuity of elections in accordance with the principles of Luber and Jurdil, and legally regulated in chapter IV of Law Number 15 Year 2011 concerning General Election Administrators. states that Bawaslu is a competent supervisory agency in carrying out its supervisory function and is not part of any political party. In addition to the supervisory function, Bawaslu also has the authority to follow up on several types of disputes that occur in the Election process. Penelitian dilaksanakan di Kabupaten Kepulauan Sula dengan tujuan untuk menjelaskan praktek politik transaksional yang terjadi kalangan masyarakat melali identifikasi dan menggambarkan bentuk-bentuk politik transaksional yang dipraktekan di kalangan masyaraka dengan menggunakan metode deskriptif kuantitatif. Hasil penelitian didapat bahwa mengatasi politik uang tidak cukup dengan hanya memakai pendekatan hukum saja, tp setidaknya kita membutuhkan banyak ruang gerakan bersama dengan seluruh elemen masyarakat untuk sama-sama membangun satu konsensus dan kesepahaman bersama terkait dengan politik yang sehat dan santun, perlu diajarkan pendidikan politik (civic education) yang masif kepada masyarakat. Salah satu hal subtansial dan urgen yang perlu diajarkan kepada masyarakat adalah hak dan kewajiban politik sebagai warga negara. Pendidikan politik masyarakat harus masuk pada program rutin bawaslu secara berjenjang setiap tahun dan perlu mendorong penyelenggara dan pengawas pemilu beserta aparat terkait untuk melaksanakan tugas dan fungsinya secara independen, professional dan bertanggung jawab.
Abstrak: Pelanggaran terhadap Undang-undang dan peraturan Pemilihan Umum (Pemilu) akan berakibat hukum. Dengan demikan diperlukan Hubungan Masyarakat yang lazim dikenal sebagai penghubung antara institusi, lembaga dengan masyarakat, terkait publikasi atau penjelasan kinerja, disingkat menjadi (Humas). Kedudukannya dalam struktur lembaga yang menaunginya, dikenal dalam berbagai bentuk, diantaranya, Biro, Bagian, Bidang, Unit, dipimpin oleh seorang pejabat yang diberikan kewenangan berdasarkan Surat Keputusan (SK), yang menguraikan Tujuan, Pokok dan Fungsi (Tupoksi). Salah satu fungsi pokok Humas adalah pembuatan rilis berita, untuk disebarluaskan kepada masyarakat, terkait kinerja lembaga atau institusi yang membentuknya. Untuk fungsi kerja itu Humas berkewajiban membangun kemitraan dengan media, baik cetak, elektronika maupun online (Website). Berdasarkan pertimbangan pengembangan keilmuan Humas, juga pers atau kewartawanan, dilaksanakan kegiatan pelatihan bagi Staf Kantor Badan Pengawas Pemilu (Bawaslu) Provinsi Sulawesi Selatan (Sulsel), yang dengannya diharapkan tercapai pemahaman yang paripurna dalam kerja-kerja kehumasan yang harus mereka jalankan dalam menghadapi Pemilihan Umum (Pemilu), baik legislatif, eksekutif, maupun Pemilihan Langsung Kepala Daerah (Pilkada). Thus, public relations are needed, commonly known as a liaison between institutions, institutions and the community, related to publications or explanations of performance, abbreviated as (PR). Its position in the institutional structure that houses it, is known in various forms, including, Bureau, Section, Field, Unit, led by an official who is given authority based on a Decree (SK), which outlines the Purpose, Principle and Function (Auth). One of the main functions of Public Relations is making news releases, to be disseminated to the public, related to the performance of the institutions or institutions that shape it. For this work function, PR is obliged to build partnerships with the media, both print, electronics and online (Website). Based on consideration of the scientific development of Public Relations, as well as the press or journalism, a training activity was held for the Staff of the Election Supervisory Body (Bawaslu) of the Province of South Sulawesi (South Sulawesi), with which it was hoped that a complete understanding of public relations work would be carried out in the face of the General Election. The Regional Head Election held in Bandar Lampung cannot be separated from the Polemic of Regional Election Disputes so that it applies in the way of holding regional elections. Elections signify the running of the democratic process within a country therefore Elections are very important in the life of the state. The author discusses the problem of how the cause of the dispute occurs and how the legal consequences occur in the dispute resolution of the Election process handled by Bawaslu Bandar Lampung City.The author conducts a normative-empirical study (juridical law), is a legal study which is used in a research style by combining library elements or secondary data with primary data, analyzing in a qualitative descriptive way. The results of the study aim to determine the legal cause and effect in resolving the dispute process of the Bandar Lampung Regional Election by Bawaslu Bandar Lampung City in the Mayoral and Deputy Mayoral elections.
This paper aims to discuss dispute resolution of Election process by Election Supervisory Agency (Bawaslu), as well as challenges and how to dispute the election process in the future. Act Number 7 of 2017, Article 95 letter d authorized the Election Supervisory Agency to receive, examine, mediate and adjudicate and decide on the resolution of election disputes. This means that based on Act Number 7 of 2017 in resolving disputes over the election process, Bawaslu is given additional authority to conduct mediation and adjudication. Settlement of disputes by Bawaslu is a crown whose existence is awaited by the community in resolving disputes that often occur during the election stage. To answer the challenge and to get to the destination someday Bawaslu becomes the Election Court, then Bawaslu must immediately build facilities to maintain the effectiveness and capacity of Regional Bawaslu, especially District / City Bawaslu to bemore active in training their abilities and their mentaly, which are still low in resolving election disputes.Key words: Dispute resolution, General election, Election Supervisory Agency.
One of the ongoing democratic activities in 2020 is the Election for the Governor and Deputy Governor, the Regent and Deputy Regent, as well as the Mayor and Deputy Mayor simultaneously in 2020. The success of holding regional elections in Indonesia is largely determined by the performance of the election organizers, one of which is the Election Supervisors a supervisory agency that oversees the process of implementing the Pilkada stages. Pilkada supervision during a pandemic is a big challenge for the ranks of Election Supervisors in Indonesia so it is interesting to study this topic. This research focuses on the supervisory policies issued by the Bawaslu RI during the Covid-19 pandemic and is then linked to the supervision carried out by the Pemalang Regency Bawaslu during the 2020 Pilkada. This legal research used a normative juridical approach and was descriptive analytical in nature which was analysed qualitatively. The results of the study show that there are obstacles and strategies in the supervision of election during the pandemic, but Bawaslu RI and its staff including Bawaslu Pemalang in the supervision of the 2020 Pilkada also carry out with more prevention, socialization to the public through online, maximizing social media owned by the District Bawaslu, coordination between agencies / stakeholders. The Election supervision is also carried out by health protocols in handling Covid-19 in their daily activities in carrying out their duties and authorities.
